Resolution No. 6661 , ,. ,; .. 1 RESOLUTION NO. 6661 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF PROGRAM SUPPLEMENT NO. 007 TO STATE-LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP-5139 BY AND BETWEEN THE CITY OF VERNON AND THE STATE OF CALIFORNIA, ACTING BY AND THROUGH THE DEPARTMENT OF TRANSPORTATION 4 5 6 WHEREAS, the state of California and the City of Vernon entered into a State-Local Entity Master Agreement (state-Local 7 8 Partnership No. SLTPP-5139 for State Program) Transportation 9 matching funds on November 19, 1991; and 10 11 WHEREAS, the City of Vernon desires to enter into Program Supplement No. 007 to said Master Agreement to cover state matching 12 funds in the City of Vernon for street reconstruction and 13 resurfacing of portions of 50th Street and 52nd street, which were 14 nominated for partial funding under Cycle 5 of said partnership 15 16 17 program; and WHEREAS, the estimated cost of the improvements under supplement No. 007 is $146,092.00, with the city's share being $117,823.00 and the state's share being $28,269.00; and 18 19 WHEREAS, the Acting Director of Community Services has 20 recommended that Program Supplement No. 007 to said Agreement be 21 approved. 22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 23 CITY OF VERNON AS FOLLOWS: 24 SECTION 1: The City Council of the City of Vernon hereby 25 26 finds and determines that the recitals contained hereinabove are true and correct. 27 SECTION 2: The City Council of the City of Vernon hereby 28 approves Program Supplement No. 007 to State-Local Transportation , , , 1. 1 Partnership Program Agreement No. SLTPP-5139, a copy of which has 2 been presented to the city Council concurrently with this 3 resolution, and the City council hereby orders said Program 4 supplement to be received and filed by the City Clerk. 5 SECTION 3: The City Council of the City of Vernon hereby 6 authorizes the Mayor and the City Clerk to execute said program 7 supplement for, and on behalf of, the City of Vernon. 8 SECTION 4: the city Administrator/City Clerk is hereby 9 instructed to return two executed copies of Program supplement 10 No. 007 together with two certified copies of this resolution to 11 satish Chander, Chief, Local streets and Roads Branch, Department of 12 Transportation, District 7, 120 s. spring st., Los Angeles, CA 13 90012-3606. 14 SECTION 5: The City Clerk of the City of Vernon shall 15 certify to the passage of this resolution, and thereupon and 16 thereafter the same shall be in full force and effect. 17 APPROVED AND ADOPTED this 1st day of August, 1995. 18 ~ · , ;:J. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for the mutual benefit of both parties, in order to avoid program and fiscal delays that would occur if the agreement were executed after that determination was made . The total amount of State-Local Transportation Partnership funds payable by the State shall not exceed $28269 to be encumbered and reimbursed as follows : FY 94-95 $ 28269 FY 95-96 0 FY 96-97 0 Any increase in State Partnership funds will require a revised program supplement . Any decrease in State Partnership funds will require a revised finance letter. 2 . The State Funds Share is calculated based on the lower of the approved eligible application amount or the eligible award amount . 3 . SPECIAL COVENANTS FOR SLTPP PROJECTS UNDER EARLY REIMBURSEMENT PLAN AND UNDER $300 , 000 STATE SHARE These Covenants supersede any conflicting provisions of the Master Agreement : A. The LOCAL ENTITY agrees that the payment of State Share Funds will be limited to the lessor of the product of multiplying the calculated pro rata percentage as determined by the STATE by either: (a) The eligible award amount or (b) The total eligible State/Local Partnership Project cost in the approved State/Local Partnership Program Application and accepts any consequent increase in LOCAL ENTITY funding requirements . B . The LOCAL ENTITY will invoice the State for the full "State ' s Share" after the contract award or upon the State Budget Act appropriation of funds, whichever occurs later. "State ' s Share" is considered a grant and will be reimbursed as a lump sum payment regardless of final project cost . Prior to reimbursement under this Program Supplement , a Request For Early Reimbursement form, executed by the LOCAL ENTITY, must be on file with the STATE . D. The financial audit and Final Project Expenditure Report provisions of Sections 9 and 10 of ARTICLE I of the Master Agreement are not applicable to this PROJECT. 4 . The Reimbursement Ratio for this Cycle 5 (94/95) Project is 19 . 35% . 5 . In accordance with the State-Local Transportation Partnership Program Guidelines dated June 8 , 1994 the project eligibility for Cycle 5 projects is limited to contract items plus locally funded State or Local Entity furnished materials and Supplemental Work. Supplemental Work eligibility is futher defined under the Project Eligibility section of the Guildelines as limited to certain maximum costs and to non-early reimbursement projects of $300 , 000 or less . The City has scheduled the resurfacing of portions of 50th and 52nd Streets. These streets were nominated for partial funding under Cycle 5 of this program, and the City may be eligible to receive approximately $28,269 towards the construction costs. This has been reviewed by the Acting Director of Community Services and the City Attorney, and it is hereby recommended that Supplement No. 007 be approved and executed.
