A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO HERCULES FORWARDING, INC. FOR
THE OPERATION OF A TRUCK AND FREIGHT TERMINAL
AT 3240 BANDINI BOULEVARD
WHEREAS, Hercules Forwarding, Inc. has applied for
terminal at 3240 Bandini Boulevard; and
WHEREAS, the City Council of the City of Vernon
9 held a hearing on said application for a conditional use

permit on June 6, 1995; and
WHEREAS, the proposed site is a conforming use in
the Heavy Industry (M-2) Zone which has been continuously
used as a truck and freight terminal previously operated by
A & L Fuel and which requires a conditional use permit under
15 the Zoning Ordinance in order to continue the use; and

WHEREAS, the proposed operation will include the
hauling and temporary storage of food products; and
WHEREAS, the proposed site is approximately 1.4
19 acres in size, contains two buildings, and the size, shape,
20 topography and drainage of the parcel are adequate for the
21 proposed operation; and

WHEREAS, a barrier wall or landscaping will be
installed where parking or maneuvering areas adjoin a public
street pursuant to the Vernon City Code; and
WHEREAS, the proposed site is surrounded by
26 industrial uses compatible with the proposed use and no
27 adverse effect from traffic, parking, noise, odors, dust,
28
smoke, light or glare, or risk of fire, infection or

1 explosion is anticipated from the proposed operation; and
2 WHEREAS, the site has access to Bandini Boulevard
3 and in general traffic will travel from the site on Bandini
4 Boulevard to Soto Street, thence north to freeway access;
5 occasionally a truck will travel easterly from the site to
6 the 710 freeway; and the streets to be utilized within the
7 City of Vernon are sufficient to handle the traffic
8 generated from the proposed operations; and
9 WHEREAS, the site is required to have adequate
10 offstreet parking and loading facilities in accordance with
11 the Vernon City Code; and
12 WHEREAS, the conditions imposed on the conditional
13 use permit will adequately protect the public health, safety
14 and general welfare and the operation is consistent with all
15 applicable rules and laws of the City of Vernon; and
16 WHEREAS, the proposed use as to location,
17 operation, and design is consistent with the General Plan
18 and the Zoning Ordinance of the City of Vernon; and
19 WHEREAS, the project was found to be categorically
20 exempt from the California Environmental Quality Act as an
21 existing facility pursuant to Section 15301 of the
22 California Environmental Quality Act Guidelines and a Notice
23 of Exemption shall be filed with the County Clerk per
24 Section 15062 of the California Environmental Quality Act
25 Guidelines.
26 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
27 OF THE CITY OF VERNON AS FOLLOWS:
28 SECTION 1: The City Council of the City of Vernon

2 hereinabove are true and correct.

SECTION 2: Subject to the conditions set forth
below, the conditional use permit is granted to Hercules
Forwarding, Inc. for the operation of a truck and freight
terminal at 3240 Bandini Boulevard.
SECTION 3: In order to adequately protect the
public health, safety and general welfare the following
conditions are imposed:
a. The facility shall be operated in accordance
with, and made to conform with all current codes, rules,
regulations and subject to permit fees as adopted by the
City of Vernon. The facility shall be operated in a manner
14 that will prevent unsanitary conditions, odors or other
15 nuisances. Prior to occupancy a business license and
16 occupancy permit shall be obtained. All trucking
17 operations, including truck and trailer parking, shall be
18 limited to the lot located at 3240 Bandini Boulevard.
19 b. All parking and loading facilities shall be
20 paved with a hard durable surface material and shall be
21 adequately drained, and kept free of dust, mud, trash and
22 weeds. Where parking or maneuvering areas adjoin the public
23 street a barrier wall or landscaping shall be installed to
24 meet City standards.
25 c. Servicing of vehicles including washing, steam
26 cleaning and repairing shall be performed in facilities in
27 compliance with appropriate codes.
28 d. A National Pollutant Discharge Elimination

