RESOLUTION NO. 6492
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
GELDIN MEAT CO., INC., FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 2677 VERNON
AVENUE IN THE CITY OF VERNON
WHEREAS, Geldin Meat Co., Inc. occupies a parcel of
property which requires a variance from section 26.4.2-8,
Development Standards, of the Comprehensive Zoning Ordinance,
for the property located at 2677 Vernon Avenue; and
WHEREAS, G and G Investments, the owner of said
property, has authorized Geldin Meat Co., Inc. to act as its
agent in applying for this variance; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
47,000 square feet was constructed with one conforming
truck loading space and nine non-conforming truck loading
spaces measuring 10.0 feet in width and 53.3 feet in length;
and
WHEREAS, the building has two additional
non-conforming truck loading spaces that do not face the public
right-of-way and measure 10.0 feet wide and 63.0 feet long; and
WHEREAS, Geldin Meat Co., Inc. uses the building for
meat processing, and Zoning Ordinance Section 26.4.2-7 (b)
requires three truck loading spaces for buildings with a gross
floor area of between 25,001 and 50,000 square feet in size;
and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)

specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship
by requiring the nine non-conforming spaces to be 10 feet wide
and 65 feet long; and
WHEREAS, Geldin Meat Co., Inc. has indicated that
it has no plans to expand or alter the building configuration
and that the existing truck loading spaces are sufficient for
the intended use; and
WHEREAS, 2677 Vernon Avenue is located in the M zone
and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the existing street right-of-way on Vernon
Avenue is 40 feet in width, 20 feet on each side of the
centerline, and the right-of-way is built to 50.0 feet in width,
25 feet on each side of the centerline including a 5-foot
sidewalk; and
WHEREAS, the 5 feet of sidewalk on the north side of
Vernon Avenue is currently located on the G and G Investments
property; and
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a variance on August 2, 1994.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the city of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to Geldin Meat Co., Inc. at 2677
Vernon Avenue.
SECTION 3: The variance shall be granted subject to
the following conditions: (a) the usage of the non-conforming
truck loading spaces shall be limited so that no truck parked at
the loading docks shall extend into the street right-of-way as
shown on the Master Plan of Streets, dated June 16, 1992; and (b)
G and G Investments shall dedicate to the city of Vernon the 5
feet of property along Vernon Avenue which is currently used as
sidewalk.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon
and thereafter the same shall be in full force and effect.

Honorable Members:
Geldin Meat Co., Inc. has submitted an application for a Variance
from the Comprehensive Zoning Ordinance, Section 26.4.2-8,
Development Standards, for the building located at 2677 Vernon
Avenue, and transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of Posting and Mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has one conforming truck loading space and nine non-
conforming truck loading spaces that are 10 feet wide and 53.3 feet
long. The building has two additional non-conforming truck loading
spaces which do not face the public right-of-way. The company is

conforming spaces. This has been reviewed by the Acting Director
of Community Services, and it is hereby recommended that the

QUESTION #1
The existing building with loading dock was built prior to 1964.
Full right-oi-way has been fully ded.icated for street right-of-
way improvements. No further construction or demolition is
proposed at this time. I

truck circulation to drive forward a)into the access lane to the

QUESTION #2
The ordinance to have truck loading docks recessed a m~n~mum of 65
feet assumes that the company in operation owns and operates trucks
65 feet ~n 1 ength. The request ~: this business is to have
accepted the existing rece.ssed dock of 58 '4", since the Geldin Meat
Co. owns and operates trucks having a I ength I esS than 58'. In
fact all of the Vernon Ave. truck dock doors except two have 8"
concrete block wall at the lot side of sidewalk preventing any
encroachment.
QUESTION #3
The effective date of the Comprehensive Zoning Ordinance of the
City of Vernon was April 1989. The Geldin Meat Co. has neither
constructed nor changed any structure. related to the truck loading
dock since the effective date of the ordinance.

