RESOLUTION NO. 6620
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO LAWI/CSA CONSOLIDATORS, INC. FOR
THE OPERATION OF A TRUCK AND FREIGHT TERMINAL
2043 ROSS STREET
AT
WHEREAS, LAWI/CSA Consolidators, Inc. has applied
terminal at 2043 Ross Street; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on May 2, 1995; and
WHEREAS, LAWI/CSA Consolidators, Inc. is

relocating its operations to a truck and freight terminal

located at 2043 Ross Street.
The proposed site is a
grandfathered, non-conforming use in the General Industry
(M) Zone which has been used continuously as a truck and
freight terminal, and which requires a conditional use
permit under the Zoning Ordinance in order to continue the
18
use; and

WHEREAS, the proposed site is approximately 273.63
feet in length by 200 feet in width and contains three
buildings. The size, shape, topography and drainage of the
parcel are adequate for the proposed operation; and
WHEREAS, a barrier wall or landscaping will be
installed where parking or maneuvering areas adjoin a public
street pursuant to the Vernon City Code; and
WHEREAS, the proposed site is surrounded by

industrial uses compatible with the proposed use and no

adverse effect from traffic, parking, noise, odors, dust,

1 smoke, light or glare, or risk of fire, infection or
2 explosion is anticipated from the proposed operation; and
3 WHEREAS, the site has access to Ross Street and in
4 general traffic will travel from the site on Ross Street to
5 Alameda Street, thence north to freeway access. Occasionally
6 a truck will travel south on Ross Street to 38th Street,
7 thence easterly on 38th Street to freeway access. The
8 streets to be utilized within the City of Vernon are
9 sufficient to handle the traffic generated from the proposed
10 operations; and
11 WHEREAS, the site is required to have adequate
12 offstreet parking and loading facilities in accordance with
13 the Vernon City Code; and
14 WHEREAS, the conditions imposed on the conditional
15 use permit will adequately protect the public health, safety
16 and general welfare and the operation is consistent with all
17 applicable rules and laws of the City of Vernon; and
18 WHEREAS, the proposed use as to location,
19 operation, and design is consistent with the General Plan
20 and the Zoning Ordinance of the City of Vernon; and
21 WHEREAS, the project was found to be categorically
22 exempt from the California Environmental Quality Act as an
23 existing facility pursuant to Section 15301 of the
24 California Environmental Quality Act Guidelines and a Notice
25 of Exemption shall be filed with the County Clerk per
26 Section 15062 of the California Environmental Quality Act
27 Guidelines.

1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
2 OF THE CITY OF VERNON AS FOLLOWS:
3 SECTION 1: The City Council of the City of Vernon
4 hereby finds and determines that the recitals contained
5 hereinabove are true and correct.
6 SECTION 2: Subject to the conditions set forth
7 below, the conditional use permit is granted to LAWI/CSA
8 Consolidators, Inc. for the operation of a truck and freight
9 terminal at 2043 Ross Street.
10 SECTION 3: In order to adequately protect the
11 public health, safety and general welfare the following
12 conditions are imposed:
13 a. The facility shall be operated in accordance
14 with, and made to conform with all current codes, rules,
15 regulations and subject to permit fees as adopted by the
16 City of Vernon. The facility shall be operated in a manner
17 that will prevent unsanitary conditions, odors or other

19 occupancy permit shall be obtained. All trucking
20 operations, including truck and trailer parking, shall be
21 limited to the lot located at 2043 Ross Street.
22 b. A hazardous materials inventory and
23 business/contingency plan shall be submitted and a hazardous
24 materials permit shall be obtained from the City of Vernon
25 Health Department. Hazardous materials/wastes shall be
26 handled and managed in compliance with all appropriate
27 federal, state and local laws.
28 c. All parking and loading facilities shall be

1 paved with a hard durable surface material and shall be
2 adequately drained, and kept free of dust, mud, trash and
3 weeds. Where parking or maneuvering areas adjoin the public
4 street a barrier wall or landscaping shall be installed and
5 maintained to meet City standards.
6 d. Servicing of vehicles including washing, steam
7 cleaning and repairing shall be performed in facilities in
8 compliance with appropriate codes.
9 e. A National Pollutant Discharge Elimination
10 System Permit shall be obtained from the California State
11 Board of Water Resources.
12 f. No equipment or freight shall be stored on the
13 site, other than in buildings, trailers or on the docks.
14 Adequate plans and materials must be available for handling
15 leaks or spills from vehicles during storage or
16 transportation.
17 g. All required federal, state, local and
18 regulatory agency permits shall be obtained prior to
19 operation.

h. The facility's buildings shall be structurally
21 maintained to exclude rodents and the property shall be
22 maintained rodent free.
23 i. The current property owner shall submit
24 documentation of hazardous materials closure for 2043 Ross
25 Street, based on its prior operation by Reeder Fastway
26 Trucking, Inc.
27 j. All existing cracked sidewalk, curb and gutter
28 adjacent to the site in Ross Street shall be repaired and

SECTION 4:
The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.

Gentlemen:
LAWIlcSA Consolidators, Inc. has applied for a conditional
use permit to operate a truck and freight terminal at 2043 Ross
Street.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer's Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
LAWI/CSA Consolidators, Inc. was found to be categorically
exempt from the California Environmental Quality Act process,
since they will be using an existing truck terminal and the
facility is not being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.
