A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON GRANTING A CONDITIONAL USE PERMIT
TO CASTROL INDUSTRIAL NORTH AMERICA, INC.
FOR THE OPERATION OF A PETROLEUM RELATED USE
5511 DISTRICT BOULEVARD
AT
WHEREAS, Castrol Industrial North America, Inc.
permit to operate a petroleum related use at 5511 District
Boulevard; and
WHEREAS, Castrol currently operates an existing
facility at the subject site and is proposing to make
11 modifications and upgrades to certain existing bulk storage,
12 Ihandling and blending facilities as shown on Exhibit "A" as
13 ~ttached hereto and made a part hereof by reference; and
14 WHEREAS, the City Council of the City of Vernon
15 held a hearing on said application for a conditional use
16 ~ermit on August 1, 1995; and
17 WHEREAS, the proposed site is a conforming use in
18 ~he General Industrial (M) Zone which requires a conditional
19 use permit under the Zoning Ordinance; and
20 WHEREAS, the proposed site is approximately 0.84
21 acres in size, and contains buildings, structures and
22 facilities as shown on Exhibit "A". The size, shape and
23 topography of the parcel is adequate for the proposed
24 operation; and
25 WHEREAS a barrier wall or landscaping will be
26 installed where parking areas adjoin a public street
27 pursuant to the Vernon City Code; and
28 WHEREAS, the proposed site is surrounded by

1 industrial distribution type uses compatible with the
2 proposed use and no adverse effect from traffic, parking,
3 noise, odors, smoke, light or glare, or risk of fire,
4 infection, explosion or effects on wildlife resources are
5 anticipated from the proposed operation; and
6 WHEREAS, the site has access to District Boulevard
7 and to the freeway, and the streets have adequate capacity
8 and pavement type for the proposed use; and
9 WHEREAS, the site is required to have adequate
10 offstreet parking and loading facilities in accordance with
11 the Vernon City Code; and
12 WHEREAS, the Community Services Department has
13 performed an Initial Study to determine the potential
14 adverse impacts to the environment that the proposed project
15 may cause and has determined that the proposed project will
16 not have a significant effect on the environment in this
17 case because of mitigating measures. The Acting Director of
18 Community Services & Water has recommended that a Negative
19 Declaration be adopted in compliance with the California
20 Bnvironmental Quality Act; and
21 WHEREAS, the mitigating measures and the
22 conditions imposed on the conditional use permit will
23 adequately protect the public health, safety and general
24 welfare and the operation is consistent with all applicable
25 rules and laws of the City of Vernon; and
26 WHEREAS, the proposed use as to location,
27 operation, and design is consistent with the General Plan
28 and the Zoning Ordinance of the City of Vernon.

1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
2 OF THE CITY OF VERNON AS FOLLOWS:
3 SECTION 1: The City Council of the City of Vernon
4 hereby finds and determines that the recitals contained
5 hereinabove are true and correct.
6 SECTION 2: The City Council hereby approves and
7 adopts the Negative Declaration for the project and hereby
8 finds that the project will not individually or cumulatively
9 have an adverse effect on the environment including the
10 ~ildlife resources.
11 SECTION 3: Pursuant to Section 711.4(c) of the
12 Fish and Game Code, the City has found no evidence that the
13 proposed project will have the potential for adverse effects
14 :m wildlife resources and the project is therefore exempt
15 from the fees otherwise payable under Section 711.4.
16 SECTION 4: Subject to the mitigation measures and
17 conditions set forth below, the conditional use permit is
18 ~ranted to Castrol for the operation of a petroleum related
19 use at 5511 District Boulevard.
20 SECTION 5: In order to adequately protect the
21 public health, safety and general welfare the following
22 mitigating measures are required:
23 A. Castrol Industrial North America, Inc. shall
24 provide secondary containment for all stored hazardous
25 materials.
26 B. Castrol Industrial North America, Inc. shall
27 have onsite spill response resources. Castrol Industrial
28 North America, Inc. shall contract at all times with a

1 private firm to provide emergency spill response services.
2 c. Castrol Industrial North America, Inc. shall
3 submit for approval by the Vernon Health Department an
4 Emergency Response Action Plan and a Facility Response Plan.
5 These plans shall be updated as necessary
6 D. A hazardous materials inventory and
7 businesslcontingency plan shall be submitted and a hazardous
8 ~aterials permit shall be obtained from the City of Vernon
9 ~ealth Department. Only those substances approved by the
10 ~ealth and Fire Departments shall be stored, used or handled
11 at the site. Hazardous materialslwastes shall be handled
12 and managed in compliance with all appropriate federal,
13 state and local laws.
14 E. A National pollutant Discharge Elimination
15 System Permit shall be obtained from the California State
16 ~oard of Water Resources.
17 SECTION 6: The City Council hereby approves (1)
18 ~itigation Monitoring Program for Castrol Industrial North
19 America, Inc. a Petroleum Related Use, dated July 26, 1995,
20 (2) City of Vernon Community Services Department Engineer's
21 Report on Castrol Industrial North America, Inc. Conditional
22 Use Permit to Operate a Petroleum Related Use at 5511
23 District Boulevard, dated July 20, 1995, and (3) the Initial
24 Study and Checklist for the project, dated June 28, 1995.
25 Copies of said documents have been submitted to the City
26 Council concurrently herewith, and the City Clerk is
27 directed to receive and file them.

