Resolution No. 6526 --- . ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 RESOLUTION NO. 6526 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO EAST CARBON DEVELOPMENT CORPORATION ENVIRONMENTAL, L.C. FOR THE OPERATION OF A FREIGHT TERMINAL AT 3535 WASHINGTON BOULEVARD WHEREAS, East Carbon Development Corporation Environmental, L.C. (hereinafter "ECDC") has applied for a conditional use permit to operate a freight terminal at 3535 Washington Boulevard; and WHEREAS, ECDC will receive soil from various construction sites in the area and proposes to transfer the soil from trucks to rail cars for out of state shipment at the project site; and WHEREAS, some of the soil may be contaminated with small amounts of hydrocarbons; and WHEREAS, the City Council of the City of Vernon 16 held a hearing on said application for a conditional use 17 18 permit on October 4, 1994; and WHEREAS, the proposed site is a conforming use in 19 the Heavy Industry (M2) Zone which requires a conditional 20 use permit under the Zoning Ordinance; and 21 22 23 24 25 26 27 28 WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation, and a masonry wall or landscaping will be installed where parking areas adjoin a public street pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effect from traffic, parking, noise, odors, smoke, 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 light or glare, or risk of fire, infection, explosion or effects on wildlife resources are anticipated from the proposed operation; and WHEREAS, the site has access to Washington Boulevard, and in general applicant's trucks will travel from the site, east on Washington Boulevard to the 710 Freeway or from the site west on Washington Boulevard, to either Alameda Street or Santa Fe Avenue, then north on either street to the I-10 Freeway; and WHEREAS, the site is required to have adequate offstreet parking and loading facilities in accordance with the Vernon City Code; and WHEREAS, the Community Services Department has performed an Initial Study to determine the potential adverse impacts to the environment that the proposed project 16 may cause and has determined that the proposed project will 17 not have a significant effect on the environment in this 18 case because of mitigating measures. The Acting Director of 19 Community Services & Water has recommended that a Negative 20 Declaration be adopted in compliance with the California 21 Environmental Quality Act; and 22 WHEREAS, the mitigating measures and the 23 conditions imposed on the conditional use permit will 24 adequately protect the public health, safety and general 25 welfare and the operation is consistent with all applicable 26 rules and laws of the City of Vernon; and 27 WHEREAS, the proposed use as to location, 28 operation, and design is consistent with the General Plan 2 1 2 3 4 5 6 7 8 9 and the Zoning Ordinance of the City of Vernon. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council hereby approves and adopts the Negative Declaration for the project and hereby finds that the project will not individually or cumulatively 10 have an adverse effect on the environment including the 11 wildlife resources. 12 13 SECTION 3: Pursuant to Section 711.4(c) of the Fish and Game Code, the City has found no evidence that the 14 proposed project will have the potential for adverse effects 15 on wildlife resources. The project is therefore exempt from 16 the fees otherwise payable under section 711.4. 17 SECTION 4: In order to adequately protect the 18 public health, safety and general welfare the following 19 mitigating measures are required: 20 A. ECDC shall construct a work pad, surrounded by 21 a berm, under all portions of the site where the unloading 22 and stockpiling of the imported soil will take place. The 23 system work pad and the berm shall have a double containment 24 barrier with a maximum permeability of 10-6 em/see, a water 25 collection system and a continuous leak monitoring system. 26 The final work pad and berm design shall be approved by the 27 City prior to construction. 28 B. All truck exteriors shall be rinsed free of 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 any attached soil in a wash basin approved by the Community services Department prior to exiting the work area. C. The project shall comply with the latest version of SCAQMD Rule 403 fugitive dust. In addition the plan for dust control shall be submitted to the City prior to operation. D. All onsite roadways leading to and exiting the off-loading area shall be paved with a hard durable surface and shall be of adequate width and thickness to handle the proposed site traffic. E. The site shall be graded, designed and maintained so that no soil or sediment shall enter the City street or the City storm drain system at any time. A Stormwater Pollution and Prevention Plan shall be submitted to the City for approval prior to operation. If any soil is deposited in the City street or storm drain it shall be immediately removed by ECDC and proper precautions taken to see that it does not recur. 19 F. Prior to any soil being imported to the site 20 it shall be tested and certified to be classified as a non- 21 hazardous material in accordance with state and Federal 22 ~ 24 25 26 27 28 regulations. Records showing lab analysis of the soil, and location where each truckload of soil was generated shall be kept on site. G. ECDC shall construct a barrier or guard post system along the west side of the project site, in order to protect the existing high pressure gas main and electrical tower. The location and type of barrier shall be approved 4 1 by the City prior to construction. 2 H. Where vehicular traffic will cross active rail 3 tracks on the site, ECDC shall either install permanent 4 automatic railroad crossing protection devices or provide a 5 full time flagman during truck unloading hours. 6 I. All hazardous material incidents within the 7 City of Vernon shall be reported to the Vernon Fire 8 Department (911). 