A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO SOUTHERN COUNTIES TRANSPORT FOR
THE OPERATION OF A TRUCK AND FREIGHT TERMINAL
2043 ROSS STREET
AT
WHEREAS, Southern Counties Transport has applied
terminal at 2043 Ross Street; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on August 1, 1995; and
WHEREAS, the proposed site is a grandfathered,
non-conforming use in the General Industry (M) Zone which
has been used continuously as a truck and freight terminal,
and which requires a conditional use permit under the Zoning
Ordinance in order to continue the use; and
WHEREAS, the proposed site is approximately 273.63
feet in length by 200 feet in width and contains three
buildings.
The size, shape, topography and drainage of the
parcel are adequate for the proposed operation; and
WHEREAS, a barrier wall or landscaping will be
installed where parking or maneuvering areas adjoin a public
22 street pursuant to the Vernon City Code; and
23 WHEREAS, the proposed site is surrounded by
24 industrial uses compatible with the proposed use and no
25 adverse effect from traffic, parking, noise, odors, dust,
26 smoke, light or glare, or risk of fire, infection or
27 explosion is anticipated from the proposed operation; and
28 WHEREAS, the site has access to Ross Street and in

1 general traffic will travel from the site on Ross Street to
2 ~lameda Street, thence north to freeway access. Occasionally
3 a truck will travel south on Ross Street to 38th Street,
4 thence easterly on 38th Street to freeway access. The
5 streets to be utilized within the City of Vernon are
6 sufficient to handle the traffic generated from the proposed
7 operations; and
8 WHEREAS, the site is required to have adequate
9 pffstreet parking and loading facilities in accordance with
10 ~he Vernon City Code; and
11 WHEREAS, the conditions imposed on the conditional
12 ~se permit will adequately protect the public health, safety
13 and general welfare and the operation is consistent with all
14 applicable rules and laws of the City of Vernon; and
15 WHEREAS, the proposed use as to location,
16 ~peration, and design is consistent with the General Plan
17 and the Zoning Ordinance of the City of Vernon; and
18 WHEREAS, the project was found to be categorically
19 exempt from the California Environmental Quality Act as an
20 existing facility pursuant to Section 15301 of the
21 California Environmental Quality Act Guidelines and a Notice
22 ~f Exemption shall be filed with the County Clerk per
23 Section 15062 of the California Environmental Quality Act
24 Guidelines.

1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
2 OF THE CITY OF VERNON AS FOLLOWS:
3 SECTION 1: The City Council of the City of Vernon
4 hereby finds and determines that the recitals contained
5 hereinabove are true and correct.
6 SECTION 2: Subject to the conditions set forth
7 below, the conditional use permit is granted to Southern
8 Counties Transport for the operation of a truck and freight
9 terminal at 2043.Ross Street.
10 SECTION 3: In order to adequately protect the
11 public health, safety and general welfare the following
12 conditions are imposed:
13 a. The facility shall be operated in accordance
14 with, and made to conform with all current codes, rules,
15 regulations and subject to permit fees as adopted by the
16 City of Vernon. The facility shall be operated in a manner
17 that will prevent unsanitary conditions, odors or other
18 nuisances. Prior to occupancy a business license and
19 occupancy permit shall be obtained. All trucking
20 operations, including truck and trailer parking, shall be
21 limited to the lot located at 2043 Ross Street.
22 b. A hazardous materials inventory and
23 businesslcontingency plan shall be submitted and a hazardous
24 materials permit shall be obtained from the City of Vernon
25 Health Department. Hazardous materialslwastes shall be
26 handled and managed in compliance with all appropriate
27 federal, state and local laws.

1 c. All parking and loading facilities shall be
2 ~aved with a hard durable surface material and shall be
3 adequately drained, and kept free of dust, mud, trash and
4 weeds. Where parking or maneuvering areas adjoin the public
5 street a barrier wall or landscaping shall be installed and
6 maintained to meet City standards.
7 d. Servicing of vehicles including washing, steam
8 pleaning and repairing shall be performed in facilities in
9 compliance with appropriate codes.
10 e. A National Pollutant Discharge Elimination
11 System Permit shall be obtained from the California State
12 ~oard of Water Resources.
13 f. No equipment or freight shall be stored on the
14 site, other than in buildings, trailers or on the docks.
15 ~dequate plans and materials must be available for handling
16 leaks or spills from vehicles during storage or
17 transportation.
18 g. All required federal, state, local and
19 ~egulatory agency permits shall be obtained prior to
20 pperation.
21 h. The facility's buildings shall be structurally
22 ~aintained to exclude rodents and the property shall be
23 ~aintained rodent free.
24 i. The current property owner shall submit
25 ~ocumentation of hazardous materials closure for 2043 Ross
26 ~treet, based on its prior operation by LAWI/CSA
27 ~onsolidators, Inc.

