" 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 25 26 27 28 RESOLUTION NO. 6739 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO KAREN KANE COMPANY FROM SECTION 26.4.2-8 (b), OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2275 37TH STREET IN THE CITY OF VERNON WHEREAS, Karen Kane Company owns a parcel of property located at 2275 37th Street and has requested a variance from Section 25.4.2-8 (b) of the Comprehensive Zoning Ordinance; and WHEREAS, the physical condi tion of the property is unique in that the existing lot is fully developed, and is covered with a 100,592 square foot building and with required parking and loading spaces; and WHEREAS, within the building, Karen Kane Company proposes to construct a 26,289 square-foot mez zanine (second floor) addition which will cause an increase in the required number of automobile and truck parking spaces; and WHEREAS, Zoning Ordinance section 26.4.6-4 (b) requires that where insufficient space exists on a lot or parcel for compliance with the off-street parking requirements, compliance shall occur at the time of any structural al teration of the building; and WHEREAS, Zoning Ordinance section 26. 4 .2-6 specif ies that the existing building requires 125 automobile parking spaces and the mezzanine addition will require 27 additional automobile parking spaces for a total of 152 spaces; and WHEREAS, Karen Kane Company will provide 121 automobile parking spaces on the existing site and will need to provide 31 additional automobile parking spaces on the separate ... 1" parcel; and 2 WHEREAS, Zoning Ordinance Section 26.4.2-7 (a) specifies 3 that the building with the mezzanine addition requires 7 truck 4 parking spaces and Section 26.4.2-7 (b) requires 5 truck loading 5 spaces and section 26.4.2-7 (e) requires a minimum of 40 feet of 6 unobstructed maneuvering area in front of all truck parking and 7 loading spaces; and 8 WHEREAS, Karen Kane Company provides 5 truck loading 9 spaces and 6 truck parking spaces and the required maneuvering 10 area on the existing site and will need to provide 1 additional 11 truck parking space with maneuvering area on the existing site; 12 and 13 WHEREAS, Zoning Ordinance Section 26.4.2-8 (b) requires 14 that the parking facilities shall either be on the same lot as the 15 occupancy or on a separate lot or parcel located within 1,000 feet 16 from the main building, for which a covenant will be recorded 17 restricting the use of the property to parking for the benefit of 18 the use requiring the parking; and 19 WHEREAS, Karen Kane Company intends to purchase the 20 separate parcel located at 2331 27th Street which is approximately 21 3,000 feet from the main building measured as walking distance; ~ and ~ WHEREAS, the separate parcel is large enough to provide 24 a minimum of 31 automobile parking spaces; and 25 WHEREAS, 2275 37th Street is located in the M Zone and 26 the operation is consistent with the objectives of the General 27 Plan and Zoning Ordinance; and 28 WHEREAS, the City Council of the City of Vernon held a 2 1 hearing on said application for a variance on January 23, 1996. 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 3 THE CITY OF VERNON AS FOLLOWS: 4 SECTION 1: The City Council of the City of Vernon 5 hereby finds and determines that the recitals contained 6 hereinabove are true and correct. 7 SECTION 2: A variance from Section 26.4.2-8 (b) of the 8 Comprehensive Zoning Ordinance, requiring that an off-site parcel 9 used for parking shall be within 1,000 feet of the main building 10 or use, is hereby granted to Karen Kane Company at 2275 37th 11 Street. 12 SECTION 3: The variance shall be granted subject to the 13 following conditions: 14 (a) Prior to the issuance of a building permit, Karen 15 Kane Company shall acquire the property at 2331 27th street and 16 record a parking covenant thereon in the form approved by the 17 Acting Director of Community Services & Water. 18 (b) Karen Kane Company shall maintain the required 19 truck parking spaces, truck loading spaces and maneuvering areas 20 at 2275 37th Street and shall maintain the required automobile 21 parking spaces at 2275 37th Street and 2331 27th ~ Street. ~ . (c) If Karen Kane Company can no longer provide the 24 required automobile parking spaces on the parcel located at 2331 25 27th Street, then the required automobile parking spaces shall be 26 provided at 2275 37th Street and within 1,000 feet thereof. 27 (d) Prior to the occupancy of the mezzanine addition, 28 2331 27th Street shall be paved and striped to provide the 3 .. 1 required amount of automobile parking spaces and a barrier or 2 landscaping strip shall be provided where the parking area adjoins 3 the public street. 