FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 2910 ROSS STREET WHEREAS, Matheson Fast Freight, Inc. has applied for a conditional use permit to operate a truck and freight terminal at 2910 Ross Street in the City of Vernon; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on December 19, 1995; and WHEREAS, the proposed site is a conforming use in the General Industrial (M) Zone which has been continuously used as a truck and freight terminal previously operated by Con-Way Western Express and which requires a conditional use permit under the Zoning Ordinance in order to continue the use; and WHEREAS, the proposed operation will include the hauling and temporary storage of general products; and WHEREAS, the proposed site is approximately 7.8 acres in size, contains one building, and the size, shape, 21 topography and drainage of the parcel are adequate for the 22 proposed operation; and 23 WHEREAS, a barrier wall or landscaping will be 24 installed where parking or maneuvering areas adjoin a public 25 street pursuant to the Vernon City Code; and 26 WHEREAS, the proposed site is surrounded by 27 industrial uses compatible with the proposed use and no 28 adverse effect from traffic, parking, noise, odors, dust, 1 1 smoke, light or glare, or risk of fire, infection or 2 explosion is anticipated from the proposed operation; and 3 WHEREAS, the site has access to Ross Street and in 4 general traffic will travel from the site on Ross Street to 5 lameda Street, thence north to freeway access; or on Ross 6 Street to 37th Street to Santa Fe Avenue, thence to freeway 7 access; and the streets to be utilized within the City of 8 Vernon are sufficient to handle the traffic generated from 9 the proposed operations; and 10 WHEREAS, the site is required to have adequate 11 offstreet parking and loading facilities in accordance with 12 the Vernon City Code; and 13 WHEREAS, the conditions imposed on the conditional 14 use permit will adequately protect the public health, safety 15 and general welfare and the operation is consistent with all 16 applicable rules and laws of the City of Vernon; and 17 WHEREAS, the proposed use as to location, 18 operation, and design is consistent with the General Plan 19 and the Zoning Ordinance of the City of Vernon; and 20 WHEREAS, the project was found to be categorically 21 exempt from the California Environmental Quality Act as an 22 existing facility pursuant to Section 15301 of the 23 California Environmental Quality Act Guidelines and a Notice 24 of Exemption shall be filed with the County Clerk pursuant 25 to Section 15062 of the California Environmental Quality Act 26 Guidelines. 27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 28 OF THE CITY OF VERNON AS FOLLOWS: 2 1 SECTION 1: The City Council of the City of Vernon 2 hereby finds and determines that the recitals contained 3 hereinabove are true and correct. 4 SECTION 2: Subject to the conditions set forth 5 below, the conditional use permit is granted to Matheson 6 Fast Freight, Inc. for the operation of a truck and freight 7 terminal at 2910 Ross Street. 8 SECTION 3: In order to adequately protect the 9 public health, safety and general welfare the following 10 conditions are imposed: 11 a. The facility shall be operated in accordance 12 with, and made to conform with all current codes, rules, 13 regulations and subject to permit fees as adopted by the 14 City of Vernon. The facility shall be operated in a manner 15 that will prevent unsanitary conditions, odors or other 16 nuisances. Prior to occupancy a business license and 17 occupancy permit shall be obtained. All trucking 18 operations, including truck and trailer parking, shall be 19 limited to the lot located at 2910 Ross Street in the City 20 of Vernon. 21 ~ ~ 24 25 26 27 28 b. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed to meet City standards. c. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in 3 1 compliance with appropriate codes. 2 d. A National Pollutant Discharge Elimination 3 System Permit shall be obtained from the California State 4 Board of Water Resources. 5 e. No equipment or freight shall be stored on the 6 site, other than in buildings, trailers or on the docks. 7 f. Adequate plans and materials must be available 8 for handling leaks or spills from vehicles during storage or 9 transportation. 10 g. All required federal, state, local and 11 regulatory agency permits shall be obtained prior to 12 operation. 13 h. A hazardous materials inventory and 14 business/contingency plan shall be submitted and a hazardous 15 materials permit shall be obtained from the City of Vernon 16 Health Department. Hazardous materials/wastes shall be 17 handled and managed in compliance with all appropriate 18 federal, state and local laws. 19 i. The current property owner shall submit 20 ~ocumentation of hazardous materials closure for 2910 Ross 21 Street based on its prior operation by Con-Way Western 22 Express. 23 24 25 26 27 28 j. The underground fuel tanks on the site must be removed under permit issued by the City of Vernon Community Services Department or the property owner or occupant shall obtain and maintain an underground tank permit from the City of Vernon Health Department. k. Toilet rooms shall be provided with adequate 4 1 ventilation, lighting and wall mounted single service soap, 2 towel and toilet paper dispensers. 3 1. Approved drinking water facilities shall be 4 provided for employees. 5 m. The property shall be provided with adequate 6 refuse containers and refuse disposal service. 7 n. The facility's buildings shall be structurally 8 maintained to exclude rodents and the property shall be 9 maintained rodent free. 10 o. The facility shall be operated in a manner 11 which will not impede traffic on Ross Street. 12 p. It is a trucking company providing pick-up and delivery service of a wide range of items including electronics, builqing materials, clothing and stationary. 1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and the General Plan. The site is presently being used as a truck and freight terminal. 2.
