A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON GRANTING A CONDITIONAL USE PERMIT TO
SYLVIA FILIPPINI DBA: IL TRENO RESTAURANT, FOR A
RETAIL COMMERCIAL USE WHICH WILL GENERATE MORE
THAN 20 VEHICLE TRIPS PER DAY PER 1,000 GROSS
SQUARE FEET OF FLOOR AREA AT 5351 SANTA FE AVENUE
AND ADJACENT PROPERTY
WHEREAS, Sylvia Filippini dba: Il Treno Restaurant
has applied for a conditional use permit for the expansion
of a retaillcommercial use with a proposed additional floor
area of approximately 1,653 square feet at 5351 and 5403
Santa Fe Avenue, in the Commercial-Industrial (C-M) Zone.
WHEREAS, the City Council by Resolution No. 6190
on January 5, 1993, granted a conditional use permit to
Sylvia Filippini for a retail commercial use (restaurant) of
approximately 1,170 square feet at 5351 Santa Fe Avenue in
the City of Vernon which has subsequently been operated as
II Treno Restaurant; and
WHEREAS, parking for said use is located on a lot
at 5415 Santa Fe Avenue subject to a recorded easement, and
said easement will be expanded to accommodate the increased
parking required by this permit; and
WHEREAS, a portion of the expanded restaurant and
parking will be located on the Ernest L. Rose property,
(Fred and Ellen Owen, trustees) one railcar of the
restaurant will sit on the Southern Pacific Transportation
property, another railcar of the restaurant will be situated
on the All American Trimming, Inc. property and a portion of
the parking will be located on the Feichtinger property

1 (Sylvester Feichtinger, trustee), which the owners of the
2 restaurant are currently leasing.
3 WHEREAS, the proposed use will generate more than
4 20 vehicle trips per day per 1,000 square feet of floor area
5 and requires a conditional use permit under Section 26.3.7-3
6 of the zoning code; and
7 WHEREAS, the size, shape, topography and drainage
8 of the parcels owned and leased are adequate for the
9 ~roposed operation; and
10 WHEREAS, the proposed site is surrounded by
11 industrial uses compatible with the proposed use and no
12 adverse effect from traffic, parking, noise, odors, dust,
13 smoke, light or glare, or risk of fire, infection or
14 ~xplosion is anticipated from the proposed operation; and
15 WHEREAS, the site has adequate access to Santa Fe
16 ~venue and 55th Street, and it is anticipated that traffic
17 will travel to the site from all directions. Santa Fe
18 ~venue and 55th Street have adequate capacity to handle the
19 ~raffic generated from the proposed operation; and
20 WHEREAS, there are no conditions imposed by State
21 ~r Federal laws; and
22 WHEREAS, the project was found to be categorically
23 exempt from the California Environmental Quality Act as an
24 existing facility pursuant to Section 15301 of the
25 California Environmental Quality Act Guidelines and a Notice
26 ~f Exemption shall be filed with the County Clerk per
27 Section 15062 of the California Environmental Quality Act
28 Guidelines.

1 WHEREAS, the conditions imposed on the conditional
2 use permit will adequately protect the public health, safety
3 and general welfare, and the operation is consistent with
4 all applicable rules and laws of the City of Vernon; and
5 WHEREAS, the proposed use is consistent with the
6 General Plan and the Comprehensive Zoning Ordinance of the
7 City of Vernon.
8 WHEREAS, the City Council of the City of Vernon
9 held a hearing on said application for a conditional use
10 permit on June 20, 1995.
11 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
12 JF THE CITY OF VERNON AS FOLLOWS:
13 SECTION 1: That the City Council of the City of
14 Vernon hereby finds and determines that the recitals
15 80ntained hereinabove are true and correct.
16 SECTION 2: The conditional use permit granted to
17 Sylvia Filippini pursuant to Resolution No. 6190 on January
18 5, 1993, is hereby cancelled.
19 SECTION 3: Subject to the conditions set forth
20 below the conditional use permit is hereby granted to Sylvia
21 ~ilippini dba: II Treno Restaurant for the expansion of a
22 ~etail/commercial use located at 5351 Santa Fe Avenue.
23 SECTION 4: In order to adequately protect the
24 public health, safety and general welfare the following
25 conditions are imposed:
26 a. The facility shall be operated in accordance
27 with all current codes, rules, regulations and subject to
28 permit fees as adopted by the City of Vernon. Prior to