9 J. ECDC shall obtain a solid waste facility 10 permit from the California Integrated Waste Management Board 11 ("Board"), whenever the Board promulgates permitting 12 regulations for solid waste transfer stations that handle 13 non-traditional wastes such as contaminated soil. 14 K. Prior to operation, ECDC shall prepare and 15 maintain a detailed operations plan for this soil transfer 16 facility. The plan shall specifically discuss: screening 17 of incoming loads for hazardous materials; leak monitoring 18 system below work pad; response to discerned leaks; 19 maintenance of load monitoring records; handling of rejected 20 loads; working hours; worker safety program; dust control; 21 backflow protection for potable water supplies; and control 22 of run-off water. The operations plan must be approved by 23 the Community Services and Health Departments of the City of 24 Vernon prior to operation of the facility. 25 L. ECDC shall comply with South Coast Air Quality 26 Management District requirements at all times. 27 M. ECDC shall comply with the hazardous materials reporting requirements of City of Vernon Ordinance No. 961, Hazardous Materials Monitoring Program. o. ECDC shall obtain and maintain a City of Vernon health permit for a Waste Transfer station. P. ECDC shall obtain and maintain all required state and Regulatory Agency permits prior to occupancy. SECTION 5: The City Council hereby approves the Mitigation Monitoring Program for the project. SECTION 6: In order to insure that the operation will be in harmony with its neighboring properties and will meet City Codes the following conditions are imposed upon ECDC: a. No business shall be conducted on city streets including transferring of product or cueing of vehicles. The operation of the facility shall be conducted in a manner such that a vehicle can enter the site at all times. b. ECDC shall provide all soil haulers with the attached map, marked Exhibit "A", showing the preferred routes of travel for vehicles between freeway exit and entrance points and the project site. Any soil load on a vehicle entering or exiting the site shall be covered. c. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. Prior to occupancy a City of Vernon business license and occupancy permit shall be obtained. All trucking operations, including truck and trailer 6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 parking, shall be limited to the lot located at 3535 Washington Boulevard. ECDC shall obtain proper building permits prior to any construction, demolition or removal of equipment. d. A log, in a form approved by the City of Vernon, of soils received at the facility and their weight shall be kept and made available to the City of Vernon or its independent accountant at all times. e. The number of employee parking spaces required per Vernon City Code shall be provided and maintained. f. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash or weeds. g. Where parking or maneuvering areas adjoin a public street or streets, a masonry wall not less than 30 inches in height or landscaped area a minimum of 4 feet in width, measured from the property line, shall be established along such frontage, except at driveways, walkways or where other openings are necessary. h. Guard posts shall be constructed at the ends of all driveways. i. ECDC shall not perform vehicle maintenance operations onsite unless specifically authorized by the City of Vernon Community services and Health Departments. j. ECDC shall operate the facility in a manner that avoids the creation of nuisances. k. A guard rail or wall shall be constructed at 7 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the top of the slope adjacent to Washington Boulevard. I. ECDC shall perform the mitigating measures set forth. m. This conditional use permit and its conditions, and the mitigating measures shall be accepted by ECDC and any assignees or successors, by a written instrument, executed and acknowledged, filed with the Vernon City Clerk within thirty (30) days of its approval, stating that the recitals and conditions are correct. If said acceptance is not so filed, this permit shall be null and void and of no effect. SECTION 7: ECDC and any successors in interest, shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the gross negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon or awarded against the City of Vernon on behalf of any party in such a proceeding. The city of Vernon does not waive its right to participate in the defense of any such action. SECTION 8: Subject to the mitigation measures and 8 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 conditions set forth above, the conditional use permit is granted to ECDC for the operation of a freight terminal at 3535 Washington Boulevard. SECTION 9: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. 1994. After review of the application by the community Services Department, it is recommended that the conditional use permit be granted and a negative declaration be adopted. Herewith for your consideration are the following supporting documents: 1. Request for conditional use permit and information supporting the application. 2. Engineer'S Report. 3. Initial Study. 4. Proposed Mitigation Monitoring Plan. * Honorable City Council -2- September 29, 1994 In my opinion the proposed operation will pose no adverse effects to the City of Vernon and with the required mitigating measures, will have no significant eff~cts on the environment . The project is consistent with the General Plan as adopted by the City of Vernon. Therefore it is recommended that the City Council determine: 1. That the project is consistent with the General Plan as adopted by the City of Vernon. 2. That the project will not have a significant effect on the environment in this case because of the following mitigating measures adopted. 