A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AUTHORIZING THE SALE OF SURRENDERED
WEAPONS BY THE POLICE DEPARTMENT PURSUANT TO
SECTION 12028(c) OF THE PENAL CODE

WHEREAS, the Police Department has acquired numerous
6
weapons which are more particularly described in Exhibit "A"
7
attached hereto and made a part hereof by reference; and
8
WHEREAS, said weapons were surrendered to the Police
9
Department pursuant to Penal Code section 12028(c), and the
10

Finance Committee has recommended that said weapons be sold in
accordance with the provisions of said section; and
12
WHEREAS, Penal Code Section 12028(c) states that the
13
Police Department may "between the 1st and 10th days of July, in
14
each year, offer the weapons...for sale at public auction to
15
persons licensed pursuant to Section 12071 to engage in businesses
16
involving any weapon purchased;" and
17
WHEREAS, Mr. Dennis Mack, owner of the Azusa Gun Shop,
310 N. Azusa Avenue, Azusa, has offered to inventory and
18
19
categorize said weapons and to auction them to other authorized
20
21
dealers retaining a commission of 25% and paying the balance to
the City of Vernon; and
22
WHEREAS, Bruce V. Ma1kenhorst, the Purchasing Agent, has
23
recommended that the said weapons be disposed of by auction by
24
Dennis Mack to other dealers; and
25
26
WHEREAS, the City Council of the City of Vernon has
determined that it is in the best interests of the City of Vernon
27
that the property described in the attached Exhibit "A" be sold
28
pursuant to section 12028(c) of the Penal Code.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

CITY OF VERNON AS FOLLOWS:

SECTION 1: The City council of the City of Vernon hereby
4 finds and determines that the recitals contained hereinabove are
5 true and correct.

SECTION 2: The City Administrator/City Clerk is hereby
7 authorized to contract with Mr. Dennis Mack or any other
8 authorized dealer for the public auction of the property described
9 in the attached Exhibit "A" to other authorized dealers.

SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
12
thereafter the same shall be in full force and effect.
13
APPROVED AND ADOPTED this 30th day of June, 1994.
