RESOLUTION NO. 6634
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO BERT E. JESSUP TRANSPORTATION, INC.
FOR THE OPERATION OF A TRUCK AND FREIGHT
TERMINAL AT 2720 26TH STREET
WHEREAS, Bert E. Jessup Transportation, Inc. has
freight terminal at 2720 26th Street; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on June 6, 1995; and

WHEREAS, the proposed site is a conforming use in
12 the Heavy Industry (M-2) Zone which has been continuously
13 used as a truck and freight terminal and is presently being
14 operated by Condor Freight Lines, Inc. pursuant to a
15 conditional use permit granted by Resolution No. 6606 on
16 April 4, 1995; and

WHEREAS, Condor Freight Lines is entering into a
provides for joint use of the property and which requires a
conditional use permit under the Zoning Ordinance; and
WHEREAS, the proposed site is approximately 2.5
acres in size and contains one building, and the size,
shape, topography and drainage of the parcel are adequate
24 for the proposed operation; and

WHEREAS, a barrier wall or landscaping will be
26 installed where parking or maneuvering areas adjoin a public
27 street pursuant to the Vernon City Code; and
28
WHEREAS, the proposed site is surrounded by

1 industrial uses compatible with the proposed use and no
2 adverse effect from traffic, parking, noise, odors, dust,
3 smoke, light or glare, or risk of fire, infection or
4 explosion is anticipated from the proposed operation; and
5 WHEREAS, the site has access to 26th Street and in
6 general traffic will travel from the site on 26th Street to
7 Soto Street, thence north to freeway access; and the streets
8 to be utilized within the City of Vernon are sufficient to
9 handle the traffic generated from the proposed operations;
10 and

WHEREAS, the site is required to have adequate
12 offstreet parking and loading facilities in accordance with
13 the Vernon City Code; and
14 WHEREAS, the conditions imposed on the conditional
15 use permit will adequately protect the public health, safety
16 and general welfare and the operation is consistent with all
17 applicable rules and laws of the City of Vernon; and
18 WHEREAS, the proposed use as to location,
19 operation, and design is consistent with the General Plan
20 and the Zoning Ordinance of the City of Vernon; and
21 WHEREAS, the project was found to be categorically
22 exempt from the California Environmental Quality Act as an
23 existing facility pursuant to Section 15301 of the
24 California Environmental Quality Act Guidelines and a Notice
25 of Exemption shall be filed with the County Clerk per
26 Section 15062 of the California Environmental Quality Act
27 Guidelines.

SECTION 2: Subject to the conditions set forth
below, the conditional use permit is granted to
8 Bert E. Jessup Transportation, Inc. for the operation of a
9 truck and freight terminal at 2720 26th Street.
10 SECTION 3: In order to adequately protect the
11 public health, safety and general welfare the following
12 conditions are imposed:
13 a. The facility shall be operated in accordance
14 with, and made to conform with all current codes, rules,
15 regulations and subject to permit fees as adopted by the
16 City of Vernon. The facility shall be operated in a manner
17 that will prevent unsanitary conditions, odors or other
18 nuisances. Prior to occupancy a business license and
19 occupancy permit shall be obtained. All trucking
20 operations, including truck and trailer parking, shall be
21 limited to the lot located at 2720 26th Street.
22 b. All parking and loading facilities shall be
23 paved with a hard durable surface material and shall be
24 adequately drained, and kept free of dust, mud, trash and
25 weeds. Where parking or maneuvering areas adjoin the public
26 street a barrier wall or landscaping shall be installed to
27 meet City standards.
28 c. Servicing of vehicles including washing, steam
1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
2 OF THE CITY OF VERNON AS FOLLOWS:
3 SECTION 1: The City Council of the City of Vernon
4 hereby finds and determines that the recitals contained
5 hereinabove are true and correct.

h. The current property owner shall submit
21 documentation of hazardous materials closure for 2720 26th
22 Street based on its prior operation by LAWI/CSA
23 Consolidators, Inc.
24 i. The property owner shall dedicate a 10 foot
25 wide strip of land adjoining the subject property in order
26 to widen the street to 30 feet wide south of the centerline
27 of 26th Street as shown on the Master Plan of City Streets
28 dated June 16, 1992. Five additional feet of sidewalk and

1 driveway shall be constructed to increase the roadway width

of 26th Street to 30 feet as measured from the street
centerline.
A portion of the planter shall be relocated
behind the new right-of-way line.
The Fire Department
connection, point indicator valve and a portion of pipe
shall be relocated behind the new right-of-way line.
All
existing cracked sidewalk, curb & gutter adjacent to the
site in 26th Street shall be repaired to meet City
standards.

The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.
SECTION 4:
The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.

CONDITIONAL USE PERMIT TO OPERATE A
TRUCK AND FREIGHT TERMINAL AT 2720 26th STREET
(June 1, 1995)
Bert E. Jessup Transportation, Inc. has applied for a
conditional use permit to operate a truck and freight terminal at
2720 26th Street in the City of Vernon. They are an intrastate
trucking company providing pick-up and delivery service to
customers throughout California. There will be approximately 5
trucks based at this facility.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. SITE The proposed site is of adequate size and shape
for the proposed use.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to 26th Street which as
constructed is fifty feet (50') wide and has adequate capacity
and pavement type for the proposed operation. The City has
requested that the sidewalk be widened to the Master Plan width.
5. TRUCK MOVEMENTS Bert E. Jessup Transportation, Inc.
will operate approximately 2 dual axle trucks and 3 bobtails out

of the facility. They expect to have up to 12 vehicle movements,
including employees vehicles, out of the site daily with the same
number entering the site. In general trucks will travel on 26th
Street to Soto Street then north to freeway access. Occasionally
a truck will travel easterly from the site to the 710 Freeway.
6. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations and
subject to permit fees as adopted by the City of Vernon. The
facility shall be operated in a manner that will prevent
unsanitary conditions, odors or other nuisances. Prior to
occupancy a business license and occupancy permit shall be
obtained. All trucking operations, including truck and trailer
parking, shall be limited to the lot located at 2720 26th Street.
b. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed to meet City standards.
c. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with
appropriate codes.

d. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources.
e. No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks. Adequate
plans and materials must be available for handling leaks or
spills from vehicles during storage or transportation.
f. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation.
g. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/wastes shall be handled and managed in compliance with
all appropriate federal, state and local laws.
h. The current property owner shall submit documentation of
hazardous materials closure for 2720 26th Street based on .its
prior operation by LAWI/CSA Consolidators, Inc.
i. The property owner shall dedicate a 10 foot wide strip
of land adjoining the subject property in order to widen the
street to 30 feet wide south of the centerline of 26th Street as
shown on the Master Plan of City Streets dated June 16, 1992.
Five additional feet of sidewalk and driveway shall be
constructed to increase the roadway width of 26th Street to 30
feet as measured from the street centerline. A portion of the
planter shall be relocated behind the new right-of-way line. The
Fire Department connection, point indicator valve and a portion

of pipe shall be relocated behind the new right-of-way line. All
existing cracked sidewalk; curb & gutter adjacent to the site in
26th Street shall be repaired to meet City standards.
j. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.

Bert E. Jessup Transportation has applied for a conditional
use permit to opera e a truck and freight terminal at 2720 26th
Street.
Herewith for y ur consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer'S Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
Bert E. Jessup Transportation was found to be categorically
exempt from the California Environmental Quality Act process,
since they will be using an existing truck terminal and the
facility is not being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.
