RESOLUTION NO. 6734
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
GOLDBERG AND SOLOVY FOODS, INC. FROM
SECTION 26.4.2-8, DEVELOPMENT STANDARDS,
OF THE COMPREHENSIVE ZONING ORDINANCE,
FOR THE PROPERTIES LOCATED AT 5925 ALCOA
AVENUE IN THE CITY OF VERNON
WHEREAS, Goldberg and Solovy Foods, Inc. owns a parcel
of property located at 5925 Alcoa Avenue in the City of Vernon and
has requested a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance; and
WHEREAS, Goldberg and Solovy Foods, Inc. uses the
building for the food processing and the physical condition of
the property is unique in that the existing building measures
approximately 63,500 square feet including 7,140 square feet of
office space and was constructed with five non-conforming truck
loading spaces, measuring 10.0 feet in width and 40 feet in
length; and
WHEREAS, Goldberg and solovy Foods, Inc. is proposing
to construct an additional 16,094 square feet of warehouse and
2,277 square feet of enclosed loading dock area that will bring
the building to a total of 81,938 square feet; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 (b) requires
four truck loading spaces for buildings with a gross floor area
of between 50,001 and 100,000 sq~~re feet in size; and

WHEREAS, Zoning Ordinance Section 26.4.2-7 requires one
truck parking space for every 20,000 square feet of gross floor
area of manufacturing use for a t9tal of four spaces for the
74,798 square feet of manufacturing use; and

1 WHEREAS, Goldberg and Solovy Foods, Inc. will provide
2 four conforming truck loading spaces and four conforming truck
3 parking spaces with 40 feet of unobstructed maneuvering area; and
4 WHEREAS, Zoning Ordinance section 26.4.6-1 provides that
5 a non-conforming use shall not be expanded and no structural
6 alterations shall be made which will encourage the continuation
7 of the non-conforming use; and
8 WHEREAS, Zoning Ordinance section 26. 4 . 2 -8 requires that
9 all truck loading spaces be 10 feet wide and 65 feet long with 40
10 feet of unobstructed maneuvering area; and
11 WHEREAS, 5925 Alcoa Avenue is located in the M zone and
12 the operation is consistent with the objectives of the General
13 Plan and Zoning Ordinance; and
14 WHEREAS, the City council of the City of Vernon held a
15 hearing on said application for a variance on January 9, 1996.
16 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
17 THE CITY OF VERNON AS FOLLOWS:
18 SECTION 1: The City Council of the City of Vernon
19 hereby finds and determines that the recitals contained herein-
20 above are true and correct.
21 SECTION 2: A variance from section 26.4.2-8,
22 Development Standards of the Comprehensive Zoning Ordinance,
23 requiring all truck loading spaces to be 10 feet wide by 65 feet
24 long with 40 feet of unobstructed maneuvering area is hereby
25 granted to Goldberg and Solovy Foods, Inc. at 5925 Alcoa Avenue.
26 SECTION 3: The variance shall be granted subject to the
27 following conditions:

