Resolution No. 6727 .. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 6727 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO SEARS, ROEBUCK & COMPANY, FROM SECTION 26.4.2-6, AUTOMOBILE PARKING REQUIREMENTS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2700 FRUITLAND AVENUE IN THE CITY OF VERNON WHEREAS, Sears, Roebuck & Company (hereinafter "Sears") owns a parcel of property located at 2700 Fruitland Avenue in the City of Vernon which requires a variance from Section 26.4.6-7, Automatic Expiration of Non-conforming Building, of the Comprehensive Zoning ordinance; and WHEREAS, the building has been vacant for a continuous period greater than one year and Zoning Ordinance Section 26.4.6-7 specifies that a building which has been vacant for a continuous period greater than one year shall not be occupied except in the case that it has been brought into conformity with all regulations; and WHEREAS, the building is approximately 296,000 square feet and 160,319 square feet will be used for industrial purposes and the balance will remain vacant; and WHEREAS, the building was constructed with insufficient automobile parking spaces to comply with the current Zoning Ordinance requirements; and WHEREAS, Zoning Ordinance section 26.4.2-6 specifies that one automobile parking space be provided for every 1,000 square feet of gross floor area for an industrial use and one automobile parking space be provided for every 500 square feet of gross floor area for an office use and the building requires a 1 minimum of 296 automobile parking spaces; and 2 WHEREAS, the portion of the building being used for 3 industrial purposes will require 165 automobile parking spaces, 4 157 spaces for 156,609 square feet of industrial use and 8 for 5 3,710 square feet of office space; and 6 WHEREAS, Sears is proposing a construction. project 7 in order to bring the building into conformance with requirements 8 for truck parking and loading, building code, seismic stability 9 and ADA requirements; and 10 WHEREAS, Sears intends to occupy only the southerly half 11 of the existing structure commencing at the existing dividing 12 wall; and 13 WHEREAS, 2700 Fruitland Avenue is located in the M zone 14 and the operation is consistent with the objectives of the General 15 Plan and Zoning Ordinance; and 16 WHEREAS, the City Council of the city of Vernon held a 17 hearing on said application for a variance on December 19, 1995. 18 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 19 THE CITY OF VERNON AS FOLLOWS: 20 SECTION 1: The City Council of the City of Vernon 21 hereby finds and determines that the recitals contained herein- 22 above are true and correct. 23 SECTION 2: A variance from section 26.4.2-6, Automobile 24 Parking Requirements, requiring one automobile parking space per 25 1,000 square feet of gross floor area for an industrial use and 26 one space per 500 square feet of gross floor area of an office 27 use is hereby granted to Sears, Roebuck & Company at 2700 28 Fruitland Avenue. 2 1 SECTION 3: The variance shall be granted subject to 2 the following conditions: 3 (a) Prior to any modifications or construction, all 4 necessary permits shall be obtained from the City of Vernon. 5 (b) Prior to occupancy, the property shall be 6 made to substantially conform with all current City of Vernon 7 Codes (except for automobile parking) including, but not limited 8 to truck parking and loading, building code, seismic stability and 9 ADA requirements. 10 (c) Prior to occupancy, the required automobile parking 11 spaces shall be provided for the building square footage which 12 will be occupied. 13 (d) No portion of the building for which required 14 automobile parking has not been provided shall be used. 15 (e) The automobile parking for the entire building shall 16 be brought into conformance with the comprehensive Zoning 17 Ordinance prior to August 19, 2009. 18 (f) Where parking or maneuvering areas adjoin the public 19 street, a barrier wall or landscaping shall be installed and 20 maintained to meet City Standards. 21 (g) Sidewalk shall be constructed and the owner shall 22 dedicate the necessary street right-of-way to the City of Vernon 23 in order to comply with the Master Plan of streets dated June 16, 24 1992. 25 SECTION 4: Noncompliance with these conditions shall 26 constitute sufficient grounds for the city Council of the City 27 of Vernon to void this variance and require the application of 28 the authorized automobile parking space requirement. 3 ~ 4 ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 ~ 26 27 ~ STATE OF CALIFORNIA ) ) ss COUNTY OF LOS ANGELES ) I, BRUCE V. The building that it owns has been vacant for a continuous period greater than one year and Section 26.4.6-7 requires that the building shall not be occupied except in the case that it has been brought into conformity with all regulations. The building is approximately 296,000 square feet and the owner intends to use 160,319 square feet of the building. Sears is requesting occupancy of the building without bringing it into conformance with the automobile parking requirements. Sears is proposing to bring the building into conformance with requirements for truck parking and loading, building code, and ADA regulations. However, the parcel has insufficient space to provide all of the required automobile parking spaces. Sears is proposing to occupy only the southern half of the building separated by a dividing wall. They intend to occupy 156,609 square feet of industrial use and 3,710 square feet of office use. They intend to have approximately 70 ... employees per shift, however, the shifts will not overlap. In order to uphold the intent of the Comprehensive Zoning Ordinance, it is recommended that Sears be allowed to occupy only the building square footage for which it can provide the required automobile parking spaces. The proposed operation is in conformance with the Zoning Ordinance and General Plan. The existing building is non-conforming as its sideyards are less than 60' - 0" which prevent it from being allowed an unlimited area. B. Because the business license had lapsed for more than one year, the City Of Vernon initially required the entire structure and parking to be brought up to current codes. In wdrking with the City, specifically Kevin Wilson and Richard Lucas, the following mitigation and equivalency solutions have been agreed upon: C. 1. Remove a portion of the office addition on the Westerly side to accommodat~ fire truck access. 2. Remove the entire existing canopy on the West side at the loading dock. 3. Remove a portion of the existing canopy on Eastside at the loading docks. 4. Design and install ramps to meet accessibility codes at the East and West docks on the South end. 5. Create fire department truck access either on the docks (with truck ramps at the North and South ends) or along the existing spur tracks. 6. Bring the structure into seismic compliance per preliminary submittals by the structural engineer, Michael Ghodsi & Associates. 7 Layout parking/striping to the maximum per City standards within the existing parking lot. 8 Truck quantity and parking are currently acceptable. Existing office toilets will be remodeled to meet A 0 A and tile 24 accessibility codes. F. The number of Sears employees will be approximately 70 per shift, but the shifts do not over lap. Meeting the above concerns, it is hoped The City of Vernon will permit this existing facility to regain its productive use. If there still is concern, a re-visiting to this site for conformance of its use could be done in the year 2009 and can be made a condition so that continued conformity is being followed. The existing building is non-conforming as its sideyards are less than 60' - 0" which prevent it from being allowed an unlimited area. 8. Because the business license had lapsed for more than one year, the City Of Vernon initially required the entire structure and parking to be brought up to current codes. C. In wdrking with the City, specifically Kevin Wilson and Richard Lucas, the following mitigation and equivalency solutions have been agreed upon: 1. Remove a portion of the office addition on the Westerly side to accommodate fire truck access. 2. Remove the entire existing canopy on the West side at the loading dock. 3. Remove a portion of the existing canopy on Eastside at the loading docks. 4. Design and install ramps to meet accessibility codes at the East and West docks on the South end. 5. Create fire department truck access either on the docks (with truck ramps at the North and South ends) or along the existing spur tracks. 6, Bring the structure into seismic compliance per preliminary submittals by the structural engineer, Michael Ghodsi & Associates. 7. Layout parking/striping to the maximum per City standards within the existing parking lot. 8 Truck quantity and parking are currently acceptable.
