A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
SOCO-LYNCH CORPORATION, FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4560, 4584 AND
4608 50TH STREET IN THE CITY OF VERNON
WHEREAS, Soco-Lynch Corporation occupies parcels of
property located at 4560, 4584 and 4608 50th Street in the City
of Vernon which require a variance from Section 26.4.2-8,
Development Standards, of the Comprehensive Zoning Ordinance; and
WHEREAS, the owners of said properties have authorized
Soco-Lynch Corporation to act as their agents in applying for this
variance; and
WHEREAS, the physical condition of the properties is
unique in that the existing buildings measuring approximately
29,400 square feet, 25,500 square feet and 21,000 square were
constructed with two conforming truck loading spaces and twenty-
six non-conforming truck loading spaces measuring 10.0 feet in
width: eight being 50.7 feet in length and eighteen being 45.8
feet in length; and
WHEREAS, Soco-Lynch Corporation uses the buildings for
warehousing and distribution of chemicals and paint, and Zoning
Ordinance Section 26.4.2-7 (b) requires two truck loading spaces
for buildings with a gross floor area of between 8,001 and
25,000 square feet in size and three truck loading spaces for
buildings with a gross floor area of between 25,001 and 50,000
square feet in size for a total of eight required spaces for the
buildings; and

WHEREAS, Zoning Ordinance section 26.4.2-8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is grantedj and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship
by requiring the twenty-six non-conforming spaces to be 10 feet
wide and 65 feet longj and
WHEREAS, Soco-Lynch corporation has indicated that it
has no plans to expand or alter the building configuration and
that the existing truck loading spaces are sufficient for the
intended usej and
WHEREAS, 4560, 4584 and 4608 50th Street are located in
the M zone and the operation is consistent with the objectives
of the General Plan and Zoning Ordinancej and
WHEREAS, the City council of the city of Vernon held a
hearing on said application for a variance on August 16, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The city Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from Section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65 feet

long is hereby granted to Soco-Lynch Corporation at 4560, 4584 and
4608 50th street.
SECTION 3: The variance shall be granted subject to
the fOllowing condition: the usage of the non-conforming
truck loading spaces shall be limited so that no truck parked at
the loading docks shall extend into the street right-of-way as
shown on the Master Plan of Streets, dated June 16, 1992.
SECTION 4: Noncompliance with this condition shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
Soco-Lynch corporation has submitted an application for a Variance
from the Comprehensive Zoning Ordinance, Section 26.4.2-8,
Development Standards, for the buildings located at 4560, 4584 and
4608 50th Street, and transmitted herewith is the following
evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The buildings have two conforming truck loading spaces and twenty-
six non-conforming spaces that are 10 feet wide. Eight spaces are
50.7 feet long and eighteen spaces are 45.8 feet long. The company
is proposing to use only vehicles of a smaller length at the non-
conforming spaces. This has been reviewed by the Acting Director
of Community Services, and it is hereby recommended that the
Variance be granted with the following Condition:
1. The usage of the non-conforming truck loading
spaces shall be limited so that any truck parked
at the loading docks shall not extend into the
street right-of-way as shown on the Master Plan
of streets dated June 16, 1992.

(1) That special conditions and circumstances exist which are peculiar to
the land, structure, or building involved and which are not generally
applicable to other lands, structures, or buildings in the same Vicinity

_Our building and land have truck loading spaces that are sufficient in
length to enable us to load and unload without extending onto the street.
In general, many buildings i~ our general vicinity and zone have shorter
truck loading spaces which force the trucks to extend into the street to
load and unload.
(2) That literal interpretation of the provisions of this ordinance would
deprive the applic~nt of rights commonly enjoyed by other properties in the
same vicinity and zone in which the property is located, under the terms of

Our truck loading spaces are sufficient in length to allow us to use units

EXHIBIT - II
APPLICATION FOR VARIANCE
Section 26.4.2-8(C) of The Comprehensive Zoning Ordinance of
the City of Vernon, stipulates that truck loading spaces
shall be 10 feet wide by 65 feet in length. In addition,
Section 26.4.6-4(C), as amended, states: "Where insufficient
space exists on the lot or parcel for compliance with the
size requirements of the off-street loading provisions of
this chapter, the size of the existing loading docks shall
be brought into compliance at the time of any changes in
use, occupancy, expansion, structural alteration of the
building or within five (5) years of the effective date of
this chapter, whichever shall occur first."
The truck loading space at the location referenced in this
application extends 66 feet to the curb. However, the
prescribed truck loading space of 65 feet extends into the
pedestrian right-of-way. Our trucks do not extend into the
street and rarely extend onto the pedestrian right-of-way.
Our location at 50th Street is not our primary location.
This location is primarily used for warehouse storage. Our
staging, loading and shipping is primarily done from our
location at 3270 E. Washington Blvd. Our stock transfers
from our 50th Street location to our Washington Blvd.

