A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON GRANTING A CONDITIONAL USE PERMIT
TO SHAHRAM VAHDAT FOR THE OPERATION OF A RETAIL
COMMERCIAL USE (RESTAURANT) WHICH WILL GENERATE
MORE THAN 20 VEHICLE TRIPS PER DAY PER 1,000 GROSS
SQUARE FEET OF FLOOR AREA AT 2626 SANTA FE AVENUE
WHEREAS, Shahram Vahdat has applied for a
(restaurant) with a proposed floor area of approximately
4,300 square feet at 2626 Santa Fe Avenue, in the
Commercial-Industrial (C-M) Zone.

held a hearing on said application for a conditional use

WHEREAS, the City Council of the City of Vernon
permit on November 15, 1994; and

WHEREAS, the proposed use will generate more than
15 20 vehicle trips per day per 1,000 square feet of floor area

and requires a conditional use permit under Section 26.3.7-3

WHEREAS, the proposed site is of adequate size and

shape for the proposed operation; and

WHEREAS, the proposed use is surrounded by

industrial uses and is compatible therewith and no adverse

noise, odor,
dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation; and
WHEREAS, the site has adequate access to Santa Fe

Avenue, and it is anticipated that traffic will travel to
27 the site from all directions. Santa Fe Avenue has adequate

capacity to handle the traffic generated from the proposed

WHEREAS, there are no conditions imposed by State
or Federal laws; and
WHEREAS, the Community Services Department has

WHEREAS, the proposed use is consistent with the
General Plan and the Comprehensive Zoning Ordinance of the
City of Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: That the City Council of the City of
Vernon hereby finds and determines that the recitals
contained hereinabove are true and correct.
SECTION 2: That the conditional use permit is
hereby granted to Shahram Vahdat for the operation of a

18 public to the location of standard size stalls.

In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will have no significant
effects on the environment .
The project is consistent with the General Plan as adopted

Therefore it is recommended that the City Council determine:

33. An approximate 21,000:1: brick industrial facility constructed in 1922. The
facility suffered severe structural damage as a result of the most recent
earthquake. Economically, it would not make sense to repair the facility.
The building prior to the earthquake was a nonconforming building relative to
today's Vernon codes. The loading faces Santa Fe Avenue and is less than
30' from the dock to the back of the sidewalk. In addition, the property in its
existing site offers approximately 7 parking spaces, which is well below
present codes. The property was previously used as a carpet warehouse.
Being an industrial I commercial area, there is no plant life to speak of in the
area and absolutely none on the subject site. The only known animals in the
area would be birds. There are no cultural, historical or scenic aspects
relative to the existing site.
34. The surrounding properties are all industrial in nature. There is no
residential building in the area. Commercial activity is limited. There is one
restaurant located substantially further south at 55th and Santa Fe.
Generally speaking, the height of the surrounding properties is in the 15' to
20' range, The properties are built right to the property lines and are
generally nonconforming relative to today's Vernon City codes.

I woul~ like to take this opportunity to thank you for your assistance in achieving. a
. successful implementation of the provisions of Assembly Bill 3158, Chapter 1607,
Statutes of 1990.
As you are aware, this measure requires that proponents of projects subject to~ the
provisions of the California Environmental Quality Act help defray transactional costs
assOciated with the protection and management of wildlife. The Dep~ent
of Fish and . Game is charged with. the responsibility to protect .and ensure the
.continued viability-of California's wildlife resourCes. The Legislature, in adopting this
legislation, determined that it was appropriate for those persons who may consume
wildlife through urbanization and development, pay a portion of the Department's costs
to protect wildlife resources. Hunters and fishers have provided the primary funding
for this . effort in the past.
Because the public may. not be aware of these fees or may not understand th~ reason
for them, I have enclosed a general informational letter which you may want to provide
to your project proponents.