QUESTION #4
The Ci ty Counci I has granted variances to other properties who
utilize trucks shorter than the existing truck loading spaces. The
Geldin Meat Co. Inc. is a business operating and utilizing trucks
shorter than the existing truck loading spaces. In additi~n/as
explained and outlined in question no. 2, this facility provides
for a full dock unload and drive-thru and exit for trucks without
disturbing the street with any double parking or y-turn arounds.
QUESTION #5
Section 26.4.2-8(c) of the Comprehensive General Plan will not be
adversely affected by the granting of this variance. The ordinance
is developed to remove trucks from extending into the street while
parked in the loading dock and remove truck traffic congestion
while trucks exit the sites by going in reverse into street right-
of-way.
The Geldin Meat CO. IS In harmony with these goals for the
following reasons: (a) all trucks owned and operated by the Geldin
Meat Co. are less than the length of the existing recessed dock
distance, and (b) the circulation available to this property are
more extensive that other businesses in Vernon.

Geldin Meat Company has received a letter from Mr. victor H. Vaits,
Director of Community Services and Water, notifying us of the intent
of the Department to begin enforce certain zoning ordinances related
to truck loading spaces on April 18th, 1994.
After reviewing the correspondence and speaking to you, we believe
we are eligible for a variance from this zoning ordinance as we
. ,utilize trucks that are'shorter then the existing loading dock
spaces. We have obtained the services of R. C. Delphi Engineering to
to prepare and file this ordinance for us.
We have been informed by R. C. Delphi Engineering that they may not
be able to prepare and submit this request by the deadline. As a
result we respectfully request a two week extension of the time to
file until May 2, 1994.

ENGINEER'S REPORT
GELDIN MEAT CO., INC.
2677 VERNON AVENUE
VARIANCE APPLICATION
JULY 28, 1994
Geldin Meat Co., Inc, has requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 2677 Vernon Avenue in the
City of Vernon. The building that it occupies was constructed
with one conforming truck loading space and nine non-conforming
truck loading spaces measuring 10.0 feet in width and 53.3 feet
in length, The building has two additional non-conforming truck
loading spaces which do not face the public right-of-way. Geldin
Meat Co., Inc. has stated that only vehicles of smaller lengths
will be used at the nine non-conforming truck loading spaces.
The building is used for meat processing and is approximately
47,000 square feet in size.
section 26.4.2-7 (b) requires three truck loading spaces for
buildings with a gross floor area of between 25,001 and 50,000
square feet in size. section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.

The existing right-of-way on Vernon Avenue is 40 feet in
width, 20 feet on each side of the centerline. The right-of-way
is built to 50 feet in width, 25 feet on each side of the
centerline including a 5-foot sidewalk. Therefore, the 5 feet of
sidewalk on the north side of Vernon Avenue is currently located
on the property.
Geldin Meat Co., Inc, has indicated that requiring the nine
non-conforming truck loading spaces to be 65 feet long by 10 feet
wide would be a hardship. It has indicated that it has no
plans for expansion or alteration of the building configuration.
The operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted with the following conditions: (a) the usage of the non-
conforming truck loading spaces shall be limited so that no truck
parked at the loading docks shall extend into the street right-
of-way as shown on the Master Plan of streets, dated June 16,
1992; and (b) G and G Investments shall dedicate to the City of
Vernon the 5 feet of property along Vernon Avenue which is
currently used as sidewalk.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
GELDIN MEAT CO., INC., FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 2677 VERNON
AVENUE IN THE CITY OF VERNON
WHEREAS, Geldin Meat Co., Inc. occupies a parcel of
property which requires a variance from Section 26.4.2-8,
Development Standards, of the Comprehensive Zoning Ordinance,
for the property located at 2677 Vernon Avenue; and
WHEREAS, G and G Investments, the owner of said
property, has authorized Geldin Meat Co., Inc. to act as its agent
in applying for this variance; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
47,000 square feet was constructed with one conforming
truck loading space and nine non-conforming truck loading spaces
measuring 10.0 feet in width and 53.3 feet in length; and
WHEREAS, the building has two additional non-conforming
truck loading spaces that do not face the public right-of-way and
measure 10,0 feet wide and 63.0 feet long; and
WHEREAS, Geldin Meat Co., Inc. uses the building for
meat processing, and Zoning Ordinance Section 26.4.2-7 (b)
requires three truck loading spaces for buildings with a gross
floor area of between 25,001 and 50,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
