RESOLUTION NO. 6644 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON DENYING A VARIANCE TO NORTH AMERICAN LAND AND LEASING CORP. FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 3620 SANTA FE AVENUE IN THE CITY OF VERNON WHEREAS, North American Land and Leasing Corp. owns a parcel of property located at 3620 Santa Fe Avenue in the City of Vernon and has requested a variance from conformance with Section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance; and WHEREAS, the building has been vacant for more than one year and Zoning Ordinance Section 26.4.6-7 requires the building to be brought into conformity with all regulations of the zone in which it is located; and WHEREAS, the building is proposed to be used for garment cutting and the existing building measures approximately 6,500 square feet and was constructed with two non-conforming truck loading spaces measuring 10.0 feet in width and 45.0 feet in length on a lot that measures 140 feet in length and 62.5 feet in width; and WHEREAS, Zoning Ordinance Section 26.4.2-7 (a) requires one truck parking space for industrial, manufacturing, and similar uses and Zoning Ordinance Section 26.4.2-7 (b) requires one truck loading space for buildings with a gross floor area under 8,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 ~ 24 25 26 27 28 < specifies that each truck loading and parking space shall be a minimum of 10 feet wide and 65 feet long; and WHEREAS, granting a variance from Zoning Ordinance section 26.4.6-7 to a building which has been vacant for a year would constitute a privilege which has not been granted to other such buildings, and a special privilege by variance is prohibited by Zoning Ordinance Section 26.5.1-3; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on August 1, 1995. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The request by North American Land and Leasing Corp. for a variance from section 26.4.2-8, Development Standards of the Comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long and having a 40 foot unobstructed maneuvering area in front of the loading space at 3620 Santa Fe Avenue is hereby denied. SECTION 3: The City Clerk of the city of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. The rules of statutory construction in Code of civil Procedure SS1858 and 1859 support this conclusion. Both sections have been held applicable to city charter and city ordinance provisions: In re Goodrich (1911) 160 Cal. 410; Dalton vs. Lelande (1913) 22 Cal.App. 41; Gualco vs. Bakersfield (1927) 86 CA 167; Neuber vs. Royal Realty CompanY (1948) 86 Cal.App.2d 96; Currieri vs. Roseville (1970) 4 Cal.App.3d 97; Squire vs. San Francisco (19~0) 12 Cal.App.3d 974; and Gilbert v. city of Los Anqeles (1973) 33 Cal.App.3d 1082. C.C.P. S1858 contains two provisos: (1) that a judge is "not to insert what has been omitted, or to omit what has been inserted" and (2) that the construction is to give effect to all provisions or particulars to the extent possible. C.C.P. S1859 also contains two provisos: (1) that the intention of the legislative body is to be pursued and (2) that when a general and a particular provision are inconsistent, the particular provision will control the general. A City of San Diego case provides guidance as to the interpretation of a technical definition. In city of San Dieqo vs. Atlas Hotels, Inc. (1967) 252 Cal.App.2d 591, the term "special tax" as contained in the City Charter was analyzed by the Court. The City Charter contained the provision: "no special tax shall be permitted except as a expressly authorized by this Charter." Atlas Hotels argued that this applied to a 4% transient room tax. Brearley, city Attorney July 28, 1995 Definition of "Truck" in Comprehe Ordinance with regard to the variance application by North American Van and Leasing, the meaning of the work "truck" in the zoning Ordinance has been questioned. The Vernon city Code section 26.2.16 contains definitions for "Truck, interstate" and "Truck, ~ standard," but the undefined term "truck" is used in Vernon City Code section 26.4.2-7 and 26.4.2-8 with regard to parking, loading, and maneuvering requirements. The generic word "truck" is not restricted by the specific definitions. 