1 System Permit shall be obtained from the California State
2 Board of Water Resources.
3 e. No equipment or freight shall be stored on the
4 site, other than in buildings, trailers or on the docks.
5 Adequate plans and materials must be available for handling
6 leaks or spills from vehicles during storage or
7 transportation.
8 f. All required federal, state, local and
9 regulatory agency permits shall be obtained prior to
10 operation.

g. A hazardous materials inventory and
12 business/contingency plan shall be submitted and a hazardous
13 materials permit shall be obtained from the City of Vernon
14 Health Department. Hazardous materials/wastes shall be
15 handled and managed in compliance with all appropriate
16 federal, state and local laws.
17 h. The current property owner shall submit
18 documentation of hazardous materials closure for 3240
19 Bandini Boulevard based on its prior operation by A & L
20 Fuel.

i. The underground fuel tanks on the site must be
22 removed under permit issued by the City of Vernon Community
23 Services Department or the property owner or occupant shall
24 obtain and maintain an underground tank permit. The
25 underground storage tank monitoring systems shall be checked
26 by a qualified service person. Monitoring systems must meet
27 the requirements of City Ordinance No. 944. Hercules
28 Forwarding shall provide a system to positively shut down

1 the westerly tank's turbine pump in the event of a leak
2
alarm and provide a state of the art overspill protection
3 for each tank fill opening.

The tanks and dispensers shall
meet all current City codes.

Hercules Forwarding must apply for a City of
Vernon Food Warehouse Health Permit.
k.
The abandoned materials in drums and buckets
must be properly disposed of from the site and documentation
of disposal must be submitted and the wall and soil stains
in the southwest corner of the property must be
characterized and an assessment report submitted to the
Health Department by the property owner or Hercules
Forwarding, Inc.
l.
Broken or cracked sidewalk, curb, gutter or
driveway in Bandini Boulevard adjacent to the site shall be
repaired and unused driveways shall be removed and replaced
with curb, gutter and sidewalk.
m.
The facility shall be operated in a manner
19 which will not impede traffic on Bandini Boulevard.

SECTION 4:
The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.

Gentlemen:
Hercules Forwarding, Inc. has applied for a conditional use
permit to operate a truck and freight terminal at 3240 Bandini
Boulevard.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer's Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
Hercules Forwarding, Inc. was found to be categorically
exempt from the California Environmental Quality Act process,
since they will be using an existing truck terminal and the
facility is not being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

It is recommended that the City Council find that the
proposed use is categorically exempt from the California

Further it is recommended that a Notice of Exemption be
filed with the County Clerk and the conditional use permit be
granted with the following conditions:

Proposed Traffic Analysis

Hercules utilizes a local fleet of:
2 light duty trucks GVW 7M
4 medium duty trucks GVW 20M to 22M
2 heavy duty truck GVW 34M to 36M
These trucks operate between the hours of 7:00 am and 7:00 p.m. Monday through
Friday.
They will be routed on Bandini Blvd. to / from the Long Beach Freeway and also on
Soto S1. to / from the interchange of the San Bernadino, Santa Ana and Pomona
Freeways.
Our long distance fleet consists of:
6 heavy duty vehicles GVW 34M to 36M
These trucks depart our terminal after 6:00 p.m. or on weekends and
are routed Northbound on Soto St. to the Santa Ana Freeway. These vehicles
transport our goods from Southern California to Canada so they remain away from the
terminal for 3-5 days.

Hercules does both distribution and consolidation throughout the Southern California
area. Merchandise is unloaded from trailers and reloaded for local delivery . The local
vehicles also make pickups, bring them back to the warehouse and this freight is then
loaded onto our trailers for delivery to our various facilities in Canada.
Our normal operating hours are from 7:00 am to 5:00 pm. Mon through Thurs. Friday
closing time is 1 Opm. We also open on Sunday once or twice a month, requiring one or
two people on these occasions.
Hazardous Report

Hercules handles only consumer commodity hazardQus materials such as hair care
products, paint, and cleaning chemicals. These products are shipped in cartons and lor
pails and are loaded onto our trailers along with other shipments. Shipments vary in size
and in frequency. Hair care products are usually shipped weekly with total hazardous
weight of less than 1000 lbs. Paint products are also usually shipped weekly, shipment
sizes between 2000 and 20000 lbs. Other hazardous shipments are irregular. Emergency
response numbers are given on the bill of lading for each shipment. Routing of these is the
same for all units. See traffic analysis attached.

