A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON AMENDING RESOLUTION NO.
6443 WHICH GRANTED A VARIANCE TO
U.S. GROWERS COLD STORAGE, INC. FROM
SECTION 26.4,2-8, DEVELOPMENT STANDARDS,
OF THE COMPREHENSIVE ZONING ORDINANCE,
FOR THE PROPERTY LOCATED AT 3111-3261
44TH STREET IN THE CITY OF VERNON
WHEREAS, U.S. Growers Cold Storage, Inc. occupies
parcels of property located at 3111-3261 44th Street in the
City of Vernon; and
WHEREAS, the City Council by Resolution No. 6443 on
June 7, 1994, granted a variance to U.S. Growers Cold Storage,
Inc. from section 26.4.2-8, Development Standards, of the
Comprehensive Zoning Ordinance; and
WHEREAS, the conditions of said variance provided
that: (a) U.S. Growers Cold Storage, Inc. shall demolish all
buildings with non-conforming truck loading spaces between 3111
and 3261 44th Street or be in compliance with section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance by
March 1, 1996; and (b) within seven days of the adoption of
this resolution, U.S. Growers Cold Storage, Inc. shall deliver
a $50,000 certificate of Deposit to the city of Vernon, to be
refunded to U.S. Growers Cold Storage, Inc., including the
interest earned, upon compliance with condition (a) or to be
retained by the City of Vernon if compliance with condition (a)
has not been attained by March 1, 1996.
WHEREAS, U.S. Growers Cold Storage, Inc. has
indicated that it will not be able to complete the demolition
of the buildings until November 1, 1996, and that thereafter it

will build new facilities encompassing the entire northerly
block of 44th street between Boyle and Alcoa Avenues, and it
has therefore requested a time extension for the conditions of
the variance; and
WHEREAS, U.S. Growers Cold Storage, Inc. has
submitted a "Schedule for Phase I Construction, 3111 and 3211
44th street" for work to be performed at the site as shown on
Exhibit "B" which is attached hereto and made a part hereof by
reference; and
WHEREAS, Vehicle Code Section 22500 prohibits
vehicles from stopping, standing, or parking on a sidewalk, and
the City of Vernon cannot permit trucks to extend from private
property into the street right-of-way which includes the
sidewalk area; and
WHEREAS, 3111-3261 44th Street is located in the M
zone and the operation is consistent with the objectives of the
General Plan and Zoning ordinance; and
WHEREAS, the City Council of the city of Vernon held
a hearing on said application for an amendment to the variance
on October 17, 1995.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The conditions of the variance granted to
U.S. Growers Cold Storage, Inc. pursuant to Resolution No. 6443
on June 7, 1994, are hereby amended to read as follows:

(a) u.s. Growers Cold storage, Inc. shall demolish
all buildings with non-conforming truck loading spaces located
between 3111 and 3261 44th street or be in compliance with
Section 26.4.2-8, Development Standards of the Comprehensive
Zoning Ordinance by November 1, 1996;
(b) U.S. Growers Cold Storage, Inc. shall comply with
the schedule as shown on Exhibit "B" for the buildings located
at 3111 and 3121 44th Street;
(c) the $50,000 certificate of Deposit previously
delivered to the City of Vernon shall be returned to U.S.
Growers Cold storage, Inc., including the interest earned, upon
compliance with condition (a) or if compliance with conditions
(a) or (b) has not been attained, then the certificate of
Deposit shall be retained by the City of Vernon for the purpose
of constructing curb, gutter, and sidewalk including a suitable
barrier to eliminate the usage of all non-conforming docks;
(d) the usage of the non-conforming truck loading
spaces shall be limited to trucks of smaller lengths so that no
trucks parked at the loading docks shall extend into the street
right-of-way as shown on the Master Plan of Streets, dated June
16,1992;
(e) during the period between adoption of this
Resolution and U.S. Growers Cold storage, Inc.'s performance of
condition (a), u.s. Growers Cold Storage, Inc. agrees to
indemnify and hold the City of Vernon harmless against damages
resulting from trucks utilizing U.s. Cold Storage, Inc.'s
facility extending onto the sidewalk or street;
(f) the adoption of this Resolution shall not be

construed as a waiver by the city of Vernon with respect to the
enforcement of the provisions of California Vehicle Code 22500
et seq.; and
(g) all existing and future tenants shall be notified
of these restrictions and a condition stating the same shall be
placed in all future leases.
SECTION 3: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
Zoning Ordinance Section 26.4.2-8 and the authorized truck
loading space requirement.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

