A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON DENYING A VARIANCE TO
MUSTANG TERMINAL, INC., FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 4223 DISTRICT
BOULEVARD IN THE CITY OF VERNON
WHEREAS, Mustang Terminal, Inc. owns a parcel of
property located at 4223 District Boulevard in the city of Vernon
and has requested a variance from conformance with section
26.4.2-8, Development Standards, of the Comprehensive Zoning
Ordinance; and
WHEREAS, Mustang Terminal, Inc. uses the building for
warehousing, the existing building on the property measures
approximately 11,000 square feet and the building was constructed
with five non-conforming truck loading spaces which measure 9.5
feet in width and 50.7 feet in length; and
WHEREAS, pursuant to Zoning Ordinance section 26.4.2-7
(b) such use requires two truck loading spaces for buildings with
a gross floor area of between 8,001 and 25,000 square feet in
size; and
WHEREAS, Zoning Ordinance Section 26.4.2 -8 (C) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and section 26.4.6-4 (c) provides that when
insufficient space exists on the parcel, the non-conforming
loading spaces must comply with these standards within 5 years of
Apri~ 18, 1989 unless a variance is granted; and
WHEREAS, insufficient space exists on the parcel for
conforming loading spaces, and Mustang Terminal, Inc. has

indicated that at this time it cannot restrict the usage of all
..
the loading docks to vehicles that will not extend into the street
right of-way, but that if it were to recess one loading dock, it
could comply; and
WHEREAS, the Community Services Department of the City
of Vernon has recommended that, as a condition of a variance,
Mustang Terminal, Inc. agree to recess one dock within six months
and post a $10,000.00 performance bond to assure compliance; and
WHEREAS, by a letter dated December 20, 1994, Mustang
Terminal, Inc. stated that it would not be able to post such a
bond; and
WHEREAS, the proposed condition and assurance of
compliance are reasonable and necessary to the issuance of the
variance; and
WHEREAS, section 22507.2 of the Vehicle Code of the
State of California prohibits the City of Vernon from authorizing
vehicles to park on sidewalks and section 22502 prohibits
commercial vehicles on a roadway from stopping or parking on a
roadway in a direction opposed to normal traffic when loading or
unloading merchandise; and
WHEREAS, it would be against the public health, safety,
and welfare to grant a variance which would allow trucks to block
sidewalks and roadways by stopping or standing thereon while
loading and unloading; and
WHEREAS, the City Council of the city of Vernon held a
hearing on said application for a variance beginning on December
6, 1994, which was continued to December 20, 1994.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: The request for a variance from section
26.4.2-8,Development Standards of the Comprehensive Zoning
Ordinance, requiring all truck loading spaces to be 10 feet wide
by 65 feet long by Mustang Terminal, Inc. at 4223 District
Boulevard is hereby denied.
SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 4223 DISTRICT
BOULEVARD IN THE CITY OF VERNON
WHEREAS, Mustang Terminal, Inc. owns a parcel of
property located at 4223 District Boulevard in the City of Vernon
and has requested a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive zoning Ordinance; and
WHEREAS, the building is used for warehousing and the
physical condition of the property is unique in that the existing
building measures approximately 11,000 square feet and was
constructed with five non-conforming truck loading spaces
measuring 8.0 feet in width and 50.7 feet in length; and
WHEREAS, Zoning Ordinance Section 26.4..2-7 (b) requires
two truck loading spaces for buildings with a gross floor area
of between 8,001 and 25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4. 2 -8 (c) specif ies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and Section 26.4.6-4 (c) provides that a non-

years of April 18, 1989 unless a variance is granted; and
WHEREAS, there is insuff icient space on the property and
the application of the development standards for the truck loading
space requirements will create an unreasonable hardship .by

THIS APPLICANT WISHES TO PRESENT THE FOLLOWING CIRCUMSTANCES FOR THE CITY'S
CONSIDERATION:
THE APPLICANT SUBMITS THAT THE STRICT LITERAL INTERPRETATION OF SPACE
REQUIREMENT WOULD DEPRIVE THE APPLICANT OF THE RIGHTS TO ENJOY THE
PROPERTY IN QUESTION IN MANNERS CONFORMING WITH THE PUBLIC HEALTH, SAFETY,
AND WELFARE. THE APPLICANT FURTHER SUBMITS THAT THE APPLICANT IS IN
COMPLIANCE WITH THE SPIRT OF THE LEGISLATION IN THAT THE EXISTING SPACE WILL
NOT EXTEND INTO THE STREET RIGHT OF WAY. WE USE TRUCKS THAT WI ilL NOT STICK
OUT ONTO THE SIDEWALK.
TO RECESS THE SPACE WOULD INVOLVE MAJOR CONSTRUCTION WORK AND EXPENSE

