Resolution No. 6684 1 2 3 4 5 6 7 City RESOLUTION NO. 6684 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON SUPERSEDING RESOLUTION NO. 6321 AND ESTABLISHING THE RATES FOR BUSINESS LICENSE TAXES AND RELATED FEES AND DEPOSITS PURSUANT TO CHAPTER 15 OF THE VERNON CITY CODE WHEREAS, pursuant to Vernon City Code section 15.8, the Council of the City of Vernon is authorized to set business 8 license taxes, related fees and deposits by resolution; and 9 WHEREAS, the City Council has established business license 10 fees pursuant to Resolution No. 6321, adopted on September 21, 1993; 11 and 12 WHEREAS, the cost of living and general prices have 13 increased and the fees established herein reflect adjustments to 14 cover increased costs and to provide internal consistency between 15 the fee increments; and 16 WHEREAS, the City Administrator-Finance Director has 17 recommended that the business license taxes, related fees, and 18 deposits be revised as set forth herein. 19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 20 CITY OF VERNON AS FOLLOWS: 21 SECTION 1: The City Council of the city of Vernon hereby 22 finds and determines that the recitals contained hereinabove are 23 true and correct. 24 SECTION 2: Transfer Fees (V.C.C. Sec. 15.9). 25 When a business relocates within the City of Vernon, there 26 shall be no transfer fee. 27 SECTION 3: Business License Fees (V.C.C. Sec. 15.18). 28 Every person doing business or engaged in any business, 1 profession, trade or occupation, or performing any act, or otherwise 2 dealing in or with goods, wares or merchandise, and not 3 elsewhere specifically licensed by other provisions of Chapter 15 of 4 the Vernon City Code, shall pay a license fee for each calendar year 5 6 or portion thereof for the privilege of doing business in the City of Vernon as follows: 7 ANNUAL FEE 8 FOR EVERY PERSON EMPLOYING: 9 o or 1 employee (warehousing with no employees in the City of Vernon shall pay the minimum of $120.00 per year) 120.00 $ 10 11 2 to 10 employees 12 11 to 25 employees 13 26 to 50 employees 14 51 to 75 employees 15 76 to 100 employees 16 101 to 150 employees 17 151 to 200 employees 18 201 to 250 employees 19 251 to 300 employees 20 301 to 400 employees 21 401 to 500 employees 22 501 to 600 employees 23 601 to 700 employees 24 701 to 800 employees 25 801 to 900 employees 26 901 to 1,000 employees 27 1,001 to 1,100 employees 28 1,101 to 1,200 employees 180.00 245.00 345.00 455.00 565.00 675.00 790.00 905.00 1,020.00 1,135.00 1,250.00 1,365.00 1,590.00 1,815.00 $2,040.00 2,265.00 2,490.00 2,715.00 -2- " 1 ANNUAL FEE 2 FOR EVERY PERSON EMPLOYING: 3 1,201 to 1,300 employees 2,940.00 4 1,301 to 1,400 employees 3,165.00 5 1,401 to 1,500 employees 3,390.00 6 1,501 to 1,600 employees 3,615.00 7 1,601 to 1,700 employees 3,840.00 8 1,701 to 1,800 employees 4,065.00 9 1,801 to 1,900 employees 4,290.00 10 1,901 and more employees 4,515.00 11 SECTION 4: Penalties and Delinquent Charges (V. C. c. Sec. 12 15.20). 13 Delinquent business licenses, including new businesses 14 which have failed to obtain a license, shall be charged a delinquent 15 fee of ten percent (10%) for the first month and ten percent (10%) 16 per month thereafter up to a maximum of fifty percent (50%) of their 17 annual business license fee for each year of delinquency in addition 18 to the annual business license fee for each such year. 19 SECTION 5: Central station Industrial Protective Service 20 (V. C. C. Sec. 15.28). 21 Every person conducting a central station protective 22 signaling system shall pay the following fees: 23 (a) The applicant shall pay a minimum license fee of 24 $355.00 per year at the time of application for or renewal of the 25 license; 26 (b) The licensee shall pay to the City of Vernon two 27 percent (2%) of the gross receipts of business arising from 28 licensee's operations conducted in the City of Vernon, less the -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 minimum previously paid. SECTION 6: Persons without a Fixed Place of Business (V.C.C. Sec. 15.29). (a) Every person, firm or corporation engaged in or carrying on the business of an auctioneer for the sale at auction of any real or personal property shall pay a fee of $115.00 each day unless exempted by State law; (b) Every person, firm, or corporation engaging in the business of commercial still photography shall pay a fee of $60.00 each day; (c) Every person, firm, or corporation providing taxicab service in the city other than from a taxicab stand, as such terms are defined in Chapter 23 of the Code, shall pay a fee of $170.00 each year; (d) Every person, firm, or corporation providing vehicle towing services in the city shall pay a fee of $170.00 each year. SECTION 7: License Fees for Peddlers (V.C.C. Sec. 15.30). (a) Every peddler shall pay a minimum fee of $210.00 per year, or portion thereof; (b) Every peddler who calls attention to his wares, or advertises the same by use of music, entertainment, speech, fancy or grotesque dress, or otherwise, upon any public street, alley or other public place, doorway of any room or building, unenclosed or vacant lot or parcel of land within the City of Vernon, shall pay $595.00 per year, or any portion thereof; (c) Every catering vehicle engaged in the preparation and sale of hot food and drink items from said vehicle shall pay a fee of $225.00 per year; -4- 1 (d) Every catering vehicle engaged in the preparation and 2 sale of cold food and drink items only from said vehicle, shall pay 3 a fee of $180.00 per year; 4 (e) Catering vehicles not otherwise licensed,. operating in 5 the City of Vernon to serve an auction or other special event, shall 6 pay a fee of $50.00 per day for each day or portion thereof for said 7 operation. 