1. DEFINED TERMS. A comparison can be made to the California Vehicle Code which contains a generic definition for a "motor truck" in Vehicle Code S410: "A 'motor truck' or 'motortruck' is a motor vehicle designed, used, or maintained primarilY for the transportation of property." In addition to that definition, there are definitions for "gantry truck" (V.C. Sec. 335), "pickup truck" (V.C. Sec. 471), "tow truck" (V.C. Sec. 615) and vehicles used in combination with a "truck tractor" (V.C. Sec. 655) such as a "semi-trailer" (V.c. Sec. 550) or other types of trailers. As a general rule, vehicles are limited to a length of 40 feet (V.C. Sec. 35400) with exceptions for combination vehicles or buses. Combinations of vehicles are generally restricted to 65 feet (V.C. Sec. 35401(a)), although exceptions up to 75 feet are allowed. Another exception is provided for a combination I ,.) Sec. 35401.5(a)). This definition is cross-referenced in Vernon city Code section 26.2.16 under the definition of "Truck, interstate." The Vernon City Code definition for "Truck, standard" cross-references the aforementioned Vehicle Code S35401(a). Because the two Vernon City Code definitions are tied to the California Vehicle Code, they are clearly not comprehensive. For example, the~'differ from and do not include the generic definitions for "Motor truck" in Vehicle Code S410 or for "Pickup truck" in Vehicle Code S471. As another example, "Vehicle" is defined in Vehicle Code S670. This generic definition encompasses "Commercial vehicle" (V.C. S260) , "Farm labor vehicle" (V.C. S322), "Foreign vehicle" V.C. S330), "Logging vehicle" (V.C. S379), "Motor vehicle" (V.C. S415), "New vehicle" (V.C. S430), "Passenger vehicle" (V.C. S465), "Remanufactured vehicle" (V.C. S507.5), "Specially constructed vehicle" (V.c. S580), "Vanpool vehicle" (V.C. S668) and other vehicles such as a semitrailer: "A 'semitrailer' is a vehicle designed for carrying persons or property..." (V.C. S550). However, the reverse is not true. The Vernon City Code Section 26.2.16 contains definitions for "Truck, interstate" and "Truck, ~ standard," but the undefined term "truck" is used in Vernon City Code Section 26.4.2-7 and 26.4.2-8 with regard to parking, loading, and maneuvering requirements. The generic word "truck" is not restricted by the specific definitions. 1. DEFINED TERMS. A comparison can be made to the California Vehicle Code which contains a generic definition for a "motor truck" in Vehicle Code S410: "A 'motor truck' or 'motortruck' is a motor vehicle designed, used, or maintained primarily for the transportation of property." In addition to that definition, there are definitions for "gantry truck" (V.C. Sec. 335), "pickup truck" (V.C. Sec. 471), "tow truck" (V.C. sec. 615) and vehicles used in combination with a "truck tractor" (V.C. Sec. 655) such as a "semi-trailer" (V.C. Sec. 550) or other types of trailers. As a general rule, vehicles are limited to a length of 40 feet (v.C. Sec. 35400) with exceptions for combination vehicles or buses. Combinations of vehicles are generally restricted to 65 feet (V.C. Sec. 35401(a)), although exceptions up to 75 feet are allowed. S1859 also contains two provisos: (1) that the intention of the legislative body is to be pursued and (2) that when a general and a particular provision are inconsistent, the particular provision will control the general. A City of San Diego case provides guidance as to the interpretation of a technical definition. In City of San Dieao vs. Atlas Hotels. Inc. (1967) 252 Cal.App.2d 591, the term "special tax" as contained in the City Charter was analyzed by the Court. The City Charter contained the provision: "no special tax shall be permitted except as a expressly authorized by this Charter." Atlas Hotels argued that this applied to a 4% transient room tax. Malkenhorst City Clerk BVM/hr * , ENGINEER'S REPORT NORTH AMERICAN LAND AND LEASING CORP. 3620 SANTA FE AVENUE VARIANCE APPLICATION JUNE 22, 1995 North American Land and Leasing Corp. has requested a variance from the Comprehensive Zoning Ordinance Section 26.4.2- 8, Development standards, for the property located at 3620 Santa Fe Avenue in the City of Vernon. The building on the site has been vacant for more than one year. The building was constructed with two non-conforming truck loading spaces measuring 10.0 feet in width and 45.0 feet in length. North American Land and Leasing Corp. has stated that they will remove one of the docks and provide required automobile parking. Only vehicles of smaller lengths will be utilized at the remaining non-conforming truck loading space. Access for all truck loading and automobile parking is provided from Violet Alley. The building is proposed to be used for garment cutting and is approximately 6,500 square feet in size. The building will be brought into conformity with all other regulations of the zone in which it is located. Section 26.4.2-7 (b) requires one truck loading space for buildings with a gross floor area under 8,000 square feet in size. Section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and section 26.4.2-7 (e) requires ..