1 SECTION 7: In order to insure that the operation
2 will be in harmony with its neighboring properties and will
3 meet City Codes the following conditions are imposed upon
4 Castrol:
5 a. The facility shall be operated in accordance
6 with all current codes, rules, regulations and subject to
7 ~ermit fees as adopted by the City of Vernon. The facility
8 shall be operated in a manner that will prevent unsanitary
9 conditions, odors or other nuisances. A business license
10 and occupancy permit shall be maintained.
11 b. Class I and Class II liquids shall not be
12 stored in above ground tanks.
13 c. All parking and loading facilities shall be
14 paved with a hard durable surface material and shall be
15 adequately drained, and kept free of dust, mud, trash and
16 weeds. Where parking or maneuvering areas adjoin the public
17 street a barrier wall or landscaping shall be installed and
18 maintained to meet City standards.
19 d. Plans for improvements to the facility and
20 construction of structures shall be submitted to both the
21 City of Vernon's Community Services and Health Departments
22 for review and approval.
23 e. All required federal, state, local and
24 regulatory agency permits shall be obtained and maintained.
25 f. The facility's buildings shall be structurally
26 maintained to exclude rodents and the property shall be
27 maintained rodent free.
28 g. Castrol shall repair any broken, cracked or

1 displaced sidewalk, curb or gutter adjoining the site.
2 h. Castrol shall obtain rights for ingress and
3 egress from the Los Angeles Junction Railway Company for the
4 property to the south of the facility.
5 i. Castrol shall perform the mitigating measures
6 set forth herein and in the Mitigation Monitoring Program,
7 Castrol Industrial North America, Inc. Petroleum Related Use
8 dated July 26, 1995.
9 SECTION 8: Castrol and any successors in
10 interest, shall indemnify, hold harmless, and defend the
11 City of Vernon, its officers, agents, and employees from and
12 ~gainst any and all claims, complaints, or petitions for:
13 (1) damages, losses, expenses resulting from bodily injury,
14 sickness, disease, disability or death arising from the
15 ~peration of the facility excluding therefrom any such claim
16 resulting from the gross negligence or intentional
17 wrongdoing of the City of Vernon, its officers, agents or
18 employees; (2) a peremptory writ or other relief by way of
19 injunction, mandamus, or administrative mandamus; or (3)
20 legal expenses and attorney's fees incurred by the City of
21 Vernon or awarded against the City of Vernon on behalf of
22 any party in such a proceeding. The City of Vernon does not
23 waive its right to participate in the defense of any such
24 action.

PROJECT DESCRIPTION: Castrol Industrial North America, Inc.
currently operates a facility at 5511 District Boulevard. The
operation of the facility includes the storage, blending and
distribution of oils. They propose to modify and upgrade the
facility. Upgrades will include the replacement of bulk storage
tanks, modifi~ations to plant equipment and handling facilities.
The subject site is located in the M zone (General Industrial). A
conditional use permit is required per the City of Vernon
Comprehensive Zoning Ordinance.
FINDINGS: The City of Vernon has determined that the
project could have some adverse effect on the environment.
Therefore, the following Mitigation Measures are required as part
of the permit application. The requirements are designed to ensure
protection of public health and the environment.
A. Castrol Industrial North America, Inc. shall provide
secondary containment for all stored hazardous materials.
B. Castrol Industrial North America, Inc. shall have onsite
spill response resources. Castrol Industrial North
America, Inc. shall contract at all times with a private
firm to provide emergency spill response services.
C. Castrol Industrial North America, Inc. shall submit for

INTRODUCTION
Castrol Industrial North America, Inc. has submitted a conditional use
permit application to the City of Vernon requesting permission to modify and
operate a petroleum related use.
This Initial Study has been prepared to determine if the upgrade and
operation of this facility will have a significant effect upon the environment.
This study has been prepared in accordance with the California Environmental
Quality Act (CEQA). The City of Vernon will use this Initial Study as a basis
for deciding whether to prepare an Environmental Impact Report (EIR) or approve
a Negative Declaration.
PROJECT LOCATION AND EXISTING LAND USE
The existing facility is located at 5511 District Boulevard in the City of
Vernon. The project site is surrounded by Industrial and Distribution type
uses. The nearest residential dwelling is located approximately 295 feet south
of the site. The attached vicinity map depicts the local vicinity and shows the
relationship of the facility to major highways in the Los Angeles area. The site
is zoned M, General Industrial, and a petroleum related use is allowed in this
area with a conditional use permit.
PROJECT DESCRIPTION
This site has operated as a blending and packaging plant at the present
location for over 60 years. In order to increase the efficiency and modernize
the facility to offer quality product, Castrol Industrial North America, Inc.
proposes to upgrade the condition of certain existing bulk storage and handling
and blending facilities. The major focus of the upgrade is to substantially
improve the plant's ability to safely handle and store bulk petroleum products
and to comply with current NPDES requirements.
Over the past five years, several underground and above ground tanks have
been removed from the facility. Two 5,000 gallon above ground tanks will be
relocated. Four 5,000 gallon above ground tanks will be removed and replaced by
two 7,000 gallon tanks, two 9,000 gallon tanks and two 20,000 gallon tanks. The
tanks and containment will be installed according to current code requirements.
There is an existing tank farm on the east side of the property consisting of
fifteen 13,250 gallon tanks.
Removal of the tanks will increase the loading areas, thus increasing the
ability to maneuver the bulk delivery trucks and the safety of the workers.
Spill containment during loading operations will be improved by providing
concrete paving and curbs. The two existing driveways on District Boulevard will
be narrowed to allow for additional parking areas. Castrol Industrial North
America, Inc. will obtain an easement from L.A. Junction Railway Company for
ingress and egress on the railroad right-of-way to the south of the building.
By obtaining this easement the flow of traffic on the property will improve.
Trucks will no longer need to back in from District Boulevard. Trucks will be
able to enter from District Boulevard and exit onto Heliotrope Avenue.
MITIGATION MONITORING
Public Resources Code Section 21081.6 requires that agencies adopt a
monitoring or reporting program for any project which it has made findings
pursuant to Public Code 21081 or adopted a Negative Declaration pursuant to
Section 21080(c). The mitigating measures identified in this initial study, if
adopted as part of a Negative Declaration as anticipated, must be monitored for

implementation per Public Resource Code Section 21081.6.
If the project is approved as proposed, the permit issued by the City of
Vernon will, when appropriate, specify a schedule of compliance for all
mitigating measures imposed in the project approval package. The City will
routinely conduct inspections and investigations at the facility for compliance
with permit requirements.

