A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
SOUTHLAND BOX COMPANY, FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 4955 MAYWOOD AVENUE
IN THE CITY OF VERNON
WHEREAS, Southland Box Company owns a parcel of property
located at 4955 Haywood Avenue in the City of Vernon and has
requested a variance from conformance with section 26.4.2-8,
Development Standards, of the Comprehensive Zoning ordinance; and
WHEREAS, Southland Box Company uses the building for the
manufacturing of paper products and physical condition of the
property is unique in that the existing building measures
approximately 220,000 square feet and was constructed with
thirteen non-conforming truck loading spaces measuring 10.0 feet
in width with ten being 51.1 feet in length, one being 50.0 feet
in length, one being 52.5 feet in length and one being 40.8 feet
in length; and
WHEREAS, Zoning Ordinance section 26.4.2-7 (b) requires
five truck loading spaces for buildings with a gross~loor area
of between 100,000 and 200,000 square feet in size and one truck
loading space for each additional 100,000 square feet or fraction
thereof for a total of 6 spaces; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and Section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is granted; and

WHEREAS, there is insufficient space on the property and
the application of the development standards for the truck loading
space requirements will create an unreasonable hardship by
requiring the non-conforming spaces to be 10 feet wide by 65 feet
long; and
WHEREAS, Southland Box Company has indicated that it has
plans to construct two new conforming truck loading spaces
extending from the north end of the building into the parking lot
which will require relocation of the driveway at the north end of
the parking lot on Maywood Avenue; and
WHEREAS, 4955 Maywood Avenue is located in the M zone
and the manufacturing operation is consistent with the objectives
of the General Plan and Zoning Ordinance; and
WHEREAS, the City council of the City of Vernon held a
hearing on said application for a variance beginning on November
15, 1994, which was continued to December 20, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The city Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from Section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65 feet
long is hereby granted to Southland Box Company at 4955 Maywood
Avenue.
SECTION 3: The variance shall be granted subject to the

following conditions: (a) Southland Box Company shall by June 20,
1995: (i) construct two new conforming truck loading spaces
extending from the north end of the building into the parking lot;
remove the driveway at said location and relocate it such that the
south end of the driveway shall be 65.0 feet north of the north
end of the building and a minimum of 50.0 feet in width; and
construct new curb, gutter and sidewalk to replace said removed
driveway; or (ii) replace the access driveway to all of the non-
conforming loading docks with curb, gutter, and sidewalk including
suitable barriers to prevent direct truck access; and (iii) obtain
all necessary permits from the City of Vernon prior to any
construction; (b) if Southland Box Company has not completed the
construction described in above condition (a) within 30 days
hereof, Southland Box Company shall deliver a $10,000 performance
bond to the City of Vernon to be refunded upon compliance with
above condition (a); (c) said performance bond shall provide that
if compliance with condition (a) has not been attained by June 20,
1995, the performance bond shall be paid to the City of Vernon for
the purpose of constructing said curb, gutter, and sidewalk
including a suitable barrier to eliminate the usage of all of the
non-conforming loading docks; Cd) the usage of all truck loading
spaces shall be limited so that no truck parked at the loading
docks shall extend into the existing street right-of-way; and (e)
all existing and future tenants shall be notified of this
restriction and a condition stating this shall be placed in all
future leases.
SECTION 4: Noncompliance with these conditions shall

constitute sufficient grounds for the City council of the City of
Vernon to void this variance and require the application of Zoning
Ordinance section 26.4.2-8 and the authorized truck loading space
requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

1) Southland Box Company is housed in a building originally built
for them in 1941. The loading bays are recessed into the
building and easily accommodate the 40 I vans used by the
company. The applicants vehicles were bought so they would
fit the bays. other properties do not necessarily have fleets
that are sized to their bays, and have not been in business at
their locations for such a length of time.
2) The applicants structures met code at the time of
construction. It is adequate for the fleet of vehicles used
by the company. Deeper bays are unnecessary. other business
in the area enjoy the we of their structures, which either
happened to be built to specifications that met current code
or have been granted variances as their vehicles are not
impacting circulation. Lengthening the existing bays would
require major work to the structure, as well as forcing
rearrangement of heavy machinery. This would be prohibitively
disruptive and costly to this business.
3) The applicant will not interfere with travel of vehicles and
pedestrians in the pUblic right of way, as the vehicles used
by the applicant do not extend beyond the property line.
Therefore no special condition will exist.
4) As the variance requested will not impact circulation the city
streets, no special privilege is granted. The intent and
spirit of the code was to prevent impacts to travel caused by
the typical 65' semi trailer, which are not used by the
Southland Box.
5) The existing use of the property is in conformance with the
general plan. Granting the various ensures continuation of
this use and there is in concurrence

