Resolution No. 6606 1 2 3 4 5 6 for a conditional use permit to operate a truck and freight 7 8 9 10 RESOLUTION NO. 6606 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO CONDOR FREIGHT LINES, INC. FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 2720 26TH STREET WHEREAS, Condor Freight Lines, Inc. has applied terminal at 2720 26th Street; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on April 4, 1995; and 11 12 the Heavy Industry (M-2) Zone which has been continuously 13 WHEREAS, the proposed site is a conforming use in used as a truck and freight terminal previously operated by 14 LAWI/CSA Consolidators, Inc. and which requires a 15 conditional use permit under the Zoning Ordinance in order 16 to continue the use; and 17 18 WHEREAS, the proposed site is approximately 2.5 acres in size and contains two buildings. The size, shape, 19 topography and drainage of the parcel are adequate for the 20 proposed operation; and 21 22 installed where parking or maneuvering areas adjoin a public 23 WHEREAS, a barrier wall or landscaping will be street pursuant to the Vernon City Code; and 24 WHEREAS, the proposed site is surrounded by 25 industrial uses compatible with the proposed use and no 26 adverse effect from traffic, parking, noise, odors, dust, 27 smoke, light or glare, or risk of fire, infection or 28 explosion is anticipated from the proposed operation; and 1 . . 1 WHEREAS, the site has access to 26th Street and in 2 general traffic will travel from the site on 26th Street to 3 Soto Street, thence north to freeway access. The streets to 4 be utilized within the City of Vernon are sufficient to 5 handle the traffic generated from the proposed operations; 6 and 7 8 off street parking and loading facilities in accordance with 9 the Vernon City Code; and 10 WHEREAS, the site is required to have adequate WHEREAS, the conditions imposed on the conditional 11 use permit will adequately protect the public health, safety 12 and general welfare and the operation is consistent with all 13 applicable rules and laws of the City of Vernon; and 14 WHEREAS, the proposed use as to location, 15 operation, and design is consistent with the General Plan 16 and the Zoning Ordinance of the City of Vernon; and 17 18 WHEREAS, the project was found to be categorically exempt from the California Environmental Quality Act as an 19 existing facility pursuant to Section 15301 of the 20 California Environmental Quality Act Guidelines and a Notice 21 of Exemption shall be filed with the County Clerk per 22 Section 15062 of the California Environmental Quality Act 23 Guidelines. 24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 25 OF THE CITY OF VERNON AS FOLLOWS: 26 SECTION 1: The City Council of the City of Vernon 27 hereby finds and determines that the recitals contained 28 hereinabove are true and correct. 2 . . 1 SECTION 2: Subject to the conditions set forth 2 below, the conditional use permit is granted to Condor 3 Freight Lines, Inc. for the operation of a truck and freight 4 terminal at 2720 26th Street. 5 SECTION 3: In order to adequately protect the 6 public health, safety and general welfare the following 7 conditions are imposed: 8 a. The facility shall be operated in accordance 9 with, and made to conform with all current codes, rules, 10 11 regulations and subject to permit fees as adopted by the City of Vernon. The facility shall be operated in a manner 12 that will prevent unsanitary conditions, odors or other 13 nuisances. Prior to occupancy a business license and 14 occupancy permit shall be obtained. All trucking 15 operations, including truck and trailer parking, shall be 16 limited to the lot located at 2720 26th Street. 17 18 b. A hazardous materials inventory and business/contingency plan shall be submitted and a hazardous 19 materials permit shall be obtained from the City of Vernon 20 Health Department. Hazardous materials/wastes shall be 21 handled and managed in compliance with all appropriate 22 federal, state and local laws. 23 c. All parking and loading facilities shall be 24 paved with a hard durable surface material and shall be 25 adequately drained, and kept free of dust, mud, trash and 26 weeds. Where parking or maneuvering areas adjoin the public 27 street a barrier wall shall be constructed to meet City 28 standards. 3 , . 1 d. Servicing of vehicles including washing, steam 2 cleaning and repairing shall be performed in facilities in 3 compliance with appropriate codes. 4 e. A National Pollutant Discharge Elimination 5 System Permit shall be obtained from the California State 6 Board of Water Resources. 7 f. No equipment or freight shall be stored on the 8 site, other than in buildings, trailers or on the docks. 9 Adequate plans and materials must be available for handling 10 leaks or spills from vehicles during storage or 11 transportation. 