The street on which we operate (50th Street) is an
industrial street with minimal vehicular traffic and almost
no pedestrian traffic. Therefore, even when we have an
occasional truck extend into the pedestrian right-of-way we
clearly do not adversely affect the surrounding area.
The strict application of the truck loading requirements
would create an unreasonable hardship on us in light of the
fact that this is not our primary location and our truck
activity and pedestrian activity are minimal.
Furthermore, our use does not require the area specified by
this ordinance. We are able to utilize units shorter than
the existing truck loading spaces to conduct our business.
In summary, we are petitioning for a variance because we
believe that:
(1) The existing use does not and will not adversely affect
the surrounding area;
(2) The strict application of the loading requirements of
this zoning ordinance creates an unreasonable hardship;
and,
(3) Our use does not require the area specified by this
zoning ordinance.

Dear Mr. Vaits,
I am writing in response to your letter addressed to Mr. Jim
Fordham dated June 7, 1994. In an effort to clarify our
request, I am submitting an amended application which should
allow us to receive a positive recommendation from your
department. I have not enclosed the radius maps, property
owners lists and list statement and plot plans as the
originals are attached to our original application.
For purposes of this letter, I would briefly like to
summarize our situation.
*We currently have one loading dock that is recessed 71
feet from the public right-of-way and therefore
complies with the comprehensive zoning ordinance.
(We are aware that the public right-of-way extends
approximately nine (9) feet behind the existing
sidewalk. )
* Our remaining docks are approximately 50 feet from the
pUblic right-of-way.
* Our 50th Street location is not our primary location,
it is primarily used for warehouse storage. (There is
minimal activity on a day-to-day basis).
* Our staging, loading and shipping is done from our
location on Washington Blvd.
* Stock transfers from 50th Street to Washington Blvd.,
are made with one truck after 5 p.m. each day and will
be strictly loaded from our dock that extends 70 feet
to the public right-of-way.
* Any inbound shipments on trucks greater than 50 feet
will be required to be received at our loading dock
that extends 70 feet to the public right-of-way.

To require us to recess all of our docks when our use does
not require the area specified by the Comprehensive Zoning
Ordinance would create an unreasonable hardship on us. As
such, I am asking that you reconsider our amended proposal
and make a positive recommendation based upon the

SOCO-LYNCH CORPORATION
4560, 4584 AND 4608 50TH STREET
VARIANCE APPLICATION
AUGUST 11, 1994
Soco-Lynch Corporation has requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 4560, 4584 and 4608 50th
street in the City of Vernon. The buildings that it occupies
were constructed with two conforming truck loading spaces and
twenty-six non-conforming truck loading spaces measuring 10.0
feet in width: eight being 50.7 feet in length and eighteen being
45.8 feet in length. Soco-Lynch Corporation has stated that only
vehicles of smaller lengths will be used at the twenty-six non-
conforming truck loading spaces. The buildings are used for the
warehousing and distribution of chemicals and paint and are
approximately 29,400 square feet, 25,500 square feet and 21,000
square feet totaling approximately 76,000 square feet in size.
section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area of between 8,001 and 25,000
square feet in size and three truck loading spaces for buildings
with a gross floor area of between 25001 and 50,000 square feet.
For these buildings, section 26.4.2-7 (b) requires a total of
eight truck loading spaces. section 26.4.2-8 (c) of the
comprehensive Zoning Ordinance specifies that each loading space
shall be a minimum of 10 feet wide and 65 feet long and section

26.4.6-4 (c) provides that a non-conforming building must comply
with these standards within five years of April 18, 1989 unless a
variance is granted.
Soco-Lynch Corporation has indicated that requiring the non-
conforming truck loading spaces to be 65 feet long by 10 feet
wide would be a hardship. It has indicated that it has no plans
for expansion or alteration of the building configuration. The
operation is in conformance with the Zoning Ordinance and General
Plan. Therefore, it is recommended that the variance be granted
with the following condition: ~he usage of the non-conforming
truck loading spaces shall be limited so that no truck parked at
the loading docks shall extend into the street right-of-way as
shown on the Master Plan of streets, dated June 16, 1992.
