Resolution No. 6561 1 2 3 4 5 6 7 8 t , RESOLUTION NO. 6561 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF PROGRAM SUPPLEMENT NO. 006 TO STATE-LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP-5139 BY AND BETWEEN THE CITY OF VERNON AND THE STATE OF CALIFORNIA, ACTING BY AND THROUGH THE DEPARTMENT OF TRANSPORTATION 9 entered into a State-Local Entity Master Agreement (State-Local WHEREAS, the State of California and the City of Vernon Transportation Partnership Program) lO II No. for SLTPP-5139 State matching funds on November 19, 1991; and l2 WHEREAS, the City of Vernon desires to enter into Program l3 funds Supplement No. 006 to said Master Agreement to cover State matching in the for street reconstruction and l4 City of Vernon resurfacing of portions of 37th Street, 38th Street, 48th Street, l5 Bickett l6 Avenue, l7 funding 18 19 Street, Irving Street, Ross Street, Vernon Avenue, Seville and Bandini Boulevard, which were nominated for partial under Cycle 5 of said partnership program; and WHEREAS, the estimated cost of the improvements under 20 2l Supplement No. 006 is $248,617.00, with the City's share being $200,510.00 and the State's share being $48,107.00; and 22 23 WHEREAS, the Acting Director of Community Services has recommended that Program Supplement No. 006 to said Agreement be approved. 24 25 26 CITY OF VERNON AS FOLLOWS: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 27 finds and determines that the recitals contained hereinabove are SECTION 1: The City Council of the City of Vernon hereby 28 true and correct. ~- " 0{ , 1 SECTION 2: The City Council of the City of Vernon hereby 2 approves Program Supplement No. 006 to State-Local Transportation 3 partnership Program Agreement No. SLTPP-5139, a copy of which has 4 been presented to the City Council concurrently with this 5 resolution, and the City Council hereby orders said Program 6 Supplement to be received and filed by the City Clerk. 7 SECTION 3: The City Council of the City of Vernon hereby 8 authorizes the Mayor and the City Clerk to execute said Program 9 Supplement for, and on behalf of, the City of Vernon. lO SECTION 4: the City Administrator/City Clerk is hereby II instructed to return two executed copies of Program Supplement No. l2 006 together with two certified copies of this resolution to satish l3 Chander, Chief, Local Streets and Roads Branch, Department of l4 Transportation, District 7, 120 S. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for the mutual benefit of both parties, in order to avoid program and fiscal delays that would occur if the agreement were executed after that determination was made . The total amount of State-Local Transportation Partnership funds payable by the State shall not exceed $48107 to be encumbered and reimbursed as follows : FY 94-95 $ 48107 FY 95-96 0 FY 96-97 0 Any increase in State Partnership funds will require a revised program supplement . Any decrease in State Partnership funds will require a revised finance letter. 2 . In accordance with the State and Local Transportation Partnership Program Guidelines dated April 1993 , Section IV, Project Eligibility, the 106 allowance for construction engineering and contingencies is not eligible after Cycle 2 . Only state/agency furnished materials can be added to the contract item cost for State Partnership funds eligibility. 3 . SPECIAL COVENANTS FOR SLTPP PROJECTS UNDER EARLY REIMBURSEMENT PLAN AND UNDER $300, 000 STATE SHARE These Covenants supersede any conflicting provisions of the Master Agreement : A. The LOCAL ENTITY agrees that the payment of State Share Funds will be limited to the less of the product of multiplying the calculated pro rata percentage as determined by the STATE by either: (a) The eligible award amount or (b) The total eligible State/Local Partnership Project cost in the approved State/Local Partnership Program Application and accepts any consequent increase in LOCAL ENTITY funding requirements . B . The LOCAL ENTITY will invoice the State for the full "State ' s Share" after the contract award or upon the State Budget Act appropriation of funds, whichever occurs later. The City has completed the resurfacing of portions of 37th Street, 38th Street, j 48th Street, Bickett Street, Irving Street, Ross Street, Vernon Avenue, Seville Avenue and Bandini Boulevard (Contract No. 520) . These streets were nominated for partial funding under Cycle 5 of the program, and if funding is available, the City may receive up to approximately $48 , 107 towards the construction costs. this has been reviewed by the Acting Director of Community Services rind the City Attorney, and it is hereby recommended that Supplement No. 006 be approved and executed.
