RESOLUTION NO. 6544 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO CONDOR FREIGHT LINES, FROM SECTION 26.4.2-8 DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2601 26TH STREET IN THE CITY OF VERNON WHEREAS, Condor Freight Lines occupies a parcel of property located at 2601 26th Street in the City of Vernon and has requested a variance from Section 26.4.2-8, Development Standards, of the Comprehensive zoning Ordinance; and WHEREAS, Darling Delaware, the owner of said property has authorized Condor Freight Lines to act as its agent in applying for this variance; and WHEREAS, the building is used for a truck terminal and the physical condition of the property is unique in that the existing building measures approximately 9,600 square feet and was constructed with nineteen conforming truck loading spaces and fifteen non-conforming truck loading spaces, ten measuring 10.0 feet in width and 20.3 feet in length and five measuring 10 feet in width and 26.0 feet in length; and WHEREAS, Zoning Ordinance section 26. 4 . 2 -7 (b) requires two truck loading spaces for buildings with a gross floor area of between 8,001 and 25,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26. 4 . 2 -8 (c) specif ies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long, and section 26.4.6-4 (c) provides that a non- conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted; and 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 ~ 26 27 28 t t WHEREAS, there is insufficient space on the property and the application of the development standards for the truck loading space requirements will create an unreasonable hardship by requiring the fifteen non-conforming spaces to be 10 feet wide and 65 feet long; and WHEREAS, Condor Freight Lines has indicated that it has no plans to expand or alter the building configuration and that the existing truck loading spaces are sufficient for its intended use; and WHEREAS, the street right-of-way on 26th Street is constructed to 50 feet in width, 25 feet on each side of the centerline and the existing right-of-way is 40 feet in width, 20 feet on each side of the centerline, so that the existing sidewalk is located on said property; and WHEREAS, the Master Plan of Streets, dated June 16, 1992, requires the right-of-way to be 60 feet in width, 30 feet on each side of the centerline; and WHEREAS, 2601 26th Street is located in the M zone and the operation is consistent with the General Plan and Zoning Ordinance; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on November 15, 1994. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 ~ 26 27 28 SECTION 2: A variance from section 26.4.2-8, Development Standards of the Comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long is hereby granted to Condor Freight Lines at 2601 26th Street. SECTION 3: The variance shall be granted subject to the following conditions: (a) the usage of the non-conforming truck loading spaces shall be limited so that no truck parked at the loading docks shall extend into the existing street right-of- way; (b) within six months hereafter the owner shall dedicate the additionai 5.0 feet of right-of-way, currently used as sidewalk to the City of Vernon at no cost to the City; (c) within six months hereafter the owner shall construct all frontage improvements as directed by the Acting Director of Community Services including, but not limited to, replacing all cracked or damaged curb, sidewalk and driveway, removing driveways where unused and replacing with city of Vernon standard curb, gutter and sidewalk, constructing a handicap ramp and sidewalk along Harriet Street; and (d) when the street is widened to comply with the Master Plan of Streets, dated June 16, 1992, the owner shall dedicate the necessary right-of-way and the non-conforming docks shall be permanently sealed or recessed to comply with Comprehensive Zoning Ordinance section 26.4.2-8. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. The building that it occupies was constructed with nineteen conforming truck loading spaces and fifteen non- conforming truck loading spaces measuring 10.0 feet in width, with ten being 20.3 feet in length and five being 26.0 feet in length.
