A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO HEITZ TRUCKING, INC. FOR THE
OPERATION OF A TRUCK AND FREIGHT TERMINAL
AT 2065 ROSS STREET
WHEREAS, Heitz Trucking, Inc. has applied for a
conditional use permit to operate a truck and freight
terminal at 2065 Ross Street in the City of Vernon; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on March 26, 1996; and
WHEREAS, the proposed site is a conforming use in
the General Industrial (M) Zone which has been continuously
used as a truck and freight terminal previously operated by
Mexam International and which requires a conditional use
permit under the Zoning Ordinance in order to continue the
use; ~d
WHEREAS, the proposed operation will include the
hauling and temporary storage of general products; and
WHEREAS, the proposed site is approximately 1.6
acres in size, contains two buildings, and the size, shape,
topography and drainage of the parcel are adequate for the
proposed operation; and
WHEREAS, a barrier wall or landscaping will be
installed where parking or maneuvering areas adjoin a public
street pursuant to the Vernon City Code; and
WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no
adverse effect from traffic, parking, noise, odors, dust,
1 smoke, light or glare, or risk of fire, infection or
2 explosion is anticipated from the proposed operation; and
3 WHEREAS, the site has access to Ross Street and in
4 ~eneral traffic will travel from the site on Ross Street to
5 ~lameda Street, thence north to freeway access; or on Ross
6 Street to 37th Street to Santa Fe Avenue, thence to freeway
7 ~ccess; and the streets to be utilized within the City of
8 ~ernon are sufficient to handle the traffic generated from
9 the proposed operations; and
10 WHEREAS, the site is required to have adequate
11 pffstreet parking and loading facilities in accordance with
12 the Vernon City Code; and
13 WHEREAS, the conditions imposed on the conditional
14 ~se permit will adequately protect the public health, safety
15 and general welfare and the operation is consistent with all
16 applicable rules and laws of the City of Vernon; and
17 WHEREAS, the proposed use as to location,
18 pperation, and design is consistent with the General Plan
19 and the Zoning Ordinance of the City of Vernon; and
20 WHEREAS, the project was found to be categorically
21 exempt from the California Environmental Quality Act as an
22 existing facility pursuant to Section 15301 of the
23 California Environmental Quality Act Guidelines and a Notice
24 of Exemption shall be filed with the County Clerk pursuant
25 to Section 15062 of the California Environmental Quality Act
26 Guidelines.
27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
28 OF THE CITY OF VERNON AS FOLLOWS:

1 SECTION 1: The City Council of the City of Vernon
2 hereby finds and determines that the recitals contained
3 hereinabove are true and correct.
4 SECTION 2: Subject to the conditions set forth
5 below, the conditional use permit is granted to Heitz
6 Trucking, Inc. for the operation of a truck and freight
7 terminal at 2065 Ross Street.
8 SECTION 3: In order to adequately protect the
9 public health, safety and general welfare the following
10 conditions are imposed:
11 a. The facility shall be operated in accordance
12 with, and made to conform with all current codes, rules,
13 regulations and subject to permit fees as adopted by the
14 City of Vernon. All trucking operations, including truck
15 and trailer parking, shall be limited to the lot located at
16 2065 Ross Street in the City of Vernon.
17 b. All parking and loading facilities shall be
18 paved with a hard durable surface material and shall be
19 adequately drained, and kept free of dust, mud, trash and
20 ~eeds. Where parking or maneuvering areas adjoin the public
21 street a barrier wall or landscaping shall be installed to
22 ~eet City standards.
23 c. Servicing of vehicles including washing, steam
24 cleaning and repairing shall be performed in facilities in
25 compliance with appropriate codes.
26 d. A National Pollutant Discharge Elimination
27 System Permit shall be obtained from the California State
28 Board of Water Resources.

