A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AUTHORIZING THE PARTICIPATION WITH
WESTERN AREA POWER ADMINISTRATION IN THE
PREPARATION OF AN INTEGRATED RESOURCE PLAN
PURSUANT TO THE ENERGY POLICY ACT OF 1992 AND
DETERMINING THAT IT WILL NOT EMPLOY INTEGRATED
RESOURCE PLANNING PURSUANT TO 16 U.S.C. SECTION
2621

WHEREAS, certain obligations are imposed on nonregulated
9
electric utilities by the federal Public Utility Regulatory
Policies Act of 1978 in connection with the performance of
10
11
integrated resource planning, more particularly, insofar as
12 pertinent
13 2621(a):

here, by the following words of 16 U.S.C. Section
[E]ach nonregulated electric utility shall
consider each standard established by subsection
(d) of this section and make a determination
concerning whether or not it is appropriate to
implement such standard....;

WHEREAS, the City of Vernon's electric utility operation
is a nonregulated electric utility within the meaning of such
22
23
24
statute; and
WHEREAS, it is provided by Section 114 of the federal
Energy Policy Act of 1992 (42 U.S.C. Sections 7275-7276b), in
25
pertinent part, that the Western Area Power Administration
26
("WAPA") shall require certain long-term firm power customers to
27
prepare, submit, and implement integrated resource plans in
28
accordance with criteria and assistance provided by WAPA; and
1 WHEREAS, the City of Vernon is a customer to which such
2 statute applies; and
3 WHEREAS, the City intends to participate with WAPA in the
4 preparation of an Integrated Resource Plan; and
5 WHEREAS, in light of such WAPA requirement and expected
6 assistance from WAPA, no good purpose would be served by an
7 independent implementation by the City of Vernon of the aforesaid
8 requirement of 16 U.S.C. section 2621; and
9 WHEREAS, 16 U.S.C. section 2621(b) requires the City
10 Council to hold a public hearing prior to making a determination
11 respecting the adoption of an IRP procedure; and
12 WHEREAS, the City Council of the City of Vernon held a
13 public hearing on the consideration of the adoption of an IRP
14 procedure on October 4, 1994, pursuant to a duly published notice
15 and evidence was presented; and
16 WHEREAS, the City Clerk published the notice in
17 accordance with Government Code section 6066; and
18 WHEREAS, the City Clerk published a notice in the
19 Metropolitan News, which was determined to be a newspaper of
20 general circulation nearest to the City most appropriate for this
21 purpose, on September 20, 1994, which indicated that documentation
22 used in the determination of the consideration of the adoption of
23 an IRP procedure provided for herein has been available for
24 inspection by the public.
25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
26 CITY OF VERNON AS FOLLOWS:
27 SECTION 1: The City Council of the City of Vernon hereby
28 finds and determines that the recitals contained hereinabove are

1 true and correct.

SECTION 2: The City Council of the city of Vernon hereby
3 authorizes staff to participate with WAPA in the development of a
4 City of Vernon Integrated Resource Plan pursuant to the Energy
5 Policy Act of 1992.

SECTION 3: Based on the evidence presented at the public
7 hearing and on the above findings of fact, the City Council of the
8 City of Vernon hereby determines that it will not pursue
9 independent integrated resource planning pursuant to 16 U.S.C.
10 Section 2621.

SECTION 4: The City Clerk of the City of Vernon shall
12 certify to the passage of this resolution and thereupon and
13 thereafter the same shall be in full force and effect.
