RESOLUTION NO,. 6663

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE
EXECUTION OF PUBLIC IMPROVEMENTS AGREEMENT
NO. 13 BY AND BETWEEN THE CITY OF VERNON AND
PACIFIC APPAREL XPRESS, INC.

WHEREAS, PACIFIC APPAREL XPRESS, INC. has applied for an
7
occupancy permit to utilize the premises located at 3228 50th
8
street, Vernon, California; and
9
WHEREAS, a temporary occupancy permit was issued by the
City of Vernon to PACIFIC APPAREL XPRESS, INC. which requires the
10

company to install or have installed street improvements on said
12
50th Street; and
13
WHEREAS, the City of Vernon has entered or will enter
into a contract for other street improvements on said 50th street;
14
and
15

WHEREAS, the actual cost of such street improvements
will depend on the amount or amounts set forth in the street
18
improvement contract, and
19
WHEREAS, PACIFIC APPAREL XPRESS, INC. has agreed to pay
20
to the City of Vernon its proportionate share of the cost of such
21
improvements, including driveway, sidewalk, curb and gutter, in
22
the amount of Twelve Thousand Dollars and No Cents ($12,000.00);
23
and
24

WHEREAS, if the actual cost of said improvements exceeds
$12,000.00, PACIFIC APPAREL XPRESS, INC. will be billed for the
26
balance, or if the actual cost of said street improvements is less
27
than $12,000.00, the balance shall be refunded to PACIFIC APPAREL
28
XPRESS, INC.; and

1 WHEREAS, PACIFIC APPAREL XPRESS, INC. and the city of
2 Vernon desire to enter into an agreement setting forth the terms
3 and conditions for the construction and installation of street
4 improvements between Boyle Avenue and Alcoa Avenue and adjoining
5 50th street; and
6 WHEREAS, said improvements on 50th Street will benefit
7 the health, safety and welfare of the residents and business
8 population of the City.
9 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
10 THE CITY OF VERNON AS FOLLOWS:
11 SECTION 1: The City Council of the City of Vernon
12 hereby finds and determines that the recitals contained
13 hereinabove are true and correct.
14 SECTION 2: The City Council of the city of Vernon
15 hereby approves Public Improvement Agreement No. 13, a copy of
16 which has been presented to the City Council concurrently with
17 this resolution, and the City Council hereby orders said Agreement
18 to be received and filed by the City Clerk.
19 SECTION 3: The City Council of the City of Vernon
20 hereby authorizes the Mayor and the City Clerk to execute said
21 Agreement for, and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.
4 APPROVED AND ADOPTED this 1st day of August, 1995.