3. That the project will not individually or cumulatively have an adverse effect on wildlife resources. It is also recommended that a Negative Declaration be adopted with the following mitigating measures, that a Notice of Determination and a De Minimis Finding be filed with the County Clerk and that the Mitigation Monitoring program be approved. A. ECDC shall construct a work pad, surrounded by a berm, under all portions of the site where tne unloading and stockpiling of the imported soil will take place. The system work pad and the berm shall have a double containment barrier with a maximum permeability of 10-6 cmlsec, a water collection system and a continuous leak monitoring system. The final work pad and berm design shall be approved by the City prior to construction. B. All truck exteriors shall be rinsed free of any attached soil in a wash basin approved by the Community Services Department prior to exiting the work area. C. The project shall comply with the latest version of SCAQMD Rule 403 fugitive dust. In addition the plan for dust control shall be submitted to the City prior to operation. D. All onsite roadways leading to and exiting the off- loading area shall be paved with a hard durable surface and shall be of adequate width and thickness to handle the proposed site traffic. E. The site shall be graded, designed and maintained so that no soil or sediment shall enter the City street or the City storm drain system at any time. A Stormwater Pollution and Prevention Plan shall be submitted to the City for approval prior Honorable City Council -3- September 29, 1994 to operation. If any soil is deposited in the City street or storm drain it shall be immediately removed by ECDC and proper precautions taken to see that it does not recur. F. Prior to any soil being imported to the site it shall be tested and certified to be classified as a non-hazardous material in accordance with State and Federal regulations. Records shdwing lab analysis of the soil, and location where each truckload of soil was generated shall be kept on site. G. ECDC shall construct a barrier or guard post system along the west side of the project site, in order to protect the existing high pressure gas main and electrical tower. The location and type of barrier shall be approved by the City prior to construction. H. Where vehicular traffic will cross active rail tracks on the site, ECDC shall either install permanent automatic railroad crossing protection devices or provide a full time flagman during truck unloading hours. I. All hazardous material incidents within the City of Vernon shall be reported to the Vernon Fire Department (911). J. ECDC shall obtain a solid waste facility permit from the California Integrated Waste Management Board ("Board"), whenever the Board promulgates permitting regulations for solid waste transfer stations that handle non-traditional wastes such as contaminated soil. K. Prior to operation, ECDC shall prepare and maintain a detailed operations plan for this soil transfer facility. The plan shall specifically discuss: screening of incoming loads for hazardous materials; leak monitoring system below work pad; response to discerned leaks; maintenance of load monitoring records; handling of rejected loads; working hours; worker safety program; dust control; backflow protection for potable water supplies; and control of run-off water. The operations plan must be approved by the Community Services and Health Departments of the City of Vernon prior to operation of the facility. L. ECDC shall comply with South Coast Air Quality Management District requirements at all times. M. ECDC shall comply with Regional Water Quality Control Board requirements. N. ECDC shall comply with the hazardous materials reporting requirements of City of Vernon Ordinance No. 961, Hazardous Materials Monitoring Program. Honorable City Council -4- september 29, 1994 o. ECDC shall obtain and maintain a City of Vernon health permit for a Waste Transfer station. P. ECDC shall obtain and maintain all required state and Regulatory Agency permits prior to occupancy. Further it is recommended that the conditional use ,permit be granted subject to the above mitigating measures and the following conditions: a. No business shall be conducted on City streets including transferring of product or cueing of vehicles. The operation of the facility shall be conducted in a manner such that a vehicle can enter the site at all times. b. ECDC shall provide all soil haulers with the attached map, marked Exhibit "A", showing the preferred routes of travel for vehicles between freeway exit and entrance points and the project site. Any soil load on a vehicle entering or exiting the site shall be covered. . c. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. Prior to occupancy a City of Vernon business license and occupancy permit shall be obtained. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 3535 Washington Boulevard. ECDC shall obtain proper building permits prior to any construction, demolition or removal of equipment. d. A log, in a form approved by the City of Vernon, of soils received at the facility and their weight shall be kept and made available to the City of Vernon or its independent accountant at all times. e. The number of employee parking spaces required per Vernon City Code shall be provided and maintained. f. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash or weeds. g. Where parking or maneuvering areas adjoin a public street or streets, a masonry wall not less than 30 inches in height or landscaped area a minimum of 4 feet in width, measured from the property line, shall be established along such frontage, except at driveways, walkways or where other openings are necessary. ECDC shall not perform vehicle maintenance operations onsite unless specifically authorized by the City of Vernon Community Services and Health Departments. j. ECDC shall operate the facility in a manner that avoids the creation of nuisances. k. A guard rail or wall shall be constructed at the top of the slope adjacent to Washington Boulevard. I. ECDC shall perform the mitigating measures set forth. m. This conditional use permit and its conditions, and the mitigating measures shall be accepted by ECDC and any assignees or successors, by a written instrument, executed and acknowledged, filed with the Vernon City Clerk within thirty (30) days of its approval, stating that the recitals and conditions are correct. If said acceptance is not so filed, this permit shall be null and void and of no effect. If pl-fi 1 I 1 1,1 e e ENVIRONMENTAL CHECKLIST FORM INTRODUCTION East Carbon Development Corporation Environmental, L. C. (ECDC) has submitted a conditional use permit application to the City of Vernon requesting permission to construct and operate a freight terminal. This Initial study has been prepared to determine if the construction and operation of this facility will have a significant effect upon the environment. This