Resolution No. 6670 1 RESOLUTION NO. 6670 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING RESOLUTION NO. 6651 BY AMENDING VARIOUS SECTIONS, AND AMENDING SCHEDULE II, EXHIBIT "B", PAGE 14, AND SCHEDULE IV, EXHIBIT "D" AND ADDING A NEW SCHEDULE V, EXHIBIT "E" TO SAID RESOLUTION NO. 6651, WHICH FIXED THE COMPENSATION FOR CERTAIN EMPLOYEES OF SAID CITY AND AUTHORIZED CERTAIN EXPENSE ALLOWANCES 4 5 6 7 8 WHEREAS, Resolution No. 6651 was adopted by the City 9 Council of the City of Vernon on June 17, 1995, to be effective on lO July 1, 1995; and II WHEREAS, the City Council of the City of Vernon adopted Resolution No. 6656 on July 11, 1995, which approved a Third Side- Letter Agreement between the Municipal Employees Relations Representative ~nd the Vernon Police Officers' Benefit Association l2 13 14 l5 amending the Memorandum of Understanding previously adopted by 16 l7 Resolution No. 5489 on March 15, 1988, as amended by a Side-Letter Agreement adopted by Resolution No. 6001 on January 21, 1992 and 18 Second Side-Letter Agreement adopted by Resolution No. 6258 on 19 October 5, 1993; and 20 WHEREAS, the Third Side-Letter Agreement provided for 2l (1) (2) (3) (4) Detective pay increase effective September 1, 1995; Uniform allowances increase effective September 1, 1995; 22 23 24 "In lieu" holiday effective July 1, 1995; Discretionary tuition reimbursement established effective 25 September 1, 1995; 26 (5) (6) Modified longevity program effective July 1, 1995; Field Training Officer pay increase effective 27 28 September 1, 1995; 1 and 2 WHEREAS, Schedule II, Exhibit "B", page 14 of Resolution 3 No. 6651 provides for the positions and salary scales of police 4 officers and sergeants in the Vernon Police Department; and 5 WHEREAS, Schedule IV, Exhibit "D" of Resolution No. 6651 6 provides for uniform allowances of pOlice officers and sergeants 7 in the Vernon Police Department; and 8 WHEREAS, in accordance with section 2.4 of the MOU, the 9 City Council of the City of Vernon intends to establish a new lO salary schedule for the positions of police officers and sergeants 11 in the Vernon Police Department; and 12 WHEREAS, certain sections of Resolution No. 6651 need to 13 be modified in order to implement the provisions of the Third l4 Side-Letter Agreement. 15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 16 CITY OF VERNON AS FOLLOWS: 17 SECTION 1: The city council of the City of Vernon does 18 hereby find and determine that the recitals contained hereinabove 19 are true and correct. 20 SECTION 2: Effective September 1, 1995, Schedule II, 2l Exhibit "B", page 14 of Resolution No. 6651 is hereby amended to 22 establish new salary schedules for the positions of police 23 officers and sergeants in the Vernon Police Department as 24 indicated on the amended page 14 of Schedule II, Exhibit "B", 25 which is attached hereto as Attachment A and made a part hereof. 26 SECTION 3: Effective September 1, 1995, Schedule IV, 27 Exhibit "D" of Resolution 6651 is hereby amended to establish new 28 uniform allowances for the positions of police officers and -2- 1 2 3 4 5 6 7 8 9 lO 1l 12 13 14 15 16 17 18 ." sergeants in the Vernon Police Department as indicated on the amended Schedule IV, Exhibit "0", which is attached hereto as Attachment B and made a part hereof. SECTION 4: Section 5, page 6, of Resolution No. 6651 is hereby amended as follows: SECTION 5 : DESIGNATION OF SCHEDULES. That officers and employees of the City of Vernon shall receive compensation in accordance with the formula adopted herein as Schedule I, in such amounts as are set forth in Schedule II which provides a monthly amount for each position and each step in each department. In addition, expense allowances and other information where applicable for each department are set forth herein. The automobile allowances are set forth in Schedule III, the uniform allowances are set forth in Schedule IV and the compensation for court appearances and standby status are set forth in Schedule V. Salary schedules are hereby established for the following departments, as set forth in Schedule II: (a) Department of Community Services which includes the Water Department; (b) Light and Power Department; (c) Gas Municipal utility Department; (d) Fire Department; (e) Police Department; (f) City Administrator/City Clerk Department. (g) City Council Department Said Schedules I to V are attached to this resolution as "A" through "E", respectively, and incorporated herein by 19 20 2l 22 23 24 25 26 27 Exhibit 28 -3- 1 this reference as though fully set forth at length. SECTION 5: section 9, page 10, of Resolution No. 6651 is 2 3 hereby amended as follows: 4 (a) SECTION 9: LONGEVITY PROGRAM FOR EMPLOYEES. MISCELLANEOUS AND FIRE EMPLOYEES EMPLOYED ON OR AFTER JULY 1, 1994 - Seven (7) Years of Service. 5 6 7 8 All eligible employees who are employed on or after 9 July l, 1994, who attain seven (7) years of consecutive lO uninterrupted service shall receive an additional five percent 11 (5%) per month of their base salary. Such employees upon reaching 12 their 7th anniversary date shall be entitled to receive said five 13 percent (5%) per month upon said anniversary date. Further, such 14 employees will not be entitled to receive any additional 15 percentage increase to their base salary for further service. 16 This subsection shall only apply to employees hired on or after 17 July 1, 1994. 18 (b) POLICE EMPLOYEES IN GROUP 2 EMPLOYED ON OR AFTER JULY 1, 1995 - Seven (7) Years of Service. 