A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
SHAMROCK MEATS, INC., FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 3461 VERNON
AVENUE IN THE CITY OF VERNON
WHEREAS, Shamrock Meats, Inc. occupies parcels of
property which require a variance from section 26.4.2-8,
Development Standards, of the Comprehensive Zoning Ordinance,
for the property located at 3461 Vernon Avenue; and
WHEREAS, Fredrick D. stein, the owner of said property,
has authorized Shamrock Meats, Inc., to act as his agent in
applying for this variance; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
45,000 square feet was constructed with one conforming truck
loading space and ten non-conforming truck loading spaces
measuring 8 feet in width: four being 21.8 feet in length; three
being 23.8 feet in length; and three being 23.0 feet in length;
and
WHEREAS, the building has one additional truck loading
space that can be utilized when the seven westerly non-conforming
truck loading spaces are empty; and
WHEREAS, Shamrock Meats, Inc. uses the building for
slaughtering cattle and the fabrication of beef, and Zoning
Ordinance section 26.4.2-7 (b) requires three truck loading
spaces for buildings with a gross floor area of between 25,001
and 50,000 square feet in size; and

WHEREAS, Zoning Ordinance section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship
by requiring the four non-conforming spaces to be 10 feet wide
and 65 feet long; and
WHEREAS, Shamrock Meats, Inc. has indicated that it has
no plans to expand or alter the building configuration and that
the existing truck loading spaces are sufficient for the intended
use; and
WHEREAS, 3461 Vernon Avenue is located in the
Slaughtering overlay District of the M zone and the operation is
consistent with the objectives of the General Plan and zoning
Ordinance; and
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a variance on July 12, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from Section 26.4.2-8,

Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to Shamrock Meats, Inc. at 3461
Vernon Avenue.
SECTION 3: The variance shall be granted subject to
the following condition: the usage of the non-conforming truck
loading spaces shall be limited so that no truck parked at the
loading docks shall extend into the existing street right-of-way.
SECTION 4: Noncompliance with this condition shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5:
The city Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Shamrock Meats, Inc. has submitted an application for a Variance
from the Comprehensive Zoning Ordinance, Section 26.4.2-8,
Development Standards, for the building located at 346l Vernon
Avenue, and transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has one conforming truck loading space and ten non-
conforming spaces. All non-conforming spaces are 8 feet wide and
four spaces are 21.8 feet long; three are 23.8 feet long; and three
are 23 feet long. The building has one additional conforming truck
loading space that can be utilized when the seven westerly non-
conforming spaces are empty. The company is proposing to use only
vehicles of a smaller length at the non-conforming spaces. This
has been reviewed by the Interim Director of Community Services and
the City Attorney, and it is hereby recommended that the Variance
be granted contingent upon the following Condition:
1. The usage of the non-conforming truck loading
spaces shall be limited so that any truck parked
at the loading dock shall not extend into the
existing street right-of-way.

SHAMROCK MEATS, INC.
VARIANCE APPLICATION
JULY 5, 1994

Shamrock Meats, Inc. has requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 3461 Vernon Avenue in the
City of Vernon. The building that they occupy was constructed
with one conforming truck loading space and ten non-conforming
truck loading spaces measuring 8.0 feet in width: four being 21.8
feet in length; three being 23.8 feet in length; and three being
23.0 feet in length. The building has one additional conforming
truck loading space that can be utilized when the seven westerly
non-conforming truck loading spaces are empty. Shamrock Meats,
Inc. has stated that only vehicles of smaller lengths will be
used at the ten non-conforming truck loading spaces. The
building is used for slaughtering cattle and the fabrication of
beef and is approximately 45,000 square feet in size.
section 26.4.2-7 (b) requires three truck loading spaces for
buildings with a gross floor area of between 25,001 and 50,000
square feet in size. Section 26.4.2-8 (c) of the comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.

Shamrock Meats, Inc. has indicated that requiring the non-
conforming truck loading spaces to be 65 feet long by 10 feet
wide would be a hardship. They have indicated that they have no
plans for expansion or alteration of the building configuration.
Their operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted with the following condition: the usage of the non-
conforming truck loading spaces shall be limited so that no truck
parked at the loading docks shall extend into the existing street
right-of-way.
