FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 4510 SEVILLE AVENUE IN THE CITY OF VERNON WHEREAS, Albert Gerrick, Trustee, et al. owns a parcel of property located at 4510 Seville Avenue in the City of Vernon and has requested a variance from conformance with section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance; and WHEREAS, the building has been vacant for more than one year and Zoning Ordinance section 26.4.6-7 requires the building to be brought into conformity with all regulations of the zone in which it is located; and WHEREAS, the building is proposed to be used for produce processing and the existing building measures approximately 11,500 square feet and was constructed with one conforming truck loading space and six non-conforming truck loading spaces, five measuring 10.0 feet in width and 50.0 feet in length and one measuring 10.0 feet in width and 4.0 feet in length; and WHEREAS, Zoning Ordinance Section 26.4.2-7 (a) requires one truck parking space for industrial, manufacturing, and similar uses and Zoning Ordinance section 26.4.2-7 (b) requires two truck loading spaces for buildings with a gross floor area between 8,001 and 25,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 specifies that each truck loading and parking space shall be a minimum of 10 feet wide and 65 feet long; and WHEREAS, granting a variance from Zoning Ordinance section 26.4.6-7 to a building which has been vacant for a year would constitute a privilege which has not been granted to other such buildings, and a special privilege by variance is prohibited by Zoning Ordinance Section 26.5.1-3; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on August 1, 1995. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The request by Albert Gerrick, Trustee, et al. for a variance from Section 26.4.2-8, Development Standards of the Comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long and having a 40 foot unobstructed maneuvering area in front of the loading space at 4510 Seville Avenue is hereby denied. SECTION 3: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. The building on the site has been vacant for more than one year. The building was constructed with one conforming truck loading space and six non-conforming truck loading spaces five measuring 10.0 feet in width and 50.0 feet in length and one measuring 10.0 feet in width and 4.0 feet in length. Albert Gerrick, Trustee, et ale has stated that they will remove three of the docks and provide required automobile parking. Only vehicles of smaller lengths will be utilized at the remaining four non-conforming truck loading spaces. The building is proposed to be used for produce processing and is approximatelY 11,500 square feet in size. The building will be brought into conformity with all other regulations of the zone in which it is located. section 26.4.2-7 (b) requires two truck loading spaces for buildings with a gross floor area between 8,001 and 25,000 square feet in size. section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of t~ " 10 feet wide and 65 feet long and section 26.4.2-7 (e) requires all truck loading spaces to have 40 foot unobstructed maneuvering area in front of the loading space. Albert Gerrick, Trustee, et ale has indicated that requiring the non-conforming truck loading and parking spaces to be 65 feet long by 10 feet wide with a forty foot onsite maneuvering area would be a hardship. On such a unique lot the truck maneuvering requirements cannot be met. The building would have to either be combined with a neighboring property, utilized by an operation that does not require truck parking, such as an office use or demolished in order to bring it into full compliance. Albert Gerrick, Trustee, et alA has indicated that it has no plans for expansion or alteration of the building configuration. The proposed operation is in conformance with the Zoning Ordinance and General Plan. Upon field review and surveying of the lot it has been determined that there is not adequate room to provide the required aut.omobile and truck parking, loading and maneuvering. No variance has previously been granted to a building which has been vacant for more than a year. Consequently to grant Albert Gerrick, Trustee, et ale a variance would be a special privilege which is prohibited by section 26.5.1-3 of the Zoning Ordinance.