1 occupancy an occupancy permit shall be obtained.
2 b. Pursuant to the City of Vernon Comprehensive
3 Zoning Ordinance, parking and loading spaces shall be
4 provided for both the restaurant and warehouse in accordance
5 with Vernon City Code Sections 26.4.2-6 and 26.4.2-7. All
6 ~arking and maneuvering areas, including the ingress and
7 egress shall be paved. An easement for ingress and egress
8 and vehicle parking on a lot located at 5415 Santa Fe Avenue
9 shall be submitted and approved by the City and recorded
10 prior to the issuance of building permits. All parking
11 shall be limited to the lot at 5403 and 5415 Santa Fe
12 ~venue.
13 c. II Treno Restaurant shall construct all
14 frontage improvements adjacent to the site along Santa Fe
15 ~venue as directed by the Acting Director of Community
16 Services. All work shall be performed to City standards and
17 shall be completed prior to occupancy.
18 d. Adequate trash receptacles shall be provided
19 ~n the site to keep litter to a minimum. All litter
20 associated with the operation of the restaurant, blown or
21 ~ropped on adjacent properties shall be retrieved and
22 ~isposed of daily by a restaurant employee.
23 e. Any expansion or change in use shall be
24 approved by the Acting Director of Community Services and
25 the Director of Environmental Health.
26 f. The parking, driveway access and landscaping
27 shall be developed in accordance with the site plan which
28 was submitted with this application and approved by the

1 Acting Director of Community Services. No changes shall be
2 made in the site development except with the prior approval
3 of the Acting Director of Community Services.
4 g. Upon termination of the leases for the use of
5 a portion of the Southern Pacific Transportation Company
6 property, the use of a portion of the Ernest L. Rose
7 property, the use of a portion of the Feichtinger property
8 and the use of a portion of the All American Trimming, Inc.
9 property, this conditional use permit shall terminate and
10 all restaurant improvements located on that property shall
11 be removed.
12 h. A Wrong Way/Do Not Enter sign shall be
13 maintained at the Santa Fe Avenue exit only driveway.
14 i. Two sets of complete plans for improvement
15 shall be submitted by August 1, 1995. The plans shall be
16 approved by the Community Services and Health Departments
17 prior to the start of construction.
18 j. The railcar shall be rodent-proofed. An
19 inspection shall be conducted by the Health Department,
20 prior to the installation of any equipment andlor seating,
21 to verify rodent-proofing.
22 k. All food preparation and storage equipment
23 shall be within the restaurant and shall be National
24 Sanitation Foundation (NSF) approved or its equivalent and
25 approved by the Health Department prior to installation and
26 use.
27 I. An equipment list with specifications, shall
28 be submitted to the Health Department for approval prior to

Gentlemen:
Sylvia Filippini dba: II Treno Restaurant, has applied for a
conditional use permit for the expansion of the restaurant at
5351 Santa Fe Avenue.
After review of the application by the Community Services
Department, it is recommended that the conditional use permit be
granted.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer's Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
In my opinion the proposed operation will pose no adverse
effects to the, City of Vernon and will have no significant
effects on the environment, and no mitigating measures are
required.
It is recommended that the City Council find that the
proposed use is categorically exempt from the California
Environmental Quality Act process.

Further it is recommended that a Notice of Exemption be
filed with the County Clerk and the conditional use permit be
granted with the following conditions:
a. The facility shall be operated in accordance with all
current codes, rules, regulations and subject to permit fees as