ENGINEER'S REPORT
ON HERCULES FORWARDING, INC.
CONDITIONAL USE PERMIT TO OPERATE A
TRUCK AND FREIGHT TERMINAL AT 3240 BANDINI BOULEVARD
(June 1, 1995)
Hercules Forwarding, Inc. has applied for a conditional use
permit to operate a truck and freight terminal at 3240 Bandini
Boulevard in the City of Vernon. They are an international
trucking company providing pick-up and delivery service to
customers throughout Canada. There will be approximately 14
trucks based at this facility.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. SITE The proposed site is of adequate size and shape
for the proposed use.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to Bandini Boulevard. This
street is of adequate size to handle the traffic generated from
the proposed operation.
5. TRUCK MOVEMENTS Hercules Forwarding, Inc. will operate
approximately 12 dual axle trucks and 2 bobtails out of the
facility. They expect to have up to 37 vehicle movements,

including employees vehicles, out of the site daily with the same
number entering the site. In general trucks will travel on
Bandini Boulevard to Soto Street then north to freeway access.
Occasionally a truck will travel easterly from the site to the
710 Freeway.
6. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations and
subject to permit fees as adopted by the City of Vernon. The
facility shall be operated in a manner that will prevent
unsanitary conditions, odors or other nuisances. Prior to
occupancy a business license and occupancy permit shall be
obtained. All trucking operations, including truck and trailer
parking, shall be limited to the lot located at 3240 Bandini
Boulevard.
b. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed to meet City standards.
c. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with

appropriate codes.
d. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources.
e. No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks. Adequate
plans and materials must be available for handling leaks or
spills from vehicles during storage or transportation.
f. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation.
g. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/wastes shall be handled and managed in compliance with
all appropriate federal, state and local laws.
h. The current property owner shall submit documentation of
hazardous materials closure for 3240 Bandini Boulevard based on
its prior operation by A & L Fuel.
i. The underground fuel tanks on the site must be removed
under permit issued by the City of Vernon Community Services
Department or the property owner or occupant shall obtain and
maintain an underground tank permit. The underground storage
tank monitoring systems shall be checked by a qualified service
person. Monitoring systems must meet the requirements of City
Ordinance No. 944. Hercules Forwarding shall provide a system to
positively shut down the westerly tank's turbine pump in the

event of a leak alarm and provide a state of the art overspill
protection for each tank fill opening. The tanks and dispensers
shall meet all current City codes.
j. Hercules Forwarding must apply for a City of Vernon Food
Warehouse Health Permit.
k. The abandoned materials in drums and buckets must be
properly disposed of from the site and documentation of disposal
must be submitted and the wall and soil stains in the southwest
corner of the property must be characterized and an assessment
report submitted to the Health Department by the property owner
or Hercules Forwarding, Inc.
1. Broken or cracked sidewalk, curb, gutter or driveway in
Bandini Boulevard adjacent to the site shall be repaired and
unused driveways shall be removed and replaced with curb, gutter
and sidewalk.
m. The facility shall be operated in a manner which will
not impede traffic on Bandini Boulevard.

NOTICE OF PUBLIC HEARING, to be held 06/06/95, (see
attached copy) regarding a conditional use permit
application for Bert E. Jessup Transportation, Inc. to
operate a truck and freight terminal at 2720 26th Street.
One in each of the following places to wit: At the
northwest corner of 38th Street and Santa Fe Avenue; the
northeast corner of Leonis Boulevard and Pacific Boulevard;
and on the bulletin board in the lobby of the City Hall of