VARIANCE APPLICATION
OCTOBER 17, 1995
U.S. Growers Cold storage, Inc. has requested an amendment
to its variance from the Comprehensive zoning Ordinance Section
26.4.2-8, Development Standards, for the properties located at
3111-3261 44th street in the City of Vernon. The buildings that
they occupy, as shown on Exhibit "A", were constructed with five
conforming truck loading spaces and thirty-six non-conforming
truck loading spaces measuring 10.0 feet in width: two being 25.5
feet in length; four being 36.5 feet in length; four being 28.5
feet in length; five being 29.5 feet in length; one being 38.0
feet in length; eight being 62.0 feet in length; two being 45.4
feet in length; six being 22.3 feet in length; and four being
60.0 feet in length. The buildings total approximately 210,000
square feet in size and are used for cold storage.
U.S. Growers Cold storage, Inc. has indicated that it will
demolish the buildings on 44th street and build new facilities
encompassing the entire northerly block of 44th street between
Boyle and Alcoa Avenues. They were previously granted a variance
with the condition that the buildings be demolished or in
compliance by March 1, 1996. They are relocating part of their
facility to 2300 57th street and plan to begin demolition of
phase I immediately. Because they have fallen behind their
original schedule, they are requesting an extension of time in
order to complete the demolition.
section 26.4.2-7 (b) requires that a minimum of seventeen
truck loading spaces be provided as shown on Exhibit "All.
section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance
specifies that each loading space shall be a minimum of 10 feet
wide and 65 feet long and section 26.4.6-4 (c) provides that a
non-conforming building must comply with these standards within
five years of April 18, 1989 unless a variance is granted.
U.S. Growers Cold storage, Inc. has indicated that requiring
all of the non-conforming truck loading spaces to be 65 feet long
by 10 feet wide at this time would be a hardship because of the
extent of their proposed construction and the time line that is
involved. Their operation is in conformance with the zoning
Ordinance and General Plan. It is recommended that the
conditions of the variance granted to u.s. Growers Cold Storage,
Inc. pursuant to Resolution No. 6443 on June 7, 1994, be amended
to read as follows: (a) u.s. Growers Cold Storage, Inc. shall
demolish all buildings with non-conforming truck loading spaces
located between 3111 and 3261 44th Street or be in compliance
with Section 26.4.2-8, Development Standards of the Comprehensive
Zoning Ordinance by November 1, 1996; (b) u.s. Growers Cold
storage, Inc. shall comply with the schedule as shown on Exhibit

As I am sure you are well aware U.S. GROWERS COLD STORAGE, INC. has posted a
$50,000 bond with the City of V emon to assure the City that we will comply with
Vemon's off'street parking requirement (65 feet set back from sidewalk). As Richard
Lucas and many of the other City officials in the Building & Planning Department are
aware we are currently in the process of having final plans drawn up.
The reason for this letter is to inform. you that in order for us to begin this major building
project we must first find alternate space to service our customers. We have located space
at the Jetro Property, located at 2300 E. 57th Street, Vernon. Our problem is that this
space, in a worse case scenario, might not be available until September 1995.
We therefore are requesting the City to grant us the necessary time to complete Phase I of
our project and not have to forfeit our $50,000 should we go beyond the March 1996
deadline.
We appreciate your understanding of this most important matter and thank you in advance
for your cooperation. Should you have further questions please do not hesitate to call.

Dear Mr. Wilson:
Please accept my apologies for the delay of this letter. You cannot imagine how badly I
would have liked to send this long ago but due to a variety of circumstance which were
beyond our control we were unable to make any plans until now.
Our plans are as follows: On or about September 5th we will be moving our Area
Three(3121 E. 44th) operations to 2300 E.57th in Vernon. Upon completion of the
move we will cease operating Area Three. It is of course in our best interest to
accomplish this move as quickly as possible, as it will be very expensive.
Shortly after vacating this building we will begin the first phase of our project which will
consist of the complete demolition of Area Three.
Within 45 days of your receipt of this letter, Controlled Environments Construction
company will deliver to your department completed drawings of our new building.
When the plans have been approved and the building permit is granted, we will begin
construction of the new building. This phase should take approximately twelve months,
from the time the permit is issued.
Upon completion of our new building(see enclosed rendering), we will begin operating
from the new facility and per our agreement we will remove our "B" room Area Two.
This wi!1 bring us into full compliance with regard to our loading docks.

see, we at U.S. Growers are about to begin some very exciting times and the loss of
this bond would have a dampening effect on the entire project.