XXII DISCUSSION OF ENVIRONMENTAL EVALUATION
1) EARTH AND WATER RESOURCES
The topography of the City of Vernon is relatively level.
Although there are no known earthquake faults in the City, Vernon
is in a seismically active region and several faults in the area
are likely to cause moderate groundshaking in Vernon. The
modifications at the facility will require some minor grading for
the installation of tank footings. This grading will not cause
any changes to the geologic substructure, change in topography,
covering of any unique geologic or physical features, any
increase in wind or water erosion to the soil or any changes in
deposition. Since the ground is relatively level landslides and
mudslides are unlikely.
2) AIR QUALITY
The City of Vernon lies in the middle of the Los Angeles
coastal plain. The coastal plain has a semi-marine micro-
climate, which is characteristic of areas which are behind the
fog belt but constantly under the ocean's influence. Winters are
seldom cold and frost is rare. Spring days may be cloudy due to
high fog and summers are warmer than along the coast.
Winter temperatures are lower than a marine climate and
there is less fog in summer. The annual average daytime
temperature ranges from 84.10F in August to 66.60F in January.
Nighttime temperatures vary from 64.40F in summer to 48.40F in
winter. The average annual rainfall in the City is 14.85 inches
and occurs from late October to early April.
The City of Vernon is located within the South Coast Air
Basin of California. The basin covers a 6,600-square mile area
within Orange County, non-desert portions of Los Angeles County,
Riverside County, and San Bernardino County. Air quality in the
basin is monitored by the South Coast Air Quality Management
District (SCAQMD) at 35 monitoring stations throughout the area.
The monitoring station nearest to the City of Vernon is the Pico
Rivera station. Readings at the station are used to characterize
air quality in the City of Vernon.
The South Coast Air Basin, in general, has not attained
national and state standards for ozone, carbon monoxide, nitrogen
dioxide, and PM. Comparison with national and state standards
for these contaminants show that readings at the Pico Rivera
station have maximum ozone concentrations that are 2 to 3 times
the state standard and exceedances occur lout of every 3 days.
Carbon monoxide concentrations have not exceeded established
standards and nitrogen dioxide concentration rarely exceed state
or federal standards. Total suspended particulates have exceeded
the state standard but not the federal standard. Ambient levels
of PMIO are not monitored at the Pico Rivera station, so the Los
Angeles station is used for these readings. The readings
exceeded the state standard in 50 to 63 percent of the samples
but are generally less than the federal standard.
Castrol Industrial North America, Inc. currently occupies
the site and is proposing to make minor modifications to the
existing facility. At this time they are not required to have an
Air Quality Permit from the South Coast Air Quality Management
District. The proposed modifications will not change this permit
status. The modifications will include the upgrading of tanks,
upgrades to the blending process, and upgrading of the loading
facilities. No change in air emissions or ambient air quality is
anticipated as a result of the modifications. The project will
not cause any odors or any alterations to air movements or
climate.
3) WATER QUALITY
Groundwater resources in the City of Vernon consist of
inter-layer bedrock and aquifers, as found in the central Los
Angeles basin. There are no surface water bodies within the
vicinity of the project. No changes in water currents,
movements, absorption rate flood flows or drainage patterns will
occur as a result of the project. The project will not cause any
degradation to the groundwater quality and will not cause any
change in the quantity available.
Site improvements will include the construction of
containment areas. With these containment areas, the potential
of runoff from leaks or tank failures into surface waters is
minimal.
4) BIOLOGICAL RESOURCES
The City of Vernon is urbanized and plant life is limited to
non-native, introduced and ornamental species which are used for
landscaping. Existing vegetation typically found in the City
consists of street trees, grass and other vegetation commonly
used in landscaping. Animal life in Vernon and nearby urban
communities consists of bird, reptile and mammal species that
live in close proximity to man. There are no endangered animal
species in the City.
5) NOISE
The noise environment within the City is dominated by
traffic noise. The project site is located in an industrial area
already subject to relatively high ambient noise levels. The
noise generated by the facility will not cause a significant
effect on the environment.
6) LIGHT AND GLARE
The project, as proposed, will provide outside lights for
work during the night time hours. The site is located in an
industrial area and lighting of facilities is common, therefore
no impacts from light are anticipated. The project as proposed,
will create no glare.
7) LAND USE
The project area is zoned General Industrial, M. A
petroleum related use is allowed in this zone with a conditional
use permit. The City of Vernon is primarily made up of
industrial and distribution type facilities. The project site is
not located near any sensitive sites. The nearest residential
unit is 295 feet from the project's boundary. The site is
surrounded by compatible uses.
8) NATURAL RESOURCES
There are no natural resource extraction activities in or
near the City. Castrol Industrial North America, Inc. will blend
and distribute domestic oils imported from outside of the area.
The plant will only slightly increase in capacity as a result of
the upgrades. Therefore no significant impact to natural
resources is anticipated as a result of the operation.
9) RISK OF UPSET
All facilities within the City are regularly inspected by
the Vernon Fire and Health Departments for code violations. The
inspections are made to reduce the potential for urban fires and
chemical releases. The Vernon Fire Department has a fully manned
hazardous materials unit. All personnel are trained in hazardous
material response. The Castrol Industrial North America, Inc.
facility is routinely inspected annually. No significant
violations at the facility have been documented. The proposed
modifications at the facility will enhance the safety of the
facility. Containment areas will be constructed around the tank
farms. The vast majority of all shipments consist of high flash
point lubricants. The existing facility has had a very good
record in the handling of its hazardous materials.
The routing for nearly all shipments is: West on District
Boulevard, north on Atlantic Boulevard to Long Beach Freeway or
to the Castrol warehouse in Commerce.
The plant maintains on-site spill response resources for
smaller spills. Contracted response resources and equipment
would be made available for larger or worst case discharges.
Castrol Industrial North America, Inc. has contracted with
Evergreen Oil to provide immediate spill response capability for
larger spills.
10) POPULATION AND HOUSING
The population of the City of Vernon is approximately 90,
with up to 50,000 people working in the City. Castrol Industrial
North America, Inc. operates an existing facility employing
approximately 19 people. The proposed modifications will not
result in any increase in employment. Therefore no change in
population or housing will occur as a result of the project.
11) TRANSPORTATION/CIRCULATION
Several freeways serve Vernon. To the north is the Santa
Ana (I-5), Santa Monica (1-10) and the Hollywood (1-101)
freeways, to the west is the Harbor Freeway (I-I10), and to the
east is the Long Beach Freeway (1-710). Vernon has several
arterials which bisect the City. The site has access to District
Boulevard which is 47 feet in width at this location.
Approximately 10 trucks enter and exit the site a day. The
vehicles travel to the site at various times and are not
concentrated during anyone hour. The facility does not receive
any of its products by railroad tank cars at this time, but
variations in the future economic climate could require it in the
future. The volume of vehicles entering and exiting the site
will remain relatively the same after the upgrade of the
facility. The streets in the general area have adequate capacity
for the operation and are currently operating at acceptable
levels. The truck volume is negligible when compared to volumes
currently operating on Vernon streets. The trucks generally
travel west from the site on District Boulevard to Atlantic
Boulevard which leads to freeway access.
12) PUBLIC SERVICES
The City of Vernon has both a Fire and Police Department.
Castrol Industrial North America, Inc. operates an existing
facility and is proposing modifications and upgrades to this
facility. No additional public services will be required for
this facility.
13) ENERGY
Castrol Industrial North America, Inc. is proposing
modifications to their existing facility. There will be no
impact to the City of Vernon Light and Power Department. The
energy used by this operation will be negligible.
14) HUMAN HEALTH
Castrol Industrial North America, Inc. is proposing
modifications and upgrades to their existing facilities. The
Vernon Health Department makes routine inspections to their
current facility. Castrol Industrial North America, Inc.
maintains a permit for their hazardous materials. All storage
will be in conformance with Health & Safety Codes. The proposed
upgrades will improve the safety of the facility. There has been
no history of violations at this facility. The proposal will not
alter, or in any way increase the level of risk or exposure to
existing health hazards. No adverse impacts are anticipated.
15) AESTHETICS
The area surrounding the property is made up of industrial
and commercial uses. The facility will blend in and not create
any offensive visual effect.
16) RECREATIONAL
There will be no significant impact to any recreational
resources in the area.
17) CULTURAL RESOURCES
There are no known historic buildings or cultural sites in
the area. No archaeological or historical objects are expected
to be found during construction.
XXIII DISCUSSION OF LAND IMPACTS
The proposed project is in conformance with the City of
Vernon General Plan. The zoning of the site is M, which allows
petroleum uses with a conditional use permit. No impacts to
surrounding properties are expected.

