A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
GRIFFITH MICRO SCIENCE, INC., FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 4900 GIFFORD AVENUE
IN THE CITY OF VERNON
WHEREAS, Griffith Micro Science, Inc. owns a parcel
of property located at 4900 Gifford Avenue in the City of Vernon
and has requested a variance from section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance; and
WHEREAS, the building is used for the sterilizing and
warehousing of medical devices and the physical condition of the
property is unique in that the existing building measures
approximately 19,380 square feet and was constructed with three
non-conforming truck loading spaces, two measuring 9.0 feet in
width and 26.0 feet in length and one measuring 10.0 feet in width
and 40.5 feet in length; and
WHEREAS, Zoning Ordinance section 26.4.2-7 (b) requires
two truck loading spaces for buildings with a gross floor area
of between 8,001 and 25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and Section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship

by requiring the three non-conforming spaces to be 10 feet wide
and 65 feet long; and
WHEREAS, Griffith Micro Science, Inc. has indicated that
it intends to recess the two 26.0 foot loading docks an additional
12.0 feet to 38.0 feet in length and 9.0 feet in width to
accommodate its company trucks in that the non-conforming spaces,
as altered, will be sufficient for the intended use; and
WHEREAS, 4900 Gifford Avenue is located in the M zone
and the operation is consistent with the objectives of the General
Plan and Zoning Ordinance; and
WHEREAS, the City Council of the City of Vernon held a
hearing on said application for a variance beginning on December
6, 1994, which was continued to December 20, 1994 and then to
January 3, 1995.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The city Council of the city of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65 feet
long is hereby granted to Griffith Micro Science, Inc. at 4900
Gifford Avenue.
SECTION 3: The variance shall be granted subject to
the following conditions: (a) Griffith Micro Science, Inc. shall
recess the two 26.0 foot loading docks an additional 12.0 feet to

38.0 feet in length and 9.0 feet in width or shall replace the
access driveways to all of the non-conforming loading docks with
curb, gutter, and sidewalk including suitable barriers to prevent
direct truck access and shall obtain all necessary permits from
the City of Vernon prior to any construction; (b) if Griffith
Micro Science, Inc. has not completed the construction described
in condition (a) within 30 days hereof, Griffith Micro Science,
Inc. shall deliver a $10,000 performance bond to the city of
Vernon to be refunded upon compliance with above condition (a);
(c) said performance bond shall provide that if compliance with
condition (a) has not been attained by July 3, 1995, the
performance bond shall be paid to the City of Vernon for the
purpose of constructing said curb, gutter, and sidewalk including
a suitable barrier to eliminate the usage of all of the non-
conforming loading spaces; (d) the usage of the non-conforming
truck loading spaces shall be limited so that no truck parked at
the loading docks shall extend into the street right-of-way as
shown on the Master Plan of streets, dated June 16, 1992; and (e)
all existing and future tenants shall be notified of this
restriction and a condition stating this shall be placed in all
future leases.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
Zoning Ordinance Section 26.4.2-8 and authorized truck loading
space requirement.
SECTION 5: The City Clerk of the City of Vernon shall

certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
Griffith Micro Science, Inc. has submitted an application for a
Variance from the Comprehensive Zoning ordinance, Section 26.4.2-8,
Development Standards, for the building located at 4900 Gifford
Avenue, and transmitted herewith is the following evidence:
1. Application for Variance;

4. Engineer's Report.
The building was constructed with three non-conforming truck loading
spaces with two that are 9 feet wide and 26 feet long, and one that is
10 feet wide and 40.5 feet long. The company has indicated it intends
to recess the two 26 foot loading spaces 12 feet in order to
accommodate its company trucks, and is proposing to use only vehicles
of a smaller length at all of the non-conforming spaces. This has
been reviewed by the Acting Director of Community Services, and it is
hereby recommended that the Variance be granted subject to the
following Conditions:
a. within six months hereafter, Griffith Micro
Science, Inc. shall recess the two 26 foot
loading docks an additional 12 feet to 38 feet
in length and 9 feet in width.
b. The usage of the non-conforming truck loading
spaces shall be limited so that any truck that
is parked at the loading docks does not extend
into the street right-of-way as shown on the
Master plan of streets dated June 16, 1992.

feasible due to the undermining of existing foundation and potential utility supplies.