study has been prepared in accordance with the California Environmental Quality Act (CEQA). The City of Vernon will use this Initial study as a basis for deciding whether to prepare an Environmental Impact Report (EIR) or approve a Negative Declaration. PROJECT LOCATION AND EXISTING LAND USE The facility will be located at 3535 Washington Boulevard in the City of Vernon. The operation will take place on a vacant portion of Union Pacific Railways Yard. The project site is surrounded by Industrial and Distribution type uses. The nearest residential dwelling is located more than 1600 feet north of the site. The attached vicinity map depicts the local vicinity and shows the relationship of the facility to major highways in the Los Angeles area. The site is zoned M-2, Heavy Industrial,' and a freight terminal is allowed in this area with a conditional use permit. PROJECT DESCRIPTION East Carbon Development Corporation Environmental, L.C. proposes to operate a freight terminal at the project site. They intend to import to the site a maximum of 20,000 tons a week of non-hazardous soil from various construction sites in the area. They expect that a maximum of 129 trucks will deliver the soil to the site daily with 70% of the truck movements occurring during off peak hours. The soil will be dumped onto an impervious work pad and then transferred by loaders to railcars for out of state shipment. The subject site is a portion of Union Pacific Railroad Yard and is currently used for maintenance operations. A conditional use permit is required per the City of Vernon Comprehensive Zoning Ordinance. MITIGATION MONITORING Public Resources Code section 21081.6 requires that agencies adopt a monitoring or reporting program for any project which it has made findings pursuant to Public Code 21081 or adopted a Negative Declaration pursuant to section 21080(c). The mitigating measures identified in this initial study, if adopted as part of a 2 e e Negative Declaration as anticipated, must be monitored for implementation per Public Resource Code section 21081.6. If the freight terminal project is approved/as proposed, the permit issued by the city of Vernon will, when appropriate, specify a schedule of compliance for all mitigating measures imposed in the project approval package. Substantial adverse: Does the project have environmental effects which will cause adverse effects on human beings, either indirectly? substantial directly or --X 9 .. e e XXII DISCUSSION OF ENVIRONMENTAL EVALUATION EARTH AND WATER RESOURCES ECDC Environmental, L.C. proposes to transfer non-hazardous soil collected from various construction sites in the Los Angeles area from trucks to railcars for shipment out of state. The soil will contain low levels of hydrocarbons. All soil will be tested prior to being transported to the site. Trucks will off-load the dirt on to a specially constructed work pad that will have a containment berm to hold the hydrocarbon impacted soils within a defined area. The work pad will be completely underlain with a lining system consisting of from top to bottom, a permeable operationslleach collection system, a low permeability barrier layer consisting of clay andlor polyethylene geomembrane and a leak detection system. The work pad will include a precipitation runoff control system. The system will control and collect any precipitation runoff which may come in contact with hydrocarbon soils at the facility. A washing pad will also be constructed. Trucks transporting soils to the facility will be cleaned at the truck washing pad to remove soils which may be adhering to their tires or exterior surface. This will eliminate soil from being tracked off site. In addition the soil will be sprayed with water as being dumped, in order to keep dust to a minimum. with the construction of the work pad, wash pad and the water spraying, no adverse impacts to the earth or water resources are anticipated. AIR QUALITY ECDC Environmental, L.C. proposes to have a maximum of 129 trucks unload at the site. In addition a front loader will load the soil onto the railcars. The concentration of vehicles in one location may have some minor effects on the air quality however, overall air quality in the region will be improved. Instead of transporting the soil long distances to landfills or other alternative destinations, the ECDC facility, on an emissions basis, is therefore more efficient per ton of soil transported by train rather than truck. The ECDC facility will incorporate a wqter truck spray system that will eliminate dust during loading and unloading process. All loads will be covered while being transported. All trucks exiting the site will be washed to remove soil that may have adhered to the wheels or body. Prior to operation a permit and or approvals must be obtained from the South Coast Air Quality Management District. with the installation of the dust control system no adverse impacts to the air quality are expected. BIOLOGICAL The proposed project will not have a significant effect ont he existing biological resources in the area. No endangered or threatened species are expected to be found on the site. " It e NOISE The project site is within a portion of Union Pacific's yard and is surrounded by industrial and commercial uses. The noise generated by the facility will not cause a significant effect on the environment. LIGHT AND GLARE The project, as proposed, will provide lights for work during the night time hours. However since the site is located in an industrial area and the existing adjacent railroad yards Are heavily lighted at night, no impacts from light are anticipated. The project, as proposed, will create no glare. LAND USE The project area is zoned Heavy Industry, M-2. A freight terminal is allowed in this zone with a conditional use permit. NATURAL RESOURCES Diesel fuel is used to operate the vehicles. This would not be a significant impact, due to the relatively small scale of the project and the small amount of materials used. RISK OF UPSET The imported soil will contain a slight amount of hydrocarbons, but is classified as being non-hazardous in accordance with Federal and State standards. No risk is therefore associated with the soil. A high pressure gas main travels along the west side of the site. If