1 e. No equipment or freight shall be stored on the
2 site, other than in buildings, trailers or on the docks.
3 f. Adequate plans and materials must be available
4 for handling leaks or spills from vehicles during storage or
5 transportation.
6 g. All required federal, state, local and
7 regulatory agency permits shall be obtained prior to
8 operation. Prior to occupancy a business license and
9 occupancy permit shall be obtained.
10 h. A hazardous materials inventory and
11 business/contingency plan shall be submitted and a hazardous
12 materials permit shall be obtained from the City of Vernon
13 Health Department. Hazardous materials/wastes shall be
14 handled and managed in compliance with all appropriate
15 federal, state and local laws.
16 i. The current property owner shall submit
17 documentation of hazardous materials closure for 2065 Ross
18 Street based on its prior operation by Mexam International.
19 j. The underground fuel tanks on the site must be
20 removed under permit issued by the City of Vernon Community
21 Services Department or the property owner or occupant shall
22 obtain and maintain an underground tank permit from the City
23 of Vernon Health Department.
24 k. Toilet rooms shall be provided with adequate
25 ventilation, lighting and wall mounted single service soap,
26 towel and toilet paper dispensers.
27 I. Approved drinking water facilities shall be
28 provided for employees.

1 m. The facility shall be operated in a manner
2 that will prevent unsanitary conditions, odors or other
3 nuisances. The property shall be provided with adequate
4 refuse containers and refuse disposal service.
5 n. The facility's buildings shall be structurally
6 maintained to exclude rodents and the property shall be
7 maintained rodent free.
8 o. The facility shall be operated in a manner
9 which will not impede traffic on Ross Street.
10 p. All existing cracked sidewalk, curb and gutter
11 adjacent to the site in Ross Street shall be repaired and
12 maintained to meet City Standards.
13 SECTION 4: The City Clerk of the City of Vernon
14 shall certify to the passage of this resolution and
15 thereupon and thereafter the same shall be in full force and
16 effect.

Gentlemen:

Heitz Trucking, Inc. has applied for a conditional use
permit to operate a truck and freight terminal at 2065 Ross
Street in the City of Vernon.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer'S Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
Heitz Trucking, Inc. was found to be categorically exempt
from the California Environmental Quality Act process, since they
will be using an existing truck terminal and the facility is not
being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

ENGINEER'S REPORT
ON HEITZ TRUCKING, INC.
CONDITIONAL USE PERMIT TO OPERATE A
TRUCK AND FREIGHT TERMINAL AT 2065 ROSS STREET
(March 13, 1996)
Heitz Trucking, Inc. has applied for a conditional use
permit to operate a truck and freight terminal at 2065 Ross
Street in the City of Vernon. It is a trucking company providing
pick-up and delivery service of a wide range of items.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. SITE The proposed site is of adequate size and shape
for the proposed use.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to Ross Street. This street
is of adequate size to handle the traffic generated from the
proposed operation.
5. TRUCK MOVEMENTS Heitz Trucking, Inc. will operate
between 25 and 30 trucks out of the facility. Operations will be
five days a week, closed between the hours of 10pm to Sam, and on
Saturday and Sunday. In general, trucks will travel on Ross
Street to Alameda Street then north to freeway access, or on Ross
Street to 37th Street to Santa Fe Avenue then to freeway access.

6. STATE OR FEDERAL COND:ITIONS There are no conditions
imposed by State or Federal law.
7. COND:ITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with,
and made to conform with all current codes, rules, regulations
and subject to permit fees as adopted by the City of Vernon. All
trucking operations, including truck and trailer parking, shall
be limited to the lot located at 2065 Ross Street in the City of
Vernon.
b. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed to meet City standards.
c. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with
appropriate codes.
d. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources.
e. No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks.
f. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage or

transportation.
g. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
h. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/wastes shall be handled and managed in compliance with
all appropriate federal, state and local laws.
i. The current property owner shall submit documentation of
hazardous materials closure for 2065 Ross Street based on its
prior operation by Mexam International.
j. The underground fuel tanks on the site must be removed
under permit issued by the City of Vernon Community Services
Department or the property owner or occupant shall obtain and
maintain an underground tank permit from the City of Vernon
Health Department.
k. Toilet rooms shall be provided with adequate
ventilation, lighting and wall mounted single service soap, towel
and toilet paper dispensers.
1. Approved drinking water facilities shall be provided for
employees.
m. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal service.

n. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.
o. The facility shall be operated in a manner which will
not impede traffic on Ross Street.
p. All existing cracked sidewalk, curb and gutter adjacent
to the site in Ross Street shall be repaired and maintained to
meet City Standards.