PROPOSED
MITIGATION MONITORING PROGRAM
CASTROL INDUSTRIAL NORTH AMERICA,
PETROLEUM RELATED USE

INC.
Introduction
The Negative Declaration prepared for the Castrol Industrial
North America, Inc. petroleum related use project (State
Clearinghouse No. 95071062) indicates that the proposal may have
potential impacts on the environment in the absence of any
mitigation measures. The Negative Declaration indicates specific
measures and programs that should be adopted as part of the
development approval to ensure the potential adverse impacts are
mitigated.
In accordance with requirements of Section 21081.6 of the
Public Resources Code, the City Council makes the following
additional findings:
That a mitigation reporting and monitoring program
shall be implemented as specified for the Castrol
Industrial North America, Inc. project.
Site plans and/or building plans, submitted for
approval by the responsible monitoring agency, shall
include required mitigation measures/conditions; and
That an accountable enforcement agency and monitoring
agency shall be identified for mitigation
measures/conditions adopted as part of the decision
maker's final determination.
This Mitigation Monitoring Program (MMP) was prepared by the
City of Vernon Community Services Department in accordance with
AB 3180. The comprehensive MMP presents the mitigation measures
which have been adopted as conditions of approval by the Vernon
City Council, in conjunction with the adoption of the Negative
Declaration prepared for this project, and the respective
monitoring of these measures to be conducted by City staff or
their environmental consultant. The MMP will serve a dual
purpose of verifying implementation of the mitigation measures
for the Castrol project and of generating information on the
effectiveness of the mitigation measures to guide future
mitigation programs.
Scope of the MMP
The environmental analysis contained in the Initial Study
incorporated herein by reference, focused on issues determined to
be potentially significant by the City of Vernon. The
environmental analysis concluded that the environmental issues