this gas main were to be damaged a major explosion or fire could result. As a mitigating measure a fence or guard post system will have to be installed prior to operation. This fence will thereby eliminate the potential of loaders or other heavy equipment from digging into the line. Trucks will also be prevented from driving over the main. POPULATION AND HOUSING The facility will employ from 5 to 10 people. No change in population or housing will occur as a result of the project. TRANSPORTATION/CIRCULATION The project has access to Washington Boulevard. The access driveway is at a signalized intersection. The facility expects to have 129 trucks per day visit the site. Seventy percent of these trucks will arrive at the site during off peak hours, between 7 pm and 5 am. The remaining 30 percent of the trucks, approximately 39 , will arr i ve dur ing the peak hours, between 5 am and 7 pm. Washington Boulevard has two traffic lanes in each direction with a left turn pocket at the intersection. Washington Boulevard has , . e e an average daily traffic count of over 18,700. All streets to be utilized have adequate capacity to handle the traffic generated by the facility. PUBLIC SERVICES No additional public services will be required for this facility. ENERGY There will be no impact to the City of Vernon Light and Power Department. The energy used by this operation will be negligible. HUMAN HEALTH The soil being transferred at the site is classified as non- hazardous. Sanitation facilities currently exist on the site. Therefore, no health hazards are associated with this project. AESTHETICS The area .surrounding the property is made up of industrial and commercial uses. The facility will blend in and not create any offensive visual effect. RECREATIONAL There will be no significant impact to any recreational resources in the area. CULTURAL RESOURCES There are no known historic buildings or cultural sites in the area. No archaeological or historical objects are expected to be found during construction. XXIII DISCUSSION OF LAND IMPACTS The proposed project is in conformance with the City of Vernon General Plan. However, a mitigating measure will require that no dust be allowed to be emitted across the property line. Water trucks will be utilized to thoroughly wet the soil to keep dust to a minimum. 2. Introduction The Negative Declaration prepared for the ECDC Environmental, L.C. freight terminal project (state Clearinghouse No. 94071023) indicates that the proposal may have potential impacts on the environment in the absence of any mitigation. The Negative Declaration indicates specific measures and programs that should be adopted as part of the development approval to ensure the potential adverse impacts are mitigated. In accordance with requirements of section 21081.6 of the Public Resources Code, the City Council makes the following additional findings: That a mitigation reporting and monitoring program shall implemented as specified for the ECDC Environmental, L. C. freight terminal project. Site plans and/or building plans, submitted for approval by the responsible monitoring agency, have included required mitigation measures/conditions; and That an accountable enforcement agency and monitoring agency shall be identified for mitigation measureslconditions adopted as part of the decision maker's final determination. This Mitigation Monitoring Program (MMP) was prepared by the City of Vernon Community Services Department in accordance with AB 3180. The comprehensive MMP presents the mitigation measures which have been adopted as conditions of approval by the Vernon City Council, in conjunction with the adoption of the Negative Declaration prepared for this project, and the respective monitoring of these measures to be conducted by City staff or their environmental consultant. The MMP will serve a dual purpose of verifying implementation of the mitigation measures for the freight terminal project and of generating information the effectiveness of the mitigation measures to guide future mitigation programs. , Scope of the MMP The environmental analysis contained in the Initial Study incorporated herein by reference, focused on issues determined to be potentially significant by the City of Vernon. The environmental analysis concluded that the environmental issues discussed in the Initial Study, the significant and potentially significant impacts could be avoided or reduced to a level below 1 . . significance through the implementation of recommended mitigation measures. Components of the MMP The MMP is comprised of three separate phases of monitoring to ensure that all project mitigation measures have been fully implemented: (1) monitoring that will occur prior to issuance of permit; (2) monitoring that will occur during the project's construction; and (3) monitoring that will occur on an on-going basis throughout the life-time of the project. Monitorinq Prior. to Permit Issuance The first phase of the monitoring will occur prior to the issuance of proj ect permits (e. g., CUP, Solid Waste Facility Permit, building permit and grading permit) and will involve review and approval, by the City or other agencies, of the various design details and plans necessary to implement the project. The Initial Study calls for certain grading and design details, as well as other specific plans to be implemented during project operations. City staff and other agencies, as part of their plan review, will check to make sure that the required items have been incorporated into these plans. Monitorinq Durinq Construction Once the mitigation measures have been adopted as conditions of approval by the City of Vernon, a construction monitoring team will be identified. Managing the team will be the responsibility of a mitigation compliance coordinator at the City. Prior to any project implementation activities, a pre- construction meeting will take place between the city of Vernon staff and all individuals involved in the completion of the MMP to clearly establish the responsibility and authority of the participants. An effective reporting system will be established prior to any monitoring activities. All parties involved will have a clear understanding of the mitigation measures as adopted, and the mitigation measures