RESOLUTION NO. 6530 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO PAN METAL CORPORATION, FROM SECTION 26.4.2-8 (e), ACCESS, OF THE COMPREHENSIVE ZONING ORDINANCE FOR THE PROPERTY LOCATED AT 4800 ALAMEDA STREET IN THE CITY OF VERNON WHEREAS, Pan Metal Corporation occupies a parcel of property located at 4800 Alameda Street in the City of Vernon which requires a variance from section 26.4.2-8 (e), Access, of the Comprehensive Zoning Ordinance; and WHEREAS, the physical condition of the property is unique in that the proposed parcel measuring approximately 134,427 square feet is non-rectangular in shape because of a railroad spur which lies adjacent to the parcel; and WHEREAS, Pan Metal Corporation is proposing to build a 72,000 square foot building to be used for garment manufacturing; and WHEREAS, Zoning Ordinance section 26.4.2 -8 (e) specifies that no curbcut for a driveway to any parking or loading facility shall be permitted within seventy-five feet of the point of tangency of any curb return for a driveway used by trucks; and WHEREAS, Pan Metal Corporation is proposing to construct a curbcut on 48th Street for a driveway 63.0 feet east of the point of tangency of the proposed curb return on the southeast corner of Alameda and 48th Streets; and WHEREAS, Pan Metal Corporation is expanding said curb return to a 50.0 foot radius; and WHEREAS, 4800 Alameda Street is located in the M zone 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the City Council of the city of Vernon held a hearing on said application for a variance on October 18, 1994. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the city of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from Section 26.4.2-8 (e), Access, of the Comprehensive Zoning Ordinance, requiring seventy- five feet from the point of tangency of any curb return to a curb cut for a driveway to any parking or loading facility to be used by trucks is hereby granted to Pan Metal Corporation at 4800 Alameda Street. SECTION 3: The variance shall be granted subject to the following conditions: (a) Pan Metal Corporation shall expand the curb return on the southeast corner of Alameda and 48th Streets to have a radius of 50.0 feet; and (b) the curbcut for the driveway on .48th Street shall be no less than 63.0 feet from said expanded curb return. SECTION 4: Noncompliance with these conditions shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of the access requirements. ENGINEER'S REPORT PAN KETAL CORPORATION 4800 ALAMEDA STREET VARIANCE APPLICATION OCTOBER 13, 1994 stu.U Pan Metal Corporation has requested a variance from the Comprehensive Zoning Ordinance section 26.4.2-8 (e), Access, for the property located at 4800 Alameda Street in the City of Vernon. The proposed parcel measuring approximately 134,422 square feet is non-rectangular in shape because of a railroad spur which lies adjacent to the parcel. Pan Metal corporation is proposing to build a 72,000 square foot building to be used for garment manufacturing and as part of the development proposes to construct a curb cut for a driveway to be used by trucks 63.0 feet from the point of tangency of the proposed curb return on 48th Street. Section 26.4.2-8 (e) specifies that no curb cut for a driveway to any parking or loading facility shall be permitted within 75 feet of the point of tangency of any curb return for a driveway used by trucks. Pan Metal Corporation has indicated that the unusual shape of the parcel and the requirements of section 26.4.2-8 (e) creates a hardship on the usefulness of the parcel. As part of the development, Pan Metal Corporation intends to expand the existing curb to have a 50-foot radius, thus improving the traffic conditions at the existing corner. If the curb return .-,., -, _J were to remain as it currently exits, the curbcut for the driveway would be in full compliance. The operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted subject to the following conditions: (a) Pan Metal Corporation shall expand the curb return on the southeast corner of Alameda and 48th streets to have a radius of 50.0 feet; and (b) the curbcut for the driveway on 48th street shall be no less than 63.0 feet from said expanded curb return. RESOLUTION NO. 6530 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO PAN METAL CORPORATION, FROM SECTION 26.4.2-8 (e) OF THE COMPREHENSIVE ZONING ORDINANCE FOR THE PROPERTY LOCATED AT 4800 ALAMEDA STREET IN THE CITY OF VERNON WHEREAS, Pan Metal Corporation occupies a parcel of property located at 4800 Alameda Street in the City of Vernon which requires a variance from section 26.4.2-8 (e), Access, of the Comprehensive Zoning Ordinance; and WHEREAS, the physical condition of the property is unique in that the proposed parcel measuring approximately 134,427 square feet is non-rectangular in shape because of a railroad spur which lies adjacent to the parcel; and WHEREAS, Pan Metal Corporation is proposing to build a 72,000 square foot building to be used for garment manufacturing; and WHEREAS, Zoning Ordinance section 26.4.2-8 (e) specifies that no curbcut for a driveway to any parking or loading facility shall be permitted within seventy-five feet of the point of tangency of any curb return for a driveway used by trucks; and WHEREAS, Pan Metal Corporation is proposing to construct a curbcut on 48th Street for a driveway 63.0 feet east of the point of tangency of the proposed curb return on the southeast corner of Alameda and 48th Streets; and WHEREAS, Pan Metal Corporation is expanding said curb return to a 50.0 foot radius; and WHEREAS, 4800 Alameda Street is located in the M zone 1