discussed in the Initial Study, the significant and potentially
significant impacts could be avoided or reduced to a level below
significance through the implementation of recommended mitigation
measures.
Components of the MMP
The MMP is comprised of three separate phases of monitoring
to ensure that all project mitigation measures have been fully
implemented: (1) monitoring that will occur prior to issuance of
permit; (2) monitoring that will occur during the project's
construction; and (3) monitoring that will occur on an on-going
basis throughout the life-time of the project.
Monitoring Prior to Permit Issuance
The first phase of the monitoring will occur prior to the
issuance of project permits (e.g., CUP, building permit and
grading permit) and will involve review and approval, by the City
or other agencies, of the various design details and plans
necessary to implement the project. The Initial Study calls for
certain grading and design details, as well as other specific
plans to be implemented during project operations. City staff
and other agencies, as part of their plan review, will check to
make sure that the required items have been incorporated into
these plans.
Monitorinq Durinq Construction
Once the mitigation measures have been adopted as conditions
of approval by the City of Vernon, a construction monitoring team
will be identified. Managing the team will be the responsibility
of a mitigation compliance coordinator at the City.
Prior to any project implementation activities, a pre-
construction meeting will take place between the City of Vernon
staff and all individuals involved in the completion of the MMP
to clearly establish the responsibility and authority of the
participants. An effective reporting system will be established
prior to any monitoring activities. All parties involved will
have a clear understanding of the mitigation measures as
adopted, and the mitigation measures must be distributed to the
participants of the monitoring effort. Those that will have a
complete list of all the mitigation measures adopted by the City
would include the City of Vernon, the applicant and the
construction crew supervisor.
Compliance report forms will be prepared with each
mitigation measure written out on the top of the form. All
persons responsible for monitoring measures shall complete the
report and file it with the City following each monitoring
activity. The conclusions of these forms for each monitoring

effort will be compiled into a comprehensive Monitoring Report by
the appropriate City staff. The Monitoring Report will describe
the major accomplishments of the monitoring program, summarize
the problems encountered in achieving the goals of the program,
evaluate solutions developed to overcome problems, and provide a
list of recommendations for future monitoring efforts.
On-qoinq Monitoring
The requirements for on-going monitoring will be specified
in the permit conditions of the project or in the back-up reports
required as a result of those permit conditions. The City of
Vernon will be responsible for ensuring that the permit
conditions for Castrol's operations are being implemented.
Actual monitoring activities may be carried out by City-staffed
field inspections, other agency-staffed inspections, or by
specialists hired by the City or the project applicant to carry
out specific programs. In this case, the City or other
permitting agency will be responsible for reviewing the
monitoring reports as they are submitted by the project applicant
or monitors.
Non-Compliance Procedures
There are generally three separate categories of non-
compliance associated with the adopted conditions of approval:
Non-compliance requiring an immediate halt to a
specific task or piece of equipment.
Non-compliance requiring immediate corrective action,
with no work or task delay.
Non-compliance that does not warrant immediate
corrective action and results in no work or task delay.
In all three cases, the City will notify the applicant's
contractors. If non-compliance continues, the City will
implement various enforcement procedures such as IIstop workll
orders, fines and penalties (civil), permit refusal or
revocation, citations, and injunctions. It is essential that all
parties involved in the MMP understand the authority and
responsibility of the on-site monitors.
SUMMARY OF MITIGATION MEASURES AND MONITORING EFFORTS
The following text lists the petroleum related project's
mitigation measures and the monitoring efforts required to ensure
that the mitigation measures are adequately implemented.

been damaged and that the tanks are not leaking.

Reconfiguration of the tanks will increase the loading areas, thus increasing the ability to maneuver the bulk
delivery trucks and the safety of the workers. Spill containment during loading operations will be improved by
providing concrete paving and curbs. The two existing driveways on District Boulevard will be narrowed to allow
for additional parking areas. Castrol Industrial North America, Inc. will obtain an easement from L.A. Junction
Railway Company for ingress and egress on the railroad right-of-way to the south of the building. By obtaining this
easement the flow of traffic on the property will improve. Trucks will no longer need to back in from District
Boulevard. Trucks will be able to enter from District Boulevard and exit onto Heliotrope Avenue.

1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan of the City.
2. SITE The proposed site is approximately 0.84 of an acre
and is of adequate size and shape for the proposed use.
3. ADVERSE EFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire, or
explosion is anticipated from the proposed operation.
4. ACCESS The site will have access to District Boulevard
and Heliotrope Avenue. The street is of adequate size to handle
the traffic generated from the proposed operation. It may also
be receiving rail tanker cars via a Los Angeles Junction Railway
Company spur track.

5. TRUCK MOVEMENTS Castrol Industrial North America, Inc.
will have approximately 20 trucks entering and exiting the site
daily. The site will be served by District Boulevard and
Heliotrope Avenue. The streets traveled to access the site have
sufficient width to handle the traffic generated from the
proposed operation.
6. OPERATIONS The primary operations consist of the
blending and packaging of metal working lubricants, fluids and
various specialty industrial coolants.
In the manufacturing operation raw materials are received,
stored in bulk tanks, blended, quality inspected, packaged in 5
gallon pails or 55 gallon drums, or shipped as bulk product.
The first shift normally operates from 7:00 am to 3:30 pm.
The working hours for a second shift may be added with demand for
finished products.
7. HAZARDOUS MATERIALS The material to be stored in the
tanks are petroleum base oils and related petrochemical additives
used to produce metalworking cutting fluids, lubricants, and rust
preventatives. The specific product or supplier changes from
time to time but in general the characteristics of the materials
remain the same. The oils as well as the additives all have
flash points greater than 200 degrees fahrenheit and none of the
materials are toxic or extremely hazardous. The materials are
considered to be Class III Fluids. There are only small amounts
of flammable liquids at the site. These include less than ten 55
gallon drums that contain isopropyl alcohol or specialty drying

agents.
The plant maintains on-site spill response resources for
smaller spills. Contracted response resources and equipment
would be made available for larger or worst case discharges.
Castrol Industrial North America, Inc. has contracted with
Evergreen Oil to provide immediate spill response capability for
larger spills.
8. CONDITIONS It is recommended that the following
mitigating measures and conditions be set on the permit to
adequately protect the public interests:

