RESOLUTION NO. 6628
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
CHARLES J. DAVIES AND MYRIAM DAVIES FROM
SECTION 26.4.2-8, DEVELOPMENT STANDARDS,
OF THE COMPREHENSIVE ZONING ORDINANCE,
FOR THE PROPERTY LOCATED AT 4295 CHARTER
STREET IN THE CITY OF VERNON
WHEREAS, Charles J. Davies and Myriam Davies own a
parcel of property located at 4295 Charter Street in the city
of Vernon and has requested a variance from conformance with
Section 26.4.2-8, Development Standards, of the comprehensive
Zoning Ordinance; and
WHEREAS, the building is used for warehousing of
electrical effects and lighting and the physical condition of
the property is unique in that the existing building measures
approximately 56,900 square feet and was constructed with one
conforming truck loading space and nine non-conforming truck
loading spaces measuring 9.0 feet in width and from 40.5 to
63.5 feet in length; and
WHEREAS, Zoning Ordinance section 26.4.2-7 (b)
requires four truck loading spaces for buildings with a gross
floor area between 50,001 and 100,000 square feet in size; and
WHEREAS, Zoning Ordinance section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck

loading spaces requirements will create an unreasonable
hardship by requiring the non-conforming spaces to be 10 feet
wide by 65 feet long; and
WHEREAS, Charles J. Davies and Myriam Davies have
indicated that they have no plans to expand or alter the
building configuration and that the existing truck loading
spaces are sufficient for their intended use; and
WHEREAS, 4295 Charter Street is located in the M zone
and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a variance on May 16, 1995.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTI9N ~: A variance from Section 26.4.2-8 of the
Comprehensive Zoning Ordinance, requiring all truck loading
spaces to be 10 feet wide by 65 feet long, is hereby granted to
Charles J. Davies and Myriam Davies at 4295 Charter Street.
SECTION 3: The variance shall be granted subject to
the following conditions: (a) the usage of the non-conforming
truck loading spaces shall be limited so that no truck parked
at the loading docks shall extend into the existing street
right-of-way as shown on the Master Plan of Streets, dated June
16, 1992; and (b) all existing and future tenants shall be
notified of this restriction and a condition stating this shall

be placed in all future leases.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
Zoning Ordinance Section 26.4.2-8 and the authorized truck
loading space requirement.
SECTION ?: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.

Honorable Members:
Charles J. Davies and Myriam Davies have submitted an application for
a Variance from the Comprehensive Zoning Ordinance, Section 26.4.2-8,
Development Standards, for the building located at 4295 Charter
Street, and transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has one conforming truck loading space and nine non-
conforming spaces that are 9 feet wide and various lengths. The
company is proposing to use only vehicles of a smaller length at the
non-conforming truck loading spaces. This has been reviewed by the
Acting Director of Community Services, and it is hereby recommended
that the Variance be granted subject to the following Conditions:
a. The usage of the non-conforming truck loading
spaces shall be limited so that any truck
parked at the loading docks shall not extend
into the street right-of-way as shown on the
Master Plan of Streets dated June 16, 1992.
b. All existing and future tenants shall be notified
of this restriction and a condition stating this
shall be placed in all future leases.

Variance from Sec 26.4.2-8 (c) American D.J. Supply, Inc. requests to use
existinq docks as indicated on Drawing C-1001 for off-loading and loading
of 40 foot containers and 48 foot trailer~ transport common to company
business. These units,.are delivered by city tractors i.e., tractors
with a 12 foot cab. Should a 65 foot tractor and trailer unit be
encountered arrangements for off-loading and loading can be made to
use the loading dock on the east SlC1e of the building temporaLily.

The buildinq is situated on a triangular property which is bounded
on the north by railroad. tracks and on the east by railroad tracks
running southwest to northeast creatlng a large trlangular plot.
For effective use of the property loading docks are located facing
Charter Street away from the railroad tracks crossing Charter Street.

Special conditions that exist do not result from actions of the
applicant. These conditions are attributed to prior development
of the property. Using the on-site loading. docks will not obstruct
use of the sidewalks.

. The off-loading and loading of containers (40 foot) and trailers (48 foot)
under weather protected conditions is common to the area. Off-loading
and loading will not be conducted on Charter Street thus eliminating
any conqestion on Charter Street.

affect the Comprehensive General Plan:
The off-loading and loading of materials and equipment will be accomplished
on the property. These activities will not impact the Comprehensive
General Plan.

VARIANCE APPLICATION
MAY 9, 1995

Charles J. Davies and Myriam Davies have requested a variance
from the Comprehensive Zoning Ordinance section 26.4.2-8,
Development Standards, for the property located at 4295 Charter
street in the City of Vernon. The building that they own was
constructed with one conforming truck loading space and nine non-
conforming truck loading spaces measuring 9.0 feet in width and
various feet in length. They have stated that only vehicles of
smaller lengths will be used at the non-conforming truck loading
spaces. The building is used for warehousing of electrical
effects and lighting and is approximately 56,900 square feet in
size.
section 26.4.2-7 (b) requires four truck loading spaces for
buildings with a gross floor area between 50,001 and 100,000
square feet in size. section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and Section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.
Charles J. Davies and Myriam Davies have indicated that

requiring the non-conforming truck loading spaces to be 65 feet
long by 10 feet wide would be a hardship. They have indicated
that they have no plans for expansion or alteration of the
building configuration. The operation is in conformance with the
Zoning Ordinance and General Plan. Therefore, it is recommended
that the variance be granted with the following conditions: (a)
the usage of the non-conforming truck loading spaces shall be
limited so that no truck parked at the loading docks shall extend
into the existing street right-of-way as shown on the Master Plan
of streets, dated June 16, 1992; and (b) all existing and future
tenants shall be notified of this restriction and a condition
stating this shall be placed in all future leases.