The above statement is true. Other owners who have buildings constructed prior to

Honorable Members:
Griffith Micro Science, Inc. has submitted an application for a
Variance from the Comprehensive Zoning Ordinance, Section 26.4.2-8,
Development Standards, for the building located at 4900 Gifford
Avenue, and transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building was constructed with three non-conforming truck loading
spaces, two that are 9 feet wide and 26 feet long, and one that is 10
feet wide and 40.5 feet long. The company has indicated it intends to
recess both 26 foot loading spaces 12 feet in order to accommodate its
company trucks, and is proposing to use only vehicles of a smaller
length at all of the non-conforming spaces.
Staff of the Community Services Department has now completed their
review of the Variance request and Kevin Wilson, Acting Director of
community Services, has submitted a communication this date
recommending that the Variance be granted with the Conditions as
listed below:
a. Griffith Micro Science, Inc. shall recess all of
the non-conforming loading docks by June 20, 1995
to accommodate its company trucks so that any
truck parked at their loading docks does not
extend into the street right-of-way shown on the
Master Plan of Streets dated June 16, 1992, and
all necessary permits shall be obtained from the
City of Vernon prior to any construction.

VARIANCE APPLICATION
DECEMBER 15, 1994
Griffith Micro Science, Inc. has requested a variance from
the Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 4900 Gifford Avenue in the
City of Vernon. The building that it owns was constructed with
three non-conforming truck loading spaces two measuring 9.0 feet
in width and 26.0 feet in length and one measuring 10.0 feet in
width and 40.5 feet in length. It has indicated that it intends
to recess all of the non-conforming docks in order to accommodate
its company trucks. It has stated that only vehicles of smaller
lengths will be used at all of the non-conforming truck loading
spaces. The building is used for sterilizing and warehousing of
medical devices and.is approximately 19,380 square feet in size.
section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area of between 8,000 and 25,001
square feet in size. Section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.
Griffith Micro Science, Inc. has indicated that requiring the
three non-conforming truck loading spaces to be 65 feet long by
10 feet wide would be a hardship. The operation is in
conformance with the Comprehensive Zoning Ordinance and General

Plan. Therefore, it is recommended that the variance be granted
with the following conditions: (a) Griffith Micro science, Inc.
shall recess all the non-conforming loading docks by June 20,
1995 to accommodate its company trucks such that no truck parked
at the loadings docks shall extend into the street right-of-way
as shown on the Master Plan of streets, dated June 16, 1992 and
all necessary permits shall be obtained from the City of Vernon

Avenue
Griffith Micro Science, Inc. has submitted a variance
application. It is requesting a variance from the Comprehensive
Zoning Ordinance, Section 26.4.2-8, Development Standards, for the
building located at 4900 Gifford Avenue. The building that it owns
was constructed with three non-conforming loading spaces, two
measuring 9.0 feet in width and 26.0 feet in length and one
measuring 10.0 feet in width and 40.5 feet in leng,th. It has
indicated that it intends to recess the two 26.0 foot loading
spaces an additional 12.0 feet in length to 38.0 feet in length in
order to accommodate its company trucks. It is proposing to use
only vehicles of a smaller length at all of the non-conforming
truck loading spaces.
The application for variance, affidavits of posting and
mailing, and the notice of public hearing have been previously
submitted. Herewith submitted is a new engineer's report.
It is recommended that the variance be granted subject to the
following conditions:
(a) Griffith Micro Science, Inc. shall recess the two
26.0 foot loading docks an additional 12.0 feet to 38.0

VARIANCE APPLICATION
DECEMBER 27, 1994
Griffith Micro Science, Inc. has requested a variance from
the Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 4900 Gifford Avenue in the
City of Vernon. The building that it owns was constructed with
three non-conforming truck loading spaces two measuring 9.0 feet
in width and 26.0 feet in length and one measuring 10.0 feet in
width and 40.5 feet in length. In order to accommodate its
company trucks, it has indicated that it intends to recess the
two 26.0 foot loading docks an additional 12.0 feet to 38.0 feet
in length and 9.0 feet in width. It has stated that only
vehicles of smaller lengths will be used at all of the non-
conforming truck loading spaces. The building is used for
sterilizing and warehousing of medical devices and is
approximately 19,380 square feet in size.
Section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area of between 8,000 and 25,001
square feet in size. Section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these

standards within five years of April 18, 1989 unless a variance
is granted.
Griffith Micro Science, Inc. has indicated that requiring
the three non-conforming truck loading spaces to be 65 feet long
by 10 feet wide would be a hardship. The operation is in
conformance with Zoning Ordinance and General Plan. Therefore,
it is recommended that the variance be granted with the following
conditions: (a) Griffith Micro Science, Inc. shall recess the
two 26.0 foot loading docks an additional 12.0 feet to 38.0 feet
in length and 9.0 feet in width or shall replace the access
driveways to all of the non-conforming loading docks with curb,
gutter, and sidewalk including suitable barriers to prevent
direct truck access and shall obtain all necessary permits from
the City of Vernon prior to any construction; (b) if Griffith
Micro Science, Inc. has not completed the construction described
