A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON DENYING A VARIANCE TO
LEO GOLDSCHWARTZ 'TRANSPORTATION FROM
SECTIONS 26.4.2-7 AND 26.4,2-8 OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4609 HAMPTON

WHEREAS, Leo Goldschwartz Transportation occupies
City of Vernon and has requested a variance from conformance

with Section 26.4.2-7, Minimum Truck Parking and Loading
Facility Requirements, and Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance; and

WHEREAS, Eleanor Orlando and Karen Lehrer, the
owners of said property, have authorized Leo Goldschwartz

Transportation to act as their agent in applying for this

and
WHEREAS ,
Leo Goldschwartz Transportation uses the
building for the warehousing of furniture, the existing

building on the property measures approximately 15,000
square feet and the building was constructed with one non-

conforming truck loading space measuring 10.0 feet in width
and 37.9 feet in length; and
WHEREAS, pursuant to Zoning Ordinance Section
26,4,2-7 (b) such use requires two truck loading spaces for
buildings with a gross floor area of between 8,001 and
25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26,4.2-8 (c)

specifies that each truck loading space shall be a minimum

1 of 10 feet wide and 65 feet long, and Section 26.4.6-4 (c)
2 provides that when insufficient space exists on the parcel,
3 the non-conforming loading spaces must comply with these
4 standards within 5 years of April 18, 1989 unless a variance
5 is granted; and
6 WHEREAS, insufficient space exists on the parcel
7 for conforming loading spaces, and Leo Goldschwartz
8 Transportation has indicated that it has no plans to expand
9 or alter the building configuration, and cannot restrict the
10 usage of the loading docks to vehicles that will not extend
11 into the street right-of-way; and
12 WHEREAS, Section 22500 of the Vehicle Code of the
13 State of California prohibits vehicles from stopping,
14 standing, or parking on a sidewalk or in front of a driveway
15 and Section 22502 prohibits commercial vehicles on a roadway
16 from stopping or parking ona roadway in a direction opposed
17 to normal traffic when loading or unloading merchandise; and
18 WHEREAS, a city is only authorized by Vehicle Code
19 Section 22507.2 to allow an owner or lessee to park in front
20 of the owner's or lessee's driveway and is prohibited from
21 authorizing any parking on a sidewalk; and
22 WHEREAS, it would be in violation of the vehicle
23 code and against the public health, safety, and welfare to
24 grant a variance which would allow trucks to block sidewalks
25 or to stop or stand on a roadway in opposition to traffic
26 while loading and unloading; and
27 WHEREAS, the City Council of the City of Vernon
28 held a hearing on said application for a variance on

2 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
3 OF THE CITY OF VERNON AS FOLLOWS:
4 SECTION 1: The City Council of the City of Vernon
5 hereby finds and determines that the recitals contained
6 herein-above are true and correct,
7 SECTION 2: The request for a variance by Leo
8 Goldschwartz Tranportation from Section 26.4.2-7, Minimum
9 Truck Parking and Loading Facility Requirements an~Section
10 26.4.2-8, Development Standards of the Comprehensive Zoning
11 Ordinance, requiring two truck loading spaces for buildings
12 with a gross floor area between 8,001 and 25,000 square feet
13 in size and requiring all truck loading spaces to be 10 feet
14 wide by 65 feet long at 4609 Hampton Street is hereby
15 denied.

SECTION 3: The City Clerk of the City of Vernon
17 shall certify to the passage of this Resolution and
18 thereupon and thereafter the same shall be in full force and
19 effect,

Honorable Members:
Leo Goldschwartz Transportation has submitted an application for a
Variance from the Comprehensive Zoning Ordinance, sections 26.4.2-7,
Minimum Truck Parking and Loading Facility Requirements, and 26.4.2-8,
Development Standards, for the building located at 4609 Hampton
Street, and transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has one non-conforming truck loading space that is 10
feet wide and 37.9 feet long. The company advises that they cannot
restrict the usage of the loading space to vehicles of a shorter
length, and they do not intend to recess the dock. This has been
reviewed by the Acting Director of Community Services, and it is
hereby recommended that the Variance be denied.

JANUARY 26, 1995
Leo Goldschwartz Transportation has requested a variance from
the Comprehensive Zoning Ordinance Sections 26,4,2-7, Minimum
Truck Parking and Loading Facility Requirements, and 26,4,2-8,
Development Standards, for the property located at 4609 Hampton
Street in the City of Vernon, The building that it occupies was
constructed with one non-conforming truck loading space which
measures 10,0 feet in width and 37,9 feet in length, The
building is used for the warehousing of furniture and is
approximately 15,000 square feet in size,
Section 26,4,2-7 (b) requires two truck loading spaces for
buildings with a gross floor area of between 8,001 and 25,000

No special priveledqes are beinq asked for. I have been condpctjng business
in this building for over ten years and shouldn't be forced to undergo
un~ecessary changes to the building that would cause me hardship. The street
is not a busy'thoroughfare. Conducting business as I have will affect no
other business in any adverse way possible.
(5) That the granting of such ~ariance will be in harmony and not adversely
affect the Comprehensive General Plan:
The variance;,\\/'ill not affect the general plan since Hampton is a very small
quiet st!eet. This is not a situation where any traffic would be affected for
the few times my trucks might be affected. I need to continue to conduct
my business, or I will not be able to survive.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON DENYING A VARIANCE TO
LEO GOLDSCHWARTZ TRANSPORTATION FROM
SECTIONS 26.4,2-7 AND 26.4,2-8 OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4609 HAMPTON
STREET IN THE CITY OF VERNON
WHEREAS, Leo Goldschwartz Transportation occupies
a parcel of property located at 4609 Hampton Street in the
City of Vernon and has requested a variance from conformance

with Section 26.4.2-7, Minimum Truck Parking and Loading
Facility Requirements, and Section 26,4,2-8, Development
Standards, of the Comprehensive Zoning Ordinance; and
WHEREAS, Eleanor Orlando and Karen Lehrer, the
owners of said property, have authorized Leo Goldschwartz
Transportation to act as their agent in applying for this
variance; and
WHEREAS, Leo Goldschwartz Transportation uses the
building for the warehousing of furniture, the existing
building on the property measures approximately 15,000
square feet and the building was constructed with one non-
conforming truck loading space measuring 10.0 feet in width
and 37.9 feet in length; and
WHEREAS, pursuant to Zoning Ordinance Section
26,4,2-7 (b) such use requires two truck loading spaces for
buildings with a gross floor area of between 8,001 and
25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4,2-8 (c)
