RESOLUTION NO. 6691
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
KITTY QUEEN PET FOODS, INC. FROM
SECTION 26.4.2-8, DEVELOPMENT STANDARDS,
OF THE COMPREHENSIVE ZONING ORDINANCE,
FOR THE PROPERTIES LOCATED AT 4601 DOWNEY
ROAD AND 3372 THROUGH 3388 PACKERS AVENUE
IN THE CITY OF VERNON
WHEREAS, Kitty Queen Pet Foods, Inc. owns parcels of
property located at 4601 Downey Road and 3372 through 3388 Packers
Avenue in the City of Vernon as shown on Exhibit "A" which is
attached hereto and made a part hereof by reference, and has
requested a variance from Section 26.4.2 -8, Development Standards,
of the Comprehensive Zoning Ordinance; and
WHEREAS, Kitty Queen Pet Foods, Inc. uses the buildings
for the manufacturing of pet food and the physical condition of
the properties are unique in that the existing buildings measure
approximately 36,400 square feet and were constructed with ten
non-conforming truck loading spaces, measuring various feet in
in width and various feet in length shown as Items 1 through 7 and
9 through 11 on Exhibit A; and
WHEREAS, Zoning Ordinance section 26.4.2-7 (b) requires
three truck loading spaces for buildings with a gross floor area
of between 25,001 and 50,000 square feet in size.
WHEREAS, Zoning Ordinance section 26.4.2-8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is granted; and
WHEREAS, there is insufficient space on the property and

1 the application of the development standards for the truck loading
2 space requirements will create an unreasonable hardship by
3 requiring the non-conforming spaces to be 10 feet wide by 65 feet
4 long; and
5 WHEREAS, Kitty Queen Pet Foods, Inc. has indicated that
6 it has plans to recess the truck loading space marked Item 10 on
7 Exhibit A to 60.0 feet in length; and
8 WHEREAS, 4601 Downey Road and 3372 through 3388 Packers
9 Avenue are located in the M zone and the manufacturing operation
10 is consistent with the objectives of the General Plan and Zoning
11 Ordinance; and
12 WHEREAS, the City council of the City of Vernon held a
13 hearing on said application for a variance on October 3, 1995.
14 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
15 THE CITY OF VERNON AS FOLLOWS:
16 SECTION 1: The .City Council of the City of Vernon
17 hereby finds and determines that the recitals contained herein-
18 above are true and correct.
19 SECTION 2: A variance from Section 26.4.2-8,
20 Development Standards of the Comprehensive Zoning Ordinance,
21 requiring all truck loading spaces to be 10 feet wide by 65 feet
22 long is hereby granted to Kitty Queen Pet Foods, Inc. at 4601
23 Downey Road and 3372 through 3388 Packers Avenue.
24 SECTION 3: The variance shall be granted subject to the
25 following conditions: (a) Kitty Queen Pet Foods, Inc. shall bring
26 the truck loading space marked Item 10 on Exhibit A measuring 25.0
27 feet in length and 12 feet in width to 60.0 feet in length to
28 accommodate longer trucks. Plans for said construction shall be

1 submitted within five months of adoption of this resolution.
2 Permits shall be obtained for said work within six months of the
3 adoption of this Resolution. Construction shall be started on
4 said work within nine months of the adoption of this Resolution,
5 and construction shall be completed within one year of the
6 adoption of this Resolution; (b) the usage of the ten non-
7 conforming truck loading spaces shall be limited to trucks of
8 smaller lengths so that no trucks parked at the loading docks
9 shall extend into the street right-of-way as shown on the Master
10 Plan of streets, dated June 16, 1992; (c) within seven days of the
11 adoption of this Resolution, Kitty Queen Pet Foods, Inc. shall
12 deliver a $10,000 Certificate of Deposit to the City of Vernon,
13 to be refunded to Kitty Queen Pet Foods, Inc., including the
14 interest earned, upon compliance with condition (a) or if
15 compliance with above condition (a) has not been attained
16 then the Certificate of Deposit shall be retained by the City of
17 Vernon to construct curb, gutter, sidewalk and a suitable barrier
18 to eliminate the usage of all non-conforming loading docks;
19 and (d) all existing and future tenants shall be notified of these
20 restrictions and a condition stating the same shall be placed in
21 all future leases.
22 SECTION 4: Noncompliance with these conditions shall
23 constitute sufficient grounds for the City Council of the City of
24 Vernon to void this variance and require the application of Zoning
25 Ordinance Section 26.4.2-8 and the authorized truck loading space
26 requirement.

VARIANCE APPLICATION
OCTOBER 2, 1995
Kitty Queen Pet Foods, Inc. has requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the properties located at 4601 Downey ROad and
3372 through 3388 Packers Avenue in the City of Vernon. The
buildings that it owns were constructed with ten non-conforming
truck loading spaces, measuring various feet in width and various
feet in length. It has stated it will recess the most southerly
truck loading space to 60.0 feet in length. It has also stated
that only vehicles of smaller lengths will be used at all of the
non-conforming truck loading spaces. The buildings are used for
the manufacturing of pet food and are approximately 36,400 square
feet in size.
Section 26.4.2-7 (b) requires three truck loading spaces for
buildings with a gross floor area of between 25,001 and 50,000
square feet in size. Section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.
Kitty Queen Pet Foods, Inc. has stated that by requiring the
ten non-conforming truck loading spaces to be 65 feet long by 10
feet wide would be a hardship. The operation is in conformance
with the comprehensive Zoning Ordinance and General Plan.
Therefore, it is recommended that the variance be granted subject
to the fOllowing conditions: (a) Kitty Queen Pet Foods, Inc.
shall bring the truck loading space marked Item 10 on Exhibit A
measuring 25.0 feet in length and 12 feet in width to 60.0 feet
in length to accommodate longer trucks. Plans for said
construction shall be submitted within five months of adoption of
this resolution. Permits shall be obtained for said work within
six months of the adoption of this Resolution. Construction
shall be started on said work within nine months of the adoption
of this Resolution, and construction shall be completed within
one year of the adoption of this Resolution; (b) the usage of the
ten non-conforming truck loading spaces shall be limited to
