A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT FOR THE DEVELOPMENT
OF A NATIONAL POLLUTANT DISCHARGE ELIMINATION
SYSTEM ("NPDES") PERMIT GUIDANCE MANUAL BY AND
BETWEEN THE CITY OF VERNON AND THE SANTA
MONICA BAY RESTORATION FOUNDATION AND
PROVIDING FOR THE CONTRIBUTION OF FUNDS

WHEREAS, the City of Vernon desires to contribute funds
toward the development of a Guidance Manual to assist the City to
8

successfully comply with the National Pollutant Discharge
Elimination System (NPDES) permit aimed at reducing the negative
impacts of urban runoff/stormwater on Los Angeles Area waters; and

WHEREAS, it is recommended by Kevin Wilson, Acting
Director of Community Services and Water, to enter into an
agreement with the Santa Monica Bay Restoration Foundation for the
15

purpose of developing said Guidance Manual; and
WHEREAS, the Acting Director of Community Services and
Water has recommended approval of the Agreement with a
19
contribution by the City to the NPDES Guidance Manual cost in the
amount of Five Hundred Dollars and No Cents ($500.00).

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:

hereby finds and determines that the recitals contained

SECTION 2: The City Council of the City of Vernon
hereby approves the Agreement for the Development of a National

Manual, a copy of which has been presented to the City Council

orders said Agreement to be received and filed by the City Clerk.
SECTION 3: The City council of the city of Vernon

4 hereby approves the contribution to be made to Santa Monica Bay
5 Restoration Foundation.

SECTION 3: The City Council of the City of Vernon
7 hereby authorizes the Mayor and the city Clerk to execute said
8 Agreement for, and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the City of Vernon shall
10 certify to the passage of this resolution, and thereupon and
11 thereafter the same shall be in full force and effect.

RECITALS:

WHEREAS, Los Angeles County and the cities within Los
Angeles County have an on-going commitment to develop an effective
17
National Pollutant Discharge Elimination system (NPDES) permit
aimed at reducing the negative impacts of urban runoff/stormwater
18
19
on Los Angeles Area waters; and
20
21
WHEREAS, the cities, County, and the Los Angeles Regional
22
Water Quality Control Board have determined that the development
of a Guidance Manual to accompany the permit will assist the
cities and County to successfully comply with the NPDES permit by
23
24
clar1fying and expanding on the criteria of the Permit and
25
summarizing the methods by which permittees can implement
26
requirements; and
27
WHEREAS, the estimated cost of developing the Guidance
28
Manual is $67,000, with contributions expected or received from
Los Angeles County and various cities including the cities of Los

Angeles, Burbank, El Segundo, Glendale, city of La Canada-
F1intridge, Pasadena, Redondo Beach, Santa Clarita, Santa Monica,
and Vernon, and other cities may contri~ute as well; and
WHEREAS, the FOUNDATION will enter into a contract with a
consultant, to be chosen by the Regional Water Quality Control
Board upon the advice of a subcommittee of the NPDES negotiating
team duly designated by the cities and county; and
WHEREAS, by entering this Agreement, the FOUNDATION is
facilitating the development of the Guidance Manual only, and
assumes no other obligations under the Guidance Manual or the
NPDES permit; and
WHEREAS, the Los Angeles Regional Water Quality Control
Board has agreed to coordinate the work of the consultant, and the
Permit Negotiating team has agreed to advise the consultant of the
needs of the cities and the County to assure that the Guidance
Manual is useful to its audience.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL BENEFITS
TO BE DERIVED BY THE PARTIES AND OF THE PREMISES AND COVENANTS
HEREIN CONTAINED, IT IS HEREBY AGREED TO AS FOLLOWS:
SECTION 1. VERNON agrees:
a. It will contribute a grant of Five Hundred
Dollars and No Cents ($500.00) to the FOUNDATION
by December 1, 1995, upon presentation of an
invoice by the FOUNDATION.
b. By its agreement to facilitate the development
of the Guidance Manual, the FOUNDATION incurs no
responsibility or obligations set forth in tne
Manual itself or in the NPDES Permit.