must be distributed to the participants of the monitoring effort. Those that will have a complete list of all the mitigation measures adopted by the city would include the City of Vernon, the applicant and the construction crew supervisor. Compliance report forms will be prepared with each mitigation measure written out on the top of the form. All persons responsible for monitoring measures shall complete the report and file it with the City following each monitoring activity. The conclusions Of these forms for each monitoring effort will be compiled into a comprehensive Monitoring Report by the appropriate city staff. The Monitoring Report will describe the major accomplishments of the monitoring program, summarize the problems 2 , . encountered in achieving the goals of the program, evaluate solutions developed to overcome problems, and provide a list of recommendations for future monitoring efforts. On-qoinq Monitorinq The requirements for on-going monitoring will be specified in the permit conditions of the proj ect or in the back-up reports required as a result of those permit conditions. The City of Vernon will be responsible for ensuring that their permit conditions for the freight terminal's operations are being implemented. Actual monitoring activities may be carried out by City-staffed field inspections, other agency-staffed inspections, or by specialists hired by the City or the project applicant to carry out specif ic programs. In. this case, the City or other permitting agency will be responsible for reviewing the monitoring reports as they are submitted by the project applicant or monitors. Non-Compliance Procedures There are generally three separate categories of non- compliance associated with the adopted conditions of approval: Non-compliance requiring an immediate halt to a specific task or piece of equipment. Non-compliance requiring immediate corrective action, with no work or task delay. Non-compliance that does not warrant immediate corrective action and results in no work or task delay. In all three cases, the City will notify the applicant's contractors. If non-compliance continues, the responsibility for enforcement is with the City. Some methods commonly used by other lead agencies include: "stop work" orders, fines and penal ties (civil), permit revocations, citations, and injunctions. It is essential that all parties involved in the MMP understand the authority and responsibility of the on-site monitors. SUMMARY OF MITIGATION MEASURES AND MONITORING EFFORTS The following text includes a listing of the freight terminal project's mitigation measures and the monitoring efforts required to ensure that the mitigation measures are adequately implemented. 3 A. EenC shall construct a work pad, surrounded by a berm, under all portions of the site where the unloading and stockpiling of the imported soil will take place. The system work pad and the berm shall have a double containment barrier with a maximum permeability of 10-6 cmlsec, a water collection system and a continuous leak monitoring system. The final work pad and berm design shall be approved by the City prior to construction. Res~onsible Agency: City of Vernon Health and Community Services Departments Implementation: Prior to issuance of permits, the City of Vernon Health and Community Services Departments shall review the grading and, work pad construction plans to insure that it has been adequately designed. The construction of the pad will be inspected and approved by both departments. The Health Department will periodically check the leak monitoring system to insure that it is not in alarm. Frequency: Plan check and periodic Method of Verification: inspections. Plan review and approval and site B. All truck exteriors shall be rinsed free of any attached soil in a wash basin approved by the community Services Department prior to exiting the work area. Responsible Agency: Vernon Community Services Department Implementation: Throughout the life of the project, the project operator shall insure that the exterior of the vehicles exiting the site are free of soil. The Vernon Community Services Department will conduct periodic inspections to verify compliance. Frequency: Periodic Method of Implementation: site Inspection C. The project shall comply with the latest version of SCAQMD Rule 403 fugitive dust. In addition the plan for dust control shall be submitted to the city prior to operation. Responsible Aqency: Vernon Health Department Implementation: Prior to the approval of the certificate of occupancy a dust control plan shall be submitted by the operator for review and approval by the Vernon Health Department. Periodic site inspections will verify compliance with the plan. 4 . . Frequency: Plan check and periodic Method of Verification: Plan review check and site inspections D. All onsite roadways leading to and exiting the off-loading area shall be paved with a hard durable surface and shall be of adequate width and thickness to handle the proposed site traffic. Responsible Aqency: Vernon Community Services Department Implementation: Prior to issuance of the certificate of occupancy, plans must be submitted for review and approval and construction completed. Frequency: Plan check and construction Method of Verification: Plan check and site inspection E. The site shall be graded, designed and maintained so that no soil or sediment shall enter the city street or the City storm drain system at any time. A stormwater Pollution and Prevention Plan shall be submitted to the City for approval prior to operation. If any soil is deposited in the City street or storm drain it shall be immediately removed by ECDC and proper precautions taken to see that it does not recur. Responsible Agency: Vernon Community Services Department Implementation: Prior to approval of the occupancy permit the stormwater plan shall be approved by the Community Services Department. Grading plans shall be submitted to the City and approved prior to any construction. The construction will be inspected and periodic site inspections will be made to insure that soils are not deposited off site. Frequency: Plan check, construction and periodic Method of Verification: Plan check and site inspections F. Prior to any soil being imported to the site it shall be tested and certified to be classified as a non-hazardous material in accordance with state and Federal regulations. Records Showing lab analysis of the soil, and location where each truckload of soil was generated shall be kept on site. Responsible Aqency: Vernon Health Department Implementation: Throughout the life of the project the operator of the facility shall insure that proper documentation is kept on all soils received. The Health Department will periodically conduct inspections to verify compliance. 