Environmental Filing Fees

In accordance with Section 711.4 of the Fish and Game Code,
effective January 1,f1991, persons or entities are required to pay
an Environmental Filing Fee for projects subject to the California
Environmental Quality Act (CEQA) that may have any adverse affect
on wildlife resources. As defined in .Section"711.2(a) of the Fish
and Game Code: n.. ..'wildlife' ~eans and'includes all wild
animals, birds, plants, fish, amphibians, and related ecological
communities, including the habitat upon which the wildlife depends
for. its continued Viability. .. .n.. The filing fees are'due and
payable~at.the time a.Notice of Approval or Determination is filed
with the county clerk. With the exception of a documentary
handling fee., counties are required to remit 100 percent of these
fees to the Department of Fish and Game (Department).
The Legislature, in adopting environmental filing fees, intended
to exten~.the current Department user-based funding system by
allocating a portion of the costs of wildlife protection and
management to those who may consume wildlife resources through
urbanization and development. These fees are not intended to
reimburse costs specifically identifiable to individual projects,
but rather to offset a relative portion of the cumulative .effect
of all projects.
It is important to note, Section 711..4(c) of the Fish and Game
Code and Section 21089 of the Public Resources Code, " clearly
states: II.... no project shall be operative, vested, or.fina1
until the filing fees required pursuant to section 711.4 are
paid."
Fee exemptions are allowed for the following projects:
1.. All projects statutorily exempt from the provisions of
CEQA. .
2. All projects",categorically exempt .by regulations of the
Secretary for Resources from the.requirement to prepare
an e~vironmental document. ..
3. All projects found by the lead agency to be "de min~is"
when a lead agency finds and certifies that, as a result
of its environmental review, a project has no potential
for any adverse effect, either individually or
cumulatively on wildlife resources.

XXII. DISCUSSION OF ENVIRONMENTAL EVALUATION.
Earth & Water Resources - The existing building on the
site will be demolished and a new 3,300 square foot building
constructed. The majority of the site will be paved and some
landscaping will be installed. Some minor grading will take place
during construction and dust will be controlled per SCAQMD
standards. Discharge to the sewer and storm drain will be in
conformance with all applicable regulations. No adverse effects to
either resource is anticipated.
Air Ouality - The restaurant will emit some exhaust from
its ranges while cooking. All emissions will be in conformance
with SCAQMD's regulations. It is anticipated that there will be no
adverse effect to air quality as a result of the operation of the
restaurant.

site will be demolished and a new 3,300 square foot building
constructed. The majority of the site will be paved and some
landscaping will be installed. Some minor grading will take place
during construction and dust will be controlled per SCAQMD
standards. Discharge to the sewer and storm drain will be in
conformance with all applicable regulations. No adverse effects to
either resource is anticipated.
Air Ouality - The restaurant will emit some exhaust from
its ranges while cooking. All emissions will be in conformance
with SCAQMD's regulations. It is anticipated that there will be no
adverse effect to air quality as a result of the operation of the

XXII. DISCUSSION OF ENVIRONMENTAL EVALUATION.
Earth & Water Resources - The existing building on the
site will be demolished and a new 3,300 square foot building
constructed. The majority of the site will be paved and some
landscaping will be installed. Some minor grading will take place
during construction and dust will be controlled per SCAQMD
standards. Discharge to the sewer and storm drain will be in
conformance with all applicable regulations. No adverse effects to
either resource is anticipated.
Air Ouality - The restaurant will emit some exhaust from
its ranges while cooking. All emissions will be in conformance
with SCAQMD's regulations. It is anticipated that trhere will be no
adverse effect to air quality as a result of the operation of the
restaurant.

Santa Fe Avenue has a two way left turn pocket with adequate

within the vicinity have adequate capacity to handle any small
increases in traffic that may be generated. No increase in
traffic hazards to motor vehicles, bicyclists or pedestrians are
expected.

required for the proposed operation.