SECTION 2: The FOUNDATION agrees:

a. To use this money towards funding a consultant
contract to develop t~e Guidance Documen~;

b. To return to VERNON the full amount of its

contribution, within thirty (30) days of
receiving an invoice from VERNON, if for any

reason, the consultant contract does not proceed

as protected.
c. To return to VERNON within sixty (60) days of

the conclusion of the consultant contract, its
proportional share of the remaining monies.

d. To furnish VERNON with ten (10) copies of the
final Guidance Manual.
SECTION 4: Each signatory hereto represents that it has
15 been authorized to enter into this Agreement by the Party for
16 which it signs. This Agreement may be executed in counterparts,
17
each of which so executed shall be deemed an original,
irrespective of the date of the execution, and said counterparts,
18

Regional Board staff :have completed their review of the Legal Authority package that your
agency- submitted. However, for us to adequately determine your City's compliance with the
legal authority requirements of 40 CFR 122.26(d)(2)(i)(A)-(F) and the NPDES permit, we are /
requesting an additional statement from your legal counsel attesting to the adequacy of your~/

vii. Professional understanding of the industrial/commercial sector's
waste management practices;
viii. Experience of local agency :industrial waste inspection
programs; .and
ix. Any other .information that indicates a significant poten#ial for
contamination of storm water.
D. Fiscal Resources =:r
1. .The Principal Permittee, in consultation with the Permittees, shall prepare
a budget summary format not-later than Dctober 30, 1996, for use by each
Permittee to report .resources available to implement the SWMP.
2. Each Permittee. shall submit to the Principal Permittee a .summary of
resources dedicated for storm water program.implementation, not later than
60 days after budget adoption by the Permittee's elected local :governing
body. A Permittee may provide all necessary data in an alternate format
which includes the same .information unless directed otherwise by the
Executive Officer.
E. Legal AuthoritX
1. Pursuant to the time frame established in E.2, each Permittee shall
demonstrate that it .possesses .the legal authority. necessary to control
discharges to and from those portions of the Municipal Separate Storm
Sewer System {MS4) over which it has jurisdiction so as to comply with
this Order. This legal authority may be demonstrated by either a single
ordinance or a single guidance document containing all the applicable
statutes, ordinances, permits, contracts, orders or agreements which
govern a Permittee's storm water management activities, as required lay 40
CFR 122.26(d)(2)(i).

Each Permittee shall either individually or collectively possess the legal
authority to:
a. Control the contribution of. pollutants to the MS4 by storm water
discharges associated with industrial activity and the quality of storm
water discharged from sites of industrial activity, unless permitted
under a separate NPDES permit, through the following prohibitions
and requirements:
i. Prohibit the discharge of untreated wash waters to the MS4
when. gas stations, auto repair garages, or other types of
automotive service facilities are cleaned;
ii. Prohibit the discharge of untreated wastewater to the MS4 from
mobile auto washing, steam cleaning, mobile carpet .cleaning,
and other such mobile commercial and industrial operations;
iii. Prohibit to the .maximum extent practicable,. discharges to the
MS4 from areas where repair of machinery and equipment,
.including motor vehicles, which are visibly leaking oil, fluid or
antifreeze is undertaken;
iv. Prohibit the discharges of untreated runoff to the MS4 from
storage areas of materials containing grease, oil, or other
hazardous substances, and uncovered. receptacles containing
hazardous materials;
v. Prohibit the discharge of .commercial/municipal swimming .pool
filter backwash to the` MS4;
vi. Prohibit the discharge of untreated runoff from the washing of
toxic materials from paved or unpaved areas to the MS4;
vii. Prohibitor control to the maximum extent practicable washing
impervious surfaces inindustrial/commercial areas which results
in a discharge of untreated runoff. to the MS4, unless
specifically required by State or local health and safety codes;
viii. Prohibit the discharge from washing out of concrete trucks to
the MS4;
ix. Require regular sweeping or other equally effective measures
to remove debris from industrial/commercial .motor vehicle
parking lots with more than twenty-five parking spaces that are

located in areas potentially exposed to storm water; and,
x. Require the use of BMP's or placement of machinery/
equipment that is to be repaired or maintained such that .leaks,
- spills -.and other maintenance-related pollutants are not
discharged to the. MS4.;
b. Prohibit illicit discharges and .illicit connections to the MS4 and require
removal of illicit connections.
c. Control spills, dumping, or disposal of materials, including the
following,. #o the .MS4' through the following prohibitions and
requirements:
i. Prohibit littering;
ii. Prohibit the disposal of leaves, dirt, or other landscape debris
into a storm drain;
iii. Prohibit the discharge to the MS4 of any pesticide, fungicide, or
herbicide banned by the USEPA or the California Department
of Pesticide Regulation;
iv. Require proper disposal of food wastes;
v. .Prohibit the disposal of hazardous wastes into trash containers
used for municipal trash disposal so as not to cause a
discharge to the MS4; and
vi. Require, in areas exposed to storm water, the use of BMPs
and/or removal .and lawful disposal of .:all fuels,. chemicals, fuel
and chemical wastes, animal wastes, garbage, .batteries, and
other .materials which: have potential adverse impacts on water
quality.
The above requirements (Part 2.LE.1.) do not require inspection of
private property. Legal authority is necessary, however, so that if the
Permittee becomes aware of situations associated with .private.
. property Ghat cause obvious discharges of prohibited materials to the
MS4 or pose thepotential for such discharges, the Permittee has the
` legal authority to -abate such discharges.
2. Each Permittee shall