5 . ' G. ECDC shall construct a barrier or guard post system along the west side of the project site, in order to protect the existing high pressure gas main and electrical tower. The location and type of barrier shall be approved by the City prior to construction. Res90nsible Agency: City of Vernon Community services Department Implementation~ Prior to occupancy plans shall be approved and construction shall be completed Freauency: Plan check and construction Method of Verification: Plan approval and site inspection H. Where vehicUlar traffic will cross active rail tracks on the site, ECDC shall either install permanent automatic railroad crossing protection devices or provide a full time flagman during truck unloading hours. Responsible Aaency: City of Vernon Community services Department Implementation: Either the operator shall construct permanent automatic protection devices or for the life of the project the operator shall post employees at all railroad crossings to flag traffic. The Community Services Department shall make periodic inspections to insure compliance. Frequency: Plan check and construction or periodic Method of Verification: Plan approval and or site inspections I. All hazardous material incidents within the City of Vernon shall be reported to the Vernon Fire Department (911). Responsible Agency: City of Vernon Fire Department. Implementation: Throughout the life of the project, the project operator shall insure that Fire Department is notified of all hazardous material incidents. Frequency: When necessary Method of Implementation: Site visitation J. ECDC shall obtain a solid waste facility permit from the California Integrated Waste Management Board ("Board"), whenever the Board promulgates permitting regulations for solid waste transfer stations that handle non-traditional wastes such as contaminated soil. Responsible Agency: Vernon Health Department 6 . ' \ t~ , Implementation: The project operator shall obtain a facility permit from the California Integrated Waste Management Board within a reasonable length of time as set by the Vernon Health Department. Frequency: When necessary Method of Implementation: Vernon Health Department shall notify the project operator that the facility requires a permit from California Integrated Waste Management Board when permitting regulations are established. K. Prior to operation, ECDC shall prepare and maintain a detailed operations plan for this soil transfer facility. The plan shall specifically discuss: screening of incoming loads for ha2ardous materials; leak monitoring system below work pad; response to discerned leaks; maintenance of load monitoring records; handling of rejected loads; working hours; worker safety program; dust control; backflow protection for potable water supplies; and control of run-off water. The operations plan must be approved by the community services and Health Departments of the city of Vernon prior to operation of the facility. Responsible Agency: City of Vernon Health and Community services Departments . Implementation: Prior to operation, ECDCshal1 submit a complete operations plan that will provide adequate procedures for the handling of materials and related safety concerns. This document shall be approved by both the Vernon Health and community services Departments. The project operator shall insure that the facility is operated in conformance with this operations plan at all times for the life of the project. Frequency: Plan approval and periodic Method of Verifications: Plan approval and site inspections L. ECDC shall comply with South Coast Air Quality Management District requirements at all times. ResPonsible Agency: South Coast Air Quality Management District Implementation: Prior to operation, ECDC shall obtain all required permits. Frequency: Permit approval Method of Inspection: Permit approval. 8 _\ ~ . @ ~ ENGINEER'S REPORT ON EAST CARBON DEVELOPMENT CORPORATION ENVIRONMENTAL, L.C. FREIGHT TERMINAL AT 3535 WASHINGTON BOULEVARD (09/27/94) 1. PROJECT DESCRIPTION East Carbon Development Corporation Environmental, L.C. (ECDC) is proposing to operate a freight terminal at 3535 Washington Boulevard. The site will accommodate the transfer of soils containing non-hazardous levels of hydrocarbons from trucks to trains for shipment out of state. ECDC is proposing to receive soils containing small amounts of hydrocarbons at the Washington Boulevard site. The soil will be transferred from various construction project sites via truck. Soils will be tested prior to shipment to ensure that they are classified as non-hazardous in accordance with Federal and State laws. Only soils which do not exceed 50 ppm VOC will be accepted at the site. It is estimated that the maximum amount of soil to be transferred to the site will be 20,000 tons a week. This equates to an average of 129 truckloads a day. The operation will be conducted 7 days a week 24 hours a day. 70% of the loaded trucks will travel to the site during evening and early morning hours. Trucks will travel onto the 2 acre site and dump the soil onto a work pad. Then travel to a wash station where their wheels and exterior surfaces will be rinsed of any dirt before exiting the site. The work pad will be provided with a berm to contain the soils within a defined area. The pad will be completely 1 ~4- .. underlain with a lining system. The system will consist of from top down: a permeable operationslleachate collection layer; a low permeability barrier layer consisting of clay andlor polyethylene Geomembrane; and a leak detection system. The soils will be bulldozed to a surge area on the impervious work pad. Then loaded into Union Pacific Railroad gondola rail cars using a front end loader. A water spray will be used during truck