CONDITIONS:
a. The facility shall be operated in accordance with all
current codes, rules, regulations and subject to permit fees as
adopted by the City of Vernon. The facility shall be operated in
a manner that will prevent unsanitary conditions, odors or other
nuisances. A business license and occupancy permit shall be
maintained.
b. Class I and Class II liquids shall not be stored in
above ground tanks.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed and maintained to meet City
standards.
d. Plans for improvements to the facility and construction
of structures shall be submitted to both the City of Vernon's
Community Services and Health Departments for review and
approval.
e. All required federal, state, local and regulatory agency
permits shall be obtained and maintained.

f. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.

After review of the application by the Community Services
Department, it is recommended that the conditional use permit be
granted.

The project is consistent with the General Plan as adopted
by the City of Vernon.
Therefore it is recommended that the City Council determine:
1. That the project is consistent with the General Plan as
adopted by the City of Vernon.
2. That the project will not have a significant effect on
the environment in this case because of the following mitigating
measures adopted.
3. That the project will not individually or cumulatively
have an adverse effect on wildlife resources.
It is also recommended that a Negative Declaration be
adopted with the following mitigating measures, that a Notice of
Determination and a De Minimis Finding be filed with the County
Clerk and that the Mitigation Monitoring program be approved.
A. Castrol Industrial North America, Inc. shall provide
secondary containment for all stored hazardous materials.
B. Castrol Industrial North America, Inc. shall have onsite
spill response resources. Castrol Industrial North America,
Inc. shall contract at all times with a private firm to provide
emergency spill response services.
C. Castrol Industrial North America, Inc. shall submit for
approval by the Vernon Health Department an Emergency Response
Action Plan and a Facility Response Plan. These plans shall be
updated as necessary
D. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Only those
substances approved by the Health and Fire Departments shall be
stored, used or handled at the site. Hazardous materials/wastes
shall be handled and managed in compliance with all appropriate
federal, state and local laws.
E. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources.
Further it is recommended that the conditional use permit be
granted subject to the above mitigating measures and the
following conditions:

a. The facility shall be operated in accordance with all
current codes, rules, regulations and subject to permit fees as
adopted by the City of Vernon. The facility shall be operated in
a manner that will prevent unsanitary conditions, odors or other
nuisances. A business license and occupancy permit shall be
maintained.
b. Class I and Class II liquids shall not be stored in
above ground tanks.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed and maintained to meet City
standards.
d. Plans for improvements to the facility and construction
of structures shall be submitted to both the City of Vernon's
Community Services and Health Departments for review and
approval.
e. All required federal, state, local and regulatory agency
permits shall be obtained and maintained.
f. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.

Item 17.
This project will have no impact on the number of personnel or activity of this loading
facility. We have 18 operations personnel on site at this time. The staffing level
fluctuates between 12 and 24 personnel with the industrial metalworking economy.
This is also the case with multiple work shifts. We currently operate with a single shift
and anticipate improved economic conditions requiring an additional shift in the future.
Item 33.
The scope of the project is such that it will make no changes to existing soil or
topographic conditions. The location of the plant in an industrial area of the City of
Vernon renders comments on plants, animals, historical or cultural aspects not
applicable. Alterations to the District Boulevard parking areas will cause a certain
amount of scenic improvement to the area. The existing structures on site were
constructed at various times over the past 63 years. They are constructed of clay brick,
concrete masonry, frame and stucco and steel framed with metal sheathing.
Item 34.
The site is bounded to the north by District Boulevard and the Los Angeles River, to the
east by Maywood Mutual Water Company water tower #3, to the south by Los Angeles
Junction Railroad right of way and to the west by Heliotrope Avenue. The majority of
buildings in the area are of similar vintage, scale and construction. Surrounding sites
are used for industrial or manufacturing operations and have limited on-site parking and
truck maneuvering areas. Most buildings in the area are built to the property lines
relegating automobile and truck parking to public streets. Single family residential
property and a public park in the adjacent city of Maywood are located approximately
one half of a mile to the south.

SCOPE of WORK
This project is part of a continuing effort to increase the efficiency and modernize the facility to
offer quality product, a safe work place and preserve the environmental integrity of the site. As
a result of the proposed changes to the facility we will improve our spill containment, production
flow avoiding possible accidents, and overall appearance of the plant that reflects on the
community. These enhancements to the site will allow us to achieve improvements in our
product that will translate into survival in a very competitive marketplace.
The specific changes to the rear storage tanks will allow us to reallocate space in the plant for
improved safer working areas. A number of underground tanks previously removed cause a
bottleneck in our plant requiring us to utilize a number of smaller tanks to provide raw material
storage. This improved storage area will accommodate safer tanks with updated foundations
and containment area. We intend to relocate two 7,000 gallon tanks, two 20,000 gallon tanks
and two 6,200 gallon tanks replacing four of the six existing 5,000 tanks and install the
necessary foundation and containment to protect the environment.
The modification to the loading/unloading area will increase the space available to maneuver
the bulk delivery trucks as well as avoid backing trucks and trailers in and out of the driveway.
In addition to traffic flow, improvement to spill containment during loading/unloading operations
will be made with concrete paving and curbs.
As a part of this upgrade to this area, new screen walls and gates will be installed on the District
Boulevard frontage to bring site access into compliance with the current zoning code.

