Resolution No. 6586 , 1 2 3 RESOLUTION NO. 6586 4 5 6 owner of two adjacent parcels of land, parcels 2 and 3 of 7 8 9 10 A RESOLUTION OF THE CITY COUNCIL OF CITY OF VERNON APPROVING A LOT LINE ADJUSTMENT REQUESTED BY CATELLUS DEVELOPMENT CORPORATION THE WHEREAS, Catellus Development Corporation is the Parcel Map 23882, filed in book 262, pages 31-33 of Parcel maps, located in the City of Vernon, all as described and shown on the attached Exhibit "A" consisting of two (2) pages which is incorporated herein by this reference as though fully 11 set forth at length; and 12 13 WHEREAS, Catellus Development Corporation desires to adjust the common boundary between the two parcels whereby said 14 adjustment will create two new properties as described and 15 shown on the attached Exhibit "B" which is incorporated herein 16 17 18 by this reference as though fully set forth at length; and WHEREAS, Catellus Development Corporation has applied for a Lot Line Adjustment pursuant to Government Code Section 19 66412(d) of the Subdivision Map Act, which provides an 20 exemption from the Subdivision Map Act requirements as follows: 21 22 23 24 25 26 27 28 and (d) A lot line adjustment between two or more existing adjacent parcels, where the land taken from one parcel is added to an adjacent parcel, and where a greater number of parcels than originally existed is not thereby created, provided the lot line adjustment is approved by the local agency, or advisory agency...." 1 " 1 2 Community Services has recommended that said Lot Line 3 4 5 6 7 8 9 10 11 WHEREAS, Samuel Kevin Wilson, Acting Director of Adjustment be approved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon does hereby find and determine that the recitals contained hereinabove are true and correct. SECTION 2: The request for a Lot Line Adjustment dated December 13, 1994, to adjust the common boundary of the two existing properties being described in the attached Exhibit 12 "A" 13 whereby said adjustment will create two new properties as described in the attached Exhibit "B" is hereby approved in 14 accordance with the recommendation of Samuel Kevin Wilson, 15 Acting Director of Community Services. 16 17 shall certify to the passage of this resolution and thereupon 18 19 SECTION 4: The City Clerk of the City of Vernon and thereafter the same shall be in full force and effect. BW: reg Attachments - ,.... . ,~- ~ .. , I>: -;, <<;~ ENGINEER'S REPORT HAROLD ROACH CONSTRUCTION COMPANY AND CLINTON DEVELOPMENT COMPANY 2140 51ST STREET VARIANCE APPLICATION FEBRUARY 15, 1995 Harold Roach Construction Company and Clinton Development Company have requested a variance from the Comprehensive Zoning Ordinance section 26.4.2-8, Development Standards, for the property located at 2140 51st Street in the City of Vernon. The building that they own was constructed with eight non-conforming truck loading spaces measuring 8.0 feet in width and 55.0 feet in length. They have stated that only vehicles of smaller lengths will be used at the eight non-conforming truck loading spaces. The building is used for warehousing of baskets and is approximately 36,000 square feet in size. Section 26.4.2-7 (b) requires three truck loading spaces for buildings with a gross floor area between 25,001 and 50,000 square feet in size. section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within five years of April 18, 1989 unless a variance is granted. Harold Roach Construction Company and Clinton Development Company have indicated that requiring the eight non-conforming '. .' f "'~ ... .t \. truck loading spaces to be 65 feet long by 10 feet wide would be a hardship. They have indicated that they have no plans for expansion or alteration of the building configuration. The operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted with the following conditions: (a) the usage of the non- conforming truck loading spaces shall be limited so that no truck parked at the loading docks shall extend into the existing street right-of-way as shown on the Master Plan of streets, dated June 16, 1992; and (b) all existing and future tenants shall be notified of this restriction and a condition stating this shall be placed in all future leases. .
