RESOLUTION NO. 6617
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
COLONY PRODUCTS CO., INC. FROM SECTION
26.4.2-8 OF THE COMPREHENSIVE ZONING

Variance applied far (described in detail the nature and purpose of this
request for which the premises are to be used) attach additional sheet~s)
if necessary:
Variance for new dock'requirment (65') Conforming this zoning ,ordinance
would render this building useless .for our operation. We have 1026 sq ft
of existing warehouse area and would lose 608 sq ft if the loading dock is
modified or 68% of our sto):"age area. We have been oper, ating, this company
at this location slnt:e i 95l and will have 'to' close this facility unless
variance ip granted.
NOTICE TO APPLICANT:. Inth~ variance procedure it shall be shown that
the following five (5) conditions exist in reference to the property being
considered. The ap~lic~nt should answer the following statements. If you
have difficulty finding reasonable answers to the statements contained in
this applic~tio~ Jt may be an indication that your request has insufficient
factors to Justlfy approval. (Attach additional sheet(s) if necessary)
(1) That special conditions and circumstances exist which are peculiar to
the ~and, structure, or building involved and which are not generally
appllcable to other lands, structures, or buildings in the same vicinity
and zone:
Our property lines 'are our building walls. The only possible modification
would be to lengthen our existing loading dock by 36 feet.
(2) That literal interpretation of the prOV1Slons of this ordinance would
deprive the applicant of rights commonly enjoyed by other properti~s in the
same vicinit~ and zone in which the property is located, under the terms of
this Chapter'.
We would be unable to operate business at this facility due to reduced
staginq and storage space (68 %})

(3) That the special conditions and circumstances do not result from
actions of the applicant:
We have operated at this 'Iacility under same conditiOrisfor over 40 years.
(4) That granting the variance req'uested 'will not confer on the applicant
any special priVilege that is denied ,by'this Chapter to other lands,_
structures, or bUildings in the same vicinily and zone in which the property
is located:-
We would not expect any special'privileges that are denied to other Iacilities.
(5) That the granting of such variance will be in harmony and not adversely
affect the Comprehensive General Plan:
If variance is granted streets will not be blocked by trucks extending
past our property line.

ENGINEER'S REPORT
COLONY PRODUCTS CO., INC.
2848 LEONIS BOULEVARD
VARIANCE APPLICATION
APRIL 19, 1995
3;tcJ
Colony Products Co., Inc. has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8, Development
Standards, for the property located at 2848 Leonis Boulevard in
the City of Vernon. The building that it occupies was
constructed with one non-conforming truck loading space measuring
10.0 feet in width and 27.5 feet in length. It has stated that
only vehicles of smaller lengths will be used at the non-
conforming truck loading space. The building is used for the
manufacturing of pan coatings and is approximately 4,750 square
feet in size.
Section 26.4.2-7 (b) requires one truck loading space for
buildings with a gross floor area under 8,000 square feet in
size. Section 26.4.2-8 (c) of the Comprehensive zoning
Ordinance specifies that each loading space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides
that a non-conforming building must comply with these standards
within five years of April 18, 1989 unless a variance is granted.
It has indicated that requiring the non-conforming truck
loading space to be 65 feet long by 10 feet wide would be a
hardship. It has indicated that it has no plans for expansion or
alteration of the building configuration. The operation is in

conformance with the Zoning Ordinance and General Plan.
Therefore, it is recommended that the variance be granted with
the following condition: the usage of the non-conforming truck
loading space shall be limited so that no truck parked at the
loading dock shall extend into the street right-of-way as shown
on the Master Plan of streets, dated June 16, 1992.
