.. ~ ..... . 1 2 3 4 5 6 7 8 City of RESOLUTION NO. 6539 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A FIRST ADDENDUM TO AGREEMENT (MUTUAL AID AGREEMENT OF JULY 12, 1976) BY AND BETWEEN THE CITIES OF COMPTON, DOWNEY, LA HABRA HEIGHTS, LYNWOOD, MONTEBELLO, SANTA FE SPRINGS AND VERNON WHEREAS, the Area "E" fire chiefs would like to add the La Habra Heights to the Mutual Aid Agreement of July 12, 9 1976 by and between the cities of Compton, Downey, Lynwood, lO 11 Montebello, Santa Fe Springs and Vernon; and WHEREAS, the addition of La Habra Heights Fire Department l2would be beneficial to mutual aid within Area "E" as it would add 13 another city to the rotation of strike teams; and 14 WHEREAS, the City of Vernon desires to enter into a First 15 Addendum to Agreement (Mutual Aid Agreement of July 12, 1976) to allow the City o.f La Habra Heights to become a party to said 16 17 Agreement. 18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 19 CITY OF VERNON. AS FOLLOWS: 20 SECTION 1: The city Council of the City of Vernon does 21 hereby find and determine that the recitals contained hereinabove 22 are true and correct. 23 SECTION 2: The City Council of the city of Vernon hereby 24 approves the First Addendum to Agreement, a copy of which has been 25 presented to the City Council concurrently with this resolution, 26 and the City Council hereby orders said First Addendum to 27 Agreement to be received and filed by the City Clerk. 28 SECTION 3: The city Council of the city of Vernon hereby ..- .L 1 authorizes the Mayor and the City Clerk to execute said First 2 Addendum to Agreement for, and on behalf of, the city of Vernon. 3 SECTION 4: The city Clerk of the city of Vernon shall 4 certify to the passage of this resolution and thereupon and 5 thereafter the same shall be in full force and effect. 7 APPROVED AND ADOPTED this 1st day of November, 1994. ~~ ./"- (~EONIS C. In addition, all of the parties hereto agree to participate in joint training exercises, to the extent .necessary, as determined by the Fire Chiefs of each of the - signatory cities. - - - The nature and extent of aid to be furnished pursuant • to this Agreement shall be as determined by the Fire Chief of each of the signatory parties. from whom such aid is requested, based upon the availability of personnel. and equipment of the party being requested to furnish sLCh service.' (6) COTff'ENSATION. Except as provided in paragraph (3.) above, no party to .this Agreement t+~ill be required to pay any . compensation to any other party. to this Agree~iient`.for servi'ees rendered hereunder, the. mutual advantage and protection afforded by this Agreement being considered adequate compensation to-ail parties. - (7) INJURIES TO PERSONNEL. Any condensation required to be paid to any fire personnel, pursuant ~o Section 3.000 _ et seq. of the Labor Ccde, or Section 2.1000 et seq. of the Government Code, by reason of their injury, occurring while their .services are being utilized .pursuant to this Agreement, " shall be. the sole liability and responsibility-.of the party: regularly employing said g~ersonnel. / - (8) INDE~II~1I.~ ICATION. W I T N E S S E T H The Parties hereto do agree as follows: (1) R_FCITALS. This Agreement is made and entered - - into with respect to the following facts. - ~ - - - (a) that the parties hereto are geographically located in the County of Los Angeles; and (b) that each party maintains and staffs a municipal fire dEpartment for the purposes: of providing fire suppression, protection and rescue services;_and - (c) that it is to the r,utual advantage and benefit of each of the parties hereto, to reTzder si~pplerental fire suppression, prevention, protection .and rescue' services to each of the other parties in the event of a fire or other local emergency, and to ta'~ce part in joint trair_ing exercises. - ~ {d) that Title I, Dwision 7, Chapter 5 of the Government Code of the State of Cali forni a (co~rencing with Section 6500 thereof} authorizes the point exercise by t:ti.o or gore public agencies, of any power or pot-aers - co~-.