~ all truck loading spaces to have 40 foot unobstructed maneuvering area in front of the loading space. North American Land and Leasing Corp. has indicated that requiring the non-conforming truck loading and parking spaces to be 65 feet long by 10 feet wide with a forty foot onsite maneuvering area would be a hardship. The lot dimensions are 62.5' x 140'. On such a small lot the truck maneuvering requirements cannot be met. The building would have to either be combined with a neighboring property, utilized by an operation that does not require truck parking, such as an office use or demolished in order to bring it into full compliance. North American Land and Leasing Corp. has indicated that it has no plans for expansion or alteration of the building configuration. The proposed operation is in conformance with the Zoning Ordinance and General Plan. The Comprehensive Zoning Ordinance does allow fora variance to be granted based on lot size and shape. Unfortunately upon field review and surveying of the lot it has been determined that there is not adequate room to provide the required automobile and truck parking. Since the building cannot be brought up to full compliance with the City code, with the exception of truck maneuvering and truck loading and parking lengths, it is recommended the variance be denied. ~ June 22, 1995 TO: FROM: Bruce V. North American and its related corporate predecessor have owned the property at 3620 Sante Fe in the City of Vernon for more than 13 years. During that period the property has been used for a variety of purposes within the general industry zoning applicable to the property (M. zone). However, in recent years, because of a sluggish economy, it became more and more difficult to lease the property. Accordingly, though it was listed and actively marketed through brokers for lease or sale, the property remained vacant for more than one year. North American has now been successful in finding a buyer who wishes to acquire the property for. use in its garment cutting operations. This transaction has been in escrow for some time pending the determination of the problems that have arisen from the City's imposition of its 1989 Comprehensive Zoning Ordnance to the property by reason of its vacancy for more than one year. The application of the ordinance results in making the building non-conforming. Because the property is small and the building occupies more than 70% of the surface area, it is not possible for the property to meet the requirements of the 1989 Ordinance in three respects: a. Truck Loading (Sec. 26.4.2M7(b)): The loading dock is only 46' from the alleyway servicing the property and the ordinance requires 65'. c. Truck Maneuvering: The property is serviced by a 17' wide alley and cannot meet the requirements for truck maneuvering. Sec. 26.4.6.4(d) of the Ordinance specifically recognizes the problems that might arise by requiring existing facilities to meet these access, loading and off-street parking requirements. It permits the City Council by variance to relieve the occupant of all or part of the off -street parking, access and loading requirements if the City Council determines: a. The strict application of the off. street parking, access and loading requirements creates an unreasonable hardship; b. The existing use does and will not adversely affect the surrounding area; and c. The use does not require the number of spaces and/or area specified in the ordinance. Each of these criteria are clearly met by our client's property. Strict application would require that the existing building (which is in excellent condition and repair) be torn down and this constitutes an unreasonable hardship where, as here, the building is a perfectly serviceable structure. The use as a garment cutting operation clearly is within zoning, is consistent with prior usage and would not adversely affect the surrounding area. Finally, the garment cutting operation does not use semi truck-trailers and therefore does not require the truck parking and maneuvering area set forth in the ordinance. For these reasons, the staff originally recommended approval of the variance to the Council when it was first heard on June 20. However, you raised at that time a concern that notwithstanding the express provisions of the ordinance permitting a variance in these circumstances, a survey should be conducted to determine how many properties are similarly situated. Accordingly, the matter was put over for completion of the survey. We understand your position to be that based on the survey, the Council should deny the variance, even though it meets the criteria of Sec. 26.4.6-4(d), because to grant it would potentially establish a precedent for others similarly situated (in which category the survey's conclusions indiCate there in excess of 200 parcels), and that, accordingly, any relief ought to be by way of consideration of appropriate amendment to the ordinance. Regrettably