A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
ALEXANDER AND ERICA GENZEN, FROM
SECTION 26.4.2-8 OF THE COMPREHENSIVE
ZONING ORDINANCE FOR THE PROPERTY
LOCATED AT 5001 HAMPTON STREET IN THE
CITY OF VERNON
WHEREAS, Alexander and Erica Genzen own a parcel of
property which requires a variance from section 26.4.2-8,
Development Standards, of the Comprehensive zoning Ordinance,
for the property located at 5001 Hampton Street; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
6,000 square feet was constructed with one non-conforming truck
loading space measuring 10.0 feet in width and 56.9 feet in
length; and
WHEREAS, the building is used for the distribution of
paper goods and soft drinks and Zoning Ordinance section
26.4.2-7 (b) requires one truck loading space for buildings with
a gross floor area under 8,000 square feet in size; and
WHEREAS, Zoning Ordinance section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship

by requiring the non-conforming space to be 10 feet wide; and
WHEREAS, Alexander and Erica Genzen have indicated that
they have no plans to expand or alter the building configuration
and that the existing truck loading space is sufficient for the
intended use; and
WHEREAS, 5001 Hampton Street is located in the M zone
and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the existing street right-of-way on Hampton
Street is 40 feet in width, 20 feet on each side of the
centerline, and the right-of-way is built to 50.0 feet in width,
25 feet on each side of the centerline including a 5-foot
sidewalk; and
WHEREAS, the 5 feet of sidewalk on the west side of
Hampton Street is currently located on the applicants' property;
and
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a variance on August 2, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65 feet
long is hereby granted to Alexander and Erica Genzen at 5001

SECTION 3: The variance shall be granted subject to
the following conditions: (a) the usage of the non-conforming
~ruck loading space shall be limited so that no truck parked at
the loading dock shall extend into the street right-of-way as
shown on the Master Plan of Streets, dated June 16, 1992; (b) all
existing and future tenants shall be notified of this restrictio
and a condition stating this shall be placed in all future
leases; and (c) the owner shall dedicate to the City of Vernon
the 5 feet of property along Hampton Street which is currently
used as sidewalk.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the city
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon
and thereafter the same shall be in full force and effect.

Alexander and Erica Genzen have submitted an application for a
Variance from the Comprehensive Zoning Ordinance, section 26.4.2-8,
Development Standards, for the building located at 5001 Hampton
Street, and transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has one non-conforming truck loading space 10 feet
wide and 56.9 feet long, and the company is proposing to use only
vehicles of a smaller length at this space. This has been reviewed
by the Acting Director of Community services, and it is hereby
recommended that the Variance be granted with the following
Conditions:
a. The usage of the non-conforming truck loading
space shall be limited so that any truck
parked at the loading dock shall not extend
into the street right-of-way as shown on the
Master Plan of Streets dated June 16, 1992.
b. All existing and future tenants shall be
notified of this restriction and a condition
stating this shall be placed in their leases.
c. The owner shall dedicate to the City of
Vernon the five feet of property along Hampton
Street which is currently used as sidewalk.

5001 HAMPTON STREET
VARIANCE APPLICATION
JULY 28, 1994
Alexander and Erica Genzen have requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 5001 Hampton Street in the
City of Vernon. The building that they own was constructed with
one non-conforming truck loading space measuring 10.0 feet in
width and 56.9 feet in length. Alexander and Erica Genzen have
stated that only vehicles of smaller lengths will be used at the
non-conforming truck loading space. The building is used for the
distribution of paper goods and soft drinks and is approximately
6,000 square feet in size.
section 26.4.2-7 (b) requires one truck loading space for
buildings with a gross floor area under 8,000 square feet in
size. section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance
specifies that each loading space shall be a minimum of 10 feet
wide and 65 feet long and section 26.4.6-4 (c) provides that a
non-conforming building must comply with these standards within
five years of April 18, 1989 unless a variance is granted.
The existing right-of-way on Hampton Street is 40 feet in
width, 20 feet on each side of the centerline. The right-of-way
is built to 50 feet in width, 25 feet on each side of the
centerline, including 5 feet of sidewalk. Therefore, the 5 feet

of sidewalk on the west side is currently located on the
applicants' property.
Alexander and Erica Genzen have indicated that requiring the
non-conforming truck loading space to be 65 feet long by 10 feet
wide would be a hardship. They have indicated that they have no
plans for expansion or alteration of the building configuration.
The operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted with the following conditions: (a) the usage of the non-
conforming truck loading space shall be limited so that no truck
parked at the loading dock shall extend into the street right-of-
way as shown on the Master Plan of streets, dated June 16, 1992;
(b) all existing and future tenants shall be notified of this
restriction and a condition stating this shall be placed in all
future leases; and (c) the owner shall dedicate to the city of
Vernon the 5 feet of property along Hampton street which is
currently used as sidewalk.