In 1989 the city of Vernon adopted its current zoning
ordinance. One purpose of this ordinance was to eventually bring
all buildings into conformance with todays building standards. In
a!}~faffort to imprQy~.,"yaffic circulation wiThin th9 city.. minimum
size. req~i~~!ll.fm..t..s.J~:truck loadinq spaces were adopteg.. Trucks
that.----currently extend into the city streets create both a
pedestrian and vehicular hazard and often cause traffic congestion
burdening neighboring businesses. The new standard requires that
all truck loading docks be recessed 65 feet from the street right-
of-way.
Our records show that the building(s) you occupy located at
4223 District Boulevard has/have truck loading spaces that do not
conform to the new standard. Per our zoning ordinance these spaces
shall be recessed or removed by April 18, 1994.
The City Council has granted variances to those tenants who
will utilize trucks shorter than the existing truck loading spaces.
Please either obtain a building permit to recess or remove the
nonconforming loading spaces, or submit an application for a
variance before the April 18, 1994 deadline. The nonrefundable fee
for a variance is $500.00.

Honorable Members:
Mustang Terminal Inc. has submitted an application for a Variance from
the Comprehensive Zoning Ordinance, Section 26.4.2-8, Development
Standards, for the building located at 4223 District Boulevard, and
transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building was constructed with five non-conforming truck loading
spaces which are 8 feet wide and 50.7 feet long. The company plans to
recess two of the non-conforming spaces to 65 feet long and 8 feet
wide, and is proposing to use only vehicles of a smaller length at the
three remaining non-conforming spaces. This has been reviewed by the
Acting Director of community Services, and it is hereby recommended
that the Variance be granted subject to the following Conditions:
a. within six months hereof, Mustang Terminal Inc.
shall recess two of the non-conforming loading
spaces to 65 feet in length and 8 feet in width.
b. The usage of the non-conforming truck loading
spaces shall be limited so that any truck that
is parked at the loading docks does not extend
into the street right-of-way as shown on the
Master plan of streets dated June 16, 1992.
c. All existing and future tenants shall be notified
of this restriction and a condition stating this
shall be placed in all future leases.

The building was constructed with five non-conforming truck loading
spaces which are 8 feet wide and 50.7 feet long. The company plans to
recess two of the non-conforming spaces to 65 feet long and 8 feet
wide, and is proposing to use only vehicles of a smaller length at the
three remaining non-conforming spaces. Staff of the Community
Services Department has now completed their review of the Variance
request and Kevin Wilson, Acting Director of Community Services, has
submitted a communication this date recommending that the Variance be
granted with the Conditions as listed below:
a. Mustang Terminal Inc. shall recess one of the
non-conforming loading spaces to 65 feet in
length and 8 feet in width by June 20, 1995 and
shall obtain all necessary permits from the City
of Vernon prior to any construction.
b. If Mustang Terminal, Inc. has not completed the
construction described in the above Condition "a"
within 30 days hereof, Mustang Terminal, Inc.
shall deliver a $10,000 performance bond to the
City of Vernon to be refunded upon compliance
with Condition "a".

c. If compliance with Condition "a" has not been
attained by June 20, 1995, then the City of
Vernon will be authorized to forfeit said bond
and utilize the proceeds to construct curb,
gutter, sidewalk and a suitable barrier to limit

d. The usage of the truck loading spaces shall be
limited so that any truck parked at the loading
spaces does not extend into the street right-of-
way as shown on the Master Plan of streets dated
June 16, 1992.
e. All existing and future tenants shall be notified
of this restriction and a condition stating this
shall be placed in all future leases.

Mustang Terminal, Inc. has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8, Development
Standards, for the property located at 4223 District Boulevard in
the City of Vernon. The building that it owns was constructed
with five non-conforming truck loading spaces measuring 9.5 feet
in width and 50.7 feet in length. It has indicated that it plans
to recess one of the non-conforming loading spaces to 65 feet in
length and 9.5 feet in width. It has stated that only vehicles
of smaller lengths will be used at the non-conforming truck
loading spaces. The building is used for warehousing and is
approximately 11,000 square feet in size.
section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area of between 8,001 and 25,000
square feet in size. section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.
Mustang Terminal, Inc. has indicated that requiring the non-
conforming truck loading spaces to be 65 feet long by 10 feet

wide would be hardship. The operation is in conformance with the
Comprehensive Zoning Ordinance and General Plan. Therefore, it
is recommended that the variance be granted with the following
conditions: (a) Mustang Terminal, Inc. shall recess one OL the