Provide to the Principal .Permittee for submittal to the Executive
Officer, not later than. November 28, 1996, copies of ordinances,
regulations, and. other legal documents establishing legal authority,
or in the alternative:
a. A statement by its legal counsel that the Permittee has obtained
all necessary egal authority to comply with -this Order,
referencing that legal authority with specificity; and/or
b. If Part 2.I.E:2;a. is only partially fulfilled, a timely schedule .for
obtaining adequate legal authority to comply with this Order,
enumerating, with specificity, the legal authority that remains to
be obtained.
F. Best Man~ement Practice BMP) or Program Substitution or Elimination
A Permittee maypetition the Executive Officer to:
1. Substitute any BMP or program. identified in this Order, the CSWMP, or the
WMAP, if the Permittee can document that:
a. The proposed alternative BMP or program will meet or exceed the
objective of the original BMP or program in the reduction. of storm
water pollutants;. or
b. The fiscal burden of the original BMP or program is substantially
greater than the proposed alternative, but does -not achieve a
substantially .greater improvement in torm water quality; and,
c. The proposed alternative BMP or program will be implemented within
a similar period of time.
2. Eliminate any BMP or program identified in this Order, the CSWMP, and/or
the WMAP, if the Permittee can document that:
a. The BMP or program is not technically #easible and. no substitute is
available; or
b. The -cost of implementation outweighs the pollution controP benefits;
or
c. The BMP. or program is not applicable in the Permittee's jurisdiction.
The Executive Officer may approve or disapprovethe petition in accordance with

Honorable Members:
Staff has been involved in the process of negotiating the terms
of the proposed municipal National Pollution Discharge
Elimination System (NPDES) permit that is scheduled to become
effective early next year. It has been determined that a
"guidance document" is necessary to aid cities in the
interpretation of the lengthy and complex permit.
The Los Angeles Regional Water Quality Control Board worked out
an agreement with the Santa-Monica Bay Restoration Foundation to
fund development of the document with the understanding that
individual cities would enter into voluntary agreements to
contribute funds.
This has been reviewed by the Acting Director of Community
Services and the City Attorney, and it is hereby recommended that
authority be granted for the City to contribute $500 and that an
agreement with the Santa Monica Bay Restoration Foundation be
approved.

Subject: Contribution for National Pollution Discharge Elimination System
(NPDES) Guidance Docu-merit
As you are aware,. the city has been involved in the process of negotiating the
terms of the proposed municipal NPDES permit that is scheduled to take effect
early next year. .During fihe course of the negotiations it became clear to all parties
involved. that some sort of guidance document would be necessary to aid cities in
the .interpretation of the rather lengthy and complex permit. The determination
was made that all cities should voluntarily bear a proportionate cost of developing
this guidance document. Several cities indicated that they would need several
weeks to request funds from their respective city councils. However, if the
guidance document was to be finished in time for it to be used when the permit
goes into. effect early next year,. the development had to start immediately. In
order to get the development of -the document started, while giving cities some
.time to gather funds, the Los Angeles Regional Water Quality Control Board
(LARWQCB) worked out an agreement with the Santa Monica Bay Restoration
Foundation. (SMBRF) to fund the development of the document with the
understanding that individual cities would enter into voluntary agreements with the
SMBRF to contribute funds. The amount that each city should contribute ranges
from 520,000.00 for the City of Los Angeles, to 55,000.00 for Long Beach and
down to a minimum of 55.00..:00 for small cities.. While our participation in this
program is entirely voluntary, l recommend that we make the minimum 5500.00
contribution as a show of good faith. Several litigious .environmental groups are
monitoring this situation and the small-contribution would be well spent if it
deflected the scrutiny of these groups.
Attached is a copy of the Letter from the SMBRF that describes the arrangement as
well as a sample agreement for the Council to consider.

