A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
L & T GARMENT, INC. FROM SECTIONS
26.4.2-7 AND 26.4.2-8, OF THE COMPREHENSIVE
ZONING ORDINANCE, FOR THE PROPERTY LOCATED
AT 2615 FRUITLAND AVENUE IN THE CITY OF
VERNON
WHEREAS, L & T Garment, Inc. occupies a parcel of
property located at 2615 Fruitland Avenue in the City of Vernon
and has requested a variance from section 26.4.2-7, Minimum Truck
Parking and Loading Facility Requirements, and section 26.4.2-8,
Development Standards, of the Comprehensive Zoning ordinance; and
WHEREAS, Donald Klein, the owner of said property, has
authorized L & T Garment, Inc. to act as his agent in applying for
this variance; and
WHEREAS, the building is used for garment manufacturing
and the physical condition of the property is unique in that the
existing building measures approximately 57,000 square feet and
was constructed with one non-conforming truck loading space
measuring 9.0 feet in width and 22.2 feet in length; and
WHEREAS, Zoning Ordinance section 26.4.2-7 (b) requires
four truck loading spaces for buildings with a gross floor area
of between 50,001 and 100,000 square feet in size; and
WHEREAS, Zoning Ordinance section 26.4. 2 -8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is granted; and
WHEREAS, there is insufficient space on the property

1 and the application of the development standards for the truck
2 loading space requirements will create an unreasonable hardship
3 by requiring the one non-conforming space to be 10 feet wide
4 and 65 feet long; and
5 WHEREAS, L , T Garment, Inc. has indicated that it has
6 no plans to expand or alter the building configuration and that
7 the existing truck loading space is sufficient for its intended
8 use; and
9 WHEREAS, 2615 Fruitland Avenue is located in the M zone
10 and the operation is consistent with the objectives of the General
11 Plan and Zoning Ordinance; and
12 WHEREAS, the City Council of the City of Vernon held a
13 hearing on said application for a variance on March 7, 1995.
14 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
15 THE CITY OF VERNON AS FOLLOWS:
16 SECTION 1: The City Council of the City of Vernon
17 hereby finds and determines that the recitals contained herein-
18 above are true and correct.
19 SECTION 2: A variance from Section 26.4.2-7, Minimum
20 Truck Parking and Loading Facility Requirements, requiring four
21 truck loading spaces and from Section 26.4.2-8, Development
22 Standards of the Comprehensive Zoning Ordinance, requiring all
23 truck loading spaces to be 10 feet wide by 65 feet long is hereby
24 granted to L , T Garment, Inc. at 2615 Fruitland Avenue.
25 SECTION ~: The variance shall be granted subject to
26 the following condition: the usage of the non-conforming
27 truck loading space shall be limited so that no truck parked at
28 the loading dock shall extend into the street right-of-way as

SEC1ION 4: Noncompliance with this condition shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
Zoning Ordinance Section 26.4.2-8 the authorized truck loading
space requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
L & T Garment, Inc. has submitted an application requesting a Variance
from the Comprehensive Zoning Ordinance, Section 26.4.2-7, Minimum
Truck Parking and Loading Facility Requirements, and Section 26.4.2-8,
Development Standards, for the building located at 2615 Fruitland
Avenue, and transmitted herewith is the following evidence:

The building has one non-conforming truck loading space measuring 9
feet wide and 22 feet long; the company is proposing to use only
vehicles of a smaller length at this space. This has been reviewed by
the Acting Director of Community Services, and it is hereby
recommended that the Variance be granted subject to the following
Condition:

space shall be limited so that any truck parked
at the loading dock does not extend into the
street right-of-way as shown on the Master Plan

VARIANCE APPLICATION
FEBRUARY 28, 1995
L & T Garment, Inc. has requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-7, Minimum Truck
Parking and Loading Facility Requirements and section 26.4.2-8,
Development Standards, for the property located at 2615 Fruitland
Avenue in the City of Vernon. The building that it occupies was
constructed with one non-conforming truck loading space measuring
9.0 feet in width and 22.2 feet in length. It has stated that
only vehicles of smaller lengths will be used at the non-
conforming truck loading space. The building is used for garment
manufacturing and is approximately 57,000 square feet in size.
section 26.4.2-7 (b) requires four truck loading spaces for
buildings with a gross floor area of between 50,001 and 100,000
square feet in size. section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.
It has indicated that requiring the non-conforming truck
loading space to be 65 feet long by 10 feet wide would be a
hardship. It has indicated that it has no plans for expansion or
alteration of the building configuration. The operation is in
conformance with the Zoning Ordinance and General Plan.
Therefore, it is recommended that the variance be granted with
the fOllowing condition: the usage of the non-conforming truck
loading space shall be limited so that no truck parked at the
loading dock shall extend into the street right-of-way as shown
on the Master Plan of streets, dated June 16, 1992.