4 (e) Prior to the occupancy of the mezzanine addition, 5 the owner shall construct all frontage improvements at the 2331 6 27th street parcel as directed by the Acting Director of Community 7 services & Water including but not limited to, replacing all 8 cracked or damaged curb, gutter, sidewalk and driveway, removing 9 driveway where unused and replacing with City of Vernon standard 10 curb, gutter and sidewalk and constructing new standard driveway 11 where necessary. 12 (f) Karen Kane Company shall maintain all frontage at 13 2275 37th street and 2331 27th street as required by the Acting 14 Director of Community services & Water. 15 (g) All parking and loading facilities shall be 16 adequately drained and kept free of dust, mud, trash or weeds. 17 (h) Karen Kane Company shall provide at least 18 one seven-passenger vehicle to shuttle employees to and from 19 2331 27th street site at the beginning and end of each shift. 20 (i) Karen Kane Company employees shall park at 2275 21 37th Street or 2331 27th street and not on the street. ~ (j) Karen Kane Company shall reserve a sufficient ~ number of automobile parking spaces at 2275 37th street to 24 accommodate business visitors. 25 (k) If on-street parking is generated from Karen Kane 26 Company's operation, upon first notice the on-street parking shall 27 be eliminated. 28 SECTION 4: Noncompliance with these conditions 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 25 26 27 28 shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the demolition of the addition. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. Karen Kane Company occupies a 100,592 square foot building on a lot which is fully developed. It is proposing to construct a 26,289 square foot mezzanine addition to the existing building. The mezzanine addition would require 27 additional automobile parking spaces and 1 additional truck parking space. section 26.4.2-8 (b) of the Comprehensive Zoning Ordinance allows required parking to be provided on a separate parcel. However, the parcel must be within 1,000 feet of the main building and a covenant restricting the use of the property must be recorded. Karen Kane Company intends to purchase a parcel located at 2331 27th Street in order to provide the additional required parking, but the lot is 3,000 feet from the main building, measured as walking distance. The parcel is large enough to provide more than the amount of required parking spaces. Karen Kane Company intends to provide a shuttle service for its employees using the lot for parking. Karen Kane Company has stated, however, that no significant increase in their amount . of employees is expected due to the subject addition. The addition will ~dd to the efficiency of the operation and the additional parking spaces will be provided for code compliance rather than out of necessity. Karen Kane Company has agreed to provide an alternate site for the parking spaces or demolish the subject building addition if it can no longer provide parking on the parcel. The mezzanine addition requires 27 additional automobile parking spaces and 1 additional truck parking space for a total of 152 required automobile parking spaces, 5 truck loading spaces, and 7 truck parking spaces. Karen Kane Company provides 121 automobile parking spaces on the existing site and in excess of 31 parking spaces on the additional parcel, bringing the total amount of automobile parking spaces provided to in excess of 152 spaces. It also provides 5 truck loading spaces and 6 truck loading spaces on the existing site with 40 feet of unobstructed maneuvering area and will provide one additional truck parking space with maneuvering area at the existing site for the total required amount of truck parking and loading spaces. The operation is in conformance with the Zoning Ordinance and the General Plan. The racking system is removable without making major structural alterations to the building. Therefore, if off site parking is eliminated, the racks system may easily be removed from the building, keeping it with code requirements. (4) That granting the variance requested will not confer on the applicant any special priVilege that is denied by this Chapter to other landSt structurest or bUildings in the same vicinity and zone in which the propert is located: 4. No special privileges is conformed as the applicant will provide shuttle service back and forth to the primary location for the employees and the city can easily require the removal of the mezzanine addition if the parking was no longer provided. However, the parking lot will be purchased, not leased, so outside forces could not impact the required parking.