this form of relief will, if it occurs, come too late to save the existing purchase transaction. Only recently did we receive a copy of the survey and, therefore, request the opportunity to speak to its conclusions and the premise behind the staff changing its recommendation from approval of the variance to that of denial. In our view, simple fairness and the Brown Act require that we be given that opportunity. From discussion with the staff and our client's broker who is very knowledgeable with respect to properties in the area, we are convinced that there are a maximum of 10 other properties which have been made subject to the ordinance by reason of being vacant for a year and that all but one of these are abandoned, derelict structures which will need to be tom down in any event. We think the proper comparison is with these handful of properties and not with all of the potentially non-conforming properties in the City which the survey apparently included. Accordingly, while we can appreciate your legal concerns, we do not believe that an improper precedent will be established if the variance is granted. Certainly this is true if the amendment to the ordinance contemplated is in fact shortly proposed and adopted. On the other hand, our client will suffer unreasonable hardship by a delay to accommodate a possible amendment to the ordinance because they have a sale in escrow to a user which will be terminated if the right to use the property cannot be promptly obtained. It took many months to find a buyer for this parcel and if this transaction is terminated, we anticipate that the building could again fall vacant for a substantial period of time. Malkenhorst ~ City Administrator/City Clerk * Ir' y ~ " ENGINEER'S REPORT NORTH AMERICAN LAND AND LEASING CORP. 3620 SANTA FE AVENUE VARIANCE APPLICATION JUNE 15, 1995 North American Land and Leasing Corp. has requested a variance from the Comprehensive Zoning Ordinance section 26.4.2- 8, Development Standards I for the property located at 3620 Santa Fe Avenue in the City of Vernon. The building on the site has been vacant for more than one year. The building was constructed with two non-conforming truck loading spaces measuring 10.0 feet in width and 45.0 feet in length. North American Land and Leasing Corp. has stated that they will remove one of the docks and provide required automobile parking. Only vehicles of smaller lengths will be utilized at the remaining non-conforming truck loading space. Access for all truck loading and automobile parking is provided from Violet Alley. The building is proposed to be used for garment cutting and is approximately 6,500 square feet in size. The building will be brought into conformity with all other regulations of the zone in which it is located. section 26.4.2-7 (b) requires one truck loading space for buildings with a gross floor area under 8,000 square feet in size. section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and section 26.4.2-7 (e) requires - . , all truck loading spaces to have 40 foot unobstructed maneuvering area in front of the loading space. North American Land and Leasing Corp. has indicated that requiring the non-conforming truck loading and parking spaces to be 65 feet long by 10 feet wide with a forty foot onsite maneuvering area would be a hardship. The lot dimensions are 62.5' x 140'. On such a small lot the truck maneuvering requirements cannot be met. The building would have to either be combined with a neighboring property, utilized by an operation that does not require truck parking, such as an office use or demolished in order to bring it into full compliance. North American Land and Leasing Corp. has indicated that it has no plans for expansion or alteration of the building configuration. The proposed operation is in conformance with the zoning Ordinance and General Plan. The zoning code does allow for a variance to be granted based on lot size and shape. If this was a vacant lot and a new building were to be proposed a variance would be sought. Therefore, it is recommended that the variance be granted with the following conditions: (ay the usage of the non-conforming truck loading space shall be limited so that no .truck parked at the loading dock shall extend into the existing street right-of-way as shown on the Master Plan of streets, dated June 16, 1992; (b) all existing and future tenants shall be notified of this restriction and a condition stating this shall be placed in all future leases; (c) the building shall be brought into conformance with all current City codes and regulations with - , ~ the exception of truck parking, loading and maneuvering requirements; and (d) the most northerly existing loading space shall be removed and replaced with automobile parking.