ENGINEER'S REPORT
FOR IL TRENO RESTAURANT'S
CONDITIONAL USE PERMIT AT
5351 SANTA FE AVENUE
June 15, 1995
II Treno Restaurant has applied for a conditional use permit
for the expansion of the restaurant. The restaurant, which is
located at 5351 Santa Fe Avenue, will be adding another railcar.
The additional square footage for the restaurant is 1,653, of
which 850 is within the railcar, 335 will be a deck located
adjacent to the railcar and the remaining 468 will be a portion
of the warehouse at 5403 Santa Fe Avenue. The additional seating
capacity will be approximately 45,
1. GENERAL PLAN The proposed use is in conformance with
the present Zoning Ordinance and the General Plan.
2. SITE The expansion will include a small portion of
additional railroad property on a neighboring property. The
property owner will obtain easements on adjacent lots located at
5403 and 5415 Santa Fe Avenue so that ingress, egress and parking
requirements can be met. With the easements the lots will be of
adequate size and shape for the proposed use.
3. ADVERSE AFFECT The site is surrounded by industrial and
commercial uses and the proposed use is compatible therewith, and
no adverse noise, odor, dust, smoke, light or glare, or risk of
fire, infection or explosion is anticipated,
4. ACCESS The site has access to Santa Fe Avenue, 80 feet
in width, and 55th Street, 60 feet in width. The restaurant will
be served by a one way driveway. It is anticipated that traffic
on Santa Fe Avenue will not be upset by the restaurant's
operation. Santa Fe Avenue has adequate capacity and pavement
type for the proposed operation.
5. VEHICLE MOVEMENTS They have estimated that an
additional 45 customers will be served at the restaurant daily,
15 at breakfast and 30 at lunch. Most customers will either be
generated from existing drive-by vehicles or people who are
currently traveling City streets to visit competing restaurants
outside of the City. It is therefore anticipated that any
increase in traffic will be small.
6. USE The site is currently occupied bya 28,000 square
foot warehouse and the existing restaurant. It is proposing t?
expand the restaurant on the site.
7. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with all
current codes, rules, regulations and subject to permit fees as
adopted by the City of Vernon, Prior to occupancy an occupancy
permit shall be obtained,
b. Pursuant to the City of Vernon Comprehensive Zoning
Ordinance, parking and loading spaces shall be provided for both
the restaurant and warehouse in accordance with Vernon City Code
Sections 26.4.2-6 and 26.4.2-7. All parking and maneuvering

areas, including the ingress and egress shall be paved, An
easement for ingress and egress and vehicle parking on a lot
located at 5415 Santa Fe Avenue shall be submitted and approved
by the City and recorded prior to the issuance of building
permits. All parking shall be limited to the lot at 5403 and
5415 Santa Fe Avenue.
c. II Treno Restaurant shall construct all frontage
improvements adjacent to the site along Santa Fe Avenue as
directed by the Acting Director of Community Services. All work
shall be performed to City standards and shall be completed prior
to occupancy,
d. Adequate trash receptacles shall be provided on the site
to keep litter to a minimum. All litter associated with the
operation of the restaurant, blown or dropped on adjacent
propert~es shall be retrieved and disposed of daily by a
restaurant employee.
e. Any expansion or change in use shall be approved by the
Acting Director of Community Services and the Director of
Environmental H~alth.
f. The parking, driveway access and landscaping shall be
developed in accordance with the site plan which was submitted
with this application and approved by the Acting Director of
Community Services. No changes shall be made in the site
development except with the prior approval of the Acting Director
of Community Services.
g. Upon termination of the leases for the use of a portion

of the Southern Pacific Transportation Company property, the use
of a portion of the Ernest L. Rose property, the use of a portion
of the Feichtinger property and the use of a portion of the All
American Trimming, Inc. property, this conditional use permit
shall terminate and all restaurant improvements located on that
property shall be removed.
h. A Wrong Way/Do Not Enter sign shall be maintained at the
Santa Fe Avenue exit only driveway.
i. Two sets of complete plans for improvement shall be
submitted by August 1, 1995. The plans shall be approved by the
Community Services and Health Departments prior to the start of
construction.
j. The railcar shall be rodent-proofed. An inspection
shall be conducted by the Health Department, prior to the
installation of any equipment and/or seating, to verify rodent-
proofing.
k. All food preparation and storage equipment shall be
within the restaurant and shall be National Sanitation Foundation
(NSF) approved or its equivalent and approved by the Health
Department prior to installation and use.
1. An equipment list with specifications, shall be
submitted to the Health Department for approval prior to
installation,
m. The restaurant shall comply with all requirements of the
California Uniform Food Facilities Law (CURFFL).

n. No additional area beyond the existing restaurant shall
be occupied or utilized until final approval is granted by the
Health Department.
o. Sylvia Filippini dba: II Treno Restaurant, shall
maintain a sales tax permit with the State Board of Equalization
bearing the City of Vernon tax number 19039 and a City of Vernon
Business License.