j. All existing cracked sidewalk, curb and gutter
adjacent to the site in Ross Street shall be repaired and
maintained to meet City standards.
k. The underground fuel tanks on the site must be
removed under permit issued by the City of Vernon Community
Services Department or the property owner or occupant shall
pbtain and maintain an underground tank permit. The
~nderground storage tank monitoring systems shall be checked
~y a qualified service person. Monitoring systems must meet
the requirements of City Ordinance No. 944 and must have
electrical power at all times. Southern Counties Transport
shall provide a system to positively shut down the tank's
turbine pump in the event of a leak alarm and provide a
state of the art overspill protection for each tank fill
:::>pening. The tanks and dispensers shall meet all current
City codes.
SECTION 4: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.

Gentlemen:
Southern Counties Transport has applied for a conditional
use permit to operate a truck and freight terminal at 2043 Ross
Street.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer'S Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
Southern Counties Transport was found to be categorically
exempt from the California Environmental Quality Act process,
since they will be using an existing truck terminal and the
facility is not being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

It is recommended that the City Council find that the
proposed use is categorically exempt from the California
Environmental Quality Act process.
Further it is recommended that a Notice of Exemption be
filed with the County Clerk and the conditional use permit be
granted with the following conditions:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations and
subject to permit fees as adopted by the City of Vernon. The
facility shall be operated in a manner that will prevent
unsanitary conditions, odors or other nuisances. Prior to

parking, shall be limited to the lot located at 2043 Ross Street.

pursuant to I.C.C. license MC-263. As such, Southern Counties Transport
IS subject to, and follows, safety and hazardous material handling
regulations of the I.C.C. and tlie U.S. Department of Transportation with

ENGINEER'S REPORT
ON SOUTHERN COUNTIES TRANSPORT
CONDITIONAL USE PERMIT TO OPERATE A
TRUCK AND FREIGHT TERMINAL AT 2043 ROSS STREET
(July 27, 1995)
Southern Counties Transport has applied for a conditional
use permit to operate a truck and freight terminal at 2043 Ross
Street in the City of Vernon. They are an interstate trucking
company providing pick-up and delivery service to customers
throughout Southern California. There will be 7 trucks based at
this facility.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. SITE The proposed site is of adequate size and shape
for the proposed use.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to Ross Street which as
constructed is sixty feet (60') wide and has adequate capacity
and pavement type for the proposed operation.
5. TRUCK MOVEMENTS Southern Counties Transport will
operate approximately 6 dual axle trucks and 1 bobtail out of the
facility. They expect to have up to 26 vehicle movements,
including employees vehicles, out of the site daily with the same
number entering the site. In general trucks will travel on Ross
Street to Alameda Street then north to freeway access.
Occasionally a truck will travel south on Ross Street, thence
easterly on 38th Street to the 710 Freeway.
6. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations and
subject to permit fees as adopted by the City of Vernon. The
facility shall be operated in a manner that will prevent
unsanitary conditions, odors or other nuisances. Prior to
occupancy a business license and occupancy permit shall be
obtained. All trucking operations, including truck and trailer
parking, shall be limited to the lot located at 2043 Ross Street.
b. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/wastes shall be handled and managed in compliance with
all appropriate federal, state and local laws.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed and maintained to meet City

standards.
d. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with
appropriate codes.
e. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources.
f. No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks. Adequate
plans and materials must be available for handling leaks or
spills from vehicles during storage or transportation.
g. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation.
h. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.
i. The current property owner shall submit documentation of
hazardous materials closure for 2043 Ross Street, based on its
prior operation by LAWI/CSA Consolidators, Inc.
j. All existing cracked sidewalk, curb and gutter adjacent

k. The underground fuel tanks on the site must be removed
under permit issued by the City of Vernon Community Services
Department or the property owner or occupant shall obtain and
maintain an underground tank permit. The underground storage

tank monitoring systems shall be checked by a qualified service
person. Monitoring systems must meet the requirements of City
Ordinance No. 944 and must have electrical power at all times.
Southern Counties Transport shall provide a system to positively
shut down the tank's turbine pump in the event of a leak alarm
and provide a state of the art overspill protection for each tank
fill opening. The tanks and dispensers shall meet all current
City codes.
