Resolution No. 6489 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 6489 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO ALEXANDER AND ERICA GENZEN, FROM SECTIONS 26.4.2-7 AND 26.4.2-8 OF THE COMPREHENSIVE ZONING ORDINANCE FOR THE PROPERTY LOCATED AT 5005 HAMPTON STREET IN THE CITY OF VERNON WHEREAS, Alexander and Erica Genzen own a parcel of property which requires a variance from Sections 26.4.2-7, Minimum Truck Parking and Loading ~acility Requirements and 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the property located at 5005 Hampton Street; and WHEREAS, the physical condition of the property is unique in that the existing building measuring approximately 11,000 square feet was constructed with one non-conforming truck loading space measuring 10.0 feet in width and 43.0 feet in length; and WHEREAS, the building is used for manufacturing of steam cleaners, and Zoning Ordinance Section 26.4.2-7 (b) requires two truck loading spaces for buildings with a gross floor area of between 8,001 and 25,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long, and section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted; and WHEREAS, there is insufficient space on the property 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and the application of the development standards for the truck loading space requirements will create an unreasonable hardship by requiring the non-conforming space to be 10 feet wide and 65 feet long and another space to be added; and WHEREAS, Alexander and Erica Genzen have indicated that they have no plans to expand or alter the building configuration and that the existing truck loading space is sufficient for the intended use; and WHEREAS, 5005 Hampton Street is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the existing street right-of-way on Hampton Street is 40 feet in width, 20 feet on each side of the centerline, and the right-of-way is built to 50 feet in width, 25 feet on each side of the centerline including a 5-foot sidewalk; and WHEREAS, the 5 feet of sidewalk on the west side of Hampton Street is currently located on the applicants' property; and WHEREAS, the city council of the City of Vernon held a hearing on said application for a variance on August 2, 1994. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City council of the City of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from section 26.4.2-7, Minimum 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 25 26 27 28 Comprehensive Zoning Ordinance, requiring two truck loading spaces for buildings with a gross floor area between 8,001 and 25,000 square feet in size and from section 26.4.2-8, Development Standards of the Comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long is hereby granted to Alexander and Erica Genzen at 5005 Hampton Street. SECTION 3: The variance shall be granted subject to the following conditions: (a) the usage of the non-conforming truck loading space shall be limited so that no truck parked at the loading dock shall extend into the street right-of-way as shown on the Master Plan of Streets, dated June 16, 1992; (b) all existing and future tenants shall be notified of this restriction and a condition stating this shall be placed in all future leases; and (c) the owner shall dedicate to the City of Vernon the 5 feet of property along Hampton Street which is currently used as sidewalk. SECTION 4: Noncompliance with these conditions shall constitute sufficient grounds for the City Council of the city of Vernon to void this variance and require the application of the authorized truck loading space requirement. SECTION 5: The City Clerk of the City of Vernon shal certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. Malkenhorst city Administrator/City Clerk I . .. ::.i >>-1 s~ ENGINEER'S REPORT ALEXANDER AND ERICA GENZEN 5005 HAMPTON STREET VARIANCE APPLICATION JULY 28, 1994 ., Alexander and Erica Genzen have requested a variance from the Comprehensive Zoning Ordinance sections 26.4.2-7, Minimum Truck Parking and Loading Facility Requirements and 26.4.2-8, Development Standards, for the property located at 5005 Hampton Street in the City of Vernon. The building that they own waS constructed with one non-conforming truck loading space measuring 10.0 feet in width and 43.0 feet in length. Alexander and Erica Genzen have stated that only vehicles of smaller lengths will be used at the non-conforming truck loading space. The building is approximately 11,000 square feet in size and is used for the manufacturing of steam cleaners. Section 26.4.2-7 (b) requires two truck loading spaces for buildings with a gross floor area of between 8,001 and 25,000 square feet in size. section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within five years of April 18, 1989 unless a variance is granted. The existing right-of-way on Hampton Street is 40 feet in width, 20 feet on each side of the centerline. The right-of-way is built to 50 feet in width, 25 feet on each side of the centerline, including 5 feet of. sidewalk. Therefore, the 5 feet ,.i. p # . of sidewalk on the west side is currently located on the applicants' property. Alexander and Erica Genzen have indicated that requiring the addition of one loading space and requiring the existing non- conforming loading space to be 65 feet long by 10 feet wide would be a hardship. They have indicated that they have no plans for expansion or alteration of the building configuration. The operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted subject to the following conditions: (a) the usage of the truck loading space shall be limited so that no truck parked at the loading dock shall extend into the street right-of-way as shown on the Master Plan of streets, dated June 16, 1992; (b) all existing and future tenants shall be notified of this restriction and a condition stating this shall be placed in all future leases; and (c) the owner shall dedicate to the City of Vernon the 5 feet of property along Hampton street which is currently used as sidewalk.
