FROM SECTION 26.4.2-8 OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2848 LEONIS BOULEVARD IN THE CITY OF VERNON WHEREAS, Colony Products Co., Inc. occupies a parcel of property located at 2848 Leonis Boulevard in the City of Vernon and has requested a variance from Section 26.4.2-8, Development Standards, of the Comprehensive zoning Ordinance; and WHEREAS, Mc Quillin Family Trust and Brewer, R. Co. T.R. Brewer Trust, the owner of said property, has authorized Colony Products Co., Inc. to act as its agent in applying for this variance; and WHEREAS, the building is used for the manufacturing of pan coatings and the physical condition of the property is unique in that the existing building measures approximately 4,750 square feet and was constructed with one non-conforming truck loading space measuring 10.0 feet in width and 27.5 feet in length; and WHEREAS, Zoning Ordinance Section 26.4.2-7 (b) requires one truck loading space for buildings with a gross floor area under 8,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) fi;pecifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long, and Section 26.4.6-4 (c) provides that a non- conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted; and WHEREAS, there is insufficient space on the property 1 1 and the application of the development standards for the truck 2 loading space requirements will create an unreasonable hardship 3 by requiring the one non-conforming space to be 10 feet wide 4 and 65 feet long; and 5 WHEREAS, Colony Products Co., Inc. has indicated that 6 it has no plans to expand or alter the building configuration and 7 that the existing truck loading space is sufficient for its 8 intended use; and 9 WHEREAS, 2848 Leonis Boulevard is located in the M zone 10 and the operation is consistent with the objectives of the General 11 Plan and Zoning Ordinance; and 12 WHEREAS, the City Council of the City of Vernon held a 13 hearing on said application for a variance on May 2, 1995. 14 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 15 THE CITY OF VERNON AS FOLLOWS: 16 S~CTION +: The City Council of the City of Vernon 17 hereby finds and determines that the recitals contained herein- 18 above are true and correct. 19 SEGTION 2: A variance from section 26.4.2-8, 20 Development Standards of the Comprehensive zoning Ordinance, 21 requiring all truck loading spaces to be 10 feet wide by 65 feet 22 long is hereby granted to Colony Products Co., Inc. at 2848 Leonis 23 Boulevard. 24 ~E~IQN 3: The variance shall be granted SUbject to 25 the following condition: the usage of the non-conforming 26 truck loading space shall be limited so that no truck parked at 27 the loading dock shall extend into the street right-of-way as 28 shown on the Master Plan of Streets, dated June 16, 1992. 2 .. <, 1 ~ECTIO~ 4: Noncompliance with this condition shall 2 constitute sufficient grounds for the City Council of the City 3 of Vernon to void this variance and require the application of 4 Zoning Ordinance section 26.4.2-8 the authorized truck loading 5 space requirement. 6 SEC1ION 5: The City Clerk of the City of Vernon shall 7 certify to the passage of this Resolution and thereupon and 8 thereafter the same shall be in full force and effect. 9 APPROVED AND ADOPTED THIS 2ND day of May, 1995 ~' J LEO~~~ . 14 BRUCE V.MALKENHORST, City Clerk 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 STATE OF CALIFORNIA ) ) ss COUNTY OF LOS ANGELES ) I, BRUCE V. Malkenhorst City Administrator/City Clerk ~ ~..;. ioI (1) ENGINEER'S REPORT COLONY PRODUCTS CO., INC. 2848 LEONIS BOULEVARD VARIANCE APPLICATION APRIL 19, 1995 3;tcJ Colony Products Co., Inc. has requested a variance from the Comprehensive Zoning Ordinance Section 26.4.2-8, Development Standards, for the property located at 2848 Leonis Boulevard in the City of Vernon. The building that it occupies was constructed with one non-conforming truck loading space measuring 10.0 feet in width and 27.5 feet in length. It has stated that only vehicles of smaller lengths will be used at the non- conforming truck loading space. The building is used for the manufacturing of pan coatings and is approximately 4,750 square feet in size. Section 26.4.2-7 (b) requires one truck loading space for buildings with a gross floor area under 8,000 square feet in size. Section 26.4.2-8 (c) of the Comprehensive zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within five years of April 18, 1989 unless a variance is granted. It has indicated that requiring the non-conforming truck loading space to be 65 feet long by 10 feet wide would be a hardship. It has indicated that it has no plans for expansion or alteration of the building configuration. The operation is in .... -~IW --J .. conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted with the following condition: the usage of the non-conforming truck loading space shall be limited so that no truck parked at the loading dock shall extend into the street right-of-way as shown on the Master Plan of streets, dated June 16, 1992.