OPERATIONS REPORT
The primary function of this facilities to blend and package metalworking fluids, lubricants and
various specialty industrial coolants. These products are used by manufacturers of machined,
formed or fabricated metal goods such as aircraft, automobiles, ordinance or hardware items as
an aide to their process.
The majority of our products are f10wable liquid water or petroleum based materials. Our
production process is to receive these goods, run a series of quality tests to insure usability and
then blend the liquid, solids and powders together in vessels according to our formula. Once
this material is homogeneous and we have again controlled the quality to insure usability, we
then package the products in 55 gallons drums, 5 gallon pails or transfer it in bulk to one of our
bulk delivery trucks or transfer the goods to our Commerce distribution center. These
packaged products are later shipped to our customers or other Castrol regional distribution
centers.
The above is accomplished by a direct labor force of six production, two maintenance, three
quality control and four administrative support personnel. This staff increases and decreases
based on the business environment and workload. Order entry, clerical and shipping personnel
are located at our Commerce warehouse. Hours of operation for the Vernon plant are 7:00AM
to 5:30PM five days per week - Monday through Friday. Additional hours occur as required
during the week to accomplish plant work loads as well as weekend operation of the plant. In
the event of a major increase of work load it is feasible to add an evening shift, but not practical
to significantly increase the number of day shift personnel due to physical plant limitations.

TRAFFIC REPORT
General
All road traffic currently enters the site from District Boulevard via two driveways approximately
40 feet and 50 feet in width. The project will incorporate reducing the driveway widths to 30
feet each. The northwest driveway is used for trucks delivering and shipment of packaged
products in drums, pails and cartons. The driveway accesses a truck high dock that can serve
two large semi-truck trailers or three smaller bob tail trucks. The dock predominantly serves
smaller local delivery trucks making less than truckload deliveries of 55 gallon drums of raw
materials, supply service items, and product packaging such as containers. The northeast
driveway will be the entry point for bulk trucks unloading raw materials such as base oils and
additives, as well as trucks that will be loaded with finished product to be shipped bulk directly
to our customers.
Bulk loading and unloading operations occur to the east and south portions of the site in the 17
foot driveway and at the northerly half of the Los Angeles Junction Railroad right of way per
agreement with the railroad. These two positions will be configured to contain any spillage or
leaks that may occur in the operation.
Shipping Points
Most raw materials received are delivered by tank truck from the harbor or Bakersfield areas.
Supply and service trucks and the dry goods trucks delivering drum raw materials originate from
areas within the local Los Angeles and Orange County areas. Bulk product delivery from out of
state normally arrives via rail tank car or rail tank container on the rail siding to the site.
Bulk Inbound
Fourteen to twenty shipments of 6,000 to 7,000 gallons of bulk base oil arrive by tank truck
each month. The maximum receipt in anyone day does not exceed three shipments with the
normal routine being only one per day. Bulk additives are received four to eight times a month
in 4,000 to 6,000 gallon quantities. These receipts rarely exceed one per day. All of these
transactions are scheduled between the hours of 6:00AM and 6:00PM Monday through Friday.
Current business levels do not require an evening shift and weekend deliveries are rare.
Dry Cargo Inbol,Jnd and Servi~ Trucks
The number of delivery transactions vary with our business level, but can number as low as
forty to as high as seventy per month. A busy day would have eight receipts of goods or
supplies and one to three service truck transactions.
Outbound Bulls
Two Castrol Multi-compartment tank trucks make deliveries within the Los Angeles-Orange
County area. These trucks load once per day early in the morning or late in the afternoon.
Generally, both trucks do not make deliveries every day. Contract bulk carrier transactions
occur one to three times per month. These transactions are normally for destinations outside of
the Los Angeles-Orange County area, with most being out of state.
Outbound Dry Cargo
Most of the packaged product is transported via Castrol trucks to our finished product shipping
warehouse in Commerce. This occurs twice daily with one full truckload departing the plant in
the morning and one in the afternoon. Most outbound distribution emanates from the
Commerce warehouse, eliminating multiple outbound truck congestion from this site.
Parking
Insufficient required automobile and truck parking space exists on site. Six automobile spaces
currently exist and six new spaces are proposed to provide twelve spaces of the required
twenty-two. One on site bulk truck loading space exists to the east of the building and one new
off site space is proposed at the railroad right of way. This will improve the short fall of the two
required truck loading positions and one truck parking position. Company owned vehicles are
not stored on site, but at the Commerce warehouse. All parking occurs on asphalt or concrete
paving.

SPECIFICATION FOR SECONDARY
CONTAINMENT OF HAZARDOUS SUBSTANCES
The following guidelines shall be applied to the construction, sizing, drainage
and protection of required hazardous substances secondary containment areas in the
City of Vernon. These specifications are a summary of various requirements
included in the California Health and Safety Code, Uniform Fire Code and
~ California Code of Regulations.
I. CONSTRUCTION
Secondary containment barriers shall be constructed of materials of
sufficient thickness, density and composition to maintain structure integrity when
directly exposed to water and the hazardous materials they contain.
II. SINGLE PRIMARY CONTAINERS
For single primarYdcontainers, the required secondary containment must have
sufficient capacity to contain 100 percent of the volume of the primary container.
If the secondary containment area is open to precipitation then it shall be large
enough to additionally accommodate the maximum volume of a 24-hour rainfall as
determined by a 25-year storm history (7.36 inches for Downtown Los Angeles).
III. MULTIPLE PRIMARY CONTAINERS
In the case of multiple primary containers, the secondary containment
must be large enough to contain 150 percent of the largest primary container or
10 percent of the total volume of all the primary containers whichever is greater.
The same precipitation factor as in Part II must be considered if the containment
area is not covered.
IV. REMOVAL PROVISIONS
A means of removing water or spilled product shall be provided for secondary
containment areas . The removal system shall also prevent the uncontrolled release
of substances and provide for a means of analyzing the removed water/substance for
hazardous material contamination. Contaminated materials shall be disposed of at
an authorized disposal facility. An automatic pump or a valve to release liquids
from the secondary containment area is not permitted.
V. COVERAGE
It is recommended that exposed secondary containment areas be covered and
designed so as to exclude precipitation from entering the containment area.
Construction of cover must comply with building standards.
VI. NON-COMPATIBLE SUBSTANCES
Substances that in combination are incompatible or may react to cause a fire,
explosion or produce a flammable, toxic or poisonous gas shall not be stored in
the same containment area. These non-compatible substances should not have common
secondary containment barriers but should have a separate means of containment and
removal.