ENGINEER'S REPORT
FOR SHAHRAM VAHDAT'S RESTAURANT
CONDITIONAL USE PERMIT AT
2626 SANTA FE AVENUE
(October 27, 1994)
Shahram Vahdat has applied for a conditional use permit to
operate a restaurant which will generate more than 20 vehicle
trips per day per 1,000 square feet of floor area. The
restaurant will be located at 2626 Santa Fe Avenue and will have
a seating capacity of 100. The hours of operation will be from
8:00 am to 4:00 pm. In addition to serving food at the
restaurant they expect to make 25 deliveries daily.
1. GENERAL PLAN The proposed use is in conformance with
present Zoning Ordinance and the General Plan.
2. SITE The site is approximately 25,600 square feet in
size. The existing building on the site will be demolished and a
3,300 square foot structure will be constructed. In addition a
1,000 square foot patio will be installed. It is proposed that
27 standard parking stalls and 34 compact parking stalls be
provided.
3. ADVERSE AFFECT The site is surrounded by industrial and
commercial uses and the proposed use is compatible therewith, and
no adverse noise, odor, dust, smoke, light or glare, or risk of
fire, infection or explosion is anticipated.
4. ACCESS The site has access to Santa Fe Avenue, 80 feet
in width. The restaurant will be served by two driveways. It is
anticipated that traffic on Santa Fe Avenue will not be upset by
the restaurant's operation. Santa Fe Avenue has adequate
capacity and pavement type for the proposed operation and the
existing two way left turn pocket will be modified to allow
southbound vehicles to make a legal left turn into the southern
driveway. The left turn pocket will allow approximately four
vehicles to cue without restricting traffic.
5. VEHICLE MOVEMENTS They have estimated that 200
customers will be served at the restaurant daily, and anticipate
100 cars per day between the ours of 10:00 am and 3:00 pm will
enter the site. Additionally they will make 25 deliveries daily.
Most customers will either be generated from existing drive-by
vehicles or people who are currently traveling City streets to
visit competing restaurants outside of the City. The average
daily traffic on Santa Fe Avenue is approximately 28,000. It is
therefore anticipated that any increase in traffic will be
negligible.
6. USE The Zoning code requires that a conditional use
permit be granted for any commercial use that will generate more
than 20 vehicles per day per 1,000 square feet of floor area.
7. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
8. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with,
and made to conform with all current codes, rules, regulations
and subject to permit fees as adopted by the City of Vernon.

b. Pursuant to the City of Vernon Comprehensive Zoning
Ordinance, parking and loading spaces shall be provided for the.
restaurant in accordance with Vernon City Code Sections 26.4.2-6
and 26.4.2-7. All parking and maneuvering areas, including the
ingress and egress shall be paved.
c. Prior to occupancy, Shahram Vahdat shall obtain a sales
tax permit from the State Board of Equalization bearing the City
of Vernon Tax number 19039, and a City of Vernon business
license.
d. Shahram Vahdat shall construct all frontage improvements
and fund all required utility relocation and services adjacent to
the site along Santa Fe Avenue as directed by the Acting Director
of Community Services and shown on the submitted plans. The
improvements shall include the work associated with the removal
and construction of driveways on Santa Fe Avenue, and replacement
of any broken or displaced curb, gutter or sidewalk. All work
shall be performed to City standards and shall be completed prior
to occupancy.
e. Adequate trash receptacles shall be provided on the site
to keep litter to a minimum. All litter associated with the
operation of the restaurant, blown or dropped on adjacent
properties shall be retrieved and disposed of daily by a
restaurant employee.
f. The parking, driveway access and landscaping shall be
developed in accordance with the site plan which was submitted
with this application and approved by the Acting Director of

Community Services. No changes shall be made in the site
development except with the prior approval of the Acting Director
of Community Services.
g. The restaurant shall be rodent proofed.
h. The construction plans for the restaurant shall be
approved by Vernon Health Department. The restaurant shall
comply with the California Uniform Retail Facilities law.
i. All compact parking stalls shall be marked as such by
the letter C within the stall and signs shall be posted stating
compact vehicles only and directing the public to the location of
standard size stalls.