unloading and rail car loading via a water truck to maintain adequate soil moisture levels to prevent dusting. ECDC owns and operates a fully permitted, rail served landfill facility in Utah that will utilize the soils. The soils will be transported by rail to the ECDC landfill facility for use as alternative daily cover and liner cover. All railroad cars will either be covered or sealed prior to exiting the Vernon site. It is anticipated that the facility will employ 5 to 10 full time employees. Operators will be appropriately trained in emergency first aid procedures and will be thoroughly trained in operational and equipment procedures. Existing onsite office space and restroom facilities will be utilized. Adequate nighttime lighting with lighting shields will be provided as necessary. It should be noted that this type of non-hazardous bulk loading operation is a normal part of the current rail yard operations. This facility is only temporary, and is expected to operate for three to five years. 2 2. GENERAL PLAN The proposed use conforms to the zoning ordinance and the General Plan of the city. 3. SITE The proposed site is a small portion of the existing active union Pacific Railroad Yard, approximately 2 acres in size. Its most recent use was for the storage and trans loading of railroad maintenance supplies. with the exception of the small office, an LADWP transmission tower, and railroad tracks, the site is vacant. The property is relatively flat. On the west side of the property a high pressure gas main crosses under the site at an approximate depth of 10 feet. There are no known cultural, historic or scenic aspects to the site. 4. ADVERSE EFFECT The proposed site is surrounded by railroad yards and industrial and commercial uses. The closest residential unit to our knowledge is over a quarter of a mile away. The proposed use is compatible with its surroundings. No adverse noise, odor, smoke, light or glare, or risk of fire infection, or explosion is anticipated from the proposed use. ECDC has submitted a study which shows the levels of hydrocarbon compounds that the soils can contain which will result in negligible effects to the residential community. The soil imported to the site will at no time exceed these concentrations. 5. ACCESS The site has access to washington Boulevard. The street is of adequate capacity ,to handle the traffic generated by the facility. There is an existing traffic signal at the site entrance driveway. 3 6. TRUCK MOVEMENTS ECDC anticipates that an average of 129 trucks per day will travel to the site. In general traffic will travel from the site east on Washington Boulevard to the 710 freeway or west from the site on Washington Boulevard to either Santa Fe Avenue or Alameda Street, then north to the 10 freeway. Vehicles entering the site will travel the same streets in the opposite dire~tion. 70% of the truck traffic will occur between the hours of 7:00 pm and 5:00 am. Only a few trucks will travel to the site during the time that coincides with the peak hours of our City streets. The streets to be utilized appear to have sufficient capacity to handle the traffic. 7. STATE OR FEDERAL CONDITIONS There are no conditions imposed by State or Federal law. 8. MITIGATING MEASURES AND CONDITIONS It is recommended that the following mitigating measures and conditions be set on the permit to adequately protect the public interests: MITIGATING MEASURES A. ECDC shall comply with South Coast Air Quality Management D~strict requirements at all times. M. ECDC shall comply with Regional Water Quality Control Board requirements. N. ECDC shall comply with the hazardous materials reporting 6 . " requirements of City of Vernon Ordinance No. 961, Hazardous Materials Monitoring Program. O. ECDC shall obtain and maintain a city of Vernon health permit for a Waste Transfer Station. P. ECDC shall obtain and maintain all required state and Regulatory Agency permits prior to occupancy. CONDITIONS a. Nq business shall be conducted on City streets including transferring of product or cueing of vehicles. The operation of the facility shall be conducted in a manner such that a vehicle can enter the site at all times. b. ECDC shall provide all soil haulers with the attached map, marked Exhibit "A", showing the preferred routes of travel for vehicles between freeway exit and entrance points and the project site. Any soil load on a vehicle entering or exiting the site shall be covered. c. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. Prior to occupancy a City of Vernon business license and occupancy permit shall be obtained. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 3535 Washington Boulevard. ECDC shall obtain proper building permits prior to any construction, demolition or removal of equipment. d. A log, in a form approved by the City of Vernon, of 7 < .. " soils received at the facility and their weight shall be kept and made available to the City of Vernon or its independent accountant at all times. e. The number of employee parking spaces required per Vernon City Code shall be provided and maintained. f. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash or weeds. g. Where parking or maneuvering areas adjoin a public street or streets, a masonry wall not less than 30 inches in height or landscaped area a minimum of 4 feet in width, measured from the property line, shall be established along such frontage, except at driveways, walkways or where other openings are necessary. h. Guard posts shall be constructed at the ends of all driveways. i. ECDC shall not perform vehicle maintenance operations onsite unless specifically authorized by the City of Vernon Community Services and Health Departments. j. ECDC shall operate the facility in a manner that avoids the creation of nuisances. k. A guard rail or wall shall be constructed at the top of the slope adjacent to Washington Boulevard. I. ECDC shall perform the mitigating measures set forth. m. This conditional use permit and its conditions, and the mitigating measures shall be accepted by ECDC and any assignees 8 ,_// ~ , . or successors, by a written instrument, executed and acknowledged, filed with the Vernon city Clerk within thirty (30) days of its approval, stating that the recitals and conditions are correct.
