A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
ZENITH REALTY CORPORATION AND STERN
FAMILY TRUST FROM SECTION 26.4.2-8,
DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 2000 AND 2020 25TH
STREET IN THE CITY OF VERNON
WHEREAS, Zenith Realty Corporation and Stern Family
Trust own a parcel of property located at 2000 and 2020 25th
Street in the City of Vernon and have requested a variance from
conformance with Section 26.4.2-8, Development Standards, of
the Comprehensive Zoning Ordinance; and
WHEREAS, the building is used for warehousing and the
physical condition of the property is unique in that the
existing building measures approximately 41,000 square feet and
was constructed with eight non-conforming truck loading spaces
measuring 9.3 in width and 63.0 feet in length. The spaces
cannot be brought into conformance with the Zoning Ordinance
without recessing the building wall and relocating the loading
dock doors; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 (b)
requires three truck loading spaces for buildings with a gross
floor area between 25,001 and 50,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and Section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and

1 WHEREAS, there is insufficient space on the property
2 and the application of the development standards for the truck
3 loading spaces requirements will create an unreasonable
4 hardship by requiring the non-conforming spaces to be 10 feet
5 wide by 65 feet long; and
6 WHEREAS, Zenith Realty Corporation and Stern Family
7 Trust have indicated that they have no plans to expand or alter
8 the building configuration and that the existing truck loading
9 spaces are sufficient for their intended use; and
10 WHEREAS, 2000 and 2020 25th Street is located in the
11 M zone and the operation is consistent with the objectives of
12 the General Plan and Zoning Ordinance; and
13 WHEREAS, the City Council of the City of Vernon held
14 a hearing on said application for a variance on April 2, 1996.
15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
16 THE CITY OF VERNON AS FOLLOWS:
17 SECTION 1: The City Council of the City of Vernon
18 hereby finds and determines that the recitals contained
19 hereinabove are true and correct.
20 SECTION 2: A variance from Section 26.4.2-8 of the
21 Comprehensive Zoning Ordinance, requiring all truck loading
22 spaces to be 10 feet wide by 65 feet long, is hereby granted to
23 Zenith Realty Corporation and Stern Family Trust at 2000 and
24 2020 25th Street.
25 SECTION 3: The variance shall be granted subject to
26 the following conditions:
27 (a) The usage of the non-conforming truck loading

1 spaces shall be limited so that no truck parked at or using the
2 loading docks shall extend into the existing street right-of-
3 way as shown on the Master Plan of Streets, dated
4 June 16, 1992.
5 (b) All existing and future tenants shall be
6 notified of these restrictions and a condition stating the same
7 shall be placed in all future leases.
8 SECTION 4: Noncompliance with these conditions shall
9 constitute sufficient grounds for the City Council of the City
10 of Vernon to void this variance and require the application of
11 Zoning Ordinance Section 26.4.2-8 and the authorized truck
12 loading space requirement.

SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.

Honorable Members:
Zenith Realty Corporation and Stern Family Trust have submitted an
application for a Variance from the Comprehensive Zoning Ordinance,
Section 26.4.2-8, Development Standards, for the building located
at 2000 and 2020 25th Street, and transmitted herewith are the
following supporting documents as evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer'S Report.
The building has eight non-conforming truck loading spaces that are
9.3 feet wide and 63 feet long. The spaces cannot be brought into
conformance with the Zoning Ordinance without recessing the
building wall and relocating the loading dock doors. The company
is proposing to use only vehicles of a smaller length at the non-
conforming truck loading spaces. This has been reviewed by the
Director of Community Services, and it is hereby recommended that
the Variance be granted subject to the following Conditions:

Zenith Realty Corporation and Stern Family Trust have
submitted a variance application. They are requesting a variance

Meridian, in the city of Vernon, county of Los Angeles, state of California,
shown on map filed in the District Land Office on April 22, 1968, described as
follows:
Beginning at the intersection of the southerly line of a strip of land 60 feet
wide, conveyed to the city of Vernon, by deed recorded in book 5813 page 296 of
Deeds, in the office of the county recorder of said county and established by a
survey made by the city Engineer of the city of Los.Angeles, a record of which

That portion of Section 10 in Township 2 South, Range 13 West, San Bernardino
Meridian, in the city of Vernon, county of Los Angeles, state of California,
shown on map filed in the District Land Office on April 22, 1968, described as
follows:
Beginning at the intersectiqp of the southerly line of a strip of land 60 feet
wide, conveyed to the cityof Vernon, by deed recorded in book 5813 page 296 of
Deeds, in the office of the county recorder of said county and established by a
survey made by the city Engineer of the city of Los Angeles, a record of which
is on file in said City Engineer's office in Field Book/12921, pages 32, 33 and
34, with the westerly line of the easterly portion of Block B of Huntington
Industrial Tract as per map recorded in book 6 page 10 of Maps, in the office of
said county recorder, thence along said westerly line, south 00 31' 40" East,
280.33 feet to the northerly line of a strip of land 15 feet wide, described in

ZENITH REALTY CORPORATION
AND STERN FAMILY TRUST
2000 AND 2020 25TH STREET
VARIANCE APPLICATION
MARCH 27, 1996
Zenith Realty Corporation and Stern Family Trust have
requested a variance from the Comprehensive Zoning Ordinance
Section 26.4,2-8, Development Standards, for the property located
at 2000 and 2020 25th Street in the City of Vernon. The building
was constructed with eight non-conforming truck loading spaces
measuring 9.3 feet in width and 63.0 feet in length, The spaces
cannot be brought into conformance with the Zoning Ordinance
without recessing the building wall and relocating the loading
dock doors, They have stated that only vehicles of smaller
lengths will be used at the non-conforming truck loading spaces.
The building is used for warehousing and is approximately 41,000
square feet in size.
Section 26.4.2-7 (b) requires three truck loading spaces for
buildings with a gross floor area between 25,001 and 50,000
square feet in size.
Section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and Section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a variance
is granted,

Zenith Realty Corporation and Stern Family Trust have
indicated that requiring the non-conforming truck loading spaces
to be 65 feet long by 10 feet wide would be a hardship, They
have indicated that they have no plans for expansion or
alteration of the building configuration.
The operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted with the following conditions:
(a) The usage of the non-conforming truck loading spaces
shall be limited so that no truck parked at or using the loading
docks shall extend into the existing street right-of-way as shown
on the Master Plan of Streets, dated June 16, 1992.
(b) All existing and future tenants shall be notified of
these restrictions and a condition stating the same shall be
placed in all future leases,