19 20 21 All employees classified in Group 2 who are employed on or after July 1, 1995, who attain seven (7) years of consecutive 22 23 uninterrupted service shall receive an additional five percent (5%) per month of their base salary. Such employees upon reaching 24 their 7th anniversary date shall be entitled to receive said five 25 26 percent (5%) per month upon said anniversary date. Further, such employees will not be entitled to receive any additional 27 percentage increase to their base salary for further service. 28 -4- 1 This subsection shall only apply to all employees hired on or 2 after July 1, 1995. 3 SECTION 6: Section 11, page 12, of Resolution No. 6651 4 is hereby amended by adding a new subsection (c) as follows: 5 (c) ENTITLEMENT TO ONE ADDITIONAL IN LIEU HOLIDAY - POLICE DEPARTMENT EMPLOYEES IN GROUP 2. 6 7 8 Employees in the classification represented by the Police 9 Association in Group 2 shall receive during the applicable fiscal lO 11 years, effective July 1, 1995, and expiring on August 31, 2001, one additional "in lieu" holiday if the City Council, during each 12 such fisoal year, provides an additional holiday to 13 miscellaneous/general employees in addition to those holidays 14 provided for in Resolution No. 5645, Vacation and Holidays. l5 l6 17 Further, pursuant to section 5 of the Side-Letter Agreement and Section 9 of the Second Side-Letter Agreement, the additional "in lieu" holiday will be converted to ten (10) hours 18 of additional "in lieu" holiday hours for a new total of ninety 19 (90) hours for the applicable fiscal year. SECTION 7: Section 24(a), page 30 of Resolution No. 6651 20 21 is hereby modified to read as follows: 22 (a) MOU. 23 For purposes of this resolution, all of the provisions in 24 the MOD dated March 1, 1988, adopted by the City council of the 25 City of Vernon on March 15, 1988, pursuant to Resolution No. 5489, 26 as extended by a Side Letter Agreement effective October 6, 1991, 27 approved by the City Council of the city of Vernon on January 21, 28 1992, pursuant to Resolution No. 6001, the Second Side Letter -5- .. :- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 2l 22 23 24 25 26 27 28 Agreement approved by the City Council of the City of Vernon on October 5, 1993, pursuant to Resolution No. 6258, and the Third Side Letter agreement approved by the City Council of the City of Vernon on July 11, 1995, pursuant to Resolution No. 6656 are referenced herein as though fully set forth at length. SECTION 8: section 24(c), page 31 of Resolution 6651 is hereby modified to read as follows: (c) Court Appearances. Employees in the classifications represented by the Police Association in Group 2 shall be compensated for court appearances in the line of duty outside regular scheduled duty hours as specified in Schedule V, Exhibit "E." (1) Court Day Defined. An employee shall be deemed to have served a full court day appearance if the employee is required to appear at the morning session of the court and has to return on the same day after the noon recess of the court. Otherwise, an appearance during the morning session or the afternoon session only shall be considered a half court day. SECTION 9: section 24(d), page 32 of Resolution 6651 is hereby modified to read as follows: (d) Standby Status. In addition, Police Sergeants and Police Officers shall be compensated for standby status as specified in Schedule V, Exhibit "E." SECTION 10: Effective September 1, 1995, section 24(f), -6- I 2 3 4 5 6 7 8 9 lO II 12 l3 l4 15 16 17 18 19 20 2l 22 23 24 25 26 27 28 page 33 of Resolution 6651 shall be amended to read as follows: (f) Field Training Officers. Police officers assigned by the Chief of Police, or his designee, as Field Training Officers shall receive a differential of five percent (5%) of their base salary for the period so assigned. Each officer assigned as a Field Training Officer shall complete a P.O.S.T. approved Field Training Officer School prior to assignment. The number of field training officers, qualifications, and training for such assignment shall be determined by the Chief of Police. Such assignment shall be revoked at any time without recourse to the disciplinary procedure. SECTION 11: Effective September 1, 1995, section 24(1), page 35 of Resolution No. 6651, shall be amended to read as follows: (I) Detective Assignment. In the event a Police Officer or a Detective Sergeant is assigned to the detective division, he/she shall receive premium pay equal to One Hundred Seventy-Five Dollars ($175.00) per month and the premium pay shall not be considered to be part of the employee's base monthly salary when computing peace officers standards and training certificate incentives. However, only one (1) Detective Sergeant, whose duties are to investigate criminal activity, shall be eligible for said One Hundred Seventy-Five Dollars ($175.00) premium pay. SECTION 12: Effective September 1, 1995, new subsection (0) is hereby added to Section 24 to read as follows: -7- 1 (0) Tuition Reimbursement. 2 All employees in the classification represented by the 3 Police Association in Group 2 shall be entitled to receive at the 4 City Council's sole discretion the same benefit under the 5 6 educational assistance program as is provided for miscellaneous 7 city employees. The receipt by one employee of such reimbursement is not to be considered a precedent and shall not require the 8 approval by the City Council of a different employee's request for 9 similar reimbursement. 10 11 SECTION 13: In all other respects, Resolution No. 6651 shall remain in full force and effect, and the provisions of 12 Resolution No. 6651 not consistent with or in conflict with this 13 resolution are hereby repealed. 14 15 16 17 SECTION 14: The city Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect.