I received your July 24, 1995 correspondence and was pleased
to read that you intend to go forward with your project on 44th
Street. As you realize, your $50,000 compliance bond is in
jeopardy of being collected by the City. The funds would be used
to close off your driveways. The variance conditions stated that
the non-conforming truck docks were to be removed by March 1,
1996. To this date none of the promised construction has
commenced.
Therefore I would expect from your business a firm schedule
of milestones for your project, such as the dates for the start
of demolition, start of construction, submittal of plans and a
completion date for each phase. With this type of schedule I
would be able to present your request for a time limit extension
to the City Council. If a time extension is granted, the bond
will be subject to redemption if any milestone is not met.
If you have any questions, please feel free to contact me.
I am confident that we will be able to come to an equitable
resolution.

With these items presented; We would like to request the deadline(for collection of our
$50,000 bond) be extended to reflect the dates established by our construction and
executive schedule.

only comply with the City of Vemons ordinances but also improve our business, which

ENGINEER'S REPORT
U.S.GROWERS COLD STORAGE, INC.
3111-3261 44TH STREET
VARIANCE APPLICATION
SEPTEMBER 26, 1995
U.S. Growers Cold storage, Inc. has requested an amendment
to its variance from the Comprehensive Zoning Ordinance Section
26.4.2-8, Development Standards, for the properties located at
3111-3261 44th street in the City of Vernon. The buildings that
they occupy, as shown on Exhibit "A", were constructed with five
conforming truck loading spaces and thirty-six non-conforming
truck loading spaces measuring 10.0 feet in width: two being 25.5
feet in length; four being 36.5 feet in length; four being 28.5
feet in length; five being 29.5 feet in length; one being 38.0
feet in length; eight being 62.0 feet in length; two being 45.4
feet in length; six being 22.3 feet in length; and four being
60.0 feet in length. The buildings total approximately 210,000
square feet in size and are used for cold storage.
u.s. Growers Cold Storage, Inc. has indicated that it will
demolish the buildings on 44th Street and build new facilities
encompassing the entire northerly block of 44th Street between
Boyle and Alcoa Avenues. They were previously granted a variance
with the condition that the buildings be demolished or in
compliance by March 1, 1996. They are relocating part of their
facility to 2300 57th Street and plan to begin demolition of
phase I immediately. Because they have fallen behind their
original schedule, they are requesting an extension of time in
order to complete the demolition.
section 26.4.2-7 (b) requires that a minimum of seventeen
truck loading spaces be provided as shown on Exhibit "A".
section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance
specifies that each loading space shall be a minimum of 10 feet
wide and 65 feet long and Section 26.4.6-4 (c) provides that a
non-conforming building must comply with these standards within
five years of April 18, 1989 unless a variance is granted.
U.S. Growers Cold, Storage, Inc. has indicated that requiring
all of the non-conforming truck loading spaces to be 65 feet long
by 10 feet wide at this time would be a hardship because of the
extent of their proposed construction and the time line that is
involved. Their operation is in conformance with the Zoning
Ordinance and General Plan. It is recommended that the
conditions of the variance granted to U.S. Growers Cold storage,
Inc. pursuant to Resolution NO. 6443 on June 7, 1994, be amended
to read as follows: (a) U.S. Growers Cold Storage, Inc. shall
demolish all buildings with non-conforming truck loading spaces
located between 3111 and 3261 44th Street or be in compliance
with Section 26.4.2-8, Development Standards of the Comprehensive
Zoning Ordinance by November 1, 1996; and (b) the $50,000
Certificate of Deposit previously delivered to the City of Vernon
shall be returned to U.S. Growers Cold Storage, Inc., including
the interest earned, upon compliance with condition (a) or if

compliance has not been attained by November 1, 1996, the
certificate of Deposit shall be retained by the city of Vernon
for the purpose of constructing curb, gutter, and sidewalk
including a suitable barrier to eliminate the usage of all non-
conforming truck docks.