(a) When the building is expanded, Goldberg and solovy
Foods, Inc. shall (1) construct the enclosed loading dock that
will provide four conforming truck loading spaces and (2) provide
four conforming truck parking spaces, both with 40 feet of
unobstructed maneuvering area.
(b) The usage of the five non-conforming truck loading
spaces shall be limited to trucks of a length less than 40.0 feet.
(e) All vehicles, including trucks, using the parking
and/or loading facilities shall enter and leave the public street
in a front forward manner without backing or maneuvering on the
public right-of-way.
Cd) All existing and future tenants shall be notified
of these restrictions and a condition stating the same shall be
placed in all future leases.
SECTION 4: Noncompliance with these conditions shall
constitu~e sufficient grounds for the City council of the City of
Vernon to void this variance and require the application of zoning
Ordinance section 26.4.2-8 and the authorized truck loading space
requirement.
SECTIO~ 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Goldberg and Solovy Foods, Inc. has requested a variance from
the Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 5925 Alcoa Avenue in the
City of Vernon. The building that it owns was constructed with
five non-conforming truck loading spaces, measuring 10.0 feet in
width and 40.0 feet in length with 35 feet of unobstructed
maneuvering area. It is proposing to construct 16,094 square
feet of additional warehouse space and 2,277 square feet of
enclosed loading dock area that will provide four conforming
truck loading spaces. It will also provide four additional
conforming truck loading parking spaces. It has stated that only
vehicles of smaller lengths will be used at the non-conforming
truck loading spaces. The building is used for food processing
and is approximately 63,567 square feet in size before proposed
construction, including 7,140 square feet of office area.
section 26.4.2-7 (b) requires four truck loading spaces for
buildings with a gross floor area of between 50,001 and 100,000
square feet in size. section 26.4.2-7 (a) requires one truck
parking space per 20,000 square feet of gross floor area of a
manufacturing use for a total of four truck parking spaces for
the 74,798 square feet of manufacturing use. Section 26.4.2-8
of the Comprehensive Zoning Ordinan~e specifies that each loading
space shall be a minimum of 10 feet wide and 65 feet long with 40
feet of unobstructed maneuvering area. Goldberg and Solovy
Foods, Inc. has stated that requiring the five non-conforming
truck loading spaces to be 65 feet long by 10 feet wide would be
a hardship. The operation is in conformance with the
comprehensive Zoning Ordinance and General Plan. Therefore, it
is recommended that the variance be granted subject to the
following conditions:
(a) When the building is expanded, Goldberg and Solovy
Foods, Inc. shall (1) construct the enclosed loading dock that
will provide four conforming truck loading spaces and (2)
provide four conforming truck parking spaces, both with 40 feet
of unobstructed maneuvering area.
(b) The usage of the five non-conforming truck loading
spaces shall be limited to trucks of a length less than 40.0
feet.
(c) All vehicles, including trucks, using the parking
and/or loading facilities shall enter and leave the public street
in a front forward manner without backing or maneuvering on the
public right-of-way.
(d) All existing and future tenants shall be notified
of these restrictions and a condition stating the same shall be
placed in all future leases.

A comment was submitted by Vest, Inc. located at 6023 Alcoa'
Avenue regarding congestion and double-parked trailers near the
Goldberg and Solovy Foods, Inc. facility.
After visiting the site on a number of occasions, the
aforementioned conditions were not observed. However, the proposed
construction should only improve the situation since all of the
required truck parking and loading spaces along with required
maneuvering areas will be provided. This variance addresses truck
loading spaces which are above the required amount.
The c9mplaint of double-parked trailers has been forwarded to
the Police Department for their enforcement.

GOLDBERG AND SOLOVY FOODS VARIANCE APPLICATION
Variance applied for:
To allow the existing truck loading doors to remain within an existing 75'-0" front truck loading area. We
request a variance to the truck loading minimum distance for maneuvering and loading of 105'-0". These
existing doors will be serving 'Bobtail' type trucks only, no semi's. We propose constructing a new truck dock
with truck parking to conform with the City's truck loading and parking ordinance for semi trucks.
The following are in reference to the special conditions which apply to this property:
1. The existing building was designed to receive and ship from one location only. Goldberg and Solovy foods
entire inflow and outflow of product was designed to be done from this one location.
2. The current ordinance requires a total of 105'-0" (65' truck plus 40' for access) for semi loading and
parking. The existing truck loading doors have a 75'-0" loading distance but will only be used for 'Bobtail'
type trucks. Losing use of these existing 'Bobtail' truck doors will deprive Goldberg and Solovy foods of the
minimum number of truck loading doors necessary to conduct their business.
3. The current City ordinance and truck loading requirements was adopted by the City after the existing
building was built. The non-conformance of the existing truck doors became so after the fact and by no fault
of Owner. Goldberg and Solovy Foods is trying to remedy the non-conformance of the truck loading by
proposing to build a new truck dock conforming to the latest City ordinance.
4. This building will not enjoy any special privileges. The proposed new truck dock will bring the building
into conformance equal to new buildings.
5. The granting of the variance will not affect the Comprehensive general plan. The nature of the business
will not change due to the granting of the variance.