12 g. All required federal, state, local and 13 regulatory agency permits shall be obtained prior to 14 operation. 15 h. The current property owner shall submit 16 documentation of hazardous materials closure for 2720 26th 17 Street based on its prior operation by LAWI/CSA 18 Consolidators, Inc. 19 i. Condor shall dedicate a 10-foot wide strip of 20 land adjoining the subject property in order to widen the 21 street right-of-way to 30 feet wide south of the centerline 22 of 26th Street as shown on the Master Plan of City Streets 23 dated June 16, 1992. Five additional feet of sidewalk and 24 driveway shall be constructed to increase the roadway width 25 of 26th Street to 30 feet as measured from the street 26 centerline. A portion of the planter shall be relocated 27 behind the new right-of-way line. SECTION 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. Condor Freight Lines, Inc. was found to be categorically exempt from the California Environmental Quality Act process, since they will be using an existing truck terminal and the facility is not being expanded. In my opinion the proposed operation will pose no adverse effects to the City of Vernon and will not have a significant effect on the environment, and no mitigating measures are required. * Honorable City Council -2- March 30, 1995 It is recommended that the City Council find that the proposed use is categorically exempt from the California Environmental Quality Act process. CONDITIONAL USE PERMIT TO OPERATE A TRUCK AND FREIGHT TERMINAL AT 2720 26th STREET (March 30, 1995) Condor Freight Lines, Inc. has applied for a conditional use permit to operate a truck and freight terminal at 2720 26th Street in the City of Vernon. They are an intrastate trucking company providing pick-up and delivery service to customers throughout California. There will be approximately 20 trucks based at this facility. 1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and the General Plan. The site is presently being used as a truck and freight terminal. 2. SITE The proposed site is of adequate size and shape for the proposed use. 3. ADVERSE AFFECT The proposed site is surrounded by industrial uses compatible with the proposed use and no adverse noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation. 4. ACCESS The site has access to 26th Street which as constructed is fifty feet (50') wide and has adequate capacity and pavement type for the proposed operation. The City has requested that the sidewalk be widened to the Master Plan width. 5. TRUCK MOVEMENTS Condor Freight Lines, Inc. will operate approximately 13 dual axle trucks and 7 bobtails out of the facility. They expect to have up to 55 vehicle movements, including employees vehicles, out of the site daily with the same number entering the site. In general trucks will travel on 26th Street to Soto Street then north to freeway access. Occasionally a truck will travel easterly from the site to the 710 Freeway. 6. STATE OR FEDERAL CONDITIONS There are no conditions imposed by State or Federal law. 7. CONDITIONS It is recommended that the following conditions be set on the permit to adequately protect the public interests: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. Prior to occupancy a business license and occupancy permit shall be obtained. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 2720 26th Street. b. A hazardous materials inventory and business/contingency plan shall be submitted and a hazardous materials permit shall be obtained from the City of Vernon Health Department. Hazardous materials/wastes shall be handled and managed in compliance with all appropriate federal, state and local laws. c. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall shall 2 be constructed to meet City standards. d. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. e. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources. f. No equipment or freight shall be stored on the site, other than in building, trailers or on the docks. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage or transportation. g. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. h. The current property owner shall submit documentation of hazardous materials closure for 2720 26th Street based on its prior operation by LAWI/CSA Consolidators, Inc. i. Condor shall dedicate a 10 foot wide strip of land adjoining the subject property in order to widen the street to 30 feet wide south of the centerline of 26th Street as shown on the Master Plan of City Streets dated June 16, 1992. Five additional feet of sidewalk and driveway shall be constructed to increase the roadway width of 26th Street to 30 feet as measured from the street centerline. A portion of the planter shall be relocated behind the 'new right-of-way line. The Fire Department connection, point indicator valve and a portion of pipe shall be relocated behind the new right-of-way line.