8 (f) When a license for a peddler's vehicle or for a 9 catering vehicle is transferred from vehicle to vehicle, there shall 10 be a transfer fee of $60.00. 11 SECTION 8: Motion Picture Production (V.C.C. Sec. 15.31). 12 Every person engaged in motion picture production in the 13 City of Vernon shall pay the fees set forth in the filming permit 14 guidelines as approved by the City Council. 15 SECTION 9: Selling Fruits and Vegetables (V. C. C. Sec. 16 15.32). 17 Every person selling fruits and vegetables from a vehicle 18 shall pay a fee of $180.00 per year, or portion thereof. 19 SECTION 10: Dealers in Junk, Metal, Rags, Paper, etc. 20 (V.C.C. Sec. 15.33) 21 (a) Every person carrying on the business commonly known 22 as junk or scrap metal dealer shall pay a fee of $1,355.00 per year; 23 (b) A secondhand rag or paper dealer shall pay a fee of 24 $890.00 per year; 25 (c) A secondhand pipe dealer shall pay the sum of 26 $1,355.00 per year. 27 SECTION 11: Business License Fee For Warehousing (V.C.C. 28 Sec. 15.34 ) -5- 1 (a) The minimum warehousing license fee shall be $190.00 2 per year and the maximum warehousing fee shall be $1,895.00 per 3 year. Warehousing shall include distributing and wholesale 4 businesses which are not conducted in conjunction with a 5 manufacturing business; 6 (b) For every person engaged in or carrying on the 7 business of warehousing in the City of Vernon, the fee per square 8 foot shall be as follows: 9 ANNUAL FEE 10 11 12 First 5,000 sq. ft. $190.00 All square footage over 5,000 sq. ft. $ 0.0330 per sq. ft. in addition to the $190.00 13 (c) Each additional offsite warehousing facility which a 14 business may have in the City of Vernon shall have a business 15 license and the fee per square foot shall be as follows: 16 ANNUAL FEE 17 First 5,000 sq. ft. $190.00 18 All square footage over 5,000 sq. ft. $ 0.0165 per sq. ft. in addition to the $190.00 19 20 ( d) If the warehousing facility is 5,000 square feet or 21 less, then the minimum rate applies; 22 23 24 (e) Every person engaged in or carrying on the business of warehousing in conjunction with a manufacturing business and where said business has 100 employees or more at the same location, the 25 26 business license fee will be based on the number of employees, and the warehousing activity at the same location is exempt from the 27 square footage fee. 28 III -6- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 12: Shows, Circuses, Rodeos and Other Amusements (V.C.C. Sec. 15.35). Every person engaged in the business of conducting a show, circus, rodeo, or other type of amusement shall pay the following fees: (a) $170.00 per day for such show, circus, rodeo, or other type of amusement; and (b) $115.00 per day for each sideshow for which an admission fee is charged, and which is operated as a side attraction to a show, circus, rodeo, or other type of amusement licensed under subparagraph (a) above. SECTION 13: Permit for Moving of Structures (V.C.C. Sec. 15.42) . The sum of $275.00 shall be deposited with the City Clerk, payable to the city of Vernon, and a permit fee of $15.00 shall be paid for each structure moved into, in, or through the City of Vernon. SECTION 14: Used Car and Automobile Dealers Bond (V.C.C. Sec. 15.44). The applicant for a used car or automobile dealership shall file with the City Clerk along with the application, a bond for $5,000.00 executed on behalf of the City of Vernon by a duly authorized surety corporation subject to approval by the City Attorney. SECTION Secondhand Steel, 15.45) . 15: Junk, Secondhand Metal, Rags, Paper, or Pipe and Fittings Dealers' Bond (V.C.C. Sec. The applicant for a junk, secondhand metal, rags, paper, or -7- 1 secondhand steel, pipe and fittings dealership shall file with the City Clerk along with the application, a bond for $5,000.00 executed on behalf of the City of Vernon by a duly authorized surety corporation subject to approval by the City Attorney. 2 3 4 5 SECTION 16: In addition to the foregoing, the licensee or 6 permittee shall pay all other necessary fees or deposits which may 7 be required by other ordinances or resolutions of the City of Vernon 8 or applicable State laws in effect. 9 SECTION 17: The fees provided for herein shall be 10 effective January 1, 1996 All other resolutions in conflict with 11 this resolution are hereby repealed and Resolution No. 6321 is 12 specifically superseded and declared void. 13 SECTION 18: The City Clerk of the city of Vernon shall 14 certify to the passage of this resolution, and thereupon and 15 thereafter the same shall be in full force and effect. 16 APPROVED AND ADOPTED this 19th day of September, 1995. 17 18 19 20 21 22 ~~ ATTEST: d BRUCE V.
