A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
BARRY AND DORYANN CHASEN, FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4900 DISTRICT
BOULEVARD IN THE CITY OF VERNON
WHEREAS, Barry and Doryann Chasen own a parcel of
property located at 4900 District Boulevard in the City of Vernon
which requires a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive zoning Ordinance; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
12,000 square feet was constructed with one conforming truck
loading space and two non-conforming truck loading spaces
measuring 8.0 feet in width and 19.0 feet in length; and
WHEREAS, the building is used for warehousing of
fabrics, and Zoning Ordinance Section 26.4.2-7 (b) requires two
truck loading spaces for buildings with a gross floor area of
between 8,001 and 25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and Section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship

by requiring the two non-conforming spaces to be 10 feet wide and
65 feet long; and
WHEREAS, Barry and Doryann Chasen have indicated they
have no plans to expand or alter the building configuration and
that the existing truck loading spaces are sufficient for the
intended use; and
WHEREAS, 4900 District Boulevard is located in the M
zone and the operation is consistent with the objectives
of the General Plan and Zoning Ordinance; and
WHEREAS, the city council of the City of Vernon held a
hearing on said application for a variance on september 20, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65 feet
long is hereby granted to Barry and Doryann Chasen at 4900
District Boulevard.
SECTION 3: The variance shall be granted subject to
the following conditions: (a) the usage of the non-conforming
truck loading spaces shall be limited so that no truck parked at
the loading docks shall extend into the street right-of-way as
shown on the Master Plan of Streets, dated June 16, 1992; and (b)
all existing and future tenants shall be notified of this

restriction and a condition stating this shall be p~aced in all
future leases.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Application is hereby made to the city of Vernon, petitioning for
a variance of the truck loading facility requirement at 4900
District Blvd, Vernon, Ca. The gross floor area of the above
mentioned property is 12,000 square feet with one off street
parking or loading space. Our second truck loading space is located
in the southeast area of our parking lot and conforms to the 65
foot length requirement under section 26.4.2(c). Our first space
located in the front of our building does not conform to the length
and is used only for parking or as a will call for small packages.
Our customers will use either station wagons or small pick-up
trucks. It is impossible for a large truck to pick up or deliver in
this area. The distance from our loading dock to the street is 27
feet. The distance from our driveway to the traffic island located
directly behind our driveway is 30 feet. This makes it impossible
for large trucks to load or unload in this area but is convenient
for conventional cars.
In the 11 years we have owned and operated this building we have
never been able to use the area in front for larger trucks or even
medium sized trucks. In the forseeable future we will use this area
as parking space for executive cars and the pick up of small
packages. We will not allow any trucks that will extend into the
street right- of- way or will stick out on the sidewalk to use this
area. Our primary use at the present time is for executive parking
and we would not like to lose this privelege.
The applicant submits that the granting of this variance will not
confer on the applicant any special priveleges that is denied by
this chapter to other lands, structures or buildings in this
vicinity.

RAILWAY COMPANY TO EASTERLY SIDE OF LOS ANGELES AND SALT
LAKE RAILROAD (UNION PACIFIC RAILROAD, LESSEE) SAN PEDRO
BRANCH, THENCE IN 26TH STREET TO THE EASTERLY BOUNDARY
THEREIN OF THE CITY OF VERNON A DISTANCE OF APPROXIMATELY
2680 FEET, IN ACCORDANCE WITH SPECIFICATIONS NO. 196 AND PLAN
NO. B4A-1404 OF THE CITY OF VERNON.
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS, under date of November 7, 1956, Resolution No.
1993 was passed by the City Council approving Specifications No. 196 and
Plan No.B4A-1404 as prepared by The Atchison, Topeka and Santa Fe
Ry. Co., for the constructi.on of 12" cast iron water main and appurtenances
in Downey Road and 26th Street along railroad right-of-way of The Atchison,
Topeka and Santa Fe Railway Company, to easterly side of Los Angeles and
Salt Lake Railroad (Union Pacific Railroad, Lessee) San Pedro Branch,
thence in 26th Street to the easterly boundary therein of the City of Vernon,
a distance of approximately 2680 feet; and
WHEREAS, Harold A. Barnett, Consulting Engineer of the City
of Vernon reports to the City Council under date of March 15, 1957, thatthe
construction work has been completed and the water main is now in service,
and recommends that the water ,main and appurtenances be accepted as
constructed;
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1:
That the construction of 12" cast iron water
main and appurtenances in Downey Road and 26th Street along railroad right-
of-way of The Atchison, Topeka and Santa Fe Railway Company, to easterly
side of Los Angeles and Salt Lake Railroad (Union Pacific Railroad, Lessee)
San Pedro Branch, thence in 26th Street to the easterly boundary therein of
the City of Vernon, a distance of approximately 2680 feet, be, and the same
is hereby accepted.

SECTION 2:
That the City Clerk of the City of Vernon
2 is hereby directed to notify The Atchison. Topeka and Santa Fe Railway
3 Company of the acceptance of said water main and appurtenances.

SECTION 3:
The City Clerk of the City of Vernon shall
5 certify to the passage of this resolution and thereupon and thereafter the
6 same shall be in full force and effect.

Honorable Members:
Barry and Doryann Chasen have submitted an application for a
Variance from the Comprehensive Zoning Ordinance, Section 26.4.2-8,
Development Standards, for the building located at 4900 District
Boulevard, and transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has one conforming truck loading space and two non-
conforming spaces that are 8 feet wide and 19 feet long. The
company is proposing to use only vehicles of a smaller length at
the non-conforming spaces. This has been reviewed by the Acting
Director of Community Services, and it is hereby recommended that
the Variance be granted with the following Conditions:
a. The usage of the non-conforming truck loading
spaces shall be limited so that any truck
parked at the loading docks shall not extend
into the street right-of-way as shown on the
Master Plan of Streets dated June 16, 1992.
b. All existing and future tenants shall be
notified of this restriction and a condition
stating this shall be placed in all future
leases.

4900 DISTRICT BOULEVARD
VARIANCE APPLICATION
SEPTEMBER 1, 1994
Barry and Doryann Chasen have requested a variance from the
Comprehensive Zoning ordinance section 26.4.2-8, Development
Standards, for the property located at 4900 District Boulevard in
the City of Vernon. The building that they own was constructed
with one conforming truck loading space and two non-conforming
truck loading spaces measuring 8.0 feet in width and 19.0 feet in
length. Barry and Doryann Chasen have stated that only vehicles
of smalle~ lengths will be used at the two non-conforming truck
loading spaces. The building is used for the warehousing of
fabrics and is approximately 12,000 square feet in size.
Section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area of between 8,001 and 25,000
square feet in size. section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.
Barry and Doryann Chasen have indicated that requiring the
non-conforming truck loading spaces to be 65 feet long by 10 feet

wide would be a hardship. They have indicated that they have no
plans for expansion or alteration of the building configuration.
The operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted with the following conditions: (a) the usage of the non-
conforming truck loading spaces shall be limited so that no truck
parked at the loading docks shall extend into the street right-
of-way as shown on the Master Plan of streets, dated June 16,
1992; and (b) all existing and future tenants shall be notified
of this restriction and a condition stating this shall be placed
