A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON OPPOSING PROPOSITION 187, THE "SAVE OUR
STATE" INITIATIVE

WHEREAS, immigration is one of the most significant and
politically volatile issues facing California policy makers; and
6
7
WHEREAS, Proposition 187, the "Save Our State" ("SOS")
8
initiative seeks to scapegoat immigrants for the economic and
9
social woes facing California, in the midst of an election year;
10
and
II
WHEREAS, the "SOS" measure proposes to "save" our state
12
by the following:
13
1)
banning undocumented children from public
14
schools;
15
2)
requiring public school teachers to report
l6
"suspected" undocumented children to the
17
Immigration & Naturalization Service (INS);
18
deny prenatal care to undocumented women;
3)
4)
require public health workers to report to the
19
20
INS "suspected" undocumented patients, including
2l
children receiving immunizations;
22
5)
require local police to coordinate with INS in
23
deporting undocumented persons arrested for any
24
offense;
25
6)
various other punitive measures, which only
26
duplicate existing restrictions or violate state
27
or federal constitutional or statutory law; and
28
I WHEREAS, "sos" proponents contend that immigrants come to
2 California to receive public benefits and services when, in fact,
3 immigrants come for jobs, family reunification and to flee
4 persecution. Federal law already denies undocumented immigrants
5 welfare or cash assistance programs, including food stamps; and
6 WHEREAS, "SOS" proponents ignore LAPD's "special Order
7 40," and policies adopted by other law enforcement agencies, that
8 already formalize cooperation between local governments and INS
9 when undocumented persons are arrested for multiple misdemeanor
10 offenses, high grade misdemeanors or felony offenses. Computer-
II networked booking systems, throughout the state, effectively
l2 report all suspected undocumented arrestees to the INS; and
13 WHEREAS, "SOS", aside from duplicating already-existing
14 law enforcement practices, also would raise serious legal issues
15 by removing the requirement of "reasonableness" to any arrest -- a
16 basic constitutional protection against arbitrary government
17 action; and
18 WHEREAS, while studies have indicated that less than 10
19 percent of the Latino community in California is undocumented,
20 "SOS" creates a cloud of suspicion -- and places the burden of
21 proof on all Latinos to prove their legality, despite a
22 heritage of contributions, history and valor in the Golden State;
23 and
24 WHEREAS, the Ninth Circuit U.S. Court of Appeals ruled
25 this year in Gonzalez-Rivera v. INS that a stop based on race, or
26 ethnic appearance, is an egregious Constitutional violation; the
27 Court commented: "[W)e should not allow our courts to be used to
28 sanction racism in any form"; "50S" would put the state at odds

with the Court of Appeals' ruling; and
WHEREAS, in clear violation of the State Constitution and
a 1982 U.S. Supreme Court decision (Plyler v. Doe), "SOS" would
restrict undocumented persons from public schools, requiring
school officials to report any pupil or parent suspected of being
undocumented. "SOS" jeopardizes California's share of federal
education funds by violating provisions of the federal Family
Educational Rights and Privacy Act (FERPA), which prohibits the
release of information about public school students; and
WHEREAS, the history of the united States of America is
one of immigration, men, women and children, of diverse cultures,
backgrounds and beliefs, coming to this country in search of
opportunity and a better life; and
WHEREAS, policy makers should seek a responsible dialogue
and debate on immigration issues that places a greater emphasis on
servicing political asylum cases, legal residency and citizenship
cases to accurately determine status; the development of tracking
systems for all points of entry into this country; and deportation
of all undocumented persons convicted of felony crimes; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon does
hereby find and determine that the recitals contained hereinabove
are true and correct.
SECTION 2: The city Council of the City of Vernon hereby
opposes the "Save Our State" Initiative designated as Proposition
187 and directs the City Clerk to transmit a copy of this
resolution to all of its political representatives in the State of

SECTION 3: The City Council of the City of Vernon seeks
3 a responsible dialogue on the immigration issue including a
4 greater emphasis on servicing political asylum cases, legal
5 residency and citizenship cases to accurately determine status;
6 development of tracking systems for all points of entry into this
7 country; and deportation of undocumented persons convicted of
8 felony crime.

SECTION 4: The City Clerk of the City of Vernon shall
10 certify to the passage of this resolution and thereupon and
II thereafter the same shall be in full force and effect.