BULK STORAGE TANKS
There will be two outside bulk storage tank areas. One, located on the
east side of the property will consist of fIfteen 13,250 gallon steel
tanks. The second, located on the south side of the property will
consist of two 20,000 gallon steel tanks, two 7,000 gallon steel tanks,
two 6,200 gallon stainless steel tanks, and two 5,000 gallon steel
tanks. Both tank farms will have containment and engineered concrete
tank foundations that comply with existing regulations.
The material to be stored in these tanks is petroleum base oils and
related petrochemical additives used to produce metalworking cutting
fluids, lubricants, and rust preventives. The specific product or
supplier changes from time to time to address market changes but in
general the characteristics of the materials remain the same. The oils
as well as the additives all have flash points greater than 200 degrees
fahrenheit and none of the material is toxic or extremely hazardous.

Health studies have shown that many petroleum hydrocarbons and synthetic
lubricants pose potential human health risks which may vary from person to
person. As a precaution, exposure to liquids, vapors, mists or fumes should
be minimized.
EFFECTS OF OVEREXPOSURE (Signs and symptoms of exposure)
Prolonged or repeated skin contact may cause skin irritation.
NATURE OF HAZARD AND TOXICITY INFORMATION
In accordance with the current OSHA Hazard Communication Standard criteria,
this prOduct does not require a cancer hazard warning. This is because the
product is formulated from base stocks which are severely hydrotreated,
severely solvent extracted, and/or processed by mild hYdrotreatment and
extraction. Alternatively, it may consist of components not otherwise
affected by IARC criteria, such as atmospheric distillates or synthetically
derived materials, and as such is not characterized by current IARC
classification criteria.
Prolonged or repeated skin contact with this product tends to remove skin
oils, possibly leading to irritation and dermatitis; however, based on human
experience and available toxicological data, this product is judged to be
neither a "corrosive" nor an "irritant" by OSHA criteria.
Product contacting the eyes may cause eye irritation.
Product has a low order of acute oral and dermal toxicity, but minute amounts
aspirated into the lungs during ingestion or vomiting may cause mild ~o severe
pulmonary injury and possibly death.
This product is judged to have an acute oral LD50 (rat) greater than 5 g/kg of

in this mailing is a description and explanation of the information
included in our Material Safety Data Sheets (MSDS).
Exxon MSDSs comply with the OSHA Hazard Communication Standard for
carcinogens~ thus, Section E of each MSDS contains a discussion of any
materials on the California list present in the product at a level greater
than 0.1% (1000 ppm). We are in the process of determining the specific
levels of California-list materials that may be present in our products
below the reportable minimum required by OSHA.
In addition, you are probably aware that in November, 1986, the voters of
California passed Proposition 65 which became effective on January 1, 1987.
This law requires the Governor of California to publiSh a list of chemicals
"known to the state to cause cancer or reproductive toxicity" according to
a specified procedure established by the Proposition. The list has been
revised since then to include additional chemicals, and other revisions
will be forthcoming. A copy of the list can be obtained from the
California Department of Health Services.
Proposition 65 requires that a clear and reasonable warning be given to
persons in certain situations no later than 12 months after a chemical is
listed. The state has not yet provided guidance on how "significant risk"

is to be assessed, or on meeting the warning requirements. In the absence
of this guidance, the following warning is provided:

Proposition 65, including those who do not provide adequate warnings. It

employees, customers and others who may use or handle petroleum products.

The following information is intended to assist the reader in understanding
the format and the material included in Exxon's Material Safety Data Sheets
(MSDS).
A. IDENTIFICATION AND EMERGENCY INFORMATION
This section includes the product name and category. Additional
information about components and CAS numbers is shown in Section B.
The "Product Code" is Exxon's internal product identification number.
"Product Appearance and Odor" includes a physical description of the
product.
MEDICAL EMERGENCY TELEPHONE NUMBER - Exxon's 24-hour telephone number
is intended only for medical-related emergencies. After normal
business hours the caller should leave a short description of the
emergency and the call back number. The Exxon medical staff person
on duty will respond as soon as possible, normally within a few
minutes. Routine MSDS questions should be directed to Marketing
Technical Services (713) 656-5949 during normal business hours.
B. COMPONENTS AND HAZARD INFORMATION
COMPONENTS - The chemical or common names of the major constituents
are listed along with names of any ingredients believed to be health
or physical hazards and which are present in the product at a
concentration of 1% or more. Health effects and presence of
carcinogens (at 0.1% or greater) are discussed in Section E. The
major constituents of most petroleum products are refined petroleum
fractions as defined in the Inventory of Chemical Substances under the
Toxic Substances Control Act. A statement of U.S. TSCA inventory
listing of components may be found in this section.
CAS NUMBERS OF COMPONENTS - These are the Chemical Abstracts Service
Registry Numbers (CAS identification numbers) which are assigned to
individual component chemicals by the Chemical Abstracts Service, when
applicable. Some ingredients, particularly additives, are complex
mixtures to which single CAS numbers may not apply or for which
detailed composition information may not be available.
