A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON FINDING THE CITY OF VERNON TO BE IN
CONFORMANCE WITH THE CONGESTION MANAGEMENT
PROGRAM (CMP) AND ADOPTING THE CMP LOCAL
IMPLEMENTATION REPORT, IN ACCORDANCE WITH
CALIFORNIA GOVERNMENT CODE SECTION 65089

WHEREAS, the Los Angeles County Metropolitan
8
Transportation Authority ("MTA"), acting as the Congestion
9
Management Agency for Los Angeles County, adopted the 1993
10

Congestion Management Program ("CMp") on November 17, 1993; and
WHEREAS, the CMP requires that MTA annually determine
that the County and cities within the County are conforming to all
13
CMP requirements; and
14
WHEREAS, the CMP requires submittal to the MTA of the
15

CMP Local Implementation Report by September 1, 1995; and
WHEREAS, the City Council of the City of Vernon held a
noticed public hearing on August 15, 1995.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF

THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
22

hereinabove are true and correct.
SECTION 2: The city council finds and determines that
the city of Vernon has taken all of the following actions, and is
25

in conformance with all applicable statutory requirements of the
1993 CMP.

A.
The City of Vernon has adopted and continues to
implement a transportation demand management ordinance, consistent
1 with the minimum statutory requirements identified in the CMP
2 Chapter on the Transportation Demand Management Element.
3 B. The City of Vernon has adopted and continues to
4 implement a land use analysis program consistent with the minimum
5 statutory requirements identified in the CMP Chapter on the Land
6 Use Analysis Program.
7 C. The City of Vernon has adopted a Local Implementation
8 Report, attached hereto and made a part hereof by reference,
9 consistent with the requirements identified in the CMP. This
lO report balances traffic congestion impacts due to growth within
11 the City with transportation improvements, and demonstrates that
12 the City is meeting its responsibilities under the countywide
13 Deficiency Plan.
14 D. As of June 1, 1995, the City of Vernon has been
15 tracking new development activity, consistent with the
16 requirements identified in the CMP. This information will be
17 annually tabulated, as the basis for determining mitigation
18 measures which the City of Vernon may implement if necessary under
19 the Countywide Deficiency Plan.
20 SECTION 3: The City Clerk shall forward a certified

22 Transportation Authority, attention Jody E. Feerst, Acting
23 Manager, P.O. Box 194, Los Angeles, CA 90053.

SECTION 4: The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.

EXEMPTED DEVELOPMENT DEFINITIONS:
L Low/Very Low Income Housing: as defined by the California Department of Housing and
Community Development as follows:
Low-Income: equal to or less than 80% of the median income, with adjustments for family size.
Very Low-Income: equal to or less than 50% of the median income, with adjustments for family size.
2. High Density Residential Near Rail Stations: development located within 1/4 mile Of a fixed rail
passenger station and that is equal to Or greater than 120 percent of the maximum residential density
allowed under the local general plan and zoning ordinance.
3. Mixed Uses Near Rail Stations: mixed use development located within 1/4 mile of a fixed rail
passenger station, if more than half of the land area, or floor area, of the mixed use development is
used for high density residential housing.
4. Development Agreements: projects that entered into a development agreement (as specified under
Section 65864 of the California Government Code) with a local jurisdiction prior to July 10, 1989.
5. April 1992 Civil Unrest Reconstruction: until June 1, 1995, buildings and structures damaged or
destroyed in Los Angeles County as a result of civil unrest during the state of emergency declared
by the Governor on April 29, 1992.
6. Any project of a federal, state or county agency that is exempt from local jurisdiction zoning
regulations and where the local jurisdiction is precluded from exercising any approval/disapproval
authority.
These locally precluded ,projects do not have to be reported in the Local Implementation Report.

The City of Vernon will conduct a Public Hearing which you
may attend.

Vernon, CA 90058
Time:
Tuesday, August 15, 1995 at 5:00 p.m.
The City of Vernon will be conducting a Public Hearing
regarding Vernon's conformance with the Congestion Management
Plan as established by the Los Angeles County Metropolitan
Transportation Authority. The purpose of the hearing is to
obtain testimony from affected and/or interested persons
regarding this subject. The public is also invited to submit
written comments regarding the request prior to the Hearing.
Review of the file: The documentation supporting the conclusion .
that Vernon is in conformance with the Congestion Management Plan
is available in the office of Community Services, Vernon City
Hall, 4305 Santa Fe Avenue, between the hours of 7:15 a.m. and
5:15 p.m. Monday through Thursday.
If you challenge the approval of Vernon's self certification
or any provisions thereof in court, you may be limited to raising
only those issues you or someone else raised at the hearing
described in this notice or in written correspondence delivered
to the City of Vernon at, or prior to, the meeting.
