Resolution No. 6583 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RBSOLUTION NO. 6583 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO ALLIED FEATHER AND DOWN CORPORATION FROM SECTION 26.4.2-8 DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 4515 48TH STREET IN THE CITY OF VERNON WHEREAS, Allied Feather and Down corporation occupies a parcel of property located at 4515 48th Street in the City of Vernon and has requested a variance from Section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance; and WHEREAS, Madison Brent Venture, the owner of said property, has authorized Allied Feather and Down Corporation to act as their agent in applying for this variance; and WHEREAS, the building is used for the warehousing of down feathers and the physical condition of the property is unique in that the existing building measures approximately 8,300 square feet and was constructed with one conforming truck loading space and two non-conforming truck loading spaces measuring 15.0 feet in width and 29.6 feet in length; and WHEREAS, Zoning Ordinance Section 26.4.2-7 (b) requires two truck loading spaces for buildings with a gross floor area of between 8,001 and 25,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26. 4 . 2 -8 (C) specif ies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long, and Section 26.4.6-4 (c) provides that a non- conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted; and WHEREAS, there is insufficient space on the property 1 .... 1 and the application of the development standards for the truck 2 loading space requirements will create an unreasonable hardship 3 by requiring the two non-conforming spaces to be 10 feet wide 4 and 65 feet long; and 5 WHEREAS, Allied Feather and Down Corporation has 6 indicated that it has no plans to expand or alter the building 7 configuration and that the existing truck loading spaces are 8 sufficient for its intended use; and 9 WHEREAS, 4515 48th Street is located in the M zone 10 and the operation is consistent with the objectives of the General 11 Plan and Zoning Ordinance; and 12 WHEREAS, the City Council of the City of Vernon held a 13 hearing on said application for a variance on February 21, 1995. 14 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 15 THE CITY OF VERNON AS FOLLOWS: 16 SECTION 1: The City Council of the city of Vernon 17 hereby finds and determines that the recitals contained herein- 18 above are true and correct. 19 SECTlON 2: A variance from section 26.4.2-8, 20 Development Standards of the Comprehensive Zoning Ordinance, 21 requiring all truck loading spaces to be 10 feet wide by 65 feet 22 long is hereby granted to Allied Feather and Down Corporation at 23 4515 48th Street. 24 SECTION 3: The variance shall be granted subject to 25 the following condition: the usage of the non-conforming 26 truck loading spaces shall be limited so that no truck parked at 27 the loading docks shall extend into the street right-of-way as 28 2 <, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 ATTEX /. 15 BRUCE V. There is currently a 65' outside dock and a 30' deep indented dock in the buildinq. The 30' loading dock is used for standard commercial vans and small truck loading. Therefore,we are requesting a variance for 10ading under the above conditions. NOTICE TO APPLICANT: In :the variance procedure it shall be shown that the follOWTng five (5) conditions exist in reference to the property being considered. The applicant should answer the following statements. If you have difficulty finding reasonable answers to the statements contained in this application it may be an indication that your request has insufficient factors to justify approval. (Attach additional sheet(s) if necessary) (1) That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not generally applicable to oLher lands, structures, or buildings in the same vicinity and zone: The building is b~ilt approximately 20' from the street. The depth of the building is approximately 100' (feet). The loading door in question is in the easterly 1/2 of the building. If a 65' indention is required for loading the functionat use of the building would be greatly diminished. (2) That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same vicinity and zone in which the property is located, under the terms of this Chapter. Literal interpretation of the ordinance would not make a difference in the loading practice conducted by the type of business occupying the building. Recessing the loading would render the building unusable to the business; to any business. Page 3 of 4 (3) That the special conditions and circumstances do not result from actions of the applicant: ' The loading operation conducted by the type of business in the building will in no way interfere with or block any public access ways. The loading uses to this property is not different from the loading uses of adjacent properties. (4) That granting the variance requested will not confer on the applicant any special privilege that is denied by this Chapter to other lands, structures, or buildings in the same vicinity and zone in which the property is located: Several buildings in the area'of the'subject property are built in a similar manner. In the same way that other businesses in the area practice lawful loading, we will abide by all conditions granted under the variance. , (5) That the granting of such variance will be in harmony and not adversely affect the Comprepensive General Plan: The general plan was developed to prevent congestion in the street. All vehicles used by the business in the building are small in type. In no way will there ~' any congestion caused by this type of business. NOTE: Non-conforming use of neighboring lands, structures, or buildings shall not be considered grounds for the issuance of a variance. The building that it occupies was constructed with one conforming truck loading space and two non- conforming truck loading spaces measuring 15.0 feet in width and 29.6 feet in length. It has stated that only vehicles of smaller lengths will be used at the two non-conforming truck loading spaces. The building is used for the warehousing of down feathers and is approximately 8,300 square feet in size. section 26.4.2-7 (b) requires two truck loading spaces for buildings with a gross floor area of between 8,001 and 25,000 square feet in size. Section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within five years of April 18, 1989 unless a variance is granted. It has indicated that requiring the two non-conforming truck loading spaces to be 65 feet long by 10 feet wide would be a ~; hardship. It has indicated that it has no plans for expansion or alteration of the building configuration. The operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted with the fOllowing condition: the usage of the non-conforming truck loading spaces shall be limited so that no truck parked at the loading docks shall extend into the street right-of-way as shown on the Master Plan of streets, dated June 16, 1992. .; . ..