Southland Box Company has submitted an application requesting a
Variance from the comprehensive Zoning Ordinance, Section 26.4.2-8,

Gentlemen:
Upon further negotiations with Southland Box Company, it is
recommended that the variance be granted with the following
conditions:
(a) Southland Box Company shall by June 20, 1995, as
directed by the City of Vernon; (i) construct two new conforming
truck loading spaces extending from the north end of the building
into the parking lot; (ii) remove said driveway and relocate it
such that the south end of the driveway shall be 65.0 feet north of
the north end of the building and it shall be a minimum of 50.0
feet in width; (iii) construct new curb, gutter, and sidewalk to
replace removed driveway; (iv) obtain all necessary permits from
the City of Vernon prior to any construction; (b) if Southland Box
Company has not completed the construction described in above
condition (a) within 30 days hereof, Southland Box Company shall
deliver a $10,000 performance bond to the City of Vernon to be
refunded upon compliance with above condition (a); (c) if
compliance with above condition (a) has not been attained then the
City of Vernon will be authorized to forfeit said bond and utilize
the proceeds to construct curb, gutter, sidewalk and a suitable
barrier to eliminate the usage of all the non-conforming loading
docks; (d) the usage of the truck loading spaces shall be limited
so that no truck parked at the loading docks shall extend into the
existing street right-of-way; and (e) all existing and future
tenants shall be notified of this restriction and a condition
stating this shall be placed in all future leases.

VARIANCE APPLICATION
DECEMBER 15, 1994
Southland Box Company Inc. has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8, Development
Standards, for the property located at 4955 Maywood Avenue in the
City of Vernon. The building that it owns was constructed with
thirteen non-conforming truck loading spaces measuring 10.0 feet
in width with ten being 51.1 feet in length, one being 50.0 feet
in length, one being 52.5 feet in length and one being 40.8 feet
in length. It has stated that it will construct two new
conforming spaces at the north end of the building extending into
the parking lot and will relocate the driveway to said parking
lot in order to accommodate on-site maneuvering. It has also
stated that only vehicles of smaller lengths will be used at all
of the no~-conforming truck loading spaces. The building is used
for the manufacturing of paper products and is approximately
220,000 square feet in size.
Section 26.4.2-7 (b) requires five truck loading spaces for
buildings with a gross floor area of between 100,000 and 200,000
square feet in size and one truck loading space for each
additional 100,000 square feet or fraction thereof for a total of
6 spaces. Section 26.4.2-8 (c) of the Comprehensive Zoning
Ordinance specifies that each loading space shall be a minimum of
10 feet wide and 65 feet long and section 26.4.6-4 (c) provides
that a non-conforming building must comply with these standards
within five years of April 18, 1989 unless a variance is granted.
Southland Box Company has indicated that requiring the
thirteen non-conforming truck loading spaces to be 65 feet long
by 10 feet wide would be a hardship. The operation is in
conformance with the Comprehensive zoning Ordinance and General
Plan. Therefore, it is recommended that the variance be granted
with the following conditions: (a) Southland Box Company shall
by June 20, 1995, as directed by the City of Vernon; (i)
construct two new conforming truck loading spaces extending from
the north end of the building into the parking lot; (ii) remove
said driveway and relocate it such that the south end of the
driveway shall be 65.0 feet north of the north end of the
building and it shall be a minimum of 50.0 feet in width; (iii)

Honorable Members:
Southland Box Company has submitted an application requesting a

Development Standards, for the building located at 4955 Maywood
Avenue, and transmitted herewith is the following evidence:

The building has thirteen non-conforming truck loading spaces that are
10 feet wide, with ten spaces being 51.1 feet long. The remaining

After further deliberations and review of the Variance request by the
Acting Director of Community Services and the City Attorney, it is now
recommended that the Variance be granted contingent upon the following
Conditions:
a. Southland Box Company shall, by June 20, 1995,
as directed by the City of Vernon, construct
two new conforming truck loading spaces extending
from the north end of the building into the
parking lot; remove said driveway and relocate
it such that the south end of the driveway
shall be 65 feet north of the north end of