Foundation (SMBRF) and your city for the purpose of developing a Guidance Manual ~~3/266-7600
accompany the municipal storm water/urban runoff NPDES permit that is under negotiation.
Please feel free to modify it, if necessary, to conform with the format that your jurisdiction
may require.
For your information, the SMBRF is anon-profit 501(c)(3) community foundation established
by the Santa Monica Bay Restoration Project (SMBRF) to raise and receive funds from
private and governmental sources: for .Bay Restoration activities. The Foundation's by-laws
allow that funds may be contributed for a specified purpose. In this case, the funds you
contribute will be set aside for the development of the Guidance Manual. The a,ount thaat
your city contributes; is at your. ;discretion, but for your information, cities with populations
less than 90,000 are contributing between $500 - $1000.
Per the attached agreement, the Los Angeles Regional Water Quality Control Board
(LARWQCB) will coordinate the consultant's work in development of the Guidance
document, and co-permittee cities will advise the consultant regarding the needs of .the cities

AGREEMENT TO CONTRIBUTE FUNDS TOWARD THE DEVELOPMENT OF A
NPDES STORM WATER PERMIT GUIDANCE MANUAL
This agreement is made and entered into by and between the city/county of , a
political- subdivision of the State of California, herein referred to as " and the
SANTA MONICA BAY RESTORATION FOUNDATION, anot-for-profit corporation,
hereinafter referred to as "Foundation" .
WITNESSET~I
Whereas, Los Angeles County and the cities within Los Angeles County have an on-going
commitment to develop an effective National Pollutant Discharge Elimination System
(NPDES) permit .aimed at reducing the negative impacts of urban runoff/stormwater on Los
Angeles .Area waters,
Whereas, the cities, County, and the Los Angeles Regional Water .Quality Control Board
- have determined. that the development of a Guidance Manual to accompany the permit will.
assist the cities and County to successfully comply with the NPDES permit by clarifying and
expanding on the criteria of the Permit and summarizing the methods by which permittees
can implement requirements,
Whereas, the estimated cost of developing the Guidance Manual is $67,000, with
contributions expected or received from Los Angeles County, City of Los Angeles, City of
Burbank, City of El Segundo, City of Glendale, City of La Canada-Flintridge, City of
Pasadena, City of Redondo Beach, City of Santa Clarita, and City of Santa Monica, and
other cities may contribute as well,
Whereas, the Foundation will enter into a contract with. a consultant, to be chosen by the
Regional .Water Quality Control Board upon the advice of a subcommittee. of the- NPDES
negotiating team duly designated by the cities and county,
Whereas, by entering this Agreement, the Foundation is facilitating the development of the.
Guidance Manual only, and assumes no other obligations under the Guidance Manual or the
NPDES permit.
Whereas, the Los Angeles Regional Water Quality Control Board has agreed to coordinate
the work of the consultant, and the Permit Negotiating team has agreed to advise the
consultant of the needs of cities and the County to .assure that the Guidance Manual is useful
to its audience,

NOW, THEREFORE, in .consideration of .the mutual benefits to be derived by the parties
and of the premises herein contained, it is hereby agreed to as follows:
1) COUNTY/CITY AGREES THAT:
a. It will contribute a grant of $ to the Foundation by November 1, and
upon presentation of an invoice by the Foundation.
b. By its agreement to facilitate the development of the Guidance Manual, the
Foundation incurs no responsibility or obligations set forth in the Manual itself
or in the NPDES Permit
2) TI-IE,FOUN~A~'ION AOI~ES::
a. To use this money towards funding a consultant contract to develop- the
Guidance Document
b. To return to the city/county the full amount of its contribution, within thirty
days of receiving an invoice from city/county, if for any reason, the consultant
contract does not proceed as projected.-
c. To return to the cities/county within sixty (60) days of the conclusion of the
consultant contract ,its proportional share of the remaining monies.
d. To furnish the city/county with ten (10) copies of the final Guidance Manual.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by
their respective ,officers, duly authorized, by the city/county on 1995 and by the

Honorable Members:
Staff has been involved in the process of negotiating the terms
of the proposed municipal National Pollution Discharge
Elimination System (NPDE3) permit that is scheduled to become
effective early next year. It has been determined that a
"guidance document" is necessary to aid cities in the
interpretation of the lengthy and complex permit.
.The Los Angeles Regional Water Quality Control Board worked out
an agreement with the Santa. Monica Bay Restoration Foundation to
fund development of the document with-the understanding that
individual cities would enter into voluntary agreements to
contribute funds.
This has been reviewed by the Acting Director of Community
Services and the City Attorney, and it is hereby recommended. that
authority be granted for the City to contribute $500 and that an
agreement with the Santa Monica Bay Restoration Foundation be
approved.

WHEREAS, The City Council- of the City. of Vernon, by
