Resolution No. 6712 .. RESOLUTIQN NO. 6712 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION TO BE HELD ON TUESDAY, APRIL 9, 1996 WHEREAS, Section 10012 of the Elections Code of the State of California provides that the governing body of any local agency shall adopt regulations pertaining to candidates statements prepared by any candidate for municipal election, including charges for handling, packaging, and mailing such candidates statements. 12 13 14 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: GENERAL PROVISIONS. Pursuant to Section 15 10012 of the Elections Code of the State of California, each 16 candidate for elective office to be voted for at an election to be 17 held in the City of Vernon on Tuesday, April 9, 1996, may prepare a candidate's statement on an appropriate form provided by the 18 19 City Clerk. The statement may include the name, age, and 20 21 22 23 occupation of the candidate and a brief description of no more that 200 words of the candidate's education and qualifications expressed by the candidate himself or herself. The statement shall not include party affiliation of the candidate, nor 24 membership or activity in partisan political organizations. The 25 26 statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. The statement 27 may be withdrawn, but not changed, during the period for filing 28 nomination papers and until 5:00 p.m. of the next working day . . ~ ,- ~ ~ 1 after the close of the nomination period. 2 SECTION 2: SPANISH LANGUAGE. The city Clerk shall have 3 translated and printed in the voters pamphlet only the candidates' 4 statements of those candidates who request translation and 5 printing. 6 SECTION 3: ADDITIONAL MATERIALS. No candidate will be 7 permitted to include additional materials in the sample ballot 8 package. 9 SECTION 4: PAYMENT. The City Clerk shall estimate the 10 total cost including a ten percent (10%) administrative cost of 11 printing, handling, translating, and mailing the candidates 12 statements filed pursuant to the Elections Code, and require each 13 candidate filing a statement to pay in advance his or her pro rata 14 share as a condition of having his or her statement included in 15 the voter's pamphlet. The City Clerk shall bill each candidate 16 for any cost in excess of the deposit or shall refund within 30 17 days of the election any unused portion of the deposit. 18 SE9TION 5: The City Clerk shall provide each candidate 19 or the candidate's representative a copy of this Resolution at the 20 time nominating petitions are issued. 21 SECTION 6: All previous resolutions establishing council 22 policy on paYment for candidates' statements are repealed. 23 SECTION 7: This resolution shall apply at the next 24 ensuing municipal election and at each municipal election held 25 after that time. 26 III 27 III 28 III -2- 1 SECTION 8: The city Clerk of the city of Vernon is 2 3 hereby directed to certify to the passage of this resolution thereupon and thereafter the same shall be in full force and 4 effect. 5 6 .
