A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
EPKO INDUSTRIES, FROM SECTION 26.4.2-8
DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 2080 25TH
STREET IN THE CITY OF VERNON
WHEREAS, Epko Industries occupies a parcel of
property located at 2080 25th Street in the City of Vernon
which requires a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance; and
WHEREAS, the owners of said property have authorized
Epko Industries to act as their agent in applying for this
variance; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
30,000 square feet was constructed with eight non-conforming
truck loading spaces measuring 9.0 feet in width and 57.5 feet
in length; and
WHEREAS, Epko Industries uses the building for
distribution of sewing threads and wall coverings, and Zoning
Ordinance Section 26.4.2-7 (b) requires three truck loading spaces
for buildings with a gross floor area of between 25,001 and 50,000
square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and Section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is granted; and

WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship
by requiring the eight non-conforming spaces to be 10 feet wide
and 65 feet long; and
WHEREAS, Epko Industries has indicated that it has no
no plans to expand or alter the building configuration and that
the existing truck loading spaces are sufficient for the intended
use; and
WHEREAS, 2080 25th Street is located in the M zone
and the operation is consistent with the objectives of the General
Plan and Zoning Ordinance; and
WHEREAS, the city Council of the City of Vernon held a
hearing on said application for a variance on October 4, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65 feet
long is hereby granted to Epko Industries at 2080 25th Street.
SECTION 3: The variance shall be granted subject to
the following condition: the usage of the non-conforming
truck loading spaces shall be limited so that no truck parked at
the loading docks shall extend into the street right-of-way as

shown on the Master Plan of streets, dated June 16, 1992.
SECTION 4: Noncompliance with this condition shall
constitute sufficient grounds for the city council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
Epko Industries has submitted an application for a Variance from the
Comprehensive Zoning Ordinance, section 26.4.2-8, Development
Standards, for the property located at 2080 25th Street, and
transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has eight non-conforming truck loading spaces that are 9
feet wide and 57.5 feet long. The company is proposing to use only
vehicles of a smaller length at the non-conforming truck loading
spaces. This has been reviewed by the Acting Director of Community
Services, and it is hereby recommended that the Variance be granted
contingent upon the following Conditions:
a. The usage of the non-conforming truck loading spaces
shall be limited so that any truck parked at
the loading docks shall not extend into the
street right-of-way as shown on the Master Plan
of Streets dated June 16, 1992.
b. All existing and future tenants shall be notified of
this restriction and a condition stating this
shall be placed in all future leases.

NOTICE TO APPLICANT: In the variance procedure it shall be shown that
the following five (5) conditions exist in reference to the property being
considered. The applicant should answer the following statements. If you
have difficulty finding reasonable answers to the statements contained in
this application it may be an indication that your request has insufficient

(1) That special conditions and circumstances exist which are peculiar to
the land, structure, or building involved and which are not generally
applicable to other lands, structures, or buildings in the same vicinity
and zone:
The front of the loading doors are set back 62 feet from the sidewalk, which is only three feet short
of the required 65 feet
(2) That literal interpretation of the provisions of this ordinance would
deprive the applicant of rights commonly enjoyed by other properties in the
same vicinity and zone in which the property is located, under the terms of
this Chapter.

Office on April 22, 1868, described as follows:
Beginning at the intersection of the southerly line of a strip of land 60 feet wide, conveyed to the
city of Vernon, by deed recorded in book 5813 page 296 of Deeds, in the city Engineer of the city
of Los Angeles, a record of which is on file in said City Engineer's office in Field Book 1 2921 ,
pages 32, 33, and 34, with the westerly line of the easterly portion of Block 8 of Huntington
Industrial Tract as per map recorded in Book 6 page 10 of Maps, in the office of said county
recorder; thence along westerly line, south 00 31 '40" East, 280.35 feet to the notherly line of a
strip of land 15 feet wide, described in an agreement recorded in book 3529, page 160f said

EPKO INDUSTRIES
2080 25TH STREET
VARIANCE APPLICATION
SEPTEMBER 27, 1994
Epko Industries has requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 2080 25th Street in the
City of Vernon. The building that it occupies was constructed
with eight non-conforming truck loading spaces measuring 9.0 feet
in width and 57.5 feet in length. It has stated that only /
vehicles of smaller lengths will be used a~ the eight non-
conforming truck loading spaces. The building is used for the
distribution of threads and wall coverings and is approximately
30,000 square feet in size.
section 26.4.2-7 (b) requires three truck loading spaces for
buildings with a gross floor area of between 25,001 and 50,000
square feet in size. section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.
It has indicated that requiring the non-conforming truck
loading spaces to be 65 feet long by 10 feet wide would be a
hardship. It has indicated that it has no plans for expansion or

alteration of the building configuration. The operation is in
conformance with the Zoning Ordinance and General Plan.
Therefore, it is recommended that the variance be granted with
the following conditions: (a) the usage of the non-conforming
truck loading spaces shall be limited so that no truck parked at
the loading docks shall extend into the street right-of-way as
shown on the Master Plan of streets, dated June 16, 1992; and (b)
all existing and future tenants shall be notified of this
restriction and a condition stating this shall be placed in all
future leases.