~-ion to t~e~; and _ (e) that it is the desire. of the signatories here-` to to enter ti-?is mutual aid agreement, purs~~nt to the - above authority, on the terms and conditions hereinafter contained. - 1 - - (2) 2.1UTUAL AID. In the event`-of any fire or other.. local emergency occurring in any one of the signatory cities, - which, for any .reason, cannot be dealt with by that city.'s - personnel and equip~,ent, then any one or more of the parties to this Agreement shall furnish to that signatory city, such fire suppression, prevention, protec ion and rescue services as. may be reasonably required to cope. with such emergency, - subject to the limitations hereinafter set forth in this . - Agreement. In addition, all of the parties hereto agree to participate in joint training exercises, to the. extent -necessary, as determined by the Fire Chiefs of each of the signatory cities. - - - The nature and extent of aid to be furnished pursuant - to this. Agreement shall be as determined by the Fire Chief of each of the signatory parties from whom such aid is requested, based upon the availability of personnel-and equipment of the party being requested to furnisl,L-stick service. It is further expressly understood that .the aid actually furnished _~.ay be recalled at the sole discretion of he Fire Chief of the furnishing signatory party. (3) SUPERVISION.. Personnel who are furnished will work, as far -as possible, under their cT:Tn supervisors, and equipment furni shed will .ordinarily be operated by personnel - of .the party furnishing the equipment. General directions _ - relative to the work :=ill be given by the~appro~riate officers _ or persons of the party receiving .such aid. The party - receiving aid mill be respor<sible .for providing =up'plies - and-material,-such as. gasoline end oil for on-site use of - egt'ip:ent, and food for the personnel -mho are engaged in - - providing aid h-ereunder. _ (4} STATE E2~RGE~tCIES. ..This Agreement is intended to ever dray-to-day mutual aid only, and shah be of no effect - 2 - _ at'times when. the C~3lifornia Disaster and Civil Defense . h! - rlaster rlutual Aid Agreement becomes operative.. - (5) LOCAL OBLIGATIOJS. It is mutually understood and agreed that this Agreement. does not relieve any'of the parties hereto from the necessity-and obligation of-providing adequate .fire .protection within its ow-n city, and each partyhexeto .agrees.. that it shall use reasonabledil'igence in keeping its firefighting equipment. in its possession up to adequate standards, (6) COr~ENSAlION. Except as provided in paragraph (3) above, no party to .this Agreement will be required to pay any . compensation to any other party to this Agreement for services ..rendered hereunder, the mutual advantage and protection afforded by this Agreement being considered adequate compensation to all' parties. (7) INJURIES i0 FEP.SONNEL. luny condensation required to be paid to any fire personnel,. pursuant to Section 3000 _ et seq_ of the Labor Code, or Section 21000 et seq. of the Government Code, by .reason of their injury, occurring ~.ahile their services are being utilized pursuant to this'Agreeent, - shall be the sole liability and responsibility;.of "the party regularly e?~nploying said personnel. INDEi•~I;~ICATION. ..Each. of said rarties agree to - inde~!~ify and save all other parties harmless from any liability arising out of, or result g zrom the acts or omissions, ~".:,ere a duty to act exists, of any. party's fire~persann~l during.. such tLias sa?d personnel are serving in thz jurisdiction of any other party for assistance, pursuant to the teru.s of this ~igre2'~.~'ent. ~ _ (qj Tn + RD r.4RTiES _ 'This Aoree-~ent shall not be con-' strued as, or deemed ~tr~ be, an agree~:~~ent for t~~e benefit of any third party or parties, and no third party or parties shall _ 3 - _ have~the'rght of action hereunder for any cause whatsoever. Any services performed or expenditures made in connection with.. furnishing aid under this agree~r~ent by any party hereto',.. shall~be deemed, conclusively, to be`for"the protection. and ..benefit of all inhabitants anal property of such party. (IQ) TERM OF AGREEMENT. This: Agreerrterit shall commence on the date of execution hereof and shall continue in full force and effect. thereafter. r (11) WITHLR:414'AL. Any party to this Agreement "may withdraw at any tune, upon giving .thirty (30) days written notice to each of the other parties hereto, and thereafter; on the 31st day. after the giving of notice, suc'n `withdra~•7ing \ _ party shall no longer be` a party to this Agreement, but this Agreement shall continue in existence as to all partie , except the said withdraz~ng party. (I2) NOTICES.
