A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING THE ADOPTION OF A DISCRETIONARY
EDUCATIONAL ASSISTANCE PROGRAM

WHEREAS, the City Council of the City of Vernon adopted
an Educational Assistance Program by Resolution No. 5994 on
7
September 23, 1991, as modified by Resolution No. 6567 adopted on
8
December 20, 1994; and
9
WHEREAS, the Finance Committee on September 12, 1995,
10
recommended that the City Council approve a newcDiscretionary
11

Educational Assistance Program; and
WHEREAS, the City Council believes that continuing
education by City employees results not only in personal benefits
14
to those employees who take courses, but also in added competency
15
and effectiveness in their jobs which benefits the City.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
17
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the city of Vernon does
19
hereby find and determine that the recitals contained hereinabove
20
are true and correct.
21
SECTION 2: The City Council of the City of Vernon hereby
22
approves the adoption of a Discretionary Educational Assistance
23
Program.
24
SECTION 3: The City Council of the City of Vernon hereby
25
26
authorizes the City Administrator to institute such a
Discretionary Educational Assistance Program more fully described
in Exhibit "A" which is attached hereto and made a part hereof as
27

though fully set forth at length.
SECTION 4: The City Clerk of the city of Vernon shall

3 certify to the passage of this resolution and thereupon and
4 thereafter the same shall be in full force and effect.

APPROVED AND ADOPTED this 19th day of September, 1995.

EXHIBIT "A"
DISCRETIONARY EDUCATIONAL ASSISTANCE PROGRAM
Educational aid may be provided by the city of Vernon at the sole
discretion of the City council and shall be excluded from an
employee's federal gross income if the Internal Revenue Code so
provides.
In order to be considered for approval by the City Council of the
City of Vernon, all requests for reimbursement for educational
aid shall meet the following terms and conditions:
1. In order to be eligible for reimbursement, an employee shall
be a regular full-time employee who has been employed by the
City of Vernon for at least twelve (12) months. Employees
who are temporary, part-time, provisional, on leave of
absence, probation or who have been returned to probationary
status or are not considered regular employees, shall not be
eligible. Except, however, that a regular employee working
an assigned part-time schedule of at least fifty percent
(50%) of a full-time schedule, for at least five (5) years,
and has satisfied the requirements for regular status shall
be considered eligible for such aid. In such exception,
however, such aid shall be reduced to the same proportion as
the employee's regular part-time schedule is to a full-time
schedule.
2. Employees who are subject to a collective bargaining

agreement shall not be eligible unless provided for in said
bargaining agreement. However, such provision in said
agreement shall be consistent with the terms and conditions
herein.
3. Reimbursement shall be limited and shall not exceed an
employee's expenses for tuition, fees and textbooks or, in
applicable circumstances, shall not exceed a proportion of
such expenses.
4. Reimbursement shall apply to academic courses only that are
determined by the City Administrator to be job related and
shall not apply to courses involving sports, games or
hobbies, even though such courses may be required as part of
a degree program.
5. Employee must obtain pre-approval from the department head
of courses selected by employee in order to be eligible for
reimbursement of such expenses. The department head may
pre- approve such courses; however, final approval of all
such reimbursement is at the sole discretion of the city
Council. The department head may consider all factors
relating to the employee's work history with the City of
Vernon in determining such pre-approval.
6. At the conclusion of the course, the employee shall submit
an application for reimbursement form to the department head
and shall present all receipts and final grades at the end

of each semester/quarter with such request. A grade of C or
better is required for eligibility for such reimbursement.
The department head may request authorization for
reimbursement from the City Administrator and the City
Council. Such requests for such reimbursement shall be in
the sole discretion of the City Council.
7. This program shall become a part of the orientation process
conducted by the Risk Management/Personnel Department for
all new employees.
8. Reimbursement is limited to One Thousand Five Hundred
Dollars ($1,500) per fiscal year. Such limitation was based
upon tuition, fees and textbooks required by the California
State University System (Los Angeles State University for
the quarter system and Long Beach State University